NWIRP ANNUAL REPORT FY <strong>2005</strong>


Immigration-Related Terms<br />

Asylum: A discretionary benefit accorded to persons inside the US who can prove a well-founded fear of or past<br />

persecution because of race, religion, nationality, political opinions, or membership in a particular social group if returned<br />

to his/her country of origin and he/she is not statutorily barred from such relief.<br />

Removal: A proceeding to enforce the departure of persons seeking admission into the united States or persons<br />

who have been admitted but are removable. Persons who are alleged to be in violation of immigrations laws are placed in<br />

removal proceedings.<br />

Green Card or “Permanent Resident Card”: An expression that refers to the document carried<br />

by a Lawful Permanent Resident which provides proof of his or her status. The card is no longer green.<br />

<br />

Lawful Permanent Resident (LPR): Any person not a citizen of the United States who is residing the<br />

in the U.S. with permanent lawful status as an immigrant. Also referred to as “Permanent Resident Alien,” “Resident Alien<br />

Permit Holder,” and “Green Card Holder.”<br />

NACARA: The Nicaraguan Adjustment and Central American Relief Act. Signed into law in 1997, NACARA provides<br />

various forms of immigration benefits and relief from deportation to certain Nicaraguans, Cubans, Salvadorans, Guatemalans,<br />

nationals of former Soviet bloc countries and their dependents.<br />

Naturalization: The process by which U.S. citizenship is conferred upon a lawful permanent resident after<br />

he or she fulfills the requirements established by Congress in the Immigration and Nationality Act (INA). The general<br />

requirements for administrative naturalization include: a period of continuous residence and physical presence in the<br />

United States; an ability to read, write, and speak English; a knowledge and understanding of U.S. history and government;<br />

good moral character; attachment to the principles of the U.S. Constitution; and a favorable disposition toward the United<br />

States.<br />

Pro se: Means “on one’s own behalf”. Even if unable to provide direct representation, NWIRP offers legal advice and<br />

assistance to a number of persons who do not have legal represenation to represent themselves.<br />

Refugee: Any person who is outside his or her country of nationality who is unable or unwilling to return to that<br />

country because of persecution or a well-founded fear of persecution. Persecution or the fear thereof must be based on<br />

the alien’s race, religion, nationality, membership in a particular social group, or political opinion. Refugees are subject to<br />

ceilings by geographic area set <strong>annual</strong>ly by the President in consultation with Congress and are eligible to adjust to lawful<br />

permanent resident status after one year of continuous presence in the United States.<br />

T-Visa: In 2000, Congress passed the Victims of Trafficking and Violence Protection Act (VTVPA). The VTVPA created<br />

a special nonimmigrant classification designated as the T visa for victims of trafficking who are brought into the United<br />

States.<br />

US Citizen: With very few exceptions, anyone who was born in the US. Also anyone who is “naturalized.” Citizenship<br />

can be derived from parents as well, regardless of place of birth.<br />

USCIS: US Citizenship and Immigration Services is one of the new bureaus under the Dept. of Homeland Security, which<br />

replaced the INS in 2003. The USCIS is responsible for the administration of immigration and naturalization adjudication<br />

functions and establishing immigration services policies and priorities.<br />

Visa: A U.S. visa allows the bearer to apply for entry to the U.S. in a certain classification (e.g. student (F), visitor (B),<br />

temporary worker (H)). A visa does not guarantee the bearer the right to enter the United States. There are two kinds of<br />

visas– Non-immigrant and immigrant. Some are temporary while others are permanent.<br />

U-Visa: In 2000, Congress passed the Victims of Trafficking and Violence Protection Act (VTVPA). The VTVPA created a<br />

special nonimmigrant classification designated as the U visa for victims of specific crimes who assist law enforcement with<br />

the investigation and/or prosecution of the crime.


