The provisi<strong>on</strong> <strong>of</strong> services covered by this Article can <strong>on</strong>ly<br />

be d<strong>on</strong>e by the pers<strong>on</strong>s registered for the pursuit <strong>of</strong> producti<strong>on</strong><br />

or brokering activity in the domestic <strong>and</strong> internati<strong>on</strong>al<br />

market regarding the goods specified in the List <strong>of</strong><br />

<strong>Military</strong> <strong>Goods</strong>, whose headquarters are located in the territory<br />

<strong>of</strong> the Republic <strong>of</strong> Croatia, <strong>and</strong> who are registered in<br />

the Register <strong>of</strong> Service Providers for <strong>Military</strong> <strong>Goods</strong>, which<br />

was not the case prior to the drafting <strong>of</strong> this Law.<br />

Brokering services refer to the negotiati<strong>on</strong> or c<strong>on</strong>tracting<br />

<strong>of</strong> business in c<strong>on</strong>necti<strong>on</strong> with the purchase, sale or procurement<br />

<strong>of</strong> military goods specified in the List <strong>of</strong> <strong>Military</strong><br />

<strong>Goods</strong> from <strong>on</strong>e foreign country into any other foreign<br />

country, as well as the sale <strong>and</strong> purchase <strong>of</strong> military goods<br />

specified in the List <strong>of</strong> <strong>Military</strong> <strong>Goods</strong> that are located in <strong>on</strong>e<br />

foreign country for transfer into another foreign country.<br />

Brokering services do not include transportati<strong>on</strong>, financial<br />

services, insurance <strong>and</strong> reinsurance, nor do they include<br />

advertising or promoti<strong>on</strong>.<br />

Technical assistance refers to any technical assistance in regard<br />

to repair, development, producti<strong>on</strong>, assembly, testing<br />

or maintenance <strong>of</strong> military goods, <strong>and</strong> any other form <strong>of</strong><br />

technical assistance pertaining to military goods that may<br />

take a form <strong>of</strong> instructi<strong>on</strong>, training, transfer <strong>of</strong> business<br />

knowledge, or transfer <strong>of</strong> expert or advisory services.<br />

Technical assistance includes oral forms <strong>of</strong> assistance,<br />

written or voice instructi<strong>on</strong>s, trainings, transfers <strong>of</strong> business<br />

knowledge or skills, as well as c<strong>on</strong>sultancy services.<br />

The Law prescribes that the licenses for the export <strong>and</strong><br />

import <strong>of</strong> military <strong>and</strong> n<strong>on</strong>-military lethal goods, as well<br />

as those for the provisi<strong>on</strong> <strong>of</strong> services for military goods,<br />

are issued by the Ministry <strong>of</strong> Ec<strong>on</strong>omy, Labor <strong>and</strong> Entrepreneurship,<br />

<strong>on</strong> the basis <strong>of</strong> the c<strong>on</strong>sent <strong>of</strong> the Commissi<strong>on</strong><br />

for the Provisi<strong>on</strong> <strong>of</strong> C<strong>on</strong>sent for <strong>Export</strong> <strong>and</strong> <strong>Import</strong> <strong>of</strong><br />

<strong>Military</strong> <strong>Goods</strong> <strong>and</strong> N<strong>on</strong>-<strong>Military</strong> Lethal <strong>Goods</strong> <strong>and</strong> for the<br />

Provisi<strong>on</strong> <strong>of</strong> Services for <strong>Military</strong> <strong>Goods</strong>.<br />

It is important to point out that the provisi<strong>on</strong>s <strong>of</strong> this Law<br />

pertain to the export <strong>and</strong> import <strong>of</strong> military <strong>and</strong> n<strong>on</strong>-military<br />

lethal goods for commercial purposes, which means<br />

that the provisi<strong>on</strong>s <strong>of</strong> this Law do not pertain to the export<br />

<strong>and</strong> import <strong>of</strong> these goods for pers<strong>on</strong>al needs <strong>of</strong> individuals.<br />

Namely, the Law <strong>on</strong> Trade <strong>and</strong> Commerce (Official<br />

Gazette no. 87/2008) prescribes that domestic <strong>and</strong><br />

foreign natural pers<strong>on</strong>s may freely carry into the country<br />

<strong>and</strong> receive from abroad, or carry out <strong>of</strong> the country <strong>and</strong><br />

send abroad items that c<strong>on</strong>stitute pers<strong>on</strong>al luggage, victuals<br />

<strong>and</strong> items for their pers<strong>on</strong>al needs <strong>and</strong> the needs <strong>of</strong><br />

their family members; items for the needs <strong>of</strong> their household<br />

<strong>and</strong> animals, in quantities that are not intended for<br />

resale. This provisi<strong>on</strong> allows natural pers<strong>on</strong>s to freely carry<br />

into <strong>and</strong> out <strong>of</strong> the country the permitted types <strong>of</strong> goods<br />

from the List <strong>of</strong> <strong>Military</strong> <strong>Goods</strong> <strong>and</strong> the List <strong>of</strong> N<strong>on</strong>-<strong>Military</strong><br />

