Mr. Lapshyn noted that value added<br />

tax is the major generator <strong>of</strong> State<br />

Budget revenues and will be further<br />

developed to ensure compliance with<br />

EU Directive #112. In regards to the<br />

STA’s position on the problem <strong>of</strong> nonhonest<br />

VAT tax-payers, Mr. Lapshyn<br />

noted that the electronic register <strong>of</strong><br />

tax invoices is currently considered as<br />

an appropriate solution. The concept<br />

ing <strong>of</strong> VAT funds movement through<br />

bank accounts is another possible alternative<br />

but one which the <strong>Chamber</strong><br />

has lobbied against in the past.<br />

In regards to the possible adoption <strong>of</strong><br />

the Draft Tax Code, Mr. Lapshyn noted<br />

that in his opinion it is more realistic to<br />

expect the adoption <strong>of</strong> a list <strong>of</strong> amendments<br />

envisaged in the current version<br />

<strong>of</strong> the Draft Tax Code through amendments<br />

to separate laws in parallel with<br />

the 2008 Budget process.<br />

After Mr. Lapshyn’s remarks the floor<br />

was open to a number <strong>of</strong> specific<br />

questions from the gathered Cham-<br />

in Ukraine including producers, importers<br />

and exporters.<br />

disputable issues. Participants agreed<br />

to send a follow-up letter to the STA<br />

asking for clarifications on certain tax<br />

issues related to the income tax payment<br />

rules for non-residents and definition<br />

for the moment <strong>of</strong> consignment<br />

shipments. The written clarifications<br />

will be disseminated by the <strong>Chamber</strong><br />

to all interested Members through the<br />

Tax Committee.<br />

Membership proposals, have been<br />

actively advocating many issues surrounding<br />

certification and standardization<br />

including: abolition <strong>of</strong><br />

compulsory certification, separation<br />

<strong>of</strong> functions <strong>of</strong> standardization and<br />

technical regulations, market survey<br />

among different State authorities<br />

and abolition <strong>of</strong> double control<br />

on the markets and implementation<br />

<strong>of</strong> the European model <strong>of</strong> the food<br />

market survey.<br />

Afterwards, Mr. Shnypko noted that<br />

according to recent changes to the<br />

Law <strong>of</strong> Ukraine “On Consumers’<br />

Rights Protection” all laboratory research<br />

should be carried out at State<br />

budget expense.<br />

for that purpose. In this context,<br />

the State Committee is developing<br />

special legislation on the system <strong>of</strong><br />

partnership between the Committee<br />

The <strong>Chamber</strong> was pleased to host an<br />

“In-Focus” Meeting with Mrs. Inna Bogoslovska,<br />

Deputy Minister <strong>of</strong> Justice.<br />

Mrs. Bogoslovska addressed the<br />

Membership in regards to the key<br />

issues and problems <strong>of</strong> business operations<br />

in Ukraine and explained<br />

briefly the process <strong>of</strong> development<br />

and perspectives <strong>of</strong> implementation<br />

<strong>of</strong> new legislation.<br />

At the beginning <strong>of</strong> her presentation,<br />

the Deputy Minister commented on<br />

the nuances regarding the adoption<br />

<strong>of</strong> the Joint Stock Company Law and<br />

mentioned that the discussion will be<br />

open to investors. She also stressed<br />

the importance that the legislation<br />

regulating joint stock companies be<br />

similar to EU norms.<br />

The Law on Securities and Stock Exchanges<br />

was also discussed as well as<br />

the discrepancies between the Civil<br />

and Economic Codes. The floor was<br />

then opened to questions where<br />

Mr. Shnypko paid special attention<br />

to the work <strong>of</strong> the Public Council<br />

their respective spheres, were able to<br />

discuss issues relating to illegal raider<br />

attacks, corporate governance and<br />

possible changes to the Constitution.<br />

In closing the meeting, Mrs. Bogoslovska<br />

thanked the <strong>Chamber</strong> for<br />

<strong>Chamber</strong>’s Official Service Providers<br />

under the State Committee. He addressed<br />

to the business community<br />

with a proposition to take a more active<br />

part in its activities and assured<br />

the audience that all important decisions<br />

<strong>of</strong> the State Committee will be<br />

elaborated in close cooperation with<br />

the Public Council Members and discussed<br />

during the Council’s meetings.<br />

Mr. Shnypko was happy with<br />

the level <strong>of</strong> engagement and pr<strong>of</strong>essionalism<br />

<strong>of</strong> the <strong>Chamber</strong> within the<br />

Public Council.<br />

The World Economic Forum Announces the Creation<br />

<strong>of</strong> a Community <strong>of</strong> Global Growth Companies<br />

The <strong>American</strong> <strong>Chamber</strong> <strong>of</strong> <strong>Commerce</strong> in<br />

