17.11.2007 on the above mentioned subject and to say that this Ministry has<br />

not recognized Integrated System of Medicine. Moreover, currently there is<br />

no proposal to introduce or to develop Integrated System of Medicine by the<br />

Government of India. So the question of budget allocation does not arise.<br />

Insofar as recognition of Integrated System of Medicine by the State<br />

Governments are concerned, the information may kindly be obtained from<br />

the concerned State Government.<br />

1. NAME OF ASSOCIATION-<br />

(A) <strong>AYUSH</strong> MEDICAL ASSOCIATION<br />

(B) In English <strong>AYUSH</strong> MEDICAL ASSOCIATION (will be referred to as <strong>AYUSH</strong>MA)<br />

2. REGISTERED OFFICE<br />

The Registered office of the <strong>Association</strong> shall always be in N.C.T of Delhi and<br />

presently the same is situated at Kirti Nagar, New Delhi [India]<br />

3. WORKING AREA<br />

4. OBJECTS OF THE ASSOCIATION<br />

The following will be the objects of the <strong>Association</strong> -<br />

a) Assembing the modern medicinal researches, new researches, techniques<br />

and progress in <strong>AYUSH</strong> (Astang Ayurveda, Yoga with Naturopathy, Unani<br />

Tibb and Homoeopathy) to make an effort for using for the <strong>AYUSH</strong> doctors<br />

and try legally to remove all the prohibition by using new techniques,<br />

inventiontions and restricted in the field of <strong>AYUSH</strong>. And manage of its<br />

education and higher education, educational training , researches etc. And<br />

conduct the programme for these protection, promotion and all round<br />

development through publicity and broadcasting all other essential and<br />

legally remedies.<br />

b) To make continuous efforts in maintaining the state of <strong>AYUSH</strong> (Ashtang<br />

Ayurved, Yoga with Naturopathy, Unani Tibb, Siddh, Homeopathy) intact<br />

with Government of India, provincial governments, autonomous bodies,<br />

corporations, PSUs and to make all possible efforts to ward the rights and<br />

interest of practitioners of above said medicinal system and keep them<br />

aware about their rights and duties.<br />

c) To remove the <strong>AYUSH</strong> medical system from the customory and alternative<br />

medical system and try to recognised it like other scientific medical system<br />

and national medical system as modern medical system.<br />

d) To get strictly implemented the National Policy on <strong>AYUSH</strong> and for that<br />

purpose to get appointed at least one doctor of <strong>AYUSH</strong> on every Primary<br />

Health Centre (P.H.C.) and to make efforts to get appointed the <strong>AYUSH</strong><br />

doctors on the vacant posts fell due to non-availability of the allopathic<br />

doctors as has been mentioned in Paragraph 2.1 of the National Policy of<br />

<strong>AYUSH</strong> M.A.

e) To establish National <strong>AYUSH</strong> Doctors Welfare Council (NADWC) for the<br />

doctors of <strong>AYUSH</strong> to meet their timely and/or untimely death and accidental<br />

losses to their families and for fulfillment of this object to get the aids and<br />

contribution from the Government.<br />

f) To make efforts for the appointment and employment of the <strong>AYUSH</strong> doctors<br />

in the <strong>Medical</strong> Departments of Central Government like Defence, Railway,<br />

Sports etc.<br />

g) To do all such jobs which are timely or immediately required for the<br />

development of <strong>AYUSH</strong> <strong>Medical</strong> system and for the objects mentioned<br />

above.<br />

h) To make all possible efforts for providing food, clothing, shelter,<br />

transportation, medicines and other relief requirements in the event of<br />

natural calamities and disasters like flood, fire, draught, earth-quake sunami,<br />

storm etc.<br />

i) To establish and maintain permanent and temporary <strong>AYUSH</strong> treatment<br />

