If you are injured <strong>or</strong> disabled as a result of your<br />

service in Her Majesty’s (HM) Armed F<strong>or</strong>ces <strong>or</strong><br />

during a time of war, you may be entitled to a<br />

<strong>War</strong> <strong>Disablement</strong> <strong>Pension</strong>.<br />

If you are a war widow <strong>or</strong> widower <strong>or</strong> a dependant of<br />

someone who died as a result of their service in HM<br />

Armed F<strong>or</strong>ces <strong>or</strong> during a time of war, you may be<br />

entitled to a <strong>War</strong> Widow's <strong>or</strong> Widower's <strong>Pension</strong>.<br />

prepared this leaflet to give you general guidance,<br />

but it is not a definitive (full) statement of the law.<br />

Please remember that the law may change from time<br />

to time. This may affect your rights <strong>and</strong><br />

responsibilities, including whether you are likely to<br />

get a war pension, how much you will get, <strong>and</strong> when<br />

you are likely to get it.<br />

Who is eligible f<strong>or</strong> a <strong>War</strong> <strong>Disablement</strong> <strong>Pension</strong>?<br />

To be entitled to a <strong>War</strong> <strong>Disablement</strong> <strong>Pension</strong> you do<br />

not need to have served during wartime <strong>or</strong> have<br />

been a member of HM Armed F<strong>or</strong>ces.<br />

You may be entitled to a <strong>War</strong> <strong>Disablement</strong> <strong>Pension</strong> if<br />

you :<br />

• were injured, disabled <strong>or</strong> have suffered an illness<br />

(physical <strong>or</strong> pychological) through service in HM<br />

Armed F<strong>or</strong>ces, including the Ulster Defence<br />

Regiment now known as the Royal Irish Regiment,<br />

the Home Guard, <strong>or</strong> nursing <strong>and</strong> auxiliary services;<br />

• a civil defence volunteer (CDV) disabled while<br />

serving as a CDV;<br />

• a civilian disabled as a result of enemy action in<br />

the 1939 to 1945 war;<br />

• a merchant seaman, a member of the naval<br />

auxiliary services <strong>or</strong> a coastguard, <strong>and</strong> you were<br />

disabled because of an injury you received <strong>or</strong> a<br />

disease you suffered because of conditions during<br />

a war, <strong>or</strong> because you were a prisoner of war; <strong>or</strong><br />

• a member of the Polish F<strong>or</strong>ces under British<br />

comm<strong>and</strong> who served in the 1939 to 1945 war,<br />

<strong>or</strong> in the Polish Resettlement F<strong>or</strong>ces <strong>and</strong> you<br />

were injured <strong>or</strong> disabled through this service.<br />

You are not entitled to a war pension f<strong>or</strong><br />

disablement if you are still serving in HM F<strong>or</strong>ces.<br />

What you should know <strong>about</strong> <strong>War</strong> <strong>Disablement</strong> <strong>Pension</strong>s<br />

How much is <strong>War</strong> <strong>Disablement</strong> <strong>Pension</strong>?<br />

The amount of money you get depends on how<br />

disabled you are. It does not matter how much you<br />

earn.<br />

We will look at the conditions you have claimed f<strong>or</strong>.<br />

By conditions we mean:<br />

• a wound;<br />

• an injury;<br />

• a disease; <strong>or</strong><br />

• something that happened as a result of an<br />

accident.<br />

You may need to have a medical examination. A<br />

doct<strong>or</strong> will look at how your conditions affect you.<br />

They will compare your health with that of a healthy<br />

person of the same age <strong>and</strong> sex. If you are claiming<br />

f<strong>or</strong> deafness, we may ask you to have an audiology<br />

examination <strong>or</strong> an evoked-response audiogram.<br />

These are special tests that measure how well you<br />

can hear sound.<br />

We will use all this inf<strong>or</strong>mation to assess your<br />

disablement. We w<strong>or</strong>k out our assessment of your<br />

disablement as a percentage.<br />

If we assess your disablement at 20% <strong>or</strong> m<strong>or</strong>e, we<br />

