Patrick Devine: Creating Peace<br />

in Africa<br />

As a young man, Father Patrick Devine<br />

knew he wanted to dedicate his life<br />

to working among the poorest of the<br />

world. Now the founder of the Shalom Center<br />

for Conflict Resolution and Reconciliation,<br />

he has been at the forefront of positive peace<br />

efforts in Kenya and other areas of Africa and<br />

was the recipient of the 2013 International<br />

Caring Award which brought him to Washington<br />

DC with accolades by General Colin Powell<br />

among others. His work in the region began<br />

in 1988 when he joined the Society of African<br />

Missionaries and devoted his life to improving<br />

conditions in a region of the world that had<br />

been the site of persistent poverty, conflict, and<br />

social injustice. His work brought him to a poor<br />

isolated area in West Tanzania where he spent<br />

seven years as a missionary. He later became the<br />

organization’s regional superior of Kenya and<br />

Tanzania.<br />

In 2009, Father Devine founded the<br />

Shalom Center for Conflict Resolution and<br />

Reconciliation (SCCRR) with a vision of a society<br />

where peace, social justice and reconciliation<br />

prevail throughout Africa. In his own words,<br />

Father Devine states “peace in the sense of<br />

absence of violence is not enough.” In order to<br />

have true, positive peace, there must be not only<br />

an absence of violence, but the conflicting parties<br />

must care about each other’s well being. The mission<br />

of SCCRR is to work for a society free of physical<br />

violence and unjust social structures in Africa. This<br />

mission is lived out as the organization brings together<br />

leaders and opinion shapers from both sides of<br />

conflict and teaches them analytical skills to assess<br />

the problem and the peace building tools required to<br />

address it. Prior to these meetings, empirical research<br />

is conducted and both sides have agreed to name the<br />

issues to ensure these meetings are productive.<br />

Like parents all over the world, parents in this<br />

geographic area also want a better future for their<br />

children. Education is the foundation on which a more<br />

peaceful future is formed. In efforts for peace, SCCRR<br />

helps to form inter-ethnic schools to bring families<br />

from opposing groups together in order to generate<br />

conversations and cooperation between them. The<br />

organization also provides solar energy to 178 schools<br />

in the area, thereby extending the learning hours<br />

so students can do work in the evening as well as<br />

providing meeting places for the community.<br />

When asked why he named the organization<br />

the Shalom Center for Conflict Resolution and<br />

Reconciliation, Father Devine explains that Shalom<br />

means not only peace, but also peace with justice and<br />

harmony, holistically integrated. What a truly apt title<br />

for an organization that diligently works for conflict<br />

resolution and social harmony in Africa. It can serve<br />

as a paradigm for societies around the world.<br />

Domestic Violence<br />

and the Law in Kenya<br />

In the recent past domestic violence has become rampant in Kenya<br />

despite interventions, notably by civil society actors; there has<br />

been a steady increase in the number of cases and the severity of<br />

domestic violence in all regions.<br />

Hardly, a day passes without reports in the media on domestic<br />

violence. It is even worse when we see innocent children of tender<br />

ages being victims of these heinous acts of violence perpetrated<br />

against them, sometimes by those who should be their protectors.<br />

This is best captured by the cry of two girls in Nyeri:<br />

“… Two girls are at loss and unable to comprehend how the man<br />

who is supposed to protect them suddenly turned against them in<br />

such a beastly manner. The man, 55-year-old HIV positive father<br />

defiled his two daughters – aged 9 and 14, in the presence of his<br />

bedridden HIV-Positive wife, who had no strength to rescue her<br />

helpless children. And although the man was recently convicted and<br />

jailed for 50 years, the children are traumatized and living in fear…”<br />

Currently Parliament is debating the Domestic Violence Bill 2014.<br />

The bill seeks to provide for the protection and relief to victims<br />

of domestic violence. It provides for the protection for spouses,<br />

children and dependants within the family unit.<br />

Charles Kanjama is the Managing Partner of Muma & Kanjama Advocates<br />

Kenya ratified a number of international Conventions which<br />

aims at protecting the rights of individuals, for example, the Convention on the Elimination of Discrimination against<br />

Women (CEDAW) and Convention on the Rights of the Child (CRC) in March 1984. CEDAW is the most comprehensive<br />

Convention on protection of women. CEDAW enshrines principles of equality and freedom in the marriage institution<br />

which are to be enjoyed during and after the dissolution of the marriage.<br />

National laws on domestic violence<br />

The Penal Code<br />

The current practice is to criminalize Domestic Violence under provisions of the Code offences such as assault or battery;<br />

however, this approach usually trivializes violence that is perpetrated in the home. The Code cannot effectively handle<br />

Domestic Violence as Domestic Violence does not only involve physical injury but has other forms such as, psychological<br />

trauma and even financial abuse.<br />

The Code does not define what domestic violence is and hence this creates a big mischief. The Code is also ineffective in<br />

cases where domestic violence is ongoing. It does not elaborate how to handle such a situation. For example; it does not<br />

preclude the perpetrator from accessing the matrimonial where in most cases the offence occurs.<br />

The Penal Code is designed to deter perpetrators from repeating the same offence, however, no compensation for the<br />

victims is provided for despite loss of earning or physical injury that may be the results of the offence.<br />

The Protection against Domestic Violence Bill 2014<br />

The current Bill in Parliament recognizes sexual violence, child marriage, defilement, forced wife inheritance and sexual<br />

abuse as forms of domestic violence. The Bill permits each county to determine the most suitable temporary relief of<br />

protection mechanisms to ensure adequate protection of victims against stigmatization and other forms of discrimination.<br />

The Bill defines domestic violence in relation to any person as violence against that person, or threat of imminent danger<br />

to that person by any other person with whom that person is, or has been, in a domestic relation.<br />

The objects of the Bill include;<br />

1. Recognising that domestic violence, in all its forms, is unlawful behaviour; ensuring that where domestic violence<br />

occurs, there is effective legal protection for its victims by empowering the courts to make certain orders to protect<br />

victims of domestic violence;<br />

2. Ensuring that access to justice is speedy, inexpensive and simple in accordance with the law.<br />

The Bill provides various protection mechanisms, for example a police officer to whom the complaint of domestic<br />

violence has been made or who investigates the matter may help the victim to acquire shelter, medical treatment and<br />

may also advise the victim to seek other suitable protection. This encourages victims to make reports of domestic violence<br />

when they occur as they are assured of protection.<br />

The Bill provides that a person who is or has been in a domestic relationship with another person may apply to the court<br />

for a protection order in respect of the other person. Where a person is eligible to apply for a protection order; but he or<br />

she is incapacitated, whether by reason of physical or mental, intellectual or sensory impairment or fear of harm or other<br />

sufficient cause, someone else can apply for such orders on his or her behalf.<br />

In conclusion, the Bill if passed into law it will help in eradicating the escalating incidences of domestic violence in the<br />

country.<br />
