<strong>Asylum</strong> <strong>and</strong> “<strong>Credible</strong> Fear” <strong>Issues</strong> <strong>in</strong> U.S. <strong>Immigration</strong> <strong>Policy</strong>would erode two traditional values of U.S. polity—the right to due process <strong>and</strong> freedom fromrepression <strong>and</strong> persecution. 85Some argue that the law should be amended to provide an exception for people who have beenforced by terrorists to provide support. 86 The law states that an alien who commits an act that he“knows, or reasonably should know, affords material support” to a terrorist organization is<strong>in</strong>admissible. 87 It makes no exception for <strong>in</strong>stances where the alien has been coerced <strong>in</strong>toprovid<strong>in</strong>g support, <strong>and</strong> whether it should do so is an issue. 88Conclud<strong>in</strong>g ObservationsOver the past decade, the United States has admitted or adjusted about 1 million foreign nationalsto legal permanent resident (LPR) status each year, <strong>and</strong> annual asylee adjustments have rangedfrom 1% to 9% of the total. Overall, asylee adjustments comprised only 4% (411,972) of the 10.3million LPRs admitted or adjusted from FY2000 through FY2009. 89 Unlike other facets of U.S.immigration policy, asylum issues are less about the number of foreign nationals <strong>in</strong>volved <strong>and</strong>more about the qualities of the policies <strong>and</strong> the efficacy of the procedures. <strong>Asylum</strong> is anadjudication of a person based upon facts, evidence, beliefs, <strong>and</strong> circumstances that might beclear at some times yet nebulous at other times.The policy tensions of asylum often pit the promotion of our humanitarian values aga<strong>in</strong>st theprevention of fraudulent abuses; the protection of the persecuted aga<strong>in</strong>st the security of ourborders; <strong>and</strong> the obligations of our moral responsibilities <strong>in</strong>ternationally aga<strong>in</strong>st the commitmentsof our social priorities domestically. The balance of these compet<strong>in</strong>g concerns may be shaken bya crisis <strong>in</strong> a neighbor<strong>in</strong>g nation or by larger world events.
