<strong>Short</strong> <strong>Resettlement</strong> <strong>Plan</strong> <strong>for</strong> <strong>Bhatapara</strong> - <strong>Urkura</strong> <strong>3rd</strong> <strong>L<strong>in</strong>e</strong> <strong>Project</strong> <strong>in</strong> the State of Chattisgarh1. Description Of <strong>Project</strong><strong>Bhatapara</strong> -<strong>Urkura</strong> is an important Broad Gauge (BG) section connect<strong>in</strong>g Bilaspur and Raipur/Nagpur on the Howrah –Mumbai trunk route of the South Eastern Railway (SER). SER hasproposed <strong>for</strong> provid<strong>in</strong>g a third l<strong>in</strong>e between <strong>Bhatapara</strong> and <strong>Urkura</strong>, which is about 60 km <strong>in</strong>length. The entire alignment is <strong>in</strong> Raipur District of Chhattisgarh State. This l<strong>in</strong>e is part of therailway l<strong>in</strong>e between Jharsuguda and Durg that passes through major <strong>in</strong>dustrial area hav<strong>in</strong>gcoalfields, limestone and Dolomite l<strong>in</strong>es, cement plants, and steel plants. The exist<strong>in</strong>g traffic <strong>in</strong>the <strong>for</strong>m of either raw material f<strong>in</strong>ished products moves both ways.This is an important route where bulk of traffic is mov<strong>in</strong>g from Bilaspur, Katni, <strong>in</strong> addition to theEast-West traffic. This route also deals with the North-South traffic and their transfer <strong>for</strong>m oneroute to other route. S<strong>in</strong>ce, this section is heavily saturated, a <strong>3rd</strong> l<strong>in</strong>e <strong>in</strong> the section has beenconsidered necessary to augment the l<strong>in</strong>e capacity <strong>for</strong> mov<strong>in</strong>g additional coal tra<strong>in</strong>s to thermalpower plants. The nearest important junction is Bilaspur, which serves <strong>for</strong> the busy route to andfrom Katni. The <strong>3rd</strong> l<strong>in</strong>e from Bilaspur to <strong>Bhatapara</strong> is already under construction. Five cementplants are located at various stations of this section. Also, there are sponge iron plants that areunder construction. In the project region rail and roads are the ma<strong>in</strong> transportation needs <strong>for</strong>the passengers and goods traffic. National Highway 200 (NH-200) connects Raipur to Bilaspur.The location of exist<strong>in</strong>g railway l<strong>in</strong>e along with the proposed l<strong>in</strong>e <strong>in</strong> the project region is shown<strong>in</strong> Figure 1.2. Land Acquisition and ImpactsOut of 99.15 ha (Table 1) land requirement, about 0.086 ha is to be acquired from Governmentland and 1.86 ha from Private land. On the Government land no activity is be<strong>in</strong>g carried out.There is no habitation or settlement on this land. The rema<strong>in</strong><strong>in</strong>g 97.2 ha are with<strong>in</strong> the exist<strong>in</strong>gROW, <strong>in</strong> the <strong>for</strong>m of strip and are already <strong>in</strong> the jurisdiction of SER free from any encumbrances.The private lands to be acquired are agricultural land and belongs to 22 households(Annexure1). The average loss of agricultural land per family is less than 20% of their totalhold<strong>in</strong>gs. Private land 1.86Total 99.15The construction of the <strong>3rd</strong> l<strong>in</strong>e does not <strong>in</strong>volve any displacement of human settlements. No publicproperties and <strong>in</strong>tuitional build<strong>in</strong>gs will be affected along the alignment. The proposed l<strong>in</strong>e will not haveany bear<strong>in</strong>g on the economic/ trade activities carried out by the population <strong>in</strong> the project corridor,dur<strong>in</strong>g the construction of the project. There are no <strong>in</strong>digenous/-scheduled tribes amongst the affectedpeople.3. <strong>Resettlement</strong> <strong>Plan</strong>-Objectives and Policy FrameworkThis short RP is designed to deal with limited impacts of the <strong>Bhatapara</strong>-<strong>Urkura</strong> <strong>3rd</strong> <strong>Project</strong>. Theonly type off loss <strong>in</strong> this project is agriculture land. The SER has taken the appropriate measuresto m<strong>in</strong>imize the amount of land acquisition, tak<strong>in</strong>g <strong>in</strong>to account the need of the project. Theproposed track is parallel to the exist<strong>in</strong>g down the l<strong>in</strong>e track. Close vic<strong>in</strong>ity of the exist<strong>in</strong>g downl<strong>in</strong>es has reduced l<strong>in</strong>ear disruption <strong>in</strong> the <strong>for</strong>m of land acquisition and loss of structures.Boundary stones are located along the alignment demarcat<strong>in</strong>g the jurisdiction of railway land oneither side of the exist<strong>in</strong>g double track.


