Volume 16 Issue 7 Published Monthly July/Aug 2011
Welcome to the re-designed Wildy’s Book News. We have tried to streamline the
publication and make it more user-friendly. Photos and news have been moved
to the front. The Major New Titles This Month still contains as many titles but we
have condensed the use of lengthy descriptions where they are not required. This
should allow us to increase the number of titles included each month.
We have broken down the list of the month’s subscription releases into those for
which there are annual charges and those which are charged as published.
This month’s issue includes photos from the launch of our new book Law & Society
which includes a series of five symposia which took place throughout 2008
as part of the 400th anniversary celebrations of the grant of the Temple lands by
Letters Patent to the Honourable Societies of the Inner Temple and the Middle
Temple.
Also we have pictures of the annual Lincoln’s Inn Garden Party which was held
on the only dry afternoon in early July.
As a final observation, August is the time for family holidays, that’s why Rayden
& Jackson On Divorce is usually supplemented in September.
tive. Part I explores the component
elements of promise,
its role in Greek thought and
Roman law, the importance
of the moral duty to keep
promises and the development
of promissory ideas in
medieval legal scholarship.
Part II considers the modern
contract law of a number of
legal systems from a promissory
perspective. The focus is
on the law of England, Germany
and three mixed legal
systems (Scotland, South Africa
and Louisiana), though
other legal systems are also
mentioned. Major topics
subjected to a promissory
analysis include formation
of contract, third party rights,
contractual remedies and the
renunciation of contractual
rights. Part III analyses the
future role which promise
might play in contract law,
This comprehensive two-volume
work is a collection of
determinations from OPIC,
the US governmental political
risk insurance provider,
in the form of its Memoranda
of Determinations from 1966
work is the first to
make the underlying primary
material available to the investment
law, political risk
and academic communities.
The authors have made the
claims determinations more
accessible with the inclusion
Since 2005 the law of unfair
commercial practices
has undergone a revolution.
This book presents the first
comprehensive and critical
examination of Directives
2005/29/EC concerning unfair
business-to-consumer
commercial practices and
2006/114/EC concerning
misleading and comparative
advertising. The book offers
the first detailed analysis
of the various ways in
which the two Directives
have been transposed in the
United Kingdom, Germany,
the Netherlands, Belgium
and France, with a particular
focus on incorrect transposition.
The analysis includes an
overview of the enforcement
possibilities before national
courts and authorities, and
as such will be a valuable
source for all practitioners,
policy makers and academics
working in the field of unfair
trade law. Ultimately the aim
of the book is to expound a
sound interpretation of the
relationship between unfair
trade law and competition
law in Europe, and it therefore
engages in an original
examination of these two
cornerstones of European
economic law. The author
argues that unfair trade law
and competition law should
be understood as ‘living apart
together’ - complementary
but autonomous and sometimes
even conflicting.
Application of
Human Rights Treaties:
Law, Principles, and Policy,
Oxford University Press,
Hardback, £70.00, ISBN:
9780199696208
Questions as to when a state
owes obligations under a
human rights treaty towards
an individual located outside
its territory are being brought
more and more frequently
before both international and
domestic courts. Victims of
aerial bombardment, inhabitants
of territories under
military occupation, deposed
dictators, suspected terrorists
detained in Guantanamo by
the United States, and the
family of a former KGB
spy who was assassinated
in London through the use
of a radioactive toxin, allegedly
at the orders or with
the collusion of the Russian
government - all of these
people have claimed protection
from human rights law
against a state affecting their
lives while acting outside its
territory. These matters are
extremely politically and
legally sensitive, leading to
much confusion, ambiguity
and compromise in the
existing case law. This study
attempts to clear up some of
this confusion, and expose
its real roots. It examines the
notion of state jurisdiction
in human rights treaties, and
places it within the framework
of international law. It
is not limited to an inquiry
into the semantic, ordinary
meaning of the jurisdiction
clauses in human rights
treaties, nor even to their
construction into workable
legal concepts and rules.
Rather, the interpretation
of these treaties cannot be
complete without examining
their object and purpose, and
the various policy considerations
which influence states
in their behaviour, and courts
The book thus exposes the
tension between universality
and effectiveness, which
is itself the cause of methodological
and conceptual
inconsistency in the case law.
Finally, the work elaborates
on the several possible models
of the treaties’ extraterritorial
application. It offers
not only a critical analysis
of the existing case law, but
to make companies and other
Laytime and Demurrage,
6th Edition is an indispensable
book for those new to
laytime and demurrage as
well as anyone who needs
a more in-depth analysis.
