Terms
AGENCY COMMISSIONS
15% commission to recognized advertising agencies on gross billings for advertising and
premiums (not including special services and/or production charges). No commissions will
be paid on invoices not paid within 30 days of billing date. Publisher reserves the right to
hold advertiser and/or its advertising agency jointly and severably liable for such monies as
are due and payable to the publisher.
OTHER TERMS AND CONDITIONS
Publisher and advertiser (and advertising agency) are bound by the terms and conditions in
this Rate Card. Publisher is not bound by any promises or contracts, printed or otherwise,
except as expressly agreed in signed writing. All insertion orders are subject to the terms and
condition in this Rate Card.
Publisher may reject or cancel any advertisement at any time and for any reason. Any advertisement
simulating editorial will be labeled “Advertisement”.
Advertiser and/or advertiser’s agency warrant that any advertisement submitted for publication
in The New York Enterprise Report does not violate any law or infringe any right
of any party and that the advertiser and/or agency is authorized to publish the submitted
advertisement. In consideration for publication of the advertisement in The New York
Enterprise Report, the advertiser and/or its agency will jointly and severally indemnify,
hold harmless and defend The New York Enterprise Report, RSL Media LLC, and its
employees against any and all losses and expenses arising out of the publication of such
advertisements in The New York Enterprise Report.
Any conditions on insertion orders or instructions for positioning or other requests for
advertisements will be deemed requests and are not guaranteed. The publisher’s failure to
comply with such requests (not made in writing) shall not relieve the advertiser or agency of
any and all obligations to pay for the advertising.
Publisher shall not be subject to any liability for any failure to publish or circulate all or
any part of any issue or issues of The New York Enterprise Report due to work stoppages
(including strikes), accidents, fires, acts of God or any other circumstance not within the
control of Publisher.
The above terms and conditions shall be deemed incorporated in every insertion order submitted to The New York
Enterprise Report unless otherwise noted in signed writing by the Publisher.