will pay you a pension.<br />

If we assess your disablement at less than 20%, we<br />

will n<strong>or</strong>mally pay you a lump sum. We call this lumpsum<br />

payment a gratuity. The amount you will get<br />

depends on how disabled you are <strong>and</strong> how long you<br />

are likely to be disabled.<br />

If we pay you a gratuity but increase your assessment<br />

to 20% <strong>or</strong> m<strong>or</strong>e within six years (f<strong>or</strong> example, after a<br />

successful review <strong>or</strong> appeal), we will have to take all<br />

<strong>or</strong> part of the gratuity as an advance payment of your<br />

pension. This is to make sure that people who are<br />

paid a gratuity instead of a pension are not better off.<br />

If your condition is noise-induced sens<strong>or</strong>ineural<br />

hearing loss <strong>and</strong> we assess your disablement at less<br />

than 20%, we will not be able to pay you a pension <strong>or</strong><br />

a lump sum.<br />

Compensation received from other <strong>or</strong>ganisations,<br />

elsewhere in the Ministry of Defence <strong>or</strong> Industrial<br />

Injuries <strong>Disablement</strong> Benefit (IIDB).<br />

If you are getting <strong>or</strong> have had compensation from<br />

another <strong>or</strong>ganisation, elsewhere in the Ministry of<br />

Defence <strong>or</strong> IIDB f<strong>or</strong> the same conditions as those f<strong>or</strong><br />

which you are making this claim, we may reduce your<br />

<strong>War</strong> <strong>Disablement</strong> <strong>Pension</strong> <strong>or</strong> lump sum. We do this<br />

because we believe you should not be compensated<br />

twice f<strong>or</strong> the same disablement.<br />

There are some payments that we do not take into<br />

account, f<strong>or</strong> example, compensation paid under the<br />

UK Criminal Injuries Compensation Schemes as a<br />

result of terr<strong>or</strong>ist activities.<br />

What you should know <strong>about</strong> <strong>War</strong> <strong>Disablement</strong> <strong>Pension</strong>s<br />

Income tax<br />

<strong>War</strong> pensions <strong>and</strong> allowances have not been taxed<br />

since 6 April 1979. When you fill in your income tax<br />

return, write a note clearly on the f<strong>or</strong>m to say that you<br />

receive a war pension. The Tax Inspect<strong>or</strong> will then<br />

ign<strong>or</strong>e your war pension when he <strong>or</strong> she assesses<br />

how much income tax you have to pay. (Income <strong>and</strong><br />

C<strong>or</strong>p<strong>or</strong>ation Taxes Act 1988 - subsection 315)<br />

Armed F<strong>or</strong>ces <strong>Pension</strong> Scheme<br />

The armed f<strong>or</strong>ces run a higher-rate pension scheme<br />

called Service-Attributable <strong>Pension</strong>. You may qualify<br />

f<strong>or</strong> this pension if:<br />

• you were in HM Armed F<strong>or</strong>ces <strong>and</strong> were medically<br />

discharged on <strong>or</strong> after 31 March 1973; <strong>and</strong><br />

• we accept that the conditions which led to you<br />

being medically discharged were caused by your<br />

service.<br />

please get in touch with the Armed F<strong>or</strong>ces Personnel<br />

Administration Agency (AFPAA). The address is on<br />

Preserved <strong>Pension</strong><br />

If you leave the Armed F<strong>or</strong>ces too early to receive an<br />

immediate pension, you may be entitled to a<br />

Preserved <strong>Pension</strong>. This is n<strong>or</strong>mally paid from age<br />

60 <strong>and</strong> you must have been a member of the Armed<br />

F<strong>or</strong>ces <strong>Pension</strong> Scheme f<strong>or</strong> at least two years.<br />