The laytime and demurrage
clause appears in almost all
carriage contracts and consequently
there are now over
1,000 reported cases on the
subject. Laytime and Demurrage,
6th ed is considered as
the main source of authority
on all issues to do with laytime
and demurrage. While
other books cover laytime or
demurrage, this covers both
areas in detail.
authority on international
evolve in order to remain
fit for purpose. This volume
brings together leading
practitioners to provide an
overview of what today constitutes
good governance for
pension schemes, from both a
legal and a practical perspective.
It provides the reader
with an appreciation of the
distinctive characteristics
of UK occupational pension
schemes, how they sit within
the capital markets and their
social and fiduciary responsibilities.
Providing a holistic
analysis of pension risk,
both from the trustee and the
corporate perspective, the
essays cover the crucial role
of the employer covenant, financing
and investment risk,
developments in longevity
risk hedging and insurance
de-risking, and best practice
scheme administration.
What our readers say.....
“OPIC has the institutional experience of resources to engage with the relavant legal principles at a level of
sophistication which is occasionally superior to that of some states. When presented by three co-editors of
this eminence, these volumes are a publishing event of importance” - Jan Paulsson, Freshfi elds Buckhaus
Deringer
“Kantor, Nolan and Sauvant have done us a service in pulling this information together in a coherent manner
while leaving judgements to the reader or scholar. This compendium, coming at a time when there is greater
use of and frustration with arbitration as a solution to investment disputes should help enrich the dialog about
the relavant issues of international law” - Julie Martin, Marsh
IMPORTANT FORTHCOMING PUBLICATIONS
The Law of Privilege 2nd
edition
Edited by Bankim Thanki
QC, Patrick Goodall, Henry
King, et al
Oxford University
Press, Hardcover, ISBN
9780199595433, £175.00,
due August 2011
A comprehensive reference
to legal professional privilege
in both contentious and
non-contentious situations,
this book also addresses
privilege against self-incrimination.
Providing detailed
coverage of the nature of
privilege, how it arises, how
it is lost, and its limits, this
second edition builds on the
success of the first to provide
an authoritative practitioner
reference on this widely relevant
subject. Written by a
leading team from Fountain
Court Chambers, the book
is edited by Bankim Thanki
QC, who appeared in the
Three Rivers litigation which
challenged long-established
assumptions about the nature
and scope of privilege. The
book also addresses the impact
of the Human Rights Act
1998. The text is divided into
eight logical themes. It looks
first at the policy underlying
privilege and its nature, and
then at the definitions of legal
advice privilege, which relate
to communications between
lawyer and client; and litigation
privilege, which can
attach to third party communications
in the context
of litigation. It goes on to
provide expert guidance on
issues that arise regularly in
practice, such as exceptions
(including a detailed analysis
of the crime/fraud exception),
multi-jurisdictional
issues, procedural matters,
and problem areas, such
as pre-existing and partly
privileged documents. It
also covers loss of legal professional
privilege (loss of
confidence, and implied and
express waiver); joint and
common interest privilege;
the linked area of without
prejudice privilege, its scope,
exceptions, rules governing
waiver, and the position in
respect of mediation; and
the privilege against selfincrimination.
The book is
clearly laid out, with extensive
cross-referencing and
useful summaries.
A practical handbook suitable
for the busy practitioner
field dealing with all the
basic aspects of confiscation
law, including civil remedies.
This book is useful for those
giving advice at trial stage
on the future impact of confiscation
proceedings. A clear
analysis of the proliferating
case law in the field allows
principles to be quickly identified
and understood, and a stage
by stage explanation of the
procedural requirements ensures
that required forms
and responses are completed
well and within time limits.
The book provides a review
of all the key confiscation
provisions of the Proceeds
of Crime Act 2002 including
Part V civil recovery provisions,
the use of which is set
to expand. Adrian Eissa is
a Barrister at Garden Court
Chambers and a leading
Criminal Junior specialising
in confiscation work.
Ruth Barber is a Solicitor,
Advocate and Director of
Frisby and Co Solicitors, a
Risk and Energy Infrastructure:
Cross-Border
Dimensions
by Thomas J Dimitroff (Consultant
Editor)
Globe Law & Business,
Hardcover, ISBN
9781905783489, £125.00,
due August 2011
This book examines the
spectrum of risks posed to
the development, financing,
construction and operation
of trans-boundary energy
infrastructure and the tools
that may be deployed to manage
these risks. The book
begins by examining trends
in trans-boundary energy
infrastructure and the nature
of the risks – non-technical,
technical and financing –
which infrastructure development
projects and existing
operations must anticipate
and manage. Individual
categories of intergovernmental
and host government
risk will be viewed from the
perspectives of leading international
experts. These risks,
and the tools applied to manage
them, will also be viewed
from the different viewpoints
of the state and private sector
counterparties, lenders,
affected communities and
other interested third parties,
such as indigenous communities,
individual landowners
and the non-governmental
organisations that typically
represent their interests.
