I, the undersigned, agree to the following conditions for agisting horses on property owned by the Burdekin
Shire Council, described as Lot 140 on GL1243 situated on the Bruce Highway, Ayr, (beside the Industrial
Estate).
1. Drainage Paddock Agistment Fees must be paid quarterly in advance. If payment is overdue by more
than 30 days, the horse/s will be impounded and used to recover costs.
2. No permanent structures are to be erected within the fenced agistment to section or contain your
horse on the land including fencing, electric wire or ropes;
3. A contact phone number and alternative contact phone number are to be provided to Compliance
Officer for emergency situations;
4. Descriptions of the horse in the paddock are to be provided to Compliance Officer;
5. Council is to be notified if the horse/s are being removed, If a different horse/s is to be put into the
paddock, a new application is required;
6. The owner of the agisted horse/s will be responsible for the provision of a water trough;
7. The owner of the agisted horse/s will be responsible for the health and well being of the horse and if
reported to be malnourished or not being correctly cared for the RSPCA will be contacted;
8. That entry to and attendance upon “the land” shall be entirely at the entrants risk;
9. The Compliance Officer should be notified if you have intent to vacate the property. Your access key
should be returned to Burdekin Shire Council Customer Service Centre where an acknowledgement
notice will be given to you. Fees will apply until the key is returned and acknowledgement notice
issued, regardless of the horse/s being removed from the land;
10. Indemnity - The entrant shall be solely liable for and shall indemnify and hereby indemnifies and
saves harmless Burdekin Shire Council, from and against all liability, suits, actions, proceedings,
claims, demands, penalties, losses, damage and expense which may be incurred by or brought
against or made upon Burdekin Shire Council or which Burdekin Shire Council may pay, sustain or be
put to by reason or, or arising out of or in the course of or in connection with either directly or indirectly
the exercise or attempted exercise by the entrant of its rights to enter the property except where such
liability, suits, actions, proceedings, claims, demands, penalties, losses, damage and expense arises
out of a negligent or wilful act or default of Burdekin Shire Council, it’s employees and/or it’s agents.
