Briefly the facts in this appeal are that Sh. Daljit Singh, Ex. Senior<br />

Veterinary Pharmacist, VPO Raj Bagh, Hiranagar, Kathua moved an application<br />

on 21.04.<strong>2012</strong> under J&K <strong>State</strong> RTI Act, 2009 before the Principal, Stock Assistant<br />

Training Institute, Belicharana, Jammu, seeking the following information:-<br />

“Kindly issue me Stock Assistant Training Diploma for which I have already<br />

applied to your goodself vide my application dated 17.02.<strong>2012</strong>.”<br />

The record available on the file reveals that as the PIO did not provide any<br />

information to the information seeker as sought by him, he filed an appeal on<br />

30.05.<strong>2012</strong> before the FAA i.e. Director, Animal Husbandry Department, Jammu<br />

who also did not adjudicate and dispose it of. The appellant being aggrieved of<br />

the inaction on the part of the PIO as well as the FAA, filed 2 nd appeal on<br />

30.07.<strong>2012</strong> alleging therein that no information was provided either by the PIO or<br />

by the FAA.<br />

The <strong>Commission</strong> while examining the record of the case as also the<br />

contents of the 2 nd appeal filed by the appellant issued a notice vide letter No.<br />

<strong>SIC</strong>/J/A/<strong>137</strong>/<strong>2012</strong>/4391 dated 14.08.<strong>2012</strong>, directing the PIO to send his reply to<br />

the <strong>Commission</strong> within seven days but he failed to comply the directions issued by<br />

the <strong>Commission</strong>. The record available on the file reveals that the FAA / Director<br />

Animal Husbandry Department Jammu vide letter No. DAHJ/T-215/4682 dated<br />

07.07.<strong>2012</strong> intimated the PIO / Principal Stock Assistant Training Institute,<br />

Bellicharana that the Stock Training Institute Bellicharana is not authorized to


issue diploma to the successful trainees and advised him to issue certificate of<br />

completion of training to the successful trainees. The PIO vide letter No.<br />

PSATI/307 dated 15.09.<strong>2012</strong> also informed the appellant that the information<br />

sought by him is 33 years back which is exempted u/s 8 (3) of the J&K RTI Act,<br />

2009.<br />

On the last date of hearing i.e. 18.09.<strong>2012</strong>, the PIO was directed to file<br />

written objections before the <strong>Commission</strong>. The PIO accordingly submitted his<br />

written objections, stating therein that the appellant, who was class-IV employee<br />

of Animal Husbandry Department, was deputed to Stock Assistant Training<br />

Institute, R.S. Pura for undergoing training for a period of one year during the<br />

year 1979-80 and was declared as re-appear in Annual Examination held in Sept-<br />

October 1980. But later on the appellant was declared as successful in<br />

supplementary examination held in 1981 as per the result sheet enclosed with the<br />

RTI application by the appellant. Consequently the appellant was promoted to the<br />

rank of Stock Assistant (Veternary Pharmacist) and then again promoted to the<br />

rank of Live Stock Assistant (Sr. Veternary Pharmacist) as per his applications and<br />

claims. The certificate for completion of the training issued by the Principal Stock<br />

Assistant Training Institute was mandatory which was also the basic eligibility for<br />

getting the promotion by the appellant. In case the said certificate had not been<br />

issued to the appellant, he would not have been promoted to the higher cadre<br />

which clearly indicates that the certificate in question might have already been<br />

issued to the appellant.<br />

In view of the aforesaid facts, since the information sought by the<br />

information seeker is about 33 years back and also the office of the PIO is not<br />

competent to issue such certificate as demanded by the information seeker,<br />

therefore, the appellant is hereby advised to approach the appropriate Institute<br />

for getting the duplicate copy of Stock Assistant Training Certificate of the course<br />

undertaken and completed by him during the year 1979-80.<br />

The appeal is accordingly disposed of.<br />

Notice of this decision be given free of cost to the parties.<br />
