The Plaintiff’s further averred that the said hotel was far from being in an
unacceptable state.
6. In reply to paragraph 11 of the Statement of Defense, the Plaintiffs aver
that the letter dated 16 th December, 1999, that was faxed to them, dealt
with other issues for example, payment and the issue of the quality of the
hotel was merely incidental in a very general manner.
7. In reply to paragraph 12 of the Statement Defense the Plaintiffs aver that
the letter dated 31 st December, 1999, as never received by the Plaintiff’s.
8. In further reply to paragraphs 7,8,9,10,13, and 14, of the Statement of
Defense, the Plaintiffs aver that the Defendants sent a representative to
the Plaintiff’s hotel who carried out a thorough inspection of the said hotel
as a result of which the said representative issued a report entitled;
“Representative’s Special Report”. The said report was not
unfavourable to the Plaintiffs.
Further, the Plaintiffs aver that the Defendant’s representative Mrs. Sheila
was found to be racist in her attitude towards the management of the
Plaintiffs hotel whereupon, the Plaintiffs were obliged to send an official
letter of complaint to the Defendants dated 2 nd January, 2000, wherein
the said Mrs. Sheila’s poor attitude and approach was stated.
9. In reply to paragraph 15 of the Statement of Defense the Plaintiffs states
that the matters raised in the said paragraph are highly speculative in
