General Terms & Conditions1. The Company bidding for this tender should have minimum annual turnover of Rs 50lakhs, continuously for the last three years. Last three years Audited Balance Sheetmust be attached as PROOF.2. The Company should have its OWN MANUFACTURING FACILITY withPRINTING EQUIPMENTS, for which a VALID TIN number, Service TaxRegistration Number and Company’s MOA should be required as bare minimumdocuments.3. The Equipment name, on which the Collaterals will be printed, must be specified and acopy of the Invoice of the equipments MUST be attached, as a proof of the Ownershipof the equipment.4. The tender should NOT be SUB LET to any other service provider and must beexecuted at Bidder’s unit having all equipments & infrastructure owned by thecompany itself. No consortium of two or more service providers will be accepted.5. The Manufacturing Facility MUST be highly secured physically and electronically.There must be Electronic Surveillance round the clock at the Manufacturing facility. AnUndertaking by the owner of the company should be required to ascertain the abovefact.6. Bidder must have serviced or executed similar jobs for at least three state owneduniversities for which the proofs may be required for executing the REFERENCECHECK & Credibility of the company. All details are required in complete with Nameof the university / complete address and the contact details with their Landline andmobile Numbers7. The TURN AROUND TIME in the SCOPE of Work should be a strict measure withPENALTY CLAUSES to the tune of Rs 5,000 per day delay, on the part of Serviceprovider.• All of Above clauses and information provided shall be subject to a AUDIT andValidation by the UNIVERSITY at any point of time , before , during or after the tenderPROCESS, if at all any Information or feedback is found to be wrong or mala-fide, VMOPEN UNIVERSITY RESERVES the Right to REJECT the BID without assigning anyreason whatsoever and the Bidder will have No Right to Claim any damages of anyNature.Also, the Samples as per specifications are required to be Submitted in the Technical Bidwith all other technical documents, scribing the envelope clearly as Technical Bid.Financial Bid has to be submitted separately in a separate envelope. Payment will be made only after the materials have been received in the University orproviding of the Proof of Delivery (POD) in satisfactory condition and according toapproved quality/specifications/samples or testing wherever needed.11. All the payment will be subject to TDS & Taxes as per rules.12. Before finalizing the Tender the premises of the tenderer may be inspected by theTender Committee.13. Conditional tender shall not be considered. Any tender containing addition/alterationin the above terms and conditions and the specifications of items /material will alsonot be considered except where Tender Committee of the University, recommends soin the interest of University.14. The negotiations may be held to reduce the rates. Increase in the rates afternegotiations will not be entertained and in that case the rates quoted by it in originaltender will be considered. However, the decision of tender committee in such caseswould be final and binding on tenderer.15. After acceptance of tender the successful tenderer has to submit security deposit ofthe tender value @ 5 % (Rs. 50000/-) in the form of Bank draft in favour ofVardhaman Mahaveer Open University, Kota within 15 days. The Earnest Moneydeposited with the tenders shall be adjusted in the security deposit.16. After acceptance of tender the successful tenderer has to execute an agreement onnon - judicial stamp paper of Rupees 500/- with in 15 days.17. Mark-Sheets and Certificate will be supplied with the marks / data provided by theUniversity.18. Mark-sheets and Certificate will be supplied with hologram provide by the University.19. For printing of Marke Sheets and Certificates CD of marks and other information of thestudents will be provided by the University to the bidders.20. Bidder has to upload all the marks sheets and Certificate on university websitewww.umou.ac.in in PDF /Image / other (specify by the University) format as perUniversity requirement.21. Bidder has to send all prepared marks sheet and Certificates to University’s studycentres and places as per order. No extra charge will be given for dispatching the marksheets and Certificates.22. Printing of Mark sheets and Certificate may be allotted to one or more bidders.23. No outsourcing of any work or a part of the work is allowed.24. In case of any discrepancy betweenthe offer quoted in words and in figures, the offer in words will be treated as the correct offer of theTenderer.The Tenderer has to quote his offer in Annexure – I enclosed with the Financial Bid to be placed inEnvelope ‘B’.2. After acceptance of tender the Tenderer will have to submit the security deposit 5% . security deposit 5%of successful Tenderer(s) would be refunded after the completion of agreement and the satisfactoryreport from the unit. Earnest money of unsuccessful Tenderer(s) will be refunded as early as possibleafter finalization of the tender process. No interest will be paid on such amount.3. The earnest money will be forfeited if the tender is withdrawn ;(a) at any time prior to its rejection, or(b) before or after its acceptance is communicated to the Tendereer, or(c) If the successful Tender fails to execute an agreement and fails to furnish security deposit within 15days of the receipt of the letter of acceptance.4. (a) The successful Tenderer(s) shall be required to enter into an agreement on Rs. 500/- stamp paperwith the University and comply with necessary legal formalities as per the Indian Contract Act1872. The Successful Tenderer(s) will bear all legal expenses of execution of the Agreement forcontract.(b) The successful Tenderer(s) shall execute an agreement within 15 (fifteen) days from the receipt ofthe letter of acceptance of the Tender. Agreement shall not be executed without furnishing thesecurity deposit amount adjusting earnest money.(d)If the Tenderer fails to execute the agreement and fails to furnish security amount within the timementioned above, the earnest money shall be forfeited and/or the Tenderer shall be liable to bedebarred for participation in the future tendering for a period of three years.7. Failure to fulfill any of the contractual obligations and / or execution of contract after its acceptance bythe Tenderer and/or breach of any provision of the agreement by the successful Tenderer, and/orviolation of the terms and conditions of Technical and Commercial Tender Bids and/or any of the termsand conditions in the Work order may make the tenderer liable to the blacklisted.8.
