The National Hum<strong>an</strong> Rights Commission is still not adequately equipped for full<br />

<strong>in</strong>vestigation <strong>in</strong>to serious <strong>in</strong>cidents of hum<strong>an</strong> rights violations<br />

How empowered is <strong>the</strong> Commission to protect hum<strong>an</strong> rights? C<strong>an</strong> you compel <strong>the</strong><br />

government to implement your recommendations?<br />

The reply to this question requires a comparative discourse. Nowhere <strong>in</strong> <strong>the</strong> world does <strong>an</strong>y<br />

hum<strong>an</strong> rights commission have executive powers or authority. Generally speak<strong>in</strong>g, <strong>the</strong> role of <strong>the</strong><br />

commission is supervisory, monitor<strong>in</strong>g. It is a watchdog. As a watchdog it identifies violations of<br />

hum<strong>an</strong> rights, weaknesses <strong>an</strong>d <strong>the</strong>n submits appropriate recommendations <strong>in</strong> this regard to <strong>the</strong><br />

authorities.<br />

It is a general assumption that s<strong>in</strong>ce <strong>the</strong> government has created such <strong>an</strong> <strong>in</strong>stitution, it has all<br />

<strong>in</strong>tentions to pay attention to <strong>the</strong> recommendations of <strong>the</strong> <strong>in</strong>stitution <strong>an</strong>d implement <strong>the</strong>se<br />

accord<strong>in</strong>gly. But this does not always happen. Then aga<strong>in</strong>, <strong>the</strong> law has specific provision for<br />

protection of hum<strong>an</strong> rights.<br />

If <strong>the</strong> commission notes that <strong>the</strong> government is not pay<strong>in</strong>g heed to its recommendations, it c<strong>an</strong><br />

submit a report to <strong>the</strong> President <strong>in</strong> this regard. If <strong>the</strong> President f<strong>in</strong>ds <strong>the</strong> report valid, he c<strong>an</strong> send<br />

this on for discussion <strong>in</strong> <strong>the</strong> parliament. This is mentioned <strong>in</strong> <strong>the</strong> law perta<strong>in</strong><strong>in</strong>g to NHRC. This is<br />

<strong>the</strong> strength.<br />

As NHRC was launched dur<strong>in</strong>g <strong>the</strong> rule of this government, <strong>with</strong>out draw<strong>in</strong>g reference to<br />

<strong>the</strong> past, has hum<strong>an</strong> rights violations <strong>in</strong>creased or decreased under this government?<br />

Hum<strong>an</strong> rights is a broad concept. It is not simple to draw <strong>an</strong>y f<strong>in</strong>al conclusions <strong>in</strong> this regard.<br />

Just as hum<strong>an</strong> rights covers civil <strong>an</strong>d political rights, it also encompasses economic, social <strong>an</strong>d<br />

cultural rights. Then <strong>the</strong>re is rights for peace, development, right for demilitarisation — all <strong>the</strong>se<br />

are l<strong>in</strong>ked to hum<strong>an</strong> rights. In that respect I would say that <strong>the</strong>re has been <strong>an</strong> improvement <strong>in</strong> <strong>the</strong><br />

protection of civil <strong>an</strong>d political rights. The situation has much improved <strong>in</strong> this regard <strong>in</strong><br />

comparison to what it was dur<strong>in</strong>g <strong>the</strong> last caretaker government when hum<strong>an</strong> rights were violated<br />

ramp<strong>an</strong>tly.<br />

Under <strong>the</strong> present government <strong>the</strong>re has been m<strong>an</strong>y <strong>in</strong>st<strong>an</strong>ces of hum<strong>an</strong> rights violations by <strong>the</strong><br />

law enforcement agencies. These are <strong>the</strong> hum<strong>an</strong> rights violations which cause most concern to<br />

<strong>the</strong> common people. College student Limon be<strong>in</strong>g crippled by RAB is one such <strong>in</strong>st<strong>an</strong>ce. What<br />

happened to Limon <strong>in</strong> <strong>the</strong> end? Could you all protect him?<br />

Such stray <strong>in</strong>cidents do occur. We were very active <strong>in</strong> <strong>the</strong> case of Limon; we protested <strong>in</strong> no<br />

uncerta<strong>in</strong> terms. The government did not muffle us. We are not opponents of <strong>the</strong> government.