Ukraine was pleased to be invited to actively<br />

participate in the latest initiative <strong>of</strong><br />

the World Economic Forum which took<br />

place in Dalian, People’s Republic <strong>of</strong><br />

China, September 6-8, 2007. Revealing<br />

a bold new initiative <strong>of</strong> the World Economic<br />

Forum Community, comprised<br />

<strong>of</strong> the 1,000 foremost global enterprises,<br />

Klaus Schwab, Founder and Executive<br />

Chairman, World Economic Forum, announced<br />

the creation <strong>of</strong> a new community<br />

<strong>of</strong> fast-growing companies destined<br />

to join the ranks <strong>of</strong> global multinationals<br />

in the next 5 to 10 years.<br />

In his opening remarks <strong>of</strong> the Inaugural<br />

Annual Meeting <strong>of</strong> the New Champions,<br />

Schwab had set the goal <strong>of</strong> 100 Founding<br />

Global Growth Company Members. Dur-<br />

ing the closing ceremony, he welcomed<br />

125 Founding Members, two <strong>of</strong> which<br />

are <strong>Chamber</strong> Members from Ukraine -<br />

AVentures Group and Golden Gate Business.<br />

At final tally, 40% <strong>of</strong> the members<br />

are from Asia; 26% hail from Europe; 20%<br />

are based in the Americas; and 14% come<br />

from Africa and the Middle East. “This is a<br />

truly global community,” said Schwab.<br />

III International Investment Forum “Investments Partnership<br />

Development” in Sumy Region<br />

The event was organized by the Sumy<br />

Regional State Administration and<br />

the Sumy <strong>Chamber</strong> <strong>of</strong> <strong>Commerce</strong> and<br />

Industry. Close to 250 people participated<br />

in the Forum, which included<br />

representatives <strong>of</strong> foreign and domestic<br />

investment companies, funds,<br />

foreign diplomatic missions, banks, as<br />

well as foreign representative <strong>of</strong>fices<br />

<strong>of</strong> <strong>Chamber</strong>s <strong>of</strong> Industry and Trade.<br />

During the Plenary session the Head<br />

<strong>of</strong> Sumy State Administration, Governor<br />

Pavlo Kachur, presented “Plan<br />

for Sumy” project, in which he briefly<br />

described several investment projects<br />

for the development <strong>of</strong> the regional<br />

economy. The best investors <strong>of</strong> Sumy<br />

region were also recognized with<br />

awards during the plenary session.<br />

Around 70 business projects were presented<br />

during the Forum that were<br />

created by organizations in the Sumy<br />

region. During the Forum participants<br />

were also able to discuss nuances to<br />

attracting investments into the municipal<br />

sphere, innovative projects<br />

and the tourism industry.<br />

<strong>Chamber</strong> President, Mr. Jorge Zukoski,<br />

spoke during the plenary session <strong>of</strong> the<br />

Forum highlighting issues surrounding<br />

the general investment environment <strong>of</strong><br />

Ukraine and specifically touched on the<br />

successes <strong>of</strong> many <strong>Chamber</strong> Members in<br />

doing business in the Sumy Region with the<br />

support <strong>of</strong> the Head <strong>of</strong> the Sumy State Administration,<br />

Governor Kachur, applauding<br />

his endeavors to improve the investment<br />

climate <strong>of</strong> the Sumy region.<br />

Banking and Financial Services Committee<br />

Discusses the Draft Law on Derivatives<br />

The <strong>Chamber</strong> Banking and Financial<br />

Services Committee meeting took place<br />

on Monday September 10. Committee<br />

Members discussed the Draft Law on<br />

Derivatives, recently submitted to the<br />

Verkhovna Rada, covering major issues<br />

that the document introduces, as well<br />

as its effectiveness when implemented<br />

with regard to the current situation in<br />

the financial market <strong>of</strong> Ukraine. It was<br />

agreed that the document presents the<br />

needed basics for a derivatives market<br />

to function properly, although there is<br />

a necessity in improving the relevant<br />

current legislation, i.e. NBU regulations<br />

and the Cabinet’s Resolution on Currency<br />

Control. Based on the discussion,<br />

it was decided to express support to the<br />

appropriate Parliament Committee.<br />

to the recent NBU regulations<br />

on statistical reporting and crossborder<br />

loans, identifying and sharing<br />

major implications they created<br />

for the banking sector. As per NBU<br />

Resolution # 235, it was proposed to<br />

send a letter to the National Bank <strong>of</strong><br />

Ukraine asking to repeal this resolution<br />

for the time being, taking into<br />

<strong>Chamber</strong>’s Official Service Providers<br />

account the situation on the world<br />

financial markets.<br />

Apart form this, the attendees discussed<br />

a list <strong>of</strong> financial services market<br />

related issues, as well as possible<br />

steps that should be taken to protect<br />

Member’s interests.<br />

Traditional, but Unique Toastmasters Committee Meeting<br />

Toastmasters Committee Meeting<br />

On September 12 fellow members and<br />

welcome guests <strong>of</strong> the <strong>Chamber</strong> Toastmasters<br />