CLIENT PROFILE<br />

<br />

When Meheret Kidane, a Seattle resident and U.S. Citizen,<br />

married Kiflow Kidanmariam of Ethiopia, she never<br />

anticipated so many obstacles in beginning their new life<br />

together. After their marriage ceremony in July 2003,<br />

Kidane traveled to Addis Ababa, Ethiopia, to obtain their<br />

official marriage certificate. At the U.S. Embassy, officers<br />

mistrusted her motives and accused Kidane of attempting<br />

fraud by being paid to marry Kiflow, subsequently throwing<br />

her out of the embassy office. Determined, Kidane flew<br />

back and forth until she was able to officially document<br />

their marriage, however, ran into another obstacle when<br />

she tried to bring her husband to the U.S. With no other<br />

recourse, Kidane contacted NWIRP’s Seattle Family<br />

Services Unit in December of 2003 and was assigned a<br />

legal advocate to help her with the case.<br />

Finally, A Chance to Live Happily Ever After<br />

“I was pregnant and did not want to be a single mother<br />

raising my baby alone with my husband far away,” Kidane<br />

said. Kidane, a nursing student with another young child<br />

from a former marriage, persistently filed papers in hopes<br />

of reuniting with her husband. Meheret Kidane gave birth<br />

to her daughter alone, without the loving support of her<br />

husband. After recovering from the birth, Kidane traveled<br />

to Addis Ababa to once again bring official proof of the<br />

couples’ relationship via their newborn daughter’s birth<br />

certificate. Yet again, the U.S. Embassy considered the<br />

official proof invalid.<br />

After a year of delay, NWIRP legal advocate Miriam<br />

Cervantes tried one final effort to reunite the family,<br />

referring the case to the office of Congressman<br />

McDermott (D – WA). A staff assistant, Rita Stewart, took<br />

the case into her hands and after several letters to the<br />

Embassy in Addis Ababa, Kidanmariam was finally given an<br />

appointment in October of 2004. Kidanmariam was denied<br />

entrance by the officials at the Embassy and it took a call<br />

from Ms. Stewart to again secure an appointment. After<br />

more than 18 months, Kiflow Kidanmariam was finally<br />

reunited with his wife Meheret Kidane, and was able to see<br />

his 9 month-old daughter for the first time. When asked<br />

how the transition to the United States has been, Kiflow<br />

and Meheret looked at each other lovingly and Kiflow said,<br />

“I am so happy, I couldn’t be happier.”<br />

FROM OUR EXECUTIVE DIRECTOR<br />

Dear Friends,<br />

We began this past year with a vision of hope and possibilities. The previous three years had been very challenging for<br />

NWIRP— financial support was diminishing while demand for services was increasing, taking a toll on the organization’s<br />

programs, staff and board. The year <strong>2005</strong> was an opportunity to begin building a foundation for the future work of our<br />

organization.<br />

A focus on immigrant rights was promulgated by the politics of the post 9-11 world and a new agency called Homeland<br />

Security that aggressively targeted immigrants and refugees to ensure the safety of American citizens. NWIRP responded<br />

with an affirmative and comprehensive approach to development, public relations, and building a strong infrastructure.<br />

<br />

We increased our funding by more than $350,000 between 2004 and <strong>2005</strong>. This was the first time in two years that we<br />

ended the year in the black. Additionally, we found grants to provide us with new computers in the Granger office, and<br />

another that provided us with new furniture when we moved to new offices in downtown Seattle. The move itself was a<br />

major accomplishment given the years we spent in our previous office space, which was deteriorating around us.<br />

The move of the NW Detention Center to Tacoma, which holds 850 detainees and is planning to increase to 1,000,<br />

prompted us to build a relationship with Centro Latino. A multi-service organization for the Latino community in Pierce<br />

County, Centro Latino generously provided us with free office space in an area that needed our services more than ever.<br />

In response to the growth of immigration appeals at the Federal and Ninth District Court we created a new legal unit,<br />

the Impact Litigation Unit (ILU), to deal with immigration cases at the Federal Court level. NWIRP’s presence will have a<br />

positive affect on many important cases that have the potential to impact immigration laws nationally.<br />

This past year we also began strategic planning for our organization and started expanding our development and legal<br />

departments to build a foundation for the expansion of all of our efforts. New board members are helping us develop an<br />

organization that will best reflect the needs of the community we serve.<br />

Although we are working harder than ever, today we are able to see our increasing impact in the communities we serve.<br />

We are looking forward to what 2006 and subsequent years will bring as we work to ensure that <strong>Immigrant</strong> <strong>Rights</strong> are<br />

recognized as Human <strong>Rights</strong>.<br />

(Executive Director): Magdaleno joined<br />

<strong>Northwest</strong> <strong>Immigrant</strong> <strong>Rights</strong> <strong>Project</strong> in<br />

November 2003. He has a colorful history as a<br />

farm worker organizer side by side with Cesar<br />

Chavez and has founded several successful<br />

organizations that serve immigrants. Magdaleno<br />

is a strong and compassionate leader who has<br />

helped NWIRP transition to its next level<br />

of growth.<br />

Sandra Aguilar-Salinas<br />

(Board President): Sandra joined the<br />

<strong>Northwest</strong> <strong>Immigrant</strong> <strong>Rights</strong> <strong>Project</strong>’s Board<br />

in April 2004 and is a zealous advocate for<br />

immigrants and refugees. Born in El Salvador, she<br />

truly understands some of the horrific reasons<br />

for persons seeking asylum and protection in the<br />

United States. Sandra is a high-school teacher<br />

and active volunteer and member of many<br />

immigrant community coalitions


NWIRP <strong>2005</strong> Highlights<br />

In <strong>2005</strong>, NWIRP continued to grow, reach out and increase its capabilities in order to serve more immigrants in need. Some<br />