But <strong>the</strong> government acted as <strong>an</strong> opponent to <strong>the</strong> poor college student Limon, even though you<br />

may have stood by his side. So does <strong>the</strong> government pay <strong>an</strong>y import<strong>an</strong>ce to you, that is <strong>the</strong><br />

commission? Has it punished <strong>the</strong> guilty persons?<br />

Actually <strong>the</strong> top level of <strong>the</strong> government is not <strong>in</strong>formed of <strong>the</strong> role of <strong>the</strong> government’s various<br />

hum<strong>an</strong> rights org<strong>an</strong>isations <strong>an</strong>d perhaps a misconception exists <strong>in</strong> this regard. Limon was really<br />

be<strong>in</strong>g harassed but at one po<strong>in</strong>t that halted due to <strong>the</strong> Prime M<strong>in</strong>ister’s <strong>in</strong>tervention. For four<br />

hours cont<strong>in</strong>uously, B<strong>an</strong>gladesh S<strong>an</strong>gbad S<strong>an</strong>gstha relayed <strong>the</strong> Prime M<strong>in</strong>ister’s directives <strong>in</strong> this<br />

regard, scrolled on TV. Later this was removed. But if <strong>the</strong> Prime M<strong>in</strong>isters simply utters one<br />

word, that is enough. This was very effective. The Prime M<strong>in</strong>ister said that no one should<br />

unnecessarily issue statements about Limon because by <strong>the</strong>n <strong>in</strong>vestigations has proved he was<br />

still a m<strong>in</strong>or <strong>an</strong>d that he was not <strong>in</strong>volved <strong>in</strong> <strong>an</strong>y form of violence. After that, <strong>the</strong>re had been no<br />

excesses. The <strong>in</strong>cident was extremely unfortunate. Maybe Limon had to suffer due to <strong>an</strong> error on<br />

someone’s part.<br />

Limon’s case cont<strong>in</strong>ues. Will you cont<strong>in</strong>ue to support him?<br />

We have been <strong>with</strong> him from <strong>the</strong> start. Even <strong>the</strong>n we declared we would rema<strong>in</strong> by his side, even<br />

provide him <strong>with</strong> legal aid if necessary. I am confident that Limon will receive justice from <strong>the</strong><br />

lower court. The people have seen <strong>the</strong> <strong>in</strong>cident, <strong>the</strong> court has seen it, <strong>the</strong> judges have seen it. I<br />

believe justice has not disappeared altoge<strong>the</strong>r from <strong>the</strong> country <strong>an</strong>d Limon will receive justice.<br />

A year has passed s<strong>in</strong>ce <strong>the</strong> launch<strong>in</strong>g of <strong>the</strong> Hum<strong>an</strong> Rights Commission. Is it a full-fledged<br />

commission now or does it still have <strong>the</strong> limitations it has at <strong>the</strong> start?<br />

It is about to become a full-fledged <strong>in</strong>stitution <strong>an</strong>d I have approval for 28 members of staff. They<br />

have had taken <strong>the</strong>ir appo<strong>in</strong>tment exams <strong>an</strong>d hopefully will jo<strong>in</strong> on November 1. Then NHRC<br />

will be able to function <strong>in</strong> full force.<br />

What are <strong>the</strong> commission’s achievements over <strong>the</strong> past year?<br />

There are m<strong>an</strong>y <strong>in</strong>cidents. Without nam<strong>in</strong>g names, <strong>the</strong>re was a certa<strong>in</strong> person who was deta<strong>in</strong>ed<br />