Lethal <strong>Goods</strong>, in accordance with the Law <strong>on</strong> Weap<strong>on</strong>s,<br />

without the license <strong>of</strong> the Ministry <strong>of</strong> Ec<strong>on</strong>omy, Labor <strong>and</strong><br />

Entrepreneurship, but <strong>on</strong> the basis <strong>on</strong> the acquisiti<strong>on</strong> license<br />

<strong>of</strong> the Ministry <strong>of</strong> Interior.<br />

In additi<strong>on</strong> to what we have stated above, the Law <strong>on</strong> the<br />

<strong>Export</strong> <strong>and</strong> <strong>Import</strong> <strong>of</strong> <strong>Military</strong> <strong>Goods</strong> <strong>and</strong> N<strong>on</strong>-<strong>Military</strong> Lethal<br />

<strong>Goods</strong> furthermore prescribes that certain types <strong>of</strong> licenses<br />

are issued by the Ministry <strong>of</strong> Defense, or by the Ministry<br />

<strong>of</strong> Interior: licenses for the import <strong>of</strong> goods intended<br />

for the Armed Forces <strong>of</strong> the Republic <strong>of</strong> Croatia <strong>and</strong> the<br />

police; licenses for the export <strong>of</strong> goods for the needs <strong>of</strong> the<br />

Armed Forces <strong>of</strong> the Republic <strong>of</strong> Croatia <strong>and</strong> the police with<br />

the intent <strong>of</strong> return <strong>of</strong> these goods back to the state; <strong>and</strong> licenses<br />

for the export <strong>of</strong> goods <strong>on</strong> the basis <strong>of</strong> the d<strong>on</strong>ati<strong>on</strong><br />

<strong>of</strong> the Government <strong>of</strong> the Republic <strong>of</strong> Croatia. In additi<strong>on</strong><br />

to that, the licenses for the export <strong>of</strong> goods <strong>on</strong> the basis <strong>of</strong><br />

internati<strong>on</strong>al military agreements signed by the Republic<br />

<strong>of</strong> Croatia are issued by the Ministry <strong>of</strong> Defense.<br />

Furthermore, the provisi<strong>on</strong>s <strong>of</strong> this Law make it possible<br />

to stop the transacti<strong>on</strong>s in c<strong>on</strong>necti<strong>on</strong> with military<br />

goods, when there is doubt that these goods might be<br />

delivered to forbidden destinati<strong>on</strong>s, or to forbidden end<br />

users, which is necessary in order to ensure that the Republic<br />

<strong>of</strong> Croatia meets its internati<strong>on</strong>al commitments.<br />

Namely, the Law enables the judicial bodies to adequately<br />

determine the penalties for those breaching this Law,<br />

with high pris<strong>on</strong> sentences <strong>and</strong> fines prescribed for behavior<br />

c<strong>on</strong>trary to the provisi<strong>on</strong>s <strong>of</strong> the Law<br />

2.2. Subordinate Legislati<strong>on</strong><br />

On the basis <strong>of</strong> the provisi<strong>on</strong>s <strong>of</strong> the Law <strong>on</strong> the <strong>Export</strong> <strong>and</strong><br />

<strong>Import</strong> <strong>of</strong> <strong>Military</strong> <strong>and</strong> N<strong>on</strong>-<strong>Military</strong> Lethal <strong>Goods</strong>, the Government<br />

<strong>of</strong> the Republic <strong>of</strong> Croatia is establishing the List <strong>of</strong><br />

<strong>Military</strong> <strong>Goods</strong>, which is fully harm<strong>on</strong>ized with the Comm<strong>on</strong><br />

<strong>Military</strong> List <strong>of</strong> the European Uni<strong>on</strong>, <strong>and</strong> also the List <strong>of</strong> N<strong>on</strong>-<br />

<strong>Military</strong> Lethal <strong>Goods</strong>, which represents the nati<strong>on</strong>al list.<br />

It is worth pointing out that the goods specified in both <strong>of</strong><br />

these Lists used to be subject to the license regime even<br />

prior to the passage <strong>of</strong> this Law, <strong>and</strong> that the licenses <strong>of</strong><br />

the Ministry <strong>of</strong> Ec<strong>on</strong>omy, Labor <strong>and</strong> Entrepreneurship<br />

were needed for their export or import for commercial<br />

purposes in the past as well. However, given the fact that<br />

previous export <strong>and</strong> import procedures were not comparable<br />

with European Uni<strong>on</strong> procedures, the harm<strong>on</strong>izati<strong>on</strong><br />

<strong>of</strong> the nati<strong>on</strong>al framework with the acquis communautaire<br />

became necessary.
