Examinati<strong>on</strong> Questi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> a MBBS Examinati<strong>on</strong> in Surgery<br />
On February 24, 2008, an an<strong>on</strong>ymous e-mail was sent to <strong>the</strong> local press<br />
c<strong>on</strong>cerning an alleged leakage <str<strong>on</strong>g>of</str<strong>on</strong>g> examinati<strong>on</strong> questi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> Short Answer Questi<strong>on</strong>s<br />
(SAQ) <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> MBBS Final Written Examinati<strong>on</strong> in Surgery to be held <strong>on</strong> <strong>the</strong> following<br />
day.<br />
On February 25, 2008, <strong>the</strong> examinati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> SAQ paper was held as scheduled<br />
but a replacement questi<strong>on</strong> paper made up <str<strong>on</strong>g>of</str<strong>on</strong>g> reserved questi<strong>on</strong>s was used in place <str<strong>on</strong>g>of</str<strong>on</strong>g><br />
<strong>the</strong> original SAQ Paper.<br />
by <strong>the</strong> Vice-Chancellor to investigate <strong>the</strong> matter.<br />
On <strong>the</strong> same day, a 3-pers<strong>on</strong> panel (“<strong>the</strong> Panel”) was set up<br />
The Panel was chaired by<br />
Pro-Vice-Chancellor Joseph H.W. Lee, and comprised <str<strong>on</strong>g>of</str<strong>on</strong>g> Justice Patrick S.O. Chan and<br />
Pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essor Grace W.K. Tang as members.<br />
The investigati<strong>on</strong> panel held 8 meetings from March to June, and has now<br />
submitted a report to <strong>the</strong> Vice-Chancellor.<br />
The Panel has reported <strong>the</strong> following:<br />
(a)<br />
On February 16, 2008, 5 MBBS final-year students approached a<br />
teacher in <strong>the</strong> Department <str<strong>on</strong>g>of</str<strong>on</strong>g> Surgery <strong>on</strong> an occasi<strong>on</strong> where <strong>the</strong>y served<br />
as volunteer helpers at a clinical examinati<strong>on</strong> held for <strong>the</strong> Year 4<br />
students, with a list <str<strong>on</strong>g>of</str<strong>on</strong>g> areas and topics <str<strong>on</strong>g>of</str<strong>on</strong>g> what <strong>the</strong> students had<br />
collectively guessed as <strong>the</strong> most probable areas and topics which might<br />
be examined in <strong>the</strong> SAQ Paper. During <strong>the</strong> c<strong>on</strong>versati<strong>on</strong>, <strong>the</strong> students<br />
had tried to elicit from <strong>the</strong> teacher c<strong>on</strong>cerned indicati<strong>on</strong>s, hints or clues<br />
relating to <strong>the</strong> SAQ Paper. The teacher had unintenti<strong>on</strong>ally but ei<strong>the</strong>r<br />
c<strong>on</strong>sciously or subc<strong>on</strong>sciously provided <strong>the</strong>m with hints and clues from<br />
which <strong>the</strong> students made <strong>the</strong>ir own deducti<strong>on</strong>s <strong>on</strong> <strong>the</strong> areas and topics to<br />
be examined in <strong>the</strong> SAQ Paper, and produced a list <str<strong>on</strong>g>of</str<strong>on</strong>g> possible<br />
examinati<strong>on</strong> questi<strong>on</strong>s/topics, which was circulated to all MBBS<br />
final-year students. There was a significant similarity between <strong>the</strong><br />
c<strong>on</strong>tents <str<strong>on</strong>g>of</str<strong>on</strong>g> this list and <strong>the</strong> SAQ in <strong>the</strong> original examinati<strong>on</strong> paper.<br />
(b)<br />
The Panel fully realizes that <strong>the</strong> teacher c<strong>on</strong>cerned is a compassi<strong>on</strong>ate<br />
teacher held in high esteem by his colleagues and students, and is a
caring mentor and counsellor in <strong>the</strong> eyes <str<strong>on</strong>g>of</str<strong>on</strong>g> students.<br />
(c)<br />
The Panel however is <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> view that this teacher should be resp<strong>on</strong>sible<br />
for <strong>the</strong> incident. He should be aware <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> importance <str<strong>on</strong>g>of</str<strong>on</strong>g> keeping <strong>the</strong><br />
