cause that is what is paid to the appo<strong>in</strong>ted attorney) and the judge “generally presumes the<br />
defendant can afford to reimburse” the District. This was justified on the basis that the<br />
District is located <strong>in</strong> a “relatively affluent community.” 52 If a defendant is sentenced to jail<br />
with no probation, then the judge “may waive” the reimbursement fee. If a defendant is<br />
placed on probation, the court always orders that all f<strong>in</strong>es and costs are due at time <strong>of</strong><br />
sentenc<strong>in</strong>g, but the probation <strong>of</strong>ficer can work out a payment plan with the defendant.<br />
If the defendant then fails to pay the reimbursement while on probation, they will be<br />
brought to court for a probation revocation proceed<strong>in</strong>g. One method <strong>of</strong> collect<strong>in</strong>g funds<br />
from a defendant who is on probation is wage garnishment. If the defendant is not on probation<br />
and fails to pay the reimbursement, they will be addressed by the “Show Cause<br />
other person.<br />
Next, the screen<strong>in</strong>g agency assesses a<br />
defendant’s reasonable necessary expenses<br />
and other money owed for exceptional<br />
expenses, like medical care not<br />
covered by <strong>in</strong>surance or court-ordered<br />
family support. Though jurisdictions vary as to what constitutes<br />
“necessary” expenses, most <strong>in</strong>clude rent, day-care, and utilities.<br />
Screeners then determ<strong>in</strong>e an <strong>in</strong>dividual’s available funds to contribute<br />
toward defense representation by add<strong>in</strong>g the net <strong>in</strong>come<br />
and liquid assets and subtract<strong>in</strong>g from the total the sum <strong>of</strong> reasonable<br />
and exceptional expenses. [(Net Income + Liquid Assets)<br />
– (Reasonable + Exceptional Expenses) = Available Funds].<br />
The result<strong>in</strong>g “available funds” can then be measured aga<strong>in</strong>st a<br />
second tier presumptive eligibility standard. In many jurisdictions,<br />
this second presumptive level is tied to a percentage <strong>of</strong> the<br />
Federal Poverty guidel<strong>in</strong>es. For <strong>in</strong>stance, both Louisiana and Nevada<br />
recently adopted a “presumptive threshold” <strong>of</strong> 250 percent<br />
<strong>of</strong> the Federal Poverty Guidel<strong>in</strong>e. In some jurisdictions across<br />
the country, eligibility screen<strong>in</strong>g is term<strong>in</strong>ated if a person’s net <strong>in</strong>come<br />
and liquid assets exceed these <strong>in</strong>come thresholds, and the<br />
person is deemed <strong>in</strong>eligible for public appo<strong>in</strong>tment <strong>of</strong> counsel.<br />
In others, persons can be deemed eligible if their net <strong>in</strong>come and<br />
liquid assets exceed these thresholds, but reasonable and exceptional<br />
expenses br<strong>in</strong>g them under the threshold.<br />

Nationally, many states have Pre-<strong>Trial</strong><br />
Services agencies tasked with, among<br />
other th<strong>in</strong>gs, public defender eligibility<br />
screen<strong>in</strong>g, determ<strong>in</strong><strong>in</strong>g whether or not<br />
an arrestee should be deta<strong>in</strong>ed or released<br />
on his or her own recognizance<br />
prior to <strong>in</strong>itial court appearances, and<br />
present<strong>in</strong>g judges with <strong>in</strong>dependent assessments<br />
on bail recommendations.<br />
Pre-<strong>Trial</strong> Services <strong>of</strong>ten provide greater<br />
efficiencies throughout the court system<br />
while elim<strong>in</strong>at<strong>in</strong>g much <strong>of</strong> the bias<br />
<strong>in</strong> bail determ<strong>in</strong>ations. S<strong>in</strong>ce much <strong>of</strong><br />
the same <strong>in</strong>formation is required to determ<strong>in</strong>e<br />
both eligibility for a public defender<br />
and flight risk, hav<strong>in</strong>g the<br />
<strong>in</strong>digency determ<strong>in</strong>ation done at the<br />
same time <strong>of</strong> the risk assessment could<br />
allow for earlier notification <strong>of</strong> appo<strong>in</strong>tment<br />
to the public defender <strong>of</strong>fices.<br />
This <strong>in</strong> turn will allow defenders<br />
to be more <strong>in</strong>formed when meet<strong>in</strong>g the<br />
client, lead<strong>in</strong>g to more <strong>in</strong>formed bail<br />
hear<strong>in</strong>gs. Hav<strong>in</strong>g a third party present<strong>in</strong>g<br />
objective <strong>in</strong>formation does not reduce<br />
the role <strong>of</strong> judges. The bail<br />
In lieu <strong>of</strong> the Federal Poverty guidel<strong>in</strong>es,<br />
other jurisdictions take <strong>in</strong>to account<br />
the go<strong>in</strong>g rate for private counsel to represent<br />
a defendant on various case types.<br />
For <strong>in</strong>stance, private attorneys may rout<strong>in</strong>ely<br />
ask for a $7,500 reta<strong>in</strong>er to represent<br />
a person on a felony <strong>in</strong>dictment, <strong>in</strong> which case a defendant<br />
may fall above the 250 percent Federal Poverty <strong>in</strong>dex ($2,166<br />
monthly available funds) but would still face a “substantial hardship”<br />
if he or she were to attempt to reta<strong>in</strong> private counsel. Similarly,<br />
private attorneys may rout<strong>in</strong>ely charge $800 to defend a<br />
person aga<strong>in</strong>st misdemeanor charges. In such an <strong>in</strong>stance, the<br />
defendant <strong>in</strong> the above example would not qualify for counsel if<br />
fac<strong>in</strong>g a misdemeanor charge while qualify<strong>in</strong>g if fac<strong>in</strong>g felony<br />
charges.<br />

alternative to pre-trial detention that<br />
allows defendants to ma<strong>in</strong>ta<strong>in</strong> their<br />
