<strong>Corrective</strong> <strong>Action</strong> <strong>Plan</strong><br />

1.0 INTRODUCTION<br />

On Monday, December 22, 2008, a dike containing the <strong>Tennessee</strong> <strong>Valley</strong> <strong>Authority</strong> (TVA)<br />

Kingston Fossil <strong>Plan</strong>t (KIF) dredge cells failed, releasing about 5.4 million cubic yards (cy) of fly<br />

ash and bottom ash into adjacent waterways and over land. Subsequently, the <strong>Tennessee</strong><br />

Department of Environment and Conservation (TDEC) issued a Commissioner’s Order, Case<br />

No. OGC09-0001 requiring action be taken as necessary to respond to the emergency under<br />

<strong>Tennessee</strong> Code Annotated § 69-3-109(B)(1), the Water Quality Control Act. As part of this<br />

Order, TVA is required to prepare and submit a <strong>Corrective</strong> <strong>Action</strong> <strong>Plan</strong> (CAP) within 45 days of<br />

receipt of the order. This document is the CAP.<br />

The CAP includes the following elements in response to the Commissioner’s Order:<br />

A. A plan for the comprehensive assessment of soil, surface water, and groundwater;<br />

remediation of impacted media; and, restoration of all natural resources damaged as a<br />

result of the coal ash release;<br />

B. A plan for monitoring the air and water in the area during the cleanup process;<br />

C. A plan to ensure that public and private water supplies are protected from contamination<br />

and that alternative water supplies are provided if contamination is detected;<br />

D. A plan addressing both the short term and long term management of coal ash at the<br />

Kingston <strong>Plan</strong>t, including remediation and stabilization of the failed ash waste cells,<br />

proper management of the recovered ash, and a revised closure plan for the Class II ash<br />

disposal facility; and,<br />

E. A plan to address any health or safety hazards posed by the ash to workers and the<br />

public.<br />

<strong>Plan</strong>s previously submitted for the short-term work underway are referenced.<br />

Sections 1.1 and 1.2 provide background information and summarize TVA’s initial response<br />

actions. Section 1.3 outlines the organization of the CAP.<br />

TVA’s objectives for the recovery effort are:<br />

• Maintaining the health and safety of the public and response personnel;<br />

• Involving the public, affected property owners, and other agencies in the formulation of<br />

response activities;<br />

• Restoring impacted natural and public resources expeditiously; and<br />

• Making things as good, if not better than they were before.<br />