Committee gathered together<br />

for a regular, but unique again meeting.<br />

Despite the unusual venue setup with<br />

a long table in the middle the meeting<br />

turned to be informative, spectacular<br />

and stimulating. The evening’s word<br />

“TYRO”.<br />

At the beginning the attendees were<br />

delighted to welcome two new members<br />

<strong>of</strong> the Toastmasters Club: Yulia Lubiana<br />

(EBS) and Dmytro Tkachenko,<br />

(Baker Tilly Ukraine).<br />

Further, as it was planned, Oksana Reshetnik<br />

(Procter&Gamble) delivered her<br />

project on body language. She managed<br />

to show the value <strong>of</strong> gestures and body<br />

movements while speaking and proved<br />

that there were different ways to use body<br />

language to communicate your message.<br />

The impromptu session “Table Topics”<br />

was pr<strong>of</strong>essionally prepared and conducted<br />

by Marina Seredkina (BAT). The<br />

Table speakers had the chance to revert<br />

back to childhood and make a choice<br />

between being a diligent crummer or<br />

a nimble non-achiever, “Simpsons” or<br />

old kind Soviet cartoons; different ways<br />

<strong>of</strong> the child-rearing process.<br />

The meeting was finished with<br />

speech evaluators.<br />

Committee Meeting meets Mr Vyacheslav Shoptenko<br />

Members <strong>of</strong> the <strong>Chamber</strong> BMET<br />

Committee conducted their regular<br />

meeting on September 13.<br />

The meeting was dedicated to the<br />

subjects <strong>of</strong> innovations in educational<br />

techniques, tactic and strategic<br />

development plans for the<br />

Committee.<br />

Travel and Tourism Committee Meeting<br />

Members <strong>of</strong> the <strong>Chamber</strong> Travel and<br />

Tourism Committee gathered for a<br />

meeting on September 20. The agenda<br />

issues turned to be really pressing<br />

and pulled together both players <strong>of</strong><br />

the market and consumers <strong>of</strong> their<br />

services – to discuss issues and proceed<br />

with determining the Committee’s<br />

further activity.<br />

At the beginning Yuliya Kobuk, Committee<br />

Coordinator, updated the at-<br />

tendees on the Position Paper sent to<br />

certain Embassies and its development.<br />

Having considered the matter, the participants<br />

agreed to try to conduct meetings<br />

with some Embassy representatives<br />

<strong>of</strong> countries who are to enter the<br />

Schengen zone in the nearest future.<br />

In the course <strong>of</strong> the meeting such problems<br />

as railway tickets for foreigners in<br />

the city <strong>of</strong> Kharkiv; foreigners’, working<br />

in Ukraine, business trips legislative de-<br />

<strong>Chamber</strong>’s Official Service Providers<br />

• What SIFE is, its activity, benefits, achievements,<br />

and functioning plans;<br />

• SIFE in Ukraine.<br />

The presentation was followed by<br />

discussion and similar experience<br />

sharing.<br />

Further meeting’s consideration covered<br />

the matters <strong>of</strong> future presentations<br />

<strong>of</strong> the Matrix and Roundtable<br />

with deans <strong>of</strong> MBA schools. The action<br />

plan and terms were defined accordingly. <br />

finintion, reports, advances reimbursement<br />

and taxation; legal and taxation<br />

role <strong>of</strong> E-ticket boarding passes usage<br />

were discussed. Based on the discussion<br />

the guests came to the decision to write<br />

a pair <strong>of</strong> letters to the approproate authorities<br />

and conduct a joint meeting<br />

with the <strong>Chamber</strong> Tax Committee to<br />

ask its Members for pr<strong>of</strong>essional advice<br />

and cosider possible futher steps for the<br />

Travel & Tourism Committee.<br />

As for the State program <strong>of</strong> Euro-<br />

2012 preparation, it was agreed to<br />

wait until the elections were over to<br />

work on proposals to it as there is<br />

now strategic view <strong>of</strong> and collaboration<br />

between the governmetal bodies<br />

concerning the preparation activities.<br />

It was also updated that until then no<br />

significant national measures as for<br />

the preparation had been made and<br />

it was quite difficult to work on the<br />

program under the conditions.<br />

The <strong>Chamber</strong> was pleased to invite<br />

World-famous Hyatt International<br />

Corporation opened a new five-star<br />

Hyatt Regency Kyiv hotel, for which<br />

the press conference was held on the<br />

5th <strong>of</strong> September.<br />

The sleek, stylish hotel houses 234<br />

generously sized deluxe rooms, including<br />

25 Suites, with up- to date<br />

comfortable equipment. Centrally<br />

located in the historical centre on<br />

Tarasova Street next to the Saint<br />

Sophia Square, the hotel is the ideal<br />