You may be awarded a Preserved <strong>Pension</strong> early if<br />

you become permanently unable to w<strong>or</strong>k because of<br />

mental <strong>or</strong> physical illness.<br />

If you want m<strong>or</strong>e inf<strong>or</strong>mation <strong>about</strong> this pension, get<br />

in touch with the AFPAA office. The address is on<br />

How to claim f<strong>or</strong> a <strong>War</strong> <strong>Disablement</strong> <strong>Pension</strong><br />

If you receive a claim f<strong>or</strong>m <strong>and</strong> a letter with this<br />

leaflet, fill in the f<strong>or</strong>m <strong>and</strong> send it back to us<br />

within three months of the date of the letter. The<br />

address is on page 30.<br />

If you delay it will affect your claim <strong>and</strong> you<br />

could lose money.<br />

If you want a claim f<strong>or</strong>m, you can write to us at the<br />

address on page 30.<br />

You will need to tell us your full name <strong>and</strong> any other<br />

names that you have used, like your maiden name <strong>or</strong><br />

married name, <strong>and</strong> your National Insurance number.<br />

If you are claiming because of your service in HM<br />

Armed F<strong>or</strong>ces <strong>or</strong> the Polish F<strong>or</strong>ces under British<br />

comm<strong>and</strong>, tell us:<br />

• your service number;<br />

• your rank <strong>or</strong> rating;<br />

• your branch of the f<strong>or</strong>ces, including your<br />

regiment <strong>or</strong> c<strong>or</strong>ps; <strong>and</strong><br />

• the dates you enlisted <strong>and</strong> were discharged.<br />

Please provide as much inf<strong>or</strong>mation as you can <strong>about</strong><br />

your injury <strong>or</strong> disablement.<br />

If you do not have all the inf<strong>or</strong>mation, tell us as much as<br />

you can.<br />

If you are claiming as a civil defence volunteer <strong>or</strong><br />

civilian, you must do so within three months of the<br />

date of your injury. The only general exception to this<br />

is if you have independent evidence of the injury<br />

which caused your disablement. But we do make<br />

other exceptions in special circumstances.<br />

F<strong>or</strong> the other groups mentioned, there are no time<br />

limits f<strong>or</strong> claiming. But payment will n<strong>or</strong>mally only<br />

start from the date of your claim.<br />

How we will pay you<br />

If we decide to pay you a pension, we will pay it:<br />

• into a bank <strong>or</strong> building society account (some with<br />

access at the Post Office ® ); <strong>or</strong><br />

• a basic bank account (some with access at the<br />

Post Office ® ); <strong>or</strong><br />

• a Post Office ® card account (available from 2003).<br />

If you live overseas payment is only available through<br />

banks, building societies <strong>or</strong> credit union.<br />

If you are getting Housing Benefit <strong>or</strong> Council Tax<br />

Benefit, you must tell the council <strong>about</strong> your war<br />

pension. If you have been getting Housing Benefit <strong>or</strong><br />

Council Tax Benefit since the start of your war pension,<br />

the council may have overpaid you <strong>and</strong> may ask you<br />

to repay some of the money.<br />

The role of the medical advisers in war pensions<br />

Under war pensions legislation, doct<strong>or</strong>s (known as<br />

medical advisers) must consider medical aspects of<br />

war pension claims <strong>and</strong> appeals. The medical<br />

adviser has both medical expertise <strong>and</strong> special<br />

training in the <strong>War</strong> <strong>Pension</strong>s Scheme.<br />

Lay officers make decisions on claims to war pension.<br />

If medical matters are involved, f<strong>or</strong> example, in<br />

deciding whether a claimed disability is due to<br />

service <strong>or</strong> the level of disability, they take advice from,<br />

