NOTICE OF REOUEST FOR SPECIFIC COMMENTS<br />

Please take notice that the <strong>Louisiana</strong> Public Service Commission (“<strong>LPSC</strong>” or<br />

“Commission” “Staff’) is requesting specific comments as indicated at the August 20, 2012<br />

Technical Conference in this matter. These comments are due no later than October 8, 2012.<br />

Specifically, please address separately and completely the following questions:<br />

1) Please state which of the below options you believe to be the most fair and reasonable<br />

method of billing for net metering customers and <strong>ex</strong>plain the reasons for your response:<br />

a. Assessment of a minimum charge similar to the $50 discussed at the<br />

Technical Conference to cover fixed costs, along with compensation at the<br />

fuel clause rate rather than retail;<br />

b. Compensation at avoided cost (Eg., rather than an offset, the total bill would<br />

be reduced by the kWh generated at avoided cost);<br />

a. If you believe compensation at avoided cost is appropriate, please<br />

<strong>ex</strong>plain how avoided cost should be calculated (Eg., Peak daylight<br />

avoided cost?);<br />

c. The current method of retail credit or offset;<br />

a. If you believe the current method should continue unchanged, please<br />

address the concern of growing cross-subsidization.<br />

d. If you believe some alternative to the above methods should be employed,<br />

please <strong>ex</strong>plain it in detail here, and discuss why you believe it is fair and<br />

reasonable.<br />

2) The following questions refer to aggregate net metering (“ANM”). For the purpose of<br />

these questions, ANM is defined as the allocation of <strong>ex</strong>cess net generation against<br />

electricity usage at multiple accounts of the same customer that are physically connected.<br />

a. As an alternative to ANM, should the Commission require that net metering<br />

customers be given a refund once a year if they are carrying a negative usage<br />

balance?<br />

b. If the Commission were to amend its rules to allow ANM, should all customer<br />

classes be eligible? If not, please state which customer classes or groups of<br />

customers (eg., agricultural customers) should be eligible to aggregate their<br />

meters.<br />

c. If the Commission were to amend its rules to allow ANM, should the Commission<br />

limit the distance between an ANM customer’s generation facility and the<br />

customer’s <strong>part</strong>icipating meters?<br />

d. Should there be a limit on aggregate meters on the same account?<br />

e. Should customers that wish to aggregate meters be required to pay an upfront<br />

charge to cover the administrative costs that will be necessary to implement<br />

aggregate net metering (please refer to the responses of utilities on March 27,<br />

2012 regarding the administrative costs). If so, how should this be implemented?<br />

f. Should utilities be allowed to assess a distribution network charge on ANM<br />

customers to reflect the wheeling of power between customer locations? If so,<br />

how should this be implemented?<br />

3) The following questions refer to virtual net metering (“VNM”). For the purpose of these<br />

questions VNM is defined as the allocation of <strong>ex</strong>cess net generation against electricity<br />

usage at multiple accounts of the same customer that are not physically connected.<br />

a. Should the Commission allow VNM?<br />

b. If so, which of the safeguards above should also apply to VNM?<br />

c. Should any additional safeguards or <strong>ex</strong>clusions be added?<br />

4) Based on the comments received thus far, Staff believes it would be appropriate to clarify<br />

the net metering rules to allow net metering customers to enter into a lease with a fixed<br />

price and fixed term, where the leasing company provides only maintenance and repair,<br />

but to prohibit power purchase agreements (“PPAs”) which could result in the third <strong>part</strong>y<br />

provider becoming an unregulated retail seller of electricity. Please state whether you<br />

agree or disagree and what changes you believe should be made to the rules in this<br />

regard.<br />

5) Please offer any other suggestions or comments relevant to the issues remaining in this<br />

docket, but not addressed fully above.<br />

Staff requests that you provide specific comments on the above issues no later than<br />

Monday, October 8, 2012. The n<strong>ex</strong>t steps will be determined once Staff has had an opportunity<br />

to review these responses and complete its cost of service analysis.<br />
