6-1-4. Record <strong>of</strong> <strong>Licenses</strong>.<br />

The <strong>City</strong> shall keep records <strong>of</strong> all information<br />

acquired pursuant to the sale <strong>of</strong> licenses and registration<br />

<strong>of</strong> bicycles.<br />

6-1-<strong>1.</strong> Application for and issuance <strong>of</strong> licenses.<br />

A. Application for a bicycle license shall be made<br />

to the <strong>City</strong> or a dealer upon a form provided by the<br />

<strong>City</strong>. A license fee <strong>of</strong> such sum as the <strong>City</strong> Council<br />

shall establish by resolution shall be paid at the time the<br />

license is issued.<br />

B. <strong>Licenses</strong> issued under this section shall be<br />

valid for the period <strong>of</strong> time for which the applicant<br />

owns the bicycle.<br />

C. No license shall be issued when the <strong>City</strong> has<br />

knowledge or reasonable grounds to believe that the<br />

applicant is not the owner <strong>of</strong> or entitled to the<br />

possession <strong>of</strong> the bicycle.<br />

6-1-2. Unlawful to tamper with license or serial<br />

number.<br />

A. It shall be unlawful for any person to remove<br />

or alter in any manner a manufacturer, frame, serial, or<br />

license number on a cycle without the express<br />

permission <strong>of</strong> the Director <strong>of</strong> the Department <strong>of</strong> Public<br />

Safety.<br />

B. It shall be unlawful for any person to possess a<br />

cycle which has had the manufacturer, frame, serial, or<br />

license number removed or altered in any way, except<br />

when the Director <strong>of</strong> Public Safety has given express<br />

permission for such removal or alteration.<br />

6-1-3. Unlawful to sell without serial number.<br />

It shall be unlawful, except as hereinafter provided,<br />

for any dealer to sell any cycle which does not have a<br />

manufacturer, frame, serial, or license number on its<br />

frame. Where a cycle has no such numbers, or where<br />

such numbers are illegible, in order to lawfully sell the<br />

cycle the dealer shall permanently stamp or have<br />

stamped on the frame the number <strong>of</strong> the license to be<br />

issued for that cycle.<br />

The laws pertaining to bicycles which are set forth<br />

in the Utah Code and which are approved and adopted<br />

as part <strong>of</strong> the Traffic Code <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>Orem</strong>, are<br />

hereby approved, adopted, and incorporated herein and<br />

shall be applicable to all persons riding bicycles within<br />

the <strong>City</strong>. By this reference, these provisions are made a<br />

part <strong>of</strong> the <strong>Orem</strong> <strong>City</strong> Code as fully as if set out at<br />

length herein, and they shall be controlling within the<br />

limits <strong>of</strong> the <strong>City</strong>. However, this section is not intended<br />

and does not purport to grant unto the <strong>City</strong> any powers<br />

or jurisdiction not specifically or impliedly granted by<br />

law.<br />

6-3-<strong>1.</strong> Definition.<br />

6-3-2. Records, dealer licensing.<br />

6-3-3. Inspection <strong>of</strong> Records.<br />

6-3-<strong>1.</strong> Definition.<br />

A. As used in this Chapter, "cycle" shall mean a<br />

device upon which any person may ride, propelled by<br />

human power through a belt, chain or gears and having<br />

one or more wheels in tandem or other arrangement.<br />

Cycles with one or more wheels <strong>of</strong> at least twenty (20)<br />

inches in diameter and frame size <strong>of</strong> at least fourteen<br />

(14) inches shall be subject to this <strong>Article</strong>. Cycles with<br />

their largest wheel size less than twenty (20) inches in<br />

diameter and with a frame size less than fourteen (14)<br />

inches shall be exempt from this <strong>Article</strong>, but these or<br />

any other cycles exempt from this <strong>Article</strong> may be<br />

licensed by their owners upon request.<br />

B. As used in this Chapter, "dealer" shall mean<br />

any merchant or retailer who sells cycles in the <strong>City</strong>,<br />

and all employees or agents <strong>of</strong> such merchant or<br />

retailer.<br />

6-3-2. Records, dealer licensing.<br />

A. All dealers shall, immediately upon the sale <strong>of</strong><br />

any cycle complete a bicycle registration form.<br />

Registration forms shall include the following<br />

information:<br />

<strong>1.</strong> The name, address, and telephone number<br />

<strong>of</strong> the retailer.<br />

2. The year, make, and model <strong>of</strong> the cycle.<br />

3. A general description <strong>of</strong> the cycle.<br />

4. The name, address, and telephone number<br />

<strong>of</strong> the purchaser.<br />

5. Notice to the customer <strong>of</strong> the procedure to<br />

obtain a <strong>City</strong> <strong>of</strong> <strong>Orem</strong> bicycle license.<br />

B. All registration forms shall be sent to the<br />

Department <strong>of</strong> Public Safety by the dealer within thirty<br />

(30) days <strong>of</strong> the date <strong>of</strong> sale.<br />

6-3-3. Inspection <strong>of</strong> Records.<br />

All dealers shall be required to show to any police<br />

<strong>of</strong>ficer <strong>of</strong> this <strong>City</strong>, upon request, any registration form<br />

filled out pursuant to this Chapter, provided such<br />

request is made during normal business hours.<br />

A violation <strong>of</strong> this Chapter shall be a class B<br />

misdemeanor as defined in the Utah Code Annotated,<br />

1953, as amended.<br />

6-4-2. Severability.<br />

If any provision, clause, sentence, or paragraph <strong>of</strong><br />

this Chapter or the application there<strong>of</strong> to any person or<br />

circumstance shall be held invalid, such invalidity shall<br />

not affect the other provisions or applications <strong>of</strong> this<br />

Chapter which can be given effect independent from the<br />

invalid provision or application, and to this extent the<br />

provisions <strong>of</strong> this Chapter are hereby declared to be<br />

severable.<br />