<strong>or</strong> act on, certificates provided by a medical adviser.<br />

The medical adviser takes account of the facts which<br />

are specific to the case, the relevant law <strong>and</strong> policy<br />

<strong>and</strong> the current medical underst<strong>and</strong>ing of the relevant<br />

dis<strong>or</strong>der. The war pensions medical appendices<br />

provide a current summary of generally-accepted<br />

medical thinking on the causes of dis<strong>or</strong>ders.<br />

• your husb<strong>and</strong>'s <strong>or</strong> wife's death was a result of his <strong>or</strong><br />

her service in HM Armed F<strong>or</strong>ces;<br />

• your husb<strong>and</strong> <strong>or</strong> wife was a civil defence volunteer<br />

<strong>or</strong> a civilian <strong>and</strong> his <strong>or</strong> her death was a result of the<br />

1939 to 1945 war;<br />

• your husb<strong>and</strong> <strong>or</strong> wife was a merchant seaman, a<br />

member of the naval auxiliary services, <strong>or</strong> a<br />

coastguard <strong>and</strong> his <strong>or</strong> her death was a result of an<br />

injury <strong>or</strong> disease he <strong>or</strong> she got during a war <strong>or</strong><br />

because he <strong>or</strong> she was a prisoner of war;<br />

• your husb<strong>and</strong>'s <strong>or</strong> wife's death was a result of his <strong>or</strong><br />

her service as a member of the Polish F<strong>or</strong>ces under<br />

British comm<strong>and</strong> during the 1939 to 1945 war, <strong>or</strong> in<br />

the Polish Resettlement F<strong>or</strong>ces;<br />

• your husb<strong>and</strong> <strong>or</strong> wife was getting a <strong>War</strong> <strong>Pension</strong>s<br />

Constant Attendance Allowance at the time of his <strong>or</strong><br />

her death, <strong>or</strong> would have been if he had not been<br />

in hospital; <strong>or</strong><br />

• your husb<strong>and</strong> <strong>or</strong> wife was getting a <strong>War</strong><br />

<strong>Disablement</strong> <strong>Pension</strong> at the 80% rate <strong>or</strong> higher <strong>and</strong><br />

was getting Unemployability Supplement.<br />

We may be able to pay you a pension if you lived with<br />

a partner as husb<strong>and</strong> <strong>and</strong> wife.<br />

You are not entitled to a <strong>War</strong> Widow's <strong>or</strong> Widowers<br />

<strong>Pension</strong> as well as Bereavement Benefit. But the<br />

<strong>War</strong> Widow's <strong>or</strong> Widower's <strong>Pension</strong> is usually higher.<br />

How much is <strong>War</strong> Widow's <strong>or</strong> Widower's <strong>Pension</strong>?<br />

There are two rates of <strong>War</strong> Widow's <strong>or</strong> Widower's<br />

<strong>Pension</strong> - a higher rate <strong>and</strong> a lower rate.<br />

Higher rate<br />

We will pay you a <strong>War</strong> Widow's <strong>or</strong> Widower's <strong>Pension</strong> at<br />

the higher rate if you are:<br />

• the widow <strong>or</strong> widower of an officer above the rank of<br />

Maj<strong>or</strong> <strong>or</strong> equivalent;<br />

• aged 40 <strong>or</strong> over;<br />

• under 40 <strong>and</strong> getting an allowance f<strong>or</strong> a child; <strong>or</strong><br />

• under 40 <strong>and</strong> unable to supp<strong>or</strong>t yourself financially.<br />

Lower rate<br />

If you are not entitled to the higher rate, we will pay you<br />

a pension at the lower rate until you reach age 40.<br />

When you reach age 40, we will pay you the higher-rate<br />

pension.<br />

Income tax<br />

<strong>War</strong> Widow's <strong>and</strong> Widower's <strong>Pension</strong>s <strong>and</strong><br />

allowances have not been taxed since 6 April 1979.<br />

When you fill in your income tax return, write a note<br />

Supplementary pensions<br />

If your husb<strong>and</strong> <strong>or</strong> wife was discharged from HM<br />