Centres, camps for the treatment of the physically challenged/ disabled<br />

persons (men and women) like blind, deaf, dumb and having other physical<br />

in-capabilities.<br />

j) To help the handicapped to provide them disability certificate and organise<br />

the camps system on different places in the whole of India. In this relation<br />

and attempt for the presence of concerning local officers in the camp and<br />

simultaneously to issue the disability certificates for the present handicapts<br />

in the camp and decide it to provide them the knowledge for the facilities<br />

and other aids given by state government and cental government.<br />

k) To work for the welfare and to provide medical, psychological or any other<br />

help to the destitute women, rape victims or the women suffering from<br />

gynecological ailments.<br />

l) To make arrangement for the night stay of the <strong>AYUSH</strong> doctors in different<br />

cities and towns.<br />

m) The entire income, receipt, movable and immovable property shall be solely<br />

used and invested for the aforesaid aims and objects of the <strong>Association</strong><br />

and none of its part or benefit out of the said income shall be used by the<br />

present or previous member or any person claiming through any present<br />

and past member. No payment shall be made to any such person and he<br />

will not be a beneficiary of the same and therefore no person shall have<br />

any claim over the assets movable or immovable property of the Society<br />

on the basis of its membership nor he/she shall be able to get anything out<br />

5. Procedure to obtain the object-<br />

1) To estabished and organised the programmes in the whole of India,<br />

National, Provincial, District and city level etc. Organise committees sub<br />

mittees and trust councel for the progress of modern scientific and recent<br />

researches and techniques and progress with <strong>AYUSH</strong> in the field of medical<br />

and <strong>AYUSH</strong> MEDICAL ASSOCIATION and organissation.<br />

2) To generate, collect and publish the literature and to preserve, restore and<br />

maintain the ancient and modern books and manuscripts relating to <strong>AYUSH</strong><br />

(Ashtang Ayurved, Yoga with Naturopathy, Unani, Sidh, Homeopathy). If<br />

<strong>AYUSH</strong>MA desires to collect, publish, print and circulate booklets, magazines<br />

of such literature which are related to the medical streams of <strong>AYUSH</strong>.<br />

3) To distribute prizes, certificates and other inspiring rewards and honors to<br />

the doctors, scientists and learned persons working in the fields of <strong>AYUSH</strong><br />

(Ashtang Ayurved, Yoga with Naturopathy, Unani, Sidh, Homeopathy).<br />

4) To establish organize and maintain workshops, industries, health centers<br />

libraries, reading rooms, orchard for production of herbal medicines relating<br />

to and required by the practitioners/doctors of <strong>AYUSH</strong> (Ashtang Ayurved,<br />

Yoga and Naturopathy, Unani, Sidh, Homeopathy) and to make all efforts<br />

for their development, production, preservation, and also to maintain the<br />

museums for the doubtful, hardly available medicines, badly generated<br />

botanical products.<br />

5) To spread knowledge of all the branches of <strong>AYUSH</strong> (Ashtang Ayurved, Yoga<br />

with Naturopathy, Unani, Sidh, Homeopathy) to all walks of life and factions<br />

of society, to make them understood the benefits and characterstics of the<br />

system of treatment in all the said branches of knowledge and also to do<br />

all other such type of works.<br />

6) To hold, maintain and arrange the workshops for advertisement,<br />

renaissance and spreading the knowledge and to educate people regarding<br />

<strong>AYUSH</strong> (Ashtang Ayurved, Yoga with Naturopathy, Unani, Sidh, Homeopathy)<br />

and all its branches and to find out doctors who are able to devote for the<br />

development and strengthening programe of the said branches of<br />

knowledge.<br />

7) All the income such as donations, contribution, fee, interest etc. and the<br />

property of <strong>AYUSH</strong>MA shall be used for the objects mentioned in the<br />

Memorandum of the <strong>AYUSH</strong> <strong>Medical</strong> <strong>Association</strong>. But for the safety, security,<br />

maintain and upkeep of the movable and immovable property of <strong>AYUSH</strong><br />

<strong>Medical</strong> <strong>Association</strong> of India Trust shall be created. All movable and<br />

immovable property of AYUSMA shall remain in the name and under control<br />

<strong>AYUSH</strong> M.A.

of the ‘Trust’ and the amount of current income shall remain in a<br />

nationalized bank in the name of <strong>AYUSH</strong>MA.<br />

8) To send suggestions to the Government to make all systems of<strong>AYUSH</strong><br />

(Ashtang Ayurved, Yoga with Naturopathy, Unani, Sidh, Homeopathy) to<br />

suit within the prevailing time and the changing environments and also to<br />

prepare public renaissance and to forward the results of public opinion to<br />

the Government for necessary action.<br />

9) To get nominated the members of the <strong>Association</strong> in State Assemblies,<br />

