ISBN: 1846610265
The Employment Equality
(Age) Regulations 2006
come into force on 1 Oc-
tober 2006. The aim of
the regulations is to outlaw
discrimination on the
grounds of age, which is
the most widespread form
of discrimination in the
workplace. For the first
time there will be a default
retirement age of 65 and
employers will not be able
to retire employees before
that age unless it can
be objectively justified.
Employers must give employees
at least 6 months’
notice of the intended
retirement date, and also
consider requests from
employees to continue
working beyond the age
of 65. Age discrimination
in recruitment, promotion
and training will be outlawed
and the upper age
limit for unfair dismissal
claims will be removed.
describes equity’s role in
creating different rights
and obligations, remedies,
and procedures from those
provided by the common
provides a complete reworking
fundamental principles
underpinning Equity’s
most significant incursions
substantive integration of
Such integration is
perceived as crucial to the
continuing success of the
Human Rights and Religion
- The Islamic Headscarf
Debate in Europe
Dominic McGoldrick
Hart Publishing, Paperback,
ISBN 1841136522, £18.95,
due September 2006
The debate on multiculturalism
and human rights in
Europe was reignited in 2004
by the Islamic headscarf ban
in France. The legal and
political tensions thrown up
by this debate are now being
witnessed in many European
states. The place of religion
in schools in general, and
wearing of religious dress in
State schools in particular,
has become an issue across
Europe. Supporters of the
right to wear the Islamic
headscarf argue that the ban
and similar prohibitions infringe
a number of human
rights. This book examines
the issues by considering
questions of language, meaning
and symbolism. In doing
so it identifies the debates
behind the debates. Detailed
consideration is given to the
headscarf debate in France.
Comparative practice in a
number of European states -
Germany, Switzerland, Spain,
Italy, Belgium, the Netherlands,
the United Kingdom
and Turkey - is examined.
Brief consideration is also
given to a number of non-
European states. The book
also outlines the role and
function of an international
human rights law approach
to the Islamic headscarf. It
concludes with some wider
reflections on the broader political
and cultural struggles
that lie behind the Islamic
headscarf debate. This wider
frame of analysis reveals the
deeper significance of the
Islamic headscarf bans.
Press, Hardback, ISBN
0199274355, £50.00, due
September 2006
Exploring Law’s Empire is
a collection of essays by
leading legal theorists and
philosophers who have been
invited to develop, defend,
or critique Ronald Dworkin’s
controversial and exciting
jurisprudence. The volume
explores Dworkin’s critique
of legal positivism, his theory
of law as integrity, and his
writings on constitutional
jurisprudence. Each essay
is a cutting-edge contribution
to its field of inquiry,
the highlights of which include
an introduction by
Justice Stephen Breyer of
the United States Supreme
Court, and a concluding essay
by Dworkin himself. This
final chapter responds to the
preceding essays and lays out
Dworkin’s own vision for the
future of jurisprdence over
which has become one of the
key central planks of lifetime
are sections on more specialist
State Entities in International
Arbitration
Emmanuel Gaillard, Editor
Juris Publishing, Hardcover,
ISBN 1929446969, £85.00,
due September 2006.
States get involved in international
affairs either directly
or through their instrumentalities.
The activities of
these instrumentalities raise
many issues, two of which
have given rise to significant
recent developments both in
arbitral and domestic case
law. The first is whether
and under what conditions
a State may be held liable
for the conduct of such instrumentalities
on the basis
of an investment treaty. This
issue will be the subject of a
systematic survey of ICSID
and ICC case law and that of
other arbitral tribunals so as
to identify the circumstances
in which such liability may
arise. The second issue,
which is addressed by State
courts, is whether and under
what conditions State
instrumentalities that have
a separate and autonomous
legal personality may be
held liable for the pecuniary
obligations of the State. A
comparative law study focusing
in particular on solutions
found in French, English
and U.S. law will provide
answers to the question as to
whether an award holding a
State liable may be enforced
against the assets of instrumentalities
of that State,
where such instrumentalities
are prima facie separate
juridical persons.
