The petition for writ of habeas corpus filed in this court on June 26, 2002, is denied.<br />

Except for claim VI(B), which was resolved by a separate opinion (see In re Crew (2011) 52<br />

Cal.4th 126), each claim is denied on the merits for failure to state a prima facie case for relief.<br />

Claim VI(P), with the exception of the allegation challenging this court’s authority to request an<br />

informal response to a petition for a writ of habeas corpus, is barred as repetitive of claims<br />

presented in a prior petition. (See In re Miller (1941) 17 Cal.2d 734, 735.)<br />

Claim VI(F) is barred because, being based entirely on the facts of the appellate record, it could<br />

have been, but was not, raised on appeal. (See In re Dixon (1953) 41 Cal.2d 756, 759.)<br />

Additionally, claims VI(G) and (H) were forfeited by petitioner’s failure to raise them in the trial<br />

court. (See In re Seaton (2004) 34 Cal.4th 193, 199-200.)<br />

Justice Werdegar would deny claims VI(G) and (H) solely on the merits.<br />

The petition for writ of habeas corpus filed on September 24, 2004, is denied.<br />

Claim XVI is denied as premature, without prejudice to the filing of a renewed petition within 10<br />

days after an execution date is set.<br />

All remaining claims are denied on their merits.<br />

Except to the extent petitioner alleges his counsel rendered ineffective assistance, the following<br />

claims are also procedurally barred because they could have been raised on appeal, but were not<br />

(In re Dixon (1953) 41 Cal.2d 756, 759): VI, VII, VIII (except to the extent petitioner alleges the<br />

prosecution suppressed “the full extent of their arrangements with Dustin, the consideration given<br />

for his cooperation, and their manipulation of him so that he testified at petitioner’s preliminary<br />

hearing but not at trial” (Petn., pp. 114-116)), and XIII.<br />

The opinion in the related automatic appeal (S052520) states that petitioner Dexter Williams was<br />

found not guilty of raping Rosanna Beckham. (People v. Williams (2004) 43 Cal.4th 584, 592.)<br />

This statement is incomplete: petitioner was found guilty on count 9, but not guilty on count 8,<br />

both charging unlawful sexual intercourse by means of force and fear against Rosanna. (7 CT<br />

1843-1844.)<br />

To the extent petitioner contends his counsel rendered ineffective assistance by: (1) failing to<br />

object to the admission of Dustin’s preliminary hearing testimony on the ground that petitioner<br />

lacked an adequate opportunity to cross-examine Dustin at that hearing due the prosecution’s<br />

failure to disclose, prior to the hearing, an agreement to pay Dustin for certain living expenses as<br />

well as a secret or implied immunity agreement {petn., pp. 11-14.}; and (2) failing to request that<br />

Dustin be required to invoke his privilege against self-incrimination in front of the jury or that the<br />

jury be informed of the reason for Dustin’s absence {petn., p. 15}, the claims are also denied<br />

because they are successive: they could have been raised in petitioner’s first petition (No.<br />

S128008), but were not. (In re Clark (1993) 5 Cal.4th 750, 767-769; In re Horowitz (1949) 33<br />

Cal.2d 534, 546-547.)<br />

To the extent petitioner alleges his counsel rendered ineffective assistance by: (1) failing to object<br />

to the admission of Dustin’s preliminary hearing testimony on the ground that the prosecution or<br />

the court should have been required to offer Dustin immunity for his trial testimony, and/or failing<br />

to request immunity for Dustin {petn., p. 14}; and (2) failing to object to the admission of<br />

Dustin’s preliminary hearing testimony on the ground that the prosecution failed to establish that<br />

it had employed reasonable diligence to procure Dustin’s presence at trial within the meaning of<br />

Evidence Code section 240, subdivision (a)(5) {petn., pp. 14-15}, the claims are also denied<br />

because they were raised and rejected in petitioner’s first habeas corpus proceeding (No.<br />

S128008). (In re Miller (1941) 17 Cal.2d 734, 735.)<br />
