The news sources to which NewsBoy provides l<strong>in</strong>ks may <strong>in</strong>clude descriptions or depictions that some<br />

might deem "<strong>in</strong>decent" or "patently offensive," particularly depend<strong>in</strong>g upon <strong>the</strong> <strong>in</strong>dividual community<br />

standards to be applied. Ms. LaNoue can nei<strong>the</strong>r identify such material nor edit sources to delete such<br />

[Statement of Interest, P. 8] material. The list of NewsBoy l<strong>in</strong>ks is so extensive that she cannot even<br />

visit <strong>the</strong>m all, let alone monitor <strong>the</strong>m regularly. She is concerned that under <strong>the</strong> <strong>CD</strong>A she could be held<br />

responsible and crim<strong>in</strong>ally prosecuted for provid<strong>in</strong>g <strong>the</strong>se l<strong>in</strong>ks. The user-friendly NewsBoy site may no<br />

longer be able to provide this wealth of news access to computer users if <strong>the</strong> author may be held<br />

responsible for all <strong>the</strong> content of <strong>the</strong> l<strong>in</strong>ks.<br />

LoD Communications is an Internet service provider serv<strong>in</strong>g <strong>the</strong> Tallahassee, Florida region. It is<br />

concerned that <strong>the</strong> <strong>CD</strong>A makes it responsible for monitor<strong>in</strong>g and remov<strong>in</strong>g communications by its<br />

customers, or Web sites that it carries, based on a vague, undef<strong>in</strong>ed, and overbroad standard of what is<br />

"<strong>in</strong>decent" or "patently offensive." Todd Lawrence is LoD Communications' amicus contact person.<br />

Dr. Peter Ludlow is an Associate Professor <strong>in</strong> <strong>the</strong> Department of Philosophy at <strong>the</strong> State University of<br />

New York at Stony Brook. Included among <strong>the</strong> classes he teaches is a course entitled "Conceptual Issues<br />

<strong>in</strong> Cyberspace," which covers, <strong>in</strong> <strong>the</strong> onl<strong>in</strong>e context, such philosophical issues as <strong>the</strong> nature of self and<br />

community. His practice is to place all of his course materials for <strong>the</strong> class on his home page, but <strong>the</strong><br />

<strong>CD</strong>A has placed a chill on this teach<strong>in</strong>g practice, and he has decl<strong>in</strong>ed to place some of <strong>the</strong> more<br />

controversial materials onl<strong>in</strong>e as a result. See http://www.schnader.com/109.htm (Exhibit 42). He<br />

believes that under <strong>the</strong> <strong>CD</strong>A he may be prohibited from plac<strong>in</strong>g on that site materials relat<strong>in</strong>g to <strong>the</strong><br />

nature of onl<strong>in</strong>e sexual behavior <strong>in</strong> MUDs (multi-user <strong>in</strong>teractive games played over <strong>the</strong> Internet) and<br />

o<strong>the</strong>r materials that are essential to <strong>the</strong> course but that may be termed "<strong>in</strong>decent" or "patently offensive."<br />

The teach<strong>in</strong>g materials used for that course and located on <strong>the</strong> home page were published <strong>in</strong> book form<br />

last spr<strong>in</strong>g. See High Noon on <strong>the</strong> Electronic Frontier: Conceptual Issues <strong>in</strong> Cyberspace (MIT Press<br />

1996).<br />

Professor Ludlow also offered <strong>in</strong> <strong>the</strong> fall 1996 semester a course entitled "Moral Reason<strong>in</strong>g," which<br />

applied traditional concepts <strong>in</strong> moral reason<strong>in</strong>g to <strong>the</strong> ethical dilemmas that arise <strong>in</strong> [Statement of<br />

Interest, P. 9] cyberspace. Included on <strong>the</strong> class syllabus were discussions of censorship on <strong>the</strong> Internet<br />

and <strong>the</strong> <strong>CD</strong>A itself. Professor Ludlow believes he cannot comprehensively or mean<strong>in</strong>gfully teach <strong>the</strong>se<br />

issues without giv<strong>in</strong>g examples of communications that might be "<strong>in</strong>decent" or "patently offensive"<br />

under <strong>the</strong> <strong>CD</strong>A but which never<strong>the</strong>less are worthwhile communications, and that he cannot do so<br />

without violat<strong>in</strong>g <strong>the</strong> <strong>CD</strong>A himself. Professor Ludlow was able to make available on <strong>the</strong> class web site<br />

most of <strong>the</strong> materials for <strong>the</strong> course, but felt unable to provide onl<strong>in</strong>e copies of <strong>the</strong> more controversial<br />

materials, and made do by ei<strong>the</strong>r merely allud<strong>in</strong>g to <strong>the</strong>ir contents, or locat<strong>in</strong>g published hard copy<br />

versions of those materials.<br />

Chuck More owns an art gallery <strong>in</strong> Philadelphia, Pennsylvania. He authors a Web site to display<br />

exhibitions of artwork sold at his gallery. See http://www.schnader.com/111.htm (Exhibit 43). The art<br />

displayed <strong>the</strong>re regularly <strong>in</strong>cludes nudes, both pa<strong>in</strong>ted and photographed. See id. Such artwork,<br />

display<strong>in</strong>g as it does sexual organs, could be considered "patently offensive" accord<strong>in</strong>g to <strong>the</strong> standards<br />

of some communities, thus plac<strong>in</strong>g Mr. More <strong>in</strong> jeopardy of crim<strong>in</strong>al prosecution.<br />

Philadelphia Magaz<strong>in</strong>e is a general <strong>in</strong>terest magaz<strong>in</strong>e published by Metro Corp. and operates its own<br />

Web site. It covers a broad range of issues of <strong>in</strong>terest to <strong>the</strong> Greater Philadelphia area, some of which<br />

relate to medic<strong>in</strong>e, art, literature, social affairs, politics, education, and sexual topics. For example, its<br />

March 1996 issue <strong>in</strong>cluded a report on male prostitution <strong>in</strong> a Center City, Philadelphia neighborhood.<br />

Some material <strong>in</strong> that article might be with<strong>in</strong> <strong>the</strong> <strong>CD</strong>A's scope if it were placed on magaz<strong>in</strong>e's Web site.<br />