Environmental Judicial
Review
by Richard Moules
Hart Publishing, Hardcover,
ISBN 9781849460019,
£65.00, due September 2011
Judicial review of environmental
decisions is an important
and growing area of
public law. But although the
general principles of judicial
review have been clearly
mapped out, their application
to the particular context of
the environment is underexplored.
This book therefore
seeks to provide a detailed
and critical account of environmental
judicial review in
both domestic and EU law.
Part 1 explains the central
principles of environmental
law, such as the polluter pays
principle and the precautionary
principle, and shows how
they influence the application
of public law standards of
legality. Part 2 considers the
procedure for judicial review
with particular emphasis on
standing, protective costs,
and the availability of interim
relief. Part 3 consists
of a detailed examination of
how each of the grounds for
judicial review are applied in
the environmental context.
It highlights the increased
emphasis on consultation
and public participation in
environmental matters, the
degree of deference afforded
by the courts to scientific
and political judgments, and
the prevalence of ‘hardedged’
questions of law. Part
4 focuses on EU law and
examines direct and indirect
actions before the EU courts,
preliminary references, and
state liability. Part 5 explains
the complex regime governing
access to environmental
information. Finally, Part
6 considers infraction proceedings
brought by the EU
Commission, the role of individuals
and NGOs in relation
to such proceedings and the
interrelationships between
infraction proceedings and
judicial review.
This comprehensive guide
provides much-needed coverage
of the Environmental
2004, which impose obligations
on a wide range of organisations
and bodies. The
book is aimed at information
rights practitioners and those
in public authorities charged
with making decisions about
the disclosure of environmental
information. It provides
valuable guidance for
applicants and prospective
applicants. The book examines
the Regulations’ provisions,
including the DEFRA
and discusses the practical
aspects of the Regulations
including the definition of
environmental information,
the bodies subject to obligations,
Members’ clubs have for many years enjoyed a special status at law, in particular
in relation to the supply and sale of alcohol. The new legislation introduced by
the Licensing Act 2003 in itself justified a book for those involved in the running
of, licensing, policing or advising, members’ clubs and Ken Pain, the original author,
took the opportunity to deal with many other topics of importance to clubs,
their officers and members. Club Law Manual was intended to provide a practical
but authoritative guide to the relevant law to lawyers and non-lawyers alike and,
to police officers and local authorities and their staff.
This second edition not only brings this much used book up-to-date but enhances
the original text by introducing chapters on gambling and fund-raising, hearings
and appeals. Chapters on liabilities, employment, health and safety and food
safety have been re-written to include issues raised by readers.
The sections on entertainment, supply and sale of alcohol and internal regulation
have been expanded to incorporate amendments to the Licensing Act 2003,
changes to the law on sexual entertainment and the Equality Act 2010. In addition,
a template for club rules is included within the appendices.
The new authors are practising barristers and specialists in their fields.
THE Drink-Drive Offences:
A Handbook for Practitioners
P. M. Callow
Price: £45
ISBN: 9780854900756
Extent: 358pp
Size: 152mm x 229mm
Binding: Paperback
The statutory provisions on drink-driving are set out in just fifteen sections of the
Road Traffic Act 1988, and two from the Road Traffic Offenders Act 1988, but
there have been over 700 appeals to the Divisional Court on points of law since
the Acts came into force. The result is a body of law which is technical and complex,
covering a wide array of matters.
The Drink-Drive Offences provides a practical, comprehensive, accessible and
up-to-date account of this broad and intriguing area of law. It traces the procedure
from preliminary testing to penalties, taking the legislative provisions in
sequence and explaining the effects of the case law. The routines for preliminary
testing, and for requiring and analysing specimens of breath, blood or urine, are
examined. This includes the recurring question of the reliability of the breath
analysis instrument and the circumstances in which a blood or urine specimen
may be required instead of a breath specimen. The constituents of the offences
are explained, in chapters on the excess alcohol offences, the offences of being in
charge, the offences of being unfit to drive, and causing death by careless driving
when under the influence of drink or drugs. The statutory assumption that
the level of alcohol at the time of the offence was no less than in the specimen
receives special attention, along with the “hip flask” defence, where the motorist
asserts that it was alcohol consumed after driving which accounts for being
over the limit. A chapter is devoted to the offences of failing to co-operate with
preliminary tests and failing to provide specimens, with full consideration of what
constitutes a “reasonable excuse” for these purposes. Finally, the penalties are set
out, including special reasons for not disqualifying.
P. M. Callow LL.M is the author of Drink-Drive Case Notes (2nd edition, 2007)
and co-author of Blackstone’s Handbook for Magistrates (2nd edition, 2000).
