BAER being duly sworn, deposes and says:
1. I am Deputy Borough President for the Manhattan Borough President's
Office. I have been in this position for approximately one year. My responsibilities include
oversight of the Borough President Office's policy division; land use, housing and economic
development division; and communications division. I also serve as chair of the Manhattan
Borough Board in the absence of the Borough President.
2. I understand that the preservation group Landmark West and a few
individuals opposed to the City's sale of the building at 2 Columbus Circle to the Museum of
Arts and Design have commenced this challenge to the Manhattan Borough Board's
authorization of the sale, claiming that the notice provided was inadequate. I am fully familiar
with the facts of this case. I offer this affidavit in support of the Borough Board's response to the
challenge. This affidavit is based on personal knowledge, the records of the Borough President's
office, and conversations with employees of the Borough President's office.
