<strong>Dear</strong> <strong>Edi<strong>to</strong>r</strong>, <strong>August</strong> <strong>28</strong>, <strong>2006</strong><br />

I <strong>am</strong> <strong>writing</strong> <strong>you</strong> <strong>this</strong> <strong>letter</strong> <strong>to</strong> <strong>express</strong> my opinion on the judicial injustice I’ve<br />

suffered here on Death Row in Texas. My trail lawyer had serious mental illness and<br />

convinced me <strong>to</strong> plead guilty, and then he went and killed himself in a suicide gunshot <strong>to</strong><br />

the s<strong>to</strong>mach. My second lawyer, my state habeas lawyer was forced <strong>to</strong> take my case by the<br />

Court of Criminal Appeals, who by admission of three of his own Justices had been<br />

knowingly appointing incompetent state habeas counsel <strong>to</strong> death row inmates state habeas.<br />

They even appointed one lawyer who had been dead for over one year!<br />

My state habeas lawyer e-mailed a skeletal writ, even after he knew I had hired my<br />

own lawyer; he left out all my legal issues and ultimately got me procedurally barred.<br />

Now the state of Texas gave me a third lawyer. And as Justice Garza of the U.S. 5 th<br />

Circuit Court in New Orleans put it, “failed <strong>to</strong> expound on legal issues and abandoned<br />

other legal issues.”<br />

On <strong>August</strong> 9, 2004, Karl Keys of Capital Defense Weekly stated it as plain as can<br />

be, “Texas feels it should execute Matchett for three bad rolls of the dice on incompetent<br />

counsel.”<br />

My execution date is for September 12 th , and all I’ve ever asked for is <strong>to</strong> have my<br />

legal issues addressed on state habeas.<br />

A Federal Judge sent my case back <strong>to</strong> the state courts <strong>to</strong> put in my left out legal<br />

issues, but the Court of Criminal Appeals rejected the Writ as Abuse of Writ. How can it be<br />

abuse of writ, when I have permission from a higher court? This tactic is commonly used <strong>to</strong><br />

prevent review.<br />

My case is no different than Ricky Kerr’s who also got a bad state habeas counsel.<br />

The court reluctantly gave him a new state habeas proceeding. The only difference between<br />

him and I is he is white and I <strong>am</strong> black.<br />

All I have ever asked of the State of Texas is <strong>to</strong> give me the opportunity <strong>to</strong> have my<br />

legal issues addressed, nothing more, nothing less. When a life is at stake, every<br />

opportunity at justice should be afforded <strong>to</strong> all who face death, but here in Texas, the Court<br />

of Criminal Appeals have twisted the ideology of justice in<strong>to</strong> some façade of what some in<br />

their majority may call justice, while those thru who acknowledged the court’s failings<br />

view is as we see it: injustice.<br />

Thank <strong>you</strong> for <strong>you</strong>r time and I hope and pray <strong>you</strong>’ll print <strong>this</strong> because America<br />

needs <strong>to</strong> know there “is” a problem with the statutes of Article 11:071 (state habeas), they<br />

are faulty <strong>to</strong> the point of death.<br />
