Governments, however, continue to pretend that there is no conflict between Canadians’<br />
traditional, and constitutionally enshrined, freedoms and the new “human rights” created<br />
by legislation. But the large number of court cases dealing with precisely this conflict<br />
shows that governments are wrong. A conflict exists, and a choice must be made.<br />
Further, Canada’s federal and provincial governments also have a choice as to whether to<br />
retain or remove the sections of human rights codes which restrict freedom of speech.<br />
Nothing stops a government from removing these sections from the human rights code<br />
while retaining legislative provisions that limit discrimination in employment,<br />
accommodation and services.<br />