<strong>an</strong>d his relatives apprehended <strong>the</strong>y would not see him alive aga<strong>in</strong>. But through our efforts, we<br />

m<strong>an</strong>aged to release him <strong>an</strong>d h<strong>an</strong>d him over to his family alive. Then <strong>the</strong>re was <strong>the</strong> <strong>in</strong>cident of a<br />

few young girls be<strong>in</strong>g abducted from <strong>the</strong> road, but <strong>the</strong>n due to our <strong>in</strong>tervention <strong>the</strong> police <strong>an</strong>d<br />

RAB could speedily rescue <strong>the</strong>m. These are a few <strong>in</strong>st<strong>an</strong>ces of NHRC’s success.<br />

We also have played a role concern<strong>in</strong>g extrajudicial kill<strong>in</strong>gs, rema<strong>in</strong><strong>in</strong>g alert <strong>in</strong> this regard. That<br />

is why <strong>the</strong>re has been a considerable fall <strong>in</strong> deaths <strong>in</strong> custody <strong>an</strong>d extrajudicial kill<strong>in</strong>gs. Due to<br />

our active role, <strong>the</strong> law enforcement bodies have realised that <strong>the</strong>y must follow <strong>the</strong> rule of law.<br />

At a meet<strong>in</strong>g you recently mentioned about people disappear<strong>in</strong>g <strong>an</strong>d <strong>the</strong>n bodies turn<strong>in</strong>g up here<br />

<strong>an</strong>d <strong>the</strong>re. You perhaps were referr<strong>in</strong>g to <strong>the</strong> three youths of Dayag<strong>an</strong>j <strong>an</strong>d <strong>the</strong> Jubodal leader at<br />

Jatrabari. Will <strong>the</strong> Commission <strong>in</strong>vestigate <strong>the</strong>se <strong>in</strong>cidents?<br />

NHRC has received several such compla<strong>in</strong>ts. It has been said <strong>the</strong> persons <strong>in</strong> civil garb came <strong>an</strong>d<br />

picked up <strong>the</strong>se youth <strong>an</strong>d <strong>the</strong>y haven’t been heard of s<strong>in</strong>ce <strong>the</strong>n. None of <strong>the</strong> state agencies<br />

admit that <strong>the</strong>se miss<strong>in</strong>g persons are <strong>in</strong> <strong>the</strong>ir custody. Such <strong>in</strong>cidents are very alarm<strong>in</strong>g. The law<br />

enforcement agencies c<strong>an</strong> deta<strong>in</strong> citizens if <strong>the</strong>y commit crimes <strong>an</strong>d take legal measures


accord<strong>in</strong>gly. In such cases, <strong>the</strong> families of <strong>the</strong> deta<strong>in</strong>ed persons have <strong>the</strong> right to know that <strong>the</strong>y<br />

have been deta<strong>in</strong>ed. The compla<strong>in</strong>ts we have been receiv<strong>in</strong>g <strong>in</strong>dicate that such <strong>in</strong>cidents are<br />

occurr<strong>in</strong>g. The state is duty bound to protect its citizens.<br />

So will you be <strong>in</strong>vestigat<strong>in</strong>g <strong>the</strong> disappear<strong>an</strong>ce of <strong>the</strong> three young men <strong>in</strong> Dayag<strong>an</strong>j?<br />

We still don’t have <strong>the</strong> capacity to carry out such <strong>in</strong>vestigations. We lack <strong>the</strong> logistics. What we<br />

do now is issue a letter to <strong>the</strong> Home M<strong>in</strong>istry <strong>in</strong> regard <strong>with</strong> such <strong>in</strong>cidents <strong>an</strong>d give a certa<strong>in</strong><br />

time limit for <strong>an</strong> <strong>in</strong>quiry committee to be formed to look <strong>in</strong>to <strong>the</strong> matter <strong>an</strong>d submit a report to<br />