of NWIRP’s <strong>2005</strong> highlights:<br />

F Held our most successful fundraising event to date. More than 550 people attended our dinner to raise<br />

critical funds for immigrant rights.<br />

<br />

F Opened a new satellite office at Centro Latino in Tacoma nearby the <strong>Northwest</strong> Detention Center,<br />

which now houses more than 850 detainees.<br />

F Conducted more than 55 “Know Your <strong>Rights</strong>” immigration-related trainings, reaching more than 1,600<br />

immigrants and related service providers.<br />

F Created a new Impact Litigation Unit in response to the growing number of immigration cases at the<br />

Ninth Circuit Court of Appeals.<br />

F Hosted a Community Immigration Forum at Town Hall attended by more than 700 people including<br />

Senator Patty Murray and Seattle Mayor Greg Nickels.<br />

F Received an “excellent” evaluation from the Department of Justice for NWIRP’s Legal Orientation<br />

Program (LOP) and services provided to detainees at the <strong>Northwest</strong> Detention Center.<br />

F Organized a groundbreaking conference on providing services to victims of torture in conjunction with<br />

the Center for Victims of Torture.<br />

F Garnered extensive media coverage on outlets including NPR, Democracy Now, Radio Sol, Radio<br />

KDNA and a number of local news programs.<br />

F Provided more than 15 Continuing Education Legal Clinics for attorneys in four counties.<br />

F Obtained the approval of 886 applications for immigration benefits.<br />

F Represented immigrant rights in a number of legal panels and seminars in conjunction with the<br />

University of Washington, the King County Bar Association and others.<br />

F Hired a total of three legal advocates and one attorney to service increasing caseloads. A retired judge<br />

also joined NWIRP as a full-time volunteer.<br />

F Won two precedent-setting decisions from the United States Court of Appeals for the Ninth Circuit.<br />

F Moved Seattle offices to provide an enhanced working environment for staff and clients.

Bulgarian Client Receives Amnesty after 11 Years<br />

In his home country of Bulgaria, there was hardly<br />

a moment in Lenko’s life when he wasn’t being<br />

persecuted for his or his family’s anti-communist<br />

political beliefs and activities. Even while in his<br />

mother’s womb, Communist officials severely beat<br />

his pregnant mother. As an outspoken youth, he was<br />

interrogated and detained several times. As an adult,<br />

Lenko spent 15 years of his life being physically and<br />

psychologically tortured in various prisons. He lost<br />

hearing in one ear during an explosion that was meant<br />

to take his life. Lenko was finally forced to flee Bulgaria<br />

to protect his family and preserve his own life.<br />

When Lenko arrived alone in New York in 1993,<br />

he received assistance in completing an asylum<br />

application from a local church and was temporarily<br />

allowed to live there. With money from the church,<br />

he moved to Seattle to find work. In 1994, Lenko<br />

sought the assistance of NWIRP, which identified a<br />

pro bono attorney to represent him. While his joined<br />

the backlog of asylum applications, Lenko struggled<br />

to find work and was forced to live on the streets in an old van he bought with earnings from occasional day labor work.<br />

In the years that followed, Lenko lost contact with his pro bono attorney. NWIRP attempted to locate Lenko, but<br />

Lenko was homeless.<br />

When Lenko returned to NWIRP a few years later to check in on his case, NWIRP’s Asylum Unit took the case, helping<br />

Lenko apply for food stamps and connecting him with important services in the community. After more than 11 years,<br />

NWIRP finally received an asylum interview notice for Lenko. On February 23, <strong>2005</strong>, nearly twelve years after Lenko first<br />

came to the United States and applied for asylum, Lenko had been granted asylum protection in the United States.<br />

Risk of Deportation Averted for Mother of Four<br />

Angela, a 36 year old mother of four, came to the United States in 1990.<br />

Throughout her ten-year marriage to a U.S. citizen, she suffered both physical<br />

and mental abuse. When Angela became pregnant with their fourth child, her<br />

husband left her for another woman and refused to complete the immigrant visa<br />

petition he had filed for her. Angela feared separation from her children as well<br />

as deportation.<br />

Angela approached NWIRP’s office in Granger after she was placed in<br />

deportation removal proceedings. NWIRP’s staff assisted Angela in documenting<br />

and filing an immigration petition for victims of domestic violence, which was<br />

granted eight months later. With the approved petition, directing attorney Matt<br />

Adams, returned to immigration court with Angela and applied for an adjustment<br />

of immigration status so that Angela could become a lawful permanent resident.<br />

After a brief hearing on the merits, the immigration judge granted Angela legal<br />

status. Angela burst into tears of joy in the courtroom.<br />