Legislative Councils, Divisions , Legal body formed by the Ministry of Health<br />

and Family Welfare, Govt. of India, (C.C.I.M, C.C.H. etc.) in State<br />

Governments, and the Commissions/Councils formed by the State<br />

Government for strengthening the purposes of <strong>AYUSH</strong> to achieve maximum<br />

growth, development, protection and preservation of all the branches of<br />

<strong>AYUSH</strong> (Ashtang Ayurved, Yoga with Naturopathy, Unani, Sidh, Homeopathy)<br />

and to take active part in getting the members of the <strong>Association</strong> elected<br />

in the General elections.<br />

10) To run programmes for pointing out the possibilities of the amalgamation<br />

and co-ordination between the prevailing different developed,<br />

underdeveloped and developing streams of medical treatment and to invent<br />

systems and to. make efforts to present them as completely developed<br />

systems of medical treatment.<br />

11) <strong>AYUSH</strong> (Ashtang Ayurved, Yoga with Naturopathy, Unani, Sidh, Homeopathy)<br />

will make efforts for keeping the Govt. organization, semi government<br />

organisations like Central Council of Indian Medicine , Central Ayurved and<br />

Sidh Research Council, Central Homeopathy Research Council and Central<br />

Yoga and Naturopathy Research Council etc. in all branches of <strong>AYUSH</strong> active<br />

and busy in those streams for purposes for which they were formed.<br />

12) To make arrangements for the higher education and training for the<br />

development and research of <strong>AYUSH</strong> system of treatment, the work in that<br />

regard shall include to make arrangement and run short term programmes<br />

for revision of the system of treatment by <strong>AYUSH</strong>MA members, to settle<br />

syllabus for the same and to establish the educational and higher<br />

educational institutions/colleges of <strong>AYUSH</strong> in accordance with Central and<br />

State Government laws.<br />

13) A monthly Journal shall be published to make available the knowledge and<br />

developments in the field of the <strong>AYUSH</strong> system of treatment regarding new<br />

inventions/research to the <strong>AYUSH</strong>MA members/doctors as : well as the<br />

general public. Every endeavor shall be made to publish this journal in the<br />

name of “Journal of <strong>Ayush</strong> <strong>Medical</strong> <strong>Association</strong>”.<br />

RULES AND REGULATIONS OF THE SOCIETY<br />

Section 1. (a) It shall be <strong>AYUSH</strong> MEDICAL ASSOCIATION<br />

(b) In English it shall be referred to as <strong>AYUSH</strong> MEDICAL<br />

ASSOCIATION and in short it shall be called as <strong>AYUSH</strong><br />

M.A.<br />

The Registered office of the <strong>Association</strong> shall always be<br />

in National Capital Territory of Delhi and presently the<br />

same is situated at Kirti Nagar, New Delhi and its Central<br />

Administrative Office shall remain at <strong>AYUSH</strong> <strong>Medical</strong><br />

<strong>Association</strong>, PO Pangara, Banda-210129 U.P.<br />

All over India.<br />

DEFINITIONS<br />

Section 2. (a) <strong>Association</strong> shall mean <strong>Ayush</strong> <strong>Medical</strong> <strong>Association</strong>,<br />

which in short shall be referred to as (<strong>AYUSH</strong>MA),<br />

and it will have a logo.<br />

(b) In this Code and <strong>Constitution</strong> the word <strong>AYUSH</strong> shall<br />

