RULE 121 (Fed. R. Civ. P. 77)THE CLERK OF THE <strong>DISTRICT</strong> COURT(a) Locations. The Clerk <strong>of</strong> <strong>the</strong> <strong>District</strong> <strong>Court</strong> shall maintain <strong>of</strong>fices at 501 "I"Street, Sacramento, California 95814, where <strong>the</strong> records <strong>of</strong> <strong>the</strong> <strong>United</strong> <strong>States</strong> <strong>District</strong><strong>Court</strong> sitting in Sacramento shall be kept, and <strong>of</strong>fices at 2500 Tulare Street, Fresno,California 93721, where <strong>the</strong> records <strong>of</strong> <strong>the</strong> <strong>United</strong> <strong>States</strong> <strong>District</strong> <strong>Court</strong> sitting in Fresnoshall be kept.(b) Office Hours. The regular <strong>of</strong>fice hours <strong>of</strong> <strong>the</strong> Clerk at Sacramento andFresno shall be from 9:00 a.m. to 4:00 p.m. each day except Saturdays, Sundays, legalholidays, and such o<strong>the</strong>r times so ordered by <strong>the</strong> Chief Judge. See Fed. R. Civ. P. 77;Fed. R. Crim. P. 56.(c) Advance Payment <strong>of</strong> Fees. Except as required by law, or as o<strong>the</strong>rwisedirected by <strong>the</strong> <strong>Court</strong>, <strong>the</strong> Clerk shall not file any paper, issue any process, or renderany o<strong>the</strong>r service for which a fee is prescribed by statute or by <strong>the</strong> Judicial Conference<strong>of</strong> <strong>the</strong> <strong>United</strong> <strong>States</strong> unless <strong>the</strong> fee is prepaid. See 28 U.S.C. § 1914 et seq.(d) Civil Complaint - Filing Procedures for Attorneys. Complaint filings byattorneys in civil actions (including prisoner, habeas corpus, in forma pauperis, andremoval) shall be performed electronically. Detailed procedures are prescribed on <strong>the</strong><strong>Court</strong>'s website. See also L.R. 133.(e) Initial Action Filing Procedures - Death Penalty Habeas Corpus.Whatever <strong>the</strong> manner <strong>of</strong> <strong>the</strong>ir filing, death penalty habeas corpus initial filings shall beassigned to a Judge and, in Sacramento, to a Magistrate Judge, immediately andcommunicated to <strong>the</strong> assigned Judge and Magistrate Judge immediately.(f) Initial Action Filing Procedures - Miscellaneous Actions in General.With <strong>the</strong> sole exception <strong>of</strong> grand jury proceedings and miscellaneous actions filed bypro se plaintiffs, all documents submitted for filing in a miscellaneous proceeding, nomatter when <strong>the</strong> action was originally commenced, shall be filed in accordance with <strong>the</strong>provisions governing civil actions in general. Grand jury proceedings should besubmitted for filing by <strong>the</strong> <strong>United</strong> <strong>States</strong> Attorney in original paper format. Thesedocuments will be scanned into .pdf format by <strong>the</strong> Clerk and, except where authorizedto be publicly available, shall be kept on a secure part <strong>of</strong> <strong>the</strong> <strong>Court</strong>'s servers. All grandjury paper documents shall be returned to <strong>the</strong> <strong>United</strong> <strong>States</strong> Attorney.12