<strong>the</strong> commission. NHRC has <strong>the</strong> right to reject <strong>the</strong> Home M<strong>in</strong>istry’s report if it is not found to be<br />

satisfactory.<br />

So c<strong>an</strong> we take it that you have issued a letter to <strong>the</strong> Home M<strong>in</strong>istry concern<strong>in</strong>g <strong>the</strong>se miss<strong>in</strong>g<br />

young men?<br />

Def<strong>in</strong>itely.<br />

Our democracy is feeble <strong>an</strong>d, on top of that, <strong>the</strong> governments are aggressive <strong>an</strong>d obdurate. Is it<br />

possible, under such circumst<strong>an</strong>ces, for a person to be ensured of his or her personal security?<br />

Hum<strong>an</strong> rights violations occur when <strong>the</strong> state is somehow or <strong>the</strong> o<strong>the</strong>r <strong>in</strong>volved <strong>in</strong> <strong>the</strong> violation.<br />

In <strong>the</strong> case of <strong>an</strong> <strong>in</strong>dividual, when a violation of hum<strong>an</strong> rights occurs, we approach <strong>the</strong> m<strong>in</strong>istry<br />

connected <strong>with</strong> <strong>the</strong> concerned agency for a resolution. We even say that if a resolution is not<br />

reached, we shall go <strong>in</strong>to legal action on behalf of <strong>the</strong> victim. So no matter how weak <strong>the</strong> victim<br />

is, we shall be by his or her side. We c<strong>an</strong> file a case <strong>in</strong> court on behalf of <strong>an</strong>yone, aga<strong>in</strong>st <strong>the</strong><br />

violator of hum<strong>an</strong> rights.<br />

Generally speak<strong>in</strong>g <strong>the</strong> heads of government have a lot of rhetoric <strong>in</strong> such cases, but <strong>the</strong> state<br />

agencies like <strong>the</strong> police <strong>an</strong>d o<strong>the</strong>rs are extremely hostile.<br />

To underst<strong>an</strong>d hum<strong>an</strong> rights, <strong>the</strong>re has to be a f<strong>in</strong>er perception. That is why <strong>the</strong> fundamental<br />

objective of NHRC is to create a culture of hum<strong>an</strong> rights <strong>in</strong> B<strong>an</strong>gladesh. This c<strong>an</strong>not be done<br />

overnight; it takes time. We have just begun.<br />

You are very vocal <strong>in</strong> <strong>the</strong> media, but is <strong>the</strong>re <strong>an</strong>y <strong>in</strong>dication that <strong>the</strong> government is responsive at<br />

all?<br />

The Prime M<strong>in</strong>ister <strong>in</strong>deed attaches import<strong>an</strong>ce to <strong>the</strong> statements of <strong>the</strong> commission. We had<br />

visited <strong>the</strong> Shishu Sad<strong>an</strong> <strong>an</strong>d reported that <strong>the</strong> funds allocated for <strong>the</strong> orph<strong>an</strong>s <strong>the</strong>re was not<br />

adequate enough to meet <strong>the</strong>ir nutritional requirements. After that <strong>the</strong> State M<strong>in</strong>ister Shireen<br />

Sharm<strong>in</strong> Chowdhury submitted a proposal to <strong>the</strong> Prime M<strong>in</strong>ister <strong>an</strong>d immediately <strong>the</strong> Prime<br />

M<strong>in</strong>ister raised <strong>the</strong> budget from 1150 taka per child to 1900 taka.<br />

Then we visited <strong>the</strong> home for destitute girls <strong>an</strong>d found that meals were cooked for 100 girls <strong>an</strong>d<br />

it was <strong>the</strong> little children who were work<strong>in</strong>g <strong>in</strong> <strong>the</strong> kitchen, cle<strong>an</strong><strong>in</strong>g, cutt<strong>in</strong>g, light<strong>in</strong>g <strong>the</strong> stoves.<br />

All of this was totally <strong>in</strong>appropriate for such young children. On one hard we speak aga<strong>in</strong>st child<br />

labour <strong>an</strong>d on <strong>the</strong> o<strong>the</strong>r h<strong>an</strong>d <strong>the</strong> children of this home were <strong>in</strong>volved <strong>in</strong> such work. This was<br />

unacceptable. Upon learn<strong>in</strong>g this, <strong>the</strong> Prime M<strong>in</strong>ister immediately ordered cooks to be appo<strong>in</strong>ted<br />

to all 64 such homes situated <strong>in</strong> <strong>the</strong> respective 64 districts of <strong>the</strong> country.