In India the current legislation govern<strong>in</strong>g land acquisition <strong>for</strong> public purposes is the LandAcquisition Act of 1894. In accordance with the Act, the legal process <strong>for</strong> land acquisition hasbeen <strong>in</strong>itiated by ECOR with the District Collector (DC) of the Raipur district with a detailed mapof the proposed area. In determ<strong>in</strong><strong>in</strong>g the amount of compensation, the DC takes <strong>in</strong>toconsideration the “circle value” <strong>for</strong> payment of compensation, which is equivalent to market/replacement value. The circle rate <strong>in</strong>dexed every two years to reflect the current or marketvalue. In addition to the LA Act (1984), the compensation <strong>for</strong> the subprojects will be determ<strong>in</strong>ed<strong>in</strong> accordance with the ADB policy on <strong>in</strong>voluntary <strong>Resettlement</strong> (1995). The RP subprojects willprovide compensation as per the follow<strong>in</strong>g:i)Compensation <strong>for</strong> land will be paid as per the circle/ replacement value;ii)Owners / beneficiaries/ tenants affected, if any, will be paid <strong>for</strong> loss of trees and crops by DCat the rate estimated by a) the Forest Department <strong>for</strong> timber trees (b) State AgriculturalExtension Department <strong>for</strong> crops and(iii) Horticulture Department <strong>for</strong> perennial trees.4. Constructions and Stakeholder ParticipationDur<strong>in</strong>g the social assessment, the consultants, assisted by the EA officials, conducted villagelevel consultative meet<strong>in</strong>gs with the affected agricultural plot owners. The policy framework andthe compensation pr<strong>in</strong>ciples def<strong>in</strong>ed earlier are based on the feedback from consultationmeet<strong>in</strong>gs. This <strong>in</strong>teractive approach and processes will cont<strong>in</strong>ue dur<strong>in</strong>g the implementation ofthe subprojects. The affected plot owners have been <strong>in</strong><strong>for</strong>med of their entitlements andbenefits and implementation schedule. For project the <strong>Short</strong> RPs shall be made available to theaffected people and NGOs/ community groups after the sanction<strong>in</strong>g of loan, if any matter of thistype comes <strong>in</strong>to light.5. Implementation Framework and Cost EastimatesMOR will be responsible <strong>for</strong> implement<strong>in</strong>g the RPs through local officials <strong>in</strong> the subproject area.A senior Rail staff at the rank of executive eng<strong>in</strong>eer will be appo<strong>in</strong>ted as the <strong>Resettlement</strong>Coord<strong>in</strong>ator <strong>for</strong> the subprojects to supervise the implementation work. Grievances RedressCommittee (GRC) will be established at the subproject level with representation from the EA,APs, local Government officials and NGOs. The <strong>Resettlement</strong>s Coord<strong>in</strong>ator will chair the GRC.Other than disputes relat<strong>in</strong>g to ownership rights under the of law, GRC will review grievances<strong>in</strong>volv<strong>in</strong>g compensation payments <strong>for</strong> land and crops/ trees. Any grievances submitted to theGRC shall be resolved with <strong>in</strong> a period of 2 to 4 weeks.The estimate budget <strong>for</strong> land compensation and implementation of he project RP is about Rs.7,88,912 which has been deposited with the State Government. The rate is based on year 2001price as per revenue records. MOR ensures that resettlements budgets are delivered on time tothe DC Office and the implant<strong>in</strong>g officers <strong>for</strong> timely RP implementation. The affected landdowners will receive compensation prior to the start of the construction work.6. Monitor<strong>in</strong>g and EvaluationDur<strong>in</strong>g project implementation, MOR will establish a monitor<strong>in</strong>g system and prepare progress