c<strong>on</strong>tents <str<strong>on</strong>g>of</str<strong>on</strong>g> examinati<strong>on</strong> papers with <strong>the</strong> strictest c<strong>on</strong>fidence. He<br />
should have avoided answering questi<strong>on</strong>s put to him by students<br />
touching up<strong>on</strong> sensitive matters such as examinati<strong>on</strong> topics, and should<br />
be more careful and prudent, instead <str<strong>on</strong>g>of</str<strong>on</strong>g> succumbing to <strong>the</strong> pressures <str<strong>on</strong>g>of</str<strong>on</strong>g><br />
<strong>the</strong> students.<br />
(d)<br />
The Panel feels that students should also be resp<strong>on</strong>sible as what <strong>the</strong>y<br />
have d<strong>on</strong>e was a planned and c<strong>on</strong>certed attempt to pressurize a popular<br />
and well respected teacher into doing something which he should not do.<br />
(e)<br />
The Panel has c<strong>on</strong>cluded that <strong>the</strong> allegati<strong>on</strong> that <strong>the</strong> teacher c<strong>on</strong>cerned<br />
leaked <strong>the</strong> SAQ questi<strong>on</strong>s to individual pers<strong>on</strong>s or students for pers<strong>on</strong>al<br />
favour is unfounded.<br />
(f)<br />
The Panel is satisfied that <strong>the</strong>re is no questi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> any prejudice or<br />
unfairness caused to any individual student and any adverse effect <strong>on</strong><br />
examinati<strong>on</strong>, as <strong>the</strong> list <str<strong>on</strong>g>of</str<strong>on</strong>g> possible examinati<strong>on</strong> questi<strong>on</strong>s/topics was<br />
circulated to all students in <strong>the</strong> whole class, and as in any event, <strong>the</strong><br />
original SAQ paper was withdrawn and a replacement paper was set and<br />
used for <strong>the</strong> examinati<strong>on</strong> held <strong>on</strong> February 25.<br />
The Panel has made <strong>the</strong> following recommendati<strong>on</strong>s:<br />
(a)<br />
that in order to avoid <strong>the</strong> potential c<strong>on</strong>flict in <strong>the</strong> roles <str<strong>on</strong>g>of</str<strong>on</strong>g> a<br />
mentor/counsellor and a pers<strong>on</strong> in charge <str<strong>on</strong>g>of</str<strong>on</strong>g> or involved in endorsing <strong>the</strong><br />
final versi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> examinati<strong>on</strong> paper, Faculty mentors and counsellors<br />
should not be involved in <strong>the</strong> process <str<strong>on</strong>g>of</str<strong>on</strong>g> selecting questi<strong>on</strong>s for <strong>the</strong> final<br />
versi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> examinati<strong>on</strong> papers;<br />
(b)<br />
that <strong>the</strong> teacher involved in <strong>the</strong> incident who is a Faculty mentor and
counsellor should no l<strong>on</strong>ger be involved in <strong>the</strong> process <str<strong>on</strong>g>of</str<strong>on</strong>g> selecting <strong>the</strong><br />
final versi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> questi<strong>on</strong>s in future written examinati<strong>on</strong>s; and that a letter<br />
<str<strong>on</strong>g>of</str<strong>on</strong>g> cauti<strong>on</strong> should be issued to this teacher; and<br />
(c)<br />
that Faculty mentors and counsellors should regularly inculcate in<br />
students <strong>the</strong> correct attitude towards learning and examinati<strong>on</strong>.<br />
These recommendati<strong>on</strong>s have been accepted by <strong>the</strong> Vice-Chancellor who has taken <strong>the</strong><br />
necessary acti<strong>on</strong>s as recommended by <strong>the</strong> Panel including <strong>the</strong> issue <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> letter <str<strong>on</strong>g>of</str<strong>on</strong>g><br />
cauti<strong>on</strong>. The teacher involved in <strong>the</strong> incident has relinquished his duties relating to<br />
<strong>the</strong> selecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> final examinati<strong>on</strong> questi<strong>on</strong>s.<br />