Recently you were not permitted to enter <strong>the</strong> Sylhet Jail. The IG Prisons <strong>an</strong>d <strong>the</strong> relev<strong>an</strong>t<br />

Secretary said that prior permission was required <strong>in</strong> this regard. Do you agree?<br />

The IG Prisons had <strong>in</strong>structed his subord<strong>in</strong>ates not to allow my entry <strong>in</strong>to <strong>the</strong> prison. I th<strong>in</strong>k he is<br />

unaware of <strong>the</strong> law perta<strong>in</strong><strong>in</strong>g to <strong>the</strong> National Hum<strong>an</strong> Rights Commission. They do not know<br />

that we are empowered <strong>with</strong> <strong>the</strong> rights to <strong>in</strong>spect <strong>the</strong> jails. They should read <strong>the</strong> relev<strong>an</strong>t laws.<br />

When government officials visit <strong>the</strong> prisons, <strong>the</strong>y <strong>in</strong>form <strong>the</strong> authorities <strong>in</strong> adv<strong>an</strong>ce. That is <strong>the</strong><br />

tradition. But <strong>the</strong>ir visits <strong>an</strong>d m<strong>in</strong>e are quite different matters. If I <strong>an</strong>nounce my visit <strong>in</strong> adv<strong>an</strong>ce,<br />

I will not see <strong>the</strong> real picture of <strong>the</strong> prison. They will cle<strong>an</strong> up <strong>the</strong> place <strong>in</strong> adv<strong>an</strong>ce. The relev<strong>an</strong>t<br />

persons must be conscious about <strong>the</strong> stratus of <strong>the</strong> Hum<strong>an</strong> Rights Commission.<br />

The IG Prisons <strong>in</strong>formed me through officials of <strong>the</strong> Sylhet Jail that this time <strong>the</strong>y couldn’t<br />

permit me to enter, but next time if I let <strong>the</strong>m know <strong>in</strong> adv<strong>an</strong>ce, <strong>the</strong>y would give me a gr<strong>an</strong>d<br />

reception, guard of honour, garl<strong>an</strong>ds <strong>an</strong>d all. I let <strong>the</strong>m know I was not <strong>in</strong>terested <strong>in</strong> <strong>an</strong>y guard of<br />

honour or garl<strong>an</strong>ds because that was not <strong>the</strong> function of <strong>the</strong> commission. Our function was to pay<br />

surprise visits, observe <strong>an</strong>y <strong>in</strong>congruities <strong>an</strong>d report <strong>the</strong>se to <strong>the</strong> government along <strong>with</strong><br />

recommendations.<br />

This <strong>in</strong>cident <strong>in</strong>dicates that <strong>the</strong> government org<strong>an</strong>s are not s<strong>in</strong>cere concern<strong>in</strong>g hum<strong>an</strong> rights.<br />

They adhere to <strong>the</strong> old traditions.<br />

This is true <strong>an</strong>d I c<strong>an</strong>not disagree. They need to be much more conscious about hum<strong>an</strong> rights.<br />

They need to study this.<br />

O<strong>the</strong>r th<strong>an</strong> you <strong>the</strong> Chairm<strong>an</strong>, <strong>the</strong>re are six o<strong>the</strong>r members of NHRC. Some of <strong>the</strong>m are quite<br />

renowned personalities. But o<strong>the</strong>r th<strong>an</strong> you, no one seems to be really active <strong>in</strong> <strong>the</strong> commission.<br />

Any decision or policy adopted <strong>in</strong> <strong>the</strong> commission is done so based on discussion by <strong>the</strong> full<br />

commission. In o<strong>the</strong>r words, <strong>the</strong> decisions are taken <strong>in</strong> presence of everyone. Accord<strong>in</strong>g to <strong>the</strong><br />

rules, <strong>the</strong> commission holds a meet<strong>in</strong>g every two months. We do this regularly.<br />