Press, Hardback, ISBN
0199277400, £75.00, due
September 2007
This book provides a thorough
treatment of the legal,
economic, and policy issues
associated with safeguard
measures in the WTO system.
It includes a careful
treatment of the history of
safeguard measures under
GATT, and the impetus for
the Agreement on Safeguards
during the Uruguay Round.
It reviews the economic
arguments for and against
safeguard measures, including
the modern political
economy account of safeguards
and nullescape clausesnull
in international agreements.
Subsequent chapters
focus on the key legal issues
associated with the use of
safeguards, including the
procedural requirements,
the obligation to demonstrate
unforeseen developments
and increased imports,
the concept of nullserious
injury,null the puzzling causation
test, and limitations
on the scope of safeguard
measures including non-discrimination
principles. All
of the safeguard decisions
within the WTO dispute system
are thoroughly dissected
and analysed. Included as
appendices are the relevant
treaty text and the pertinent
national legislation of the
United States and European
Rights, Groups, and Self-
Invention: Group-Differentiated
Rights in Liberal
Theory
by Eric J. Mitnick
Ashgate Publishing, Hardback,
ISBN 0754645738,
£55.00, due September
2006
This volume describes and
critically assesses the groupdifferentiated
form of ‘right’
from within analytical, constitutive
and liberal theory. It
explores to what extent the
group-differentiated form of
right serves to shape aspects
of human identity and whether
this should be a cause for
concern. The more detailed
normative work advanced
here contextually applies the
constitutive understanding
of rights and the principles
of liberal membership to
particular examples of groupdifferentiated
citizenship.
Such examples range from
slavery and alienage, to more
affirmative classifications,
such as those apparent in the
contexts of civil unions and
affirmative action.
CHANCEL REPAIR LIABILITY
How to Research It
Revised ed
Derriman, James
ISBN: 1898029849
Hardback
Price: £19.95
The owner of any property, however small, in England or Wales, can be liable in certain
circumstances to pay for repairs to the chancel of a medieval parish church in his locality.
Until a recent case decided in the House of Lords led to a farmer and his wife being called
on to pay a £95,000 bill, many property owners, conveyancers and parochial church councils
had ignored this apparently remote corner of the law. Now, especially as a result of the
Land Registration Act 2002, chancel repair liability has become a live issue.
The need for searches to establish whether any particular land may be affected is increasingly
recognised. This book — the first of its kind — provides practical information on how
to make these searches. It does not set out to be a legal textbook, but to enable lawyers, laymen
and churchmen to understand the background and sources of information available so
that they can discover so far as is possible when, and to what extent, liability may exist.
A Foreword by Dr R. Sturt, Diocesan Registrar of Canterbury, endorses its value not only
for people who plan to do their own research, but as a mine of information for professionals,
parochial church councils and amateur historians
FROM TRUST TO TAKEOVER
Butterworths 1938-1967
A Publishing House in Transition
Gordon Graham
ISBN: 1898029814
Hardback 102pp
£12.95
Stanley Bond, a largely unrecognized publishing genius, instructed in his will that his two
infant sons should inherit the company when they attained the age of twenty-five. Until
then, the company should be run by a Trust, which he set up, most of the income from
which would go to his widow. The sons never got their inheritance. The company was sold
twenty-four years after Bond’s death. How this came about is a story of intrigue and power
plays, in researching which the author had access to confidential archives and was able to
interview witnesses of the drama. The result is a tale that throws light on the mores of privately-run
companies sliding unwillingly into the era of corporate ownership.
Gordon Graham was Chairman and Chief Executive of Butterworths from 1975 to 1990.
Prior to that he had been Managing Director of McGraw-Hill’s British subsidiary and International
Sales Manager of the McGraw-Hill Book Company, New York.
