g) Servitude/Easement (“Servidão”) - encumbrance imposed on real estate for the exclusive<br />
benefit of another property, perta<strong>in</strong><strong>in</strong>g to a different owner (e.g. right of way <strong>and</strong> the<br />
rights concern<strong>in</strong>g flow<strong>in</strong>g waters).<br />
2. Urban Lease Law<br />
The lease of real estate properties has suffered an important change through Law nr.<br />
6/2006, published on 27 February 2006 which has entered <strong>in</strong>to force on 27 June 2006.<br />
This Law approved the New Urban Lease Regime (“NRAU”), applicable to all lease<br />
agreements executed after its date of entry <strong>in</strong>to force <strong>and</strong> also, albeit with some limitations,<br />
to pre-exist<strong>in</strong>g leases <strong>and</strong> <strong>in</strong>troduces a clear <strong>in</strong>tention to assure a greater contractual<br />
freedom as concerns the def<strong>in</strong>ition of the contents of lease contracts.<br />
3. Foreign Investment<br />
F<strong>in</strong>ally, there are no restrictions for the foreign <strong>in</strong>vestment <strong>in</strong> Portugal. Thus be<strong>in</strong>g, foreigners<br />
are allowed to purchase real estate without any specific prior approval provided<br />
that a Portuguese taxpayer number is obta<strong>in</strong>ed.<br />
