RULE 121 (Fed. R. Civ. P. 77)THE CLERK OF THE DISTRICT COURT(a) Locations. The Clerk of the District Court shall maintain offices at 501 "I"Street, Sacramento, California 95814, where the records of the United States DistrictCourt sitting in Sacramento shall be kept, and offices at 2500 Tulare Street, Fresno,California 93721, where the records of the United States District Court sitting in Fresnoshall be kept.(b) Office Hours. The regular office hours of the Clerk at Sacramento andFresno shall be from 9:00 a.m. to 4:00 p.m. each day except Saturdays, Sundays, legalholidays, and such other times so ordered by the Chief Judge. See Fed. R. Civ. P. 77;Fed. R. Crim. P. 56.(c) Advance Payment of Fees. Except as required by law, or as otherwisedirected by the Court, the Clerk shall not file any paper, issue any process, or renderany other service for which a fee is prescribed by statute or by the Judicial Conferenceof the United States unless the fee is prepaid. See 28 U.S.C. § 1914 et seq.(d) Civil Complaint - Filing Procedures for Attorneys. Complaint filings byattorneys in civil actions (including prisoner, habeas corpus, in forma pauperis, andremoval) shall be performed electronically. Detailed procedures are prescribed on theCourt's website. See also L.R. 133.(e) Initial Action Filing Procedures - Death Penalty Habeas Corpus.Whatever the manner of their filing, death penalty habeas corpus initial filings shall beassigned to a Judge and, in Sacramento, to a Magistrate Judge, immediately andcommunicated to the assigned Judge and Magistrate Judge immediately.(f) Initial Action Filing Procedures - Miscellaneous Actions in General.With the sole exception of grand jury proceedings and miscellaneous actions filed bypro se plaintiffs, all documents submitted for filing in a miscellaneous proceeding, nomatter when the action was originally commenced, shall be filed in accordance with theprovisions governing civil actions in general. Grand jury proceedings should besubmitted for filing by the United States Attorney in original paper format. Thesedocuments will be scanned into .pdf format by the Clerk and, except where authorizedto be publicly available, shall be kept on a secure part of the Court's servers. All grandjury paper documents shall be returned to the United States Attorney.12
RULE 122 (Fed. R. Civ. P. 63)AUTHORITY OF ASSIGNED JUDGES AND MAGISTRATE JUDGESIN EMERGENCIESThe Judge assigned to an action, or the Magistrate Judge when authorized, shallpreside over the trial and determine all motions or other matters in that action, except asotherwise provided in Fed. R. Civ. P. 63 and Fed. R. Crim. P. 25, or as otherwiseordered, or in cases of emergency. In the event of an emergency requiring promptaction, if the assigned Judge or Magistrate Judge is unavailable, the matter shall bepresented to the Clerk for temporary assignment to another available Judge orMagistrate Judge, if necessary. In such instance, it shall be the responsibility of counselpresenting the matter to provide the Judge or Magistrate Judge to whom the matter ispresented with a detailed explanation of the necessity for the application's beinghandled on an emergency basis. The matter shall be returned to the calendar of theunavailable assigned Judge or Magistrate Judge upon the resolution of the matter,unless the matter is transferred pursuant to these Rules.13