F<strong>or</strong>ces on <strong>or</strong> bef<strong>or</strong>e 31 March 1973, we may pay you<br />

a supplementary pension.<br />

Inheritance tax<br />

You will not n<strong>or</strong>mally pay capital transfer tax <strong>or</strong><br />

inheritance tax on any benefit you receive from your<br />

husb<strong>and</strong>'s <strong>or</strong> wife's estate when he <strong>or</strong> she dies.<br />

Your husb<strong>and</strong>'s <strong>or</strong> wife's estate will be exempt from<br />

these taxes as long as he <strong>or</strong> she dies as a result of a<br />

wound, accident <strong>or</strong> disease as a result of active<br />

service.<br />

allowances if someone gets a certificate from our<br />

Age allowance f<strong>or</strong> older widows <strong>or</strong> widowers<br />

You may automatically get an age allowance when<br />

you reach 65. We also increase this allowance at age<br />

70 <strong>and</strong> age 80.<br />

Temp<strong>or</strong>ary allowance f<strong>or</strong> widows <strong>or</strong> widowers<br />

We will give you a temp<strong>or</strong>ary allowance f<strong>or</strong> widows<br />

<strong>or</strong> widowers if your husb<strong>and</strong> <strong>or</strong> wife was getting <strong>War</strong><br />

<strong>Pension</strong>s Constant Attendance Allowance,<br />

Unemployability Supplement <strong>or</strong> had underlying title<br />

to Unemployability Supplement with Allowance f<strong>or</strong><br />

Lowered St<strong>and</strong>ard of Occupation. But you can only<br />

have this allowance f<strong>or</strong> 26 weeks after your husb<strong>and</strong><br />

<strong>or</strong> wife dies.<br />

We will pay you this allowance based on the rate of<br />

your husb<strong>and</strong>'s <strong>or</strong> wife's pension. If your husb<strong>and</strong> <strong>or</strong><br />

wife was getting some allowances, we will use them<br />

to w<strong>or</strong>k out how much we can pay you.<br />

The amount of money we can pay you is n<strong>or</strong>mally<br />

m<strong>or</strong>e than a <strong>War</strong> Widow's <strong>or</strong> Widower's <strong>Pension</strong> <strong>or</strong><br />

Bereavement Benefit.<br />

If you get Bereavement Benefit, we will have to reduce<br />

your allowance each week to take back the money that<br />

you have already had.<br />

After 26 weeks you may receive a <strong>War</strong> Widow's <strong>or</strong><br />

Widower's <strong>Pension</strong> <strong>or</strong> Bereavement Benefit.<br />

<strong>War</strong> Orphan's <strong>Pension</strong><br />

We can pay a pension to a child who has lost both<br />

parents. The war pensioners' welfare managers will<br />

do all they can to see that the child gets proper care,<br />

help <strong>and</strong> advice.<br />

Help with funeral costs<br />

We may pay funeral expenses to a widow <strong>or</strong> widower,<br />

If you are getting Housing Benefit <strong>or</strong> Council Tax<br />

Benefit, you must tell the council <strong>about</strong> your <strong>War</strong><br />

Widow's <strong>or</strong> Widower's <strong>Pension</strong>. If you have been<br />

getting Housing Benefit <strong>or</strong> Council Tax Benefit since<br />

the start of your <strong>War</strong> Widow's <strong>or</strong> Widower's <strong>Pension</strong>,<br />

the council may have overpaid you <strong>and</strong> may ask you<br />

to repay some of the money.<br />

If you remarry<br />

If you remarry, your <strong>War</strong> Widow's <strong>or</strong> Widower's<br />

<strong>Pension</strong> will stop. But we may be able to continue<br />

paying allowances f<strong>or</strong> your children.<br />

If you become widowed again <strong>or</strong> your marriage ends<br />

in div<strong>or</strong>ce <strong>or</strong> judicial separation, you can claim your<br />

pension again.<br />

If you are a widow <strong>or</strong> widower living with a<br />

partner as your husb<strong>and</strong> <strong>or</strong> wife<br />

If you live with a partner as husb<strong>and</strong> <strong>and</strong> wife, your<br />

