Exclusive Interview with Father
Patrick Devine: Creating Peace
in Africa
By Patricia Lavelle
As a young man, Father Patrick Devine
knew he wanted to dedicate his life
to working among the poorest of the
world. Now the founder of the Shalom Center
for Conflict Resolution and Reconciliation,
he has been at the forefront of positive peace
efforts in Kenya and other areas of Africa and
was the recipient of the 2013 International
Caring Award which brought him to Washington
DC with accolades by General Colin Powell
among others. His work in the region began
in 1988 when he joined the Society of African
Missionaries and devoted his life to improving
conditions in a region of the world that had
been the site of persistent poverty, conflict, and
social injustice. His work brought him to a poor
isolated area in West Tanzania where he spent
seven years as a missionary. He later became the
organization’s regional superior of Kenya and
Tanzania.
In 2009, Father Devine founded the
Shalom Center for Conflict Resolution and
Reconciliation (SCCRR) with a vision of a society
where peace, social justice and reconciliation
prevail throughout Africa. In his own words,
Father Devine states “peace in the sense of
absence of violence is not enough.” In order to
have true, positive peace, there must be not only
1
an absence of violence, but the conflicting parties
must care about each other’s well being. The mission
of SCCRR is to work for a society free of physical
violence and unjust social structures in Africa. This
mission is lived out as the organization brings together
leaders and opinion shapers from both sides of
conflict and teaches them analytical skills to assess
the problem and the peace building tools required to
address it. Prior to these meetings, empirical research
is conducted and both sides have agreed to name the
issues to ensure these meetings are productive.
Like parents all over the world, parents in this
geographic area also want a better future for their
children. Education is the foundation on which a more
peaceful future is formed. In efforts for peace, SCCRR
helps to form inter-ethnic schools to bring families
from opposing groups together in order to generate
conversations and cooperation between them. The
organization also provides solar energy to 178 schools
in the area, thereby extending the learning hours
so students can do work in the evening as well as
providing meeting places for the community.
When asked why he named the organization
the Shalom Center for Conflict Resolution and
Reconciliation, Father Devine explains that Shalom
means not only peace, but also peace with justice and
harmony, holistically integrated. What a truly apt title
for an organization that diligently works for conflict
resolution and social harmony in Africa. It can serve
as a paradigm for societies around the world.
Domestic Violence
and the Law in Kenya
By Charles Kanjama and Christopher Marwa
In the recent past domestic violence has become rampant in Kenya
despite interventions, notably by civil society actors; there has
been a steady increase in the number of cases and the severity of
domestic violence in all regions.
Hardly, a day passes without reports in the media on domestic
violence. It is even worse when we see innocent children of tender
ages being victims of these heinous acts of violence perpetrated
against them, sometimes by those who should be their protectors.
This is best captured by the cry of two girls in Nyeri:
“… Two girls are at loss and unable to comprehend how the man
who is supposed to protect them suddenly turned against them in
such a beastly manner. The man, 55-year-old HIV positive father
defiled his two daughters – aged 9 and 14, in the presence of his
bedridden HIV-Positive wife, who had no strength to rescue her
helpless children. And although the man was recently convicted and
jailed for 50 years, the children are traumatized and living in fear…”
Currently Parliament is debating the Domestic Violence Bill 2014.
The bill seeks to provide for the protection and relief to victims
of domestic violence. It provides for the protection for spouses,
children and dependants within the family unit.
Charles Kanjama is the Managing Partner of Muma & Kanjama Advocates
and also a Director of Pacis Insurance Co. Ltd and Convenor of its Audit
Risk and Governance Committee.
Kenya ratified a number of international Conventions which
aims at protecting the rights of individuals, for example, the Convention on the Elimination of Discrimination against
Women (CEDAW) and Convention on the Rights of the Child (CRC) in March 1984. CEDAW is the most comprehensive
Convention on protection of women. CEDAW enshrines principles of equality and freedom in the marriage institution
which are to be enjoyed during and after the dissolution of the marriage.
National laws on domestic violence
The Penal Code
The current practice is to criminalize Domestic Violence under provisions of the Code offences such as assault or battery;
however, this approach usually trivializes violence that is perpetrated in the home. The Code cannot effectively handle
Domestic Violence as Domestic Violence does not only involve physical injury but has other forms such as, psychological
trauma and even financial abuse.
The Code does not define what domestic violence is and hence this creates a big mischief. The Code is also ineffective in
cases where domestic violence is ongoing. It does not elaborate how to handle such a situation. For example; it does not
preclude the perpetrator from accessing the matrimonial where in most cases the offence occurs.
The Penal Code is designed to deter perpetrators from repeating the same offence, however, no compensation for the
victims is provided for despite loss of earning or physical injury that may be the results of the offence.
The Protection against Domestic Violence Bill 2014
The current Bill in Parliament recognizes sexual violence, child marriage, defilement, forced wife inheritance and sexual
abuse as forms of domestic violence. The Bill permits each county to determine the most suitable temporary relief of
protection mechanisms to ensure adequate protection of victims against stigmatization and other forms of discrimination.
8
© 2015 Pacis Insurance Company Ltd
The Bill defines domestic violence in relation to any person as violence against that person, or threat of imminent danger
to that person by any other person with whom that person is, or has been, in a domestic relation.
The objects of the Bill include;
1. Recognising that domestic violence, in all its forms, is unlawful behaviour; ensuring that where domestic violence
occurs, there is effective legal protection for its victims by empowering the courts to make certain orders to protect
victims of domestic violence;
2. Ensuring that access to justice is speedy, inexpensive and simple in accordance with the law.
The Bill provides various protection mechanisms, for example a police officer to whom the complaint of domestic
violence has been made or who investigates the matter may help the victim to acquire shelter, medical treatment and
may also advise the victim to seek other suitable protection. This encourages victims to make reports of domestic violence
when they occur as they are assured of protection.
The Bill provides that a person who is or has been in a domestic relationship with another person may apply to the court
for a protection order in respect of the other person. Where a person is eligible to apply for a protection order; but he or
she is incapacitated, whether by reason of physical or mental, intellectual or sensory impairment or fear of harm or other
sufficient cause, someone else can apply for such orders on his or her behalf.
In conclusion, the Bill if passed into law it will help in eradicating the escalating incidences of domestic violence in the
country.