This sounds very bureaucratic, but hum<strong>an</strong> rights is more of a movement. It is a matter of<br />

teamwork. If you could <strong>in</strong>volve persons like Aroma Dutta or Sel<strong>in</strong>a Hossa<strong>in</strong> actively, wouldn’t<br />

that be more effective?<br />

Among <strong>the</strong> members, one member is full time <strong>an</strong>d <strong>the</strong> rema<strong>in</strong><strong>in</strong>g five are part time. That is why<br />

<strong>in</strong> our <strong>an</strong>nual report to <strong>the</strong> President, we have stated that <strong>in</strong> order to fully utilize <strong>the</strong> experience<br />

<strong>an</strong>d skills of <strong>the</strong> part-timers, we need <strong>the</strong>m to be full time members. We also have several<br />

committees. You may not see <strong>the</strong>m <strong>in</strong> <strong>the</strong> media, but <strong>the</strong>y are work<strong>in</strong>g beh<strong>in</strong>d <strong>the</strong> scenes. Their<br />

views are taken <strong>in</strong> each <strong>an</strong>d every decision.<br />

You were placed <strong>in</strong> this position as you were a pro-Awami League teacher, but now you are a<br />

stern critic of <strong>the</strong> government. It is heard that some of <strong>the</strong> commission members are not pleased<br />

<strong>with</strong> this st<strong>an</strong>d of yours <strong>an</strong>d that is why <strong>the</strong>y are no very visible.<br />

Certa<strong>in</strong> extremely sensitive <strong>in</strong>cidents have occurred <strong>in</strong> recent times, such <strong>the</strong> Limon <strong>in</strong>cident, <strong>the</strong><br />

beat<strong>in</strong>g to death of six youths <strong>in</strong> Am<strong>in</strong>bazar <strong>an</strong>d so on. The role of <strong>the</strong> commission <strong>in</strong> connection<br />

<strong>with</strong> such <strong>in</strong>cidents was decided upon by all <strong>the</strong> members toge<strong>the</strong>r. The members even decide


who will be <strong>the</strong> spokesperson to communicate <strong>with</strong> <strong>the</strong> media. And I do not see <strong>the</strong> government<br />

as <strong>an</strong> opponent <strong>an</strong>d it is not my job to belittle <strong>the</strong> government. We are simply do<strong>in</strong>g our duty.<br />

Such allegations are not true. If <strong>in</strong>deed <strong>an</strong>y members is unhappy <strong>with</strong> my role, that is<br />

unfortunate.<br />

You have po<strong>in</strong>ted out several <strong>in</strong>st<strong>an</strong>ces of hum<strong>an</strong> rights violations. Recently it was seen that a<br />

policem<strong>an</strong> held a person under his boots <strong>an</strong>d beat him up. Will you still say that <strong>the</strong> hum<strong>an</strong> rights<br />

situation has improved?<br />

If <strong>an</strong>y org<strong>an</strong> of <strong>the</strong> state violates hum<strong>an</strong> rights, <strong>the</strong> government certa<strong>in</strong>ly must take responsibility.<br />

The government c<strong>an</strong> only be blamed, however, if it does not punish <strong>the</strong> guilty persons but adopts<br />

a biased st<strong>an</strong>d <strong>an</strong>d rema<strong>in</strong>s silent about <strong>the</strong> violation. In this case <strong>the</strong> government immediately<br />

suspended <strong>the</strong> policem<strong>an</strong> <strong>in</strong>volved. This c<strong>an</strong> no longer be regard as a violation of hum<strong>an</strong> rights<br />

as <strong>the</strong> police committed a crime <strong>an</strong>d will have to face punishment for this. Had no action been<br />

taken aga<strong>in</strong>st <strong>the</strong> policem<strong>an</strong>, <strong>the</strong>n I could have said that <strong>the</strong> government or <strong>the</strong> state had violated<br />

hum<strong>an</strong> rights.<br />

The state is duty bound to protect its citizens<br />
