STRUCTURAL PRIME CONTRACTORS- SENDING COPIES OF NOTICES<br />

OFVIOLATION<br />

For structural pesticide applications, the Business anci Pr<strong>of</strong>essions Code (BPC) subsection<br />

8663Cd) requires that a copy <strong>of</strong> the notice <strong>of</strong> any violation by a fumigation subconkador musfbe<br />

sent <strong>to</strong> the prime contrac<strong>to</strong>r within 15 days from the date <strong>of</strong> violation. .;", , .' . .<br />

The purpose <strong>of</strong> this letter is <strong>to</strong> provid~ guidance <strong>to</strong> comply with the requirements <strong>of</strong> subsection<br />

8663(d). There has been some variation:in interpreting this stibseCtioh;'pOss'ibl)HJt:;6atl~e'<strong>of</strong><br />

confusion with the requiremetlts <strong>of</strong> other subsections 6f sectiori8663. ' .~~,: ·c; 'i'<br />

The <strong>Department</strong> <strong>of</strong> <strong>Pesticide</strong> <strong>Regulation</strong> CDPR) recommends complying yvith subsection 8663 by<br />

sendirrg a copy <strong>of</strong> any documentation <strong>of</strong> a violation, which would include non-compliant "<br />

inspection forms, Notices <strong>of</strong>Violation, and warning let:ters. Any violation noted would be cause<br />

<strong>to</strong> send a copy <strong>to</strong> the prime contrac<strong>to</strong>r. An explana<strong>to</strong>ry cover letter could be included with the<br />

copy <strong>of</strong>the notice '<strong>of</strong> violation, citing the authoritY <strong>of</strong>BPC section 8663( d), atthe commissioner's<br />

Obtaining the identity <strong>of</strong>the prime contrac<strong>to</strong>r is likely <strong>to</strong> be the primary logistical challenge <strong>to</strong><br />

compliance with the 15-day time limit ifthe Fumigatio:t;l Log is not available at the wo.rk site.<br />

There may also be in$tances where the violation was committed in the more distant past arid is<br />

oilly discovel:edby a records inspection or other retrospective means <strong>of</strong> data collection. In all<br />

cases, DPR reco'mmends a policy <strong>of</strong> complying with the subsection as best possible given the<br />

situation and resources available.<br />

The intent <strong>of</strong> this statute is <strong>to</strong> provide full and prompt notification <strong>to</strong> prime' contrac<strong>to</strong>rs <strong>of</strong><br />

violations incmred by their sub-contrac<strong>to</strong>rs. Conformity <strong>to</strong> this practice will promote structmal<br />

fumiga<strong>to</strong>r compliance with regula<strong>to</strong>ry requirements. '<br />