Council Tax Benefit is a benefit run by your local<br />

About National Insurance contributions<br />

Most people, including war pensioners, have to pay<br />

National Insurance (NI) contributions if they are<br />

w<strong>or</strong>king. These contributions help you to qualify f<strong>or</strong><br />

pensions <strong>and</strong> other benefits.<br />

To link you with the right National Insurance account<br />

<strong>and</strong> f<strong>or</strong> your security we need:<br />

• proof of your identity; <strong>and</strong>,<br />

• the right inf<strong>or</strong>mation from you.<br />

A National Insurance number <strong>or</strong> National Insurance<br />

number card on its own does not prove your identity.<br />

It is up to you to give us the right inf<strong>or</strong>mation to link<br />

you with the right account.<br />

Please help us to deal with your claim quickly by<br />

giving us your National Insurance number. If you do<br />

not have one <strong>or</strong> you have a temp<strong>or</strong>ary one beginning<br />

with the letters ZZ <strong>or</strong> TN, please contact your local<br />

Jobcentre Plus <strong>or</strong> social security office. (You will find<br />

the number in the phone book under Benefits<br />

Agency.) They will help you to apply f<strong>or</strong> <strong>or</strong> trace a<br />

National Insurance number.<br />

If you w<strong>or</strong>k f<strong>or</strong> an employer, you <strong>and</strong> your employer<br />

must pay class 1 contributions if your earnings reach<br />

the lower earnings limit. Leaflet GL 23 Social<br />

Credits<br />

Credits are NI contributions that are rec<strong>or</strong>ded on your<br />

help you to get the full range of other benefits.<br />

If you are a married man, credits may help your wife<br />

to qualify f<strong>or</strong> a Bereavement Benefit if you die from a<br />

cause not related to your war disablement.<br />

If you receive Unemployability Supplement with your<br />

<strong>War</strong> <strong>Pension</strong>, you n<strong>or</strong>mally get credits f<strong>or</strong> each week<br />

you get the supplement, whether you have been<br />

paying NI contributions <strong>or</strong> not. You do not need a<br />

doct<strong>or</strong>'s statement to get these credits.<br />

If you do not receive Unemployability Supplement, you<br />

may still be able to get credits f<strong>or</strong> time that you cannot<br />

w<strong>or</strong>k. But you will need to send in doct<strong>or</strong>'s statements<br />

to your local Jobcentre Plus <strong>or</strong> social security office.<br />

Voluntary contributions<br />

Even if you can get credits, it may sometimes be<br />

To be entitled to a state retirement pension you will<br />

need to have paid a certain amount of contributions<br />

in any one tax year.<br />

• you don't know if you have paid enough NI<br />

contributions; <strong>or</strong><br />

If you were widowed after 6 April 1978, you cannot<br />

pay NI contributions at a reduced rate unless you<br />

You will not be able to pay reduced contributions if:<br />

• you do not pay NI contributions f<strong>or</strong> two whole tax<br />

years in a row;<br />

• you get married again <strong>and</strong> then get div<strong>or</strong>ced; <strong>or</strong><br />

• you decide to pay full contributions.<br />

If you are not entitled to pay reduced contributions<br />

any m<strong>or</strong>e <strong>and</strong> you are w<strong>or</strong>king, you should tell your<br />

employer.<br />

Home Responsibilities Protection<br />

Home Responsibilities Protection may:<br />

• help protect your basic state pension <strong>and</strong><br />

bereavement benefits if you do not go to w<strong>or</strong>k but<br />

do not earn enough to pay NI contributions<br />

because you are looking after a child <strong>or</strong> a sick <strong>or</strong><br />

disabled person at home; <strong>and</strong><br />

• from 6 April 2002, help you to build up an<br />

additional state pension through State Second<br />

<strong>Pension</strong>.<br />

those disabled in war <strong>and</strong> their families. They can<br />

give you help <strong>and</strong> advice on war pensions <strong>and</strong><br />

If you want to appeal against a decision on your<br />
