– <strong>the</strong> non-disclosure of statements prior to <strong>the</strong> appearance of <strong>the</strong><br />

witnesses at <strong>the</strong> inquest prejudiced <strong>the</strong> ability of <strong>the</strong> applicant to<br />

participate in <strong>the</strong> inquest;<br />

– <strong>the</strong> inquest proceedings did not commence promptly.<br />

123. It is not for this Court to specify in any detail which procedures <strong>the</strong><br />

authorities should adopt in providing for <strong>the</strong> proper examination of <strong>the</strong><br />

circumstances of a killing in which State agents may be implicated. While<br />

reference has been made for example to <strong>the</strong> Scottish model of enquiry<br />

conducted by a judge of criminal jurisdiction, <strong>the</strong>re is no reason to assume<br />

that this may be <strong>the</strong> only method available. Nor can it be said that <strong>the</strong>re<br />

should be one unified procedure available satisfying all <strong>the</strong> necessary<br />

safeguards. If <strong>the</strong> aims of fact finding, criminal investigation and<br />

prosecution are carried out or shared between several authorities, as in<br />

Nor<strong>the</strong>rn Ireland, <strong>the</strong> Court considers that <strong>the</strong> requirements of Article 2 may<br />

none<strong>the</strong>less be satisfied if, while seeking to take into account o<strong>the</strong>r<br />

legitimate interests, such as national security or protection of <strong>the</strong> material<br />

relevant to o<strong>the</strong>r investigations, <strong>the</strong>y provide for <strong>the</strong> necessary safeguards in<br />

an accessible and effective manner. In <strong>the</strong> present case, <strong>the</strong> available<br />

procedures have not struck <strong>the</strong> right balance.<br />

124. <strong>The</strong> Court would observe that <strong>the</strong> shortcomings in transparency and<br />

effectiveness identified above run counter to <strong>the</strong> purpose identified by <strong>the</strong><br />

domestic courts of allaying suspicions and rumours. Proper procedures for<br />

ensuring <strong>the</strong> accountability of agents of <strong>the</strong> State are indispensable in<br />

maintaining public confidence and meeting <strong>the</strong> legitimate concerns that<br />

might arise from <strong>the</strong> use of lethal force. Lack of such procedures will only<br />

add fuel to fears of sinister motivations, as is illustrated inter alia by <strong>the</strong><br />

submissions made by <strong>the</strong> applicant concerning <strong>the</strong> alleged practice of<br />

collusion by security personnel with loyalist paramilitaries in targeting<br />

suspected members of <strong>the</strong> IRA or members of Sinn Fein.<br />

125. <strong>The</strong> Court finds that <strong>the</strong>re has been a failure to comply with <strong>the</strong><br />

procedural obligation imposed by Article 2 of <strong>the</strong> Convention and that <strong>the</strong>re<br />

has been, in this respect, a violation of that provision.<br />

II. ALLEGED VIOLATION OF ARTICLE 14 OF THE CONVENTION<br />

126. <strong>The</strong> applicant invoked Article 14 of <strong>the</strong> Convention, which<br />

provides:<br />

“<strong>The</strong> enjoyment of <strong>the</strong> rights and freedoms set forth in <strong>the</strong> Convention shall be<br />

secured without discrimination on any ground such as sex, race, colour, language,<br />

religion, political or o<strong>the</strong>r opinion, national or social origin, association with a national<br />

minority, property, birth or o<strong>the</strong>r status.”<br />

127. <strong>The</strong> applicant submitted that <strong>the</strong> circumstances of <strong>the</strong> killing of her<br />

son disclosed discrimination. <strong>The</strong> vast majority of victims from collusion<br />

between <strong>the</strong> security forces and paramilitaries came from <strong>the</strong> nationalist