have the same meaning as the President of India<br />

Dr. A.P.J.Abdul Kalam has meant in the year 2003 in<br />

First Schedule of Government of India (Allocation<br />

of Business Rules 1961 and in Second Schedule<br />

under the “Ministry of Health & Family Welfare”<br />

sin No. C) in place of ‘The Indian System of Medicine<br />

and Homeopathy Department’ the Ayurved,<br />

Naturopathy with Yoga, Unani, Sidh and Homeopath<br />

Department has been established i.e. in the word<br />

<strong>AYUSH</strong> Ayurved, Naturopathy with Yoga, Unani, Sidh<br />

and Homeopathic system of treatment and their<br />

practitioners with whatever name they are<br />

referred/called, shall be included.<br />

(c) The Central Council means the Central Managing<br />

Committee of <strong>AYUSH</strong>MA, which in English shall be<br />

referred to as Central Council.<br />

(d) The State Council means the State Managing<br />

Committee of <strong>AYUSH</strong>MA, which in English shall be<br />

<strong>AYUSH</strong> M.A.<br />

referred to as State Council.<br />

(e) The District Branch means the Managing<br />

Committee of the District, which shall be referred<br />

as District Branch in english.<br />

(f) The organ means the State councils, District<br />

branches and all organized committees, trust,<br />

councils, departments and the organizers appointed<br />

for the any purpose of <strong>AYUSH</strong> M.A.<br />

Section 3. All the committees formed in each one of the States of<br />

India, the branches established in Union Territories, which<br />

are referred to as State Councils in the following, on the<br />

same pattern the committees formed in Towns, Tehsils,<br />

Divisions etc. and the branches established in them<br />

according to the needs shall be referred in the same way.<br />

All these branches are the organs of <strong>AYUSH</strong> M.A. and the<br />

Central Council shall have the over all control on them.<br />

Section 4. Any adult person having registration as doctor under the<br />

<strong>AYUSH</strong> system established by the Department of Health<br />

and Family Welfare Department, Government of India,<br />

or any of its department, constitutional Corporations or<br />

Central <strong>Medical</strong> Councils or the recognized State <strong>Medical</strong><br />

Councils or Boards and he is accepting the Objects and<br />

programs of <strong>AYUSH</strong> M.A. shall be entitled to become a<br />

Member of <strong>AYUSH</strong> M.A. by applying on a prescribed form,<br />

but such persons practicing Yoga and Naturopathy system<br />

who have been. having degree/diploma in the streams<br />

of the Institutions detailed in 2001 Edition of Indian<br />

System of Medicines & Homeopathy published by the<br />

Health and Family Welfare Ministry, Government of India.<br />

But the doctors of Yoga and naturopathy shall be accepted<br />

as members only when they submit an Affidavit in a<br />

prescribed form with their Membership form to the effect<br />

that they are working only in Yoga and naturopathy and<br />

shall continue with the same only.<br />

(a) Any persons having eligibility specified in Section 4<br />

shall be entitled to become a Life Member of <strong>AYUSH</strong><br />

M.A. by submitting a prescribed form with Rs. 501/<br />

- as Membership fee. The membership fee for Life<br />

members shall be Rs.1100/- w.e.f. 1st April, 2010<br />

in place of Rs.501/-.<br />

(b) Any persons having eligibility specified in Section 4<br />

shall be entitled to become a Patron Member of<br />

<strong>AYUSH</strong> M.A. by submitting a prescribed form in time<br />

with Rs. 2100/- or more as Membership fee.<br />

(c) Any persons having eligibility specified in Section<br />

4(a) shall be entitled to become a Patron Member<br />

of <strong>AYUSH</strong>MA by submitting a prescribed form in<br />

time with Rs.5100/- or more as Membership fee.<br />

The provision of Special Member shall be abolished<br />

w.e.f. 1st April, 2010.<br />

Note - Such Patrons and Special Members shall<br />

automatically be the members of the Permanent<br />

Committee of <strong>AYUSH</strong>MA. The rights and authorities<br />

of Permanent Committee are mentioned in Section<br />

22.<br />

According to different sections of <strong>Constitution</strong> life<br />

long guardians and special members will have right<br />

to join and franchise in the election of officer<br />

bearers of <strong>AYUSH</strong> M.A.. If he is not deprived of<br />

voting power according to any sec. of the<br />

constituion.<br />

Every member of <strong>AYUSH</strong> M.A. will have a whole<br />

right to get guardianship <strong>AYUSH</strong> M.A. Every<br />

member of <strong>AYUSH</strong> M.A. can put up no confidence<br />

proposal against any office bearer.<br />

(d) Except the persons having eligibility specified in<br />

Section 4 such doctors having been practicing in<br />

the other stream of treatment except the streams<br />

of <strong>AYUSH</strong>MA-recognized by Government of India,<br />

who are owners of manufacturing units of<br />

depositing Rs.1100/- or more by deposit of movable<br />

or immovable assets of the like amount can become<br />

Associate Members of <strong>AYUSH</strong>MA.<br />

(e) Such citizens of India who have desires to work in<br />

support of the development of the <strong>AYUSH</strong> system<br />

in support of <strong>AYUSH</strong>MA can also become members<br />

of <strong>AYUSH</strong>MA by deposit fee of Rs.101/- or the<br />

movable or immovable assets of the like or more<br />

amount by submitting a prescribed form can<br />

become Associate Member of the <strong>AYUSH</strong>MA. Such<br />

members will be referred to as <strong>AYUSH</strong> Protecting<br />

Members. Such <strong>AYUSH</strong> Protecting Members shall<br />

also be supplied copy of the Journal of <strong>AYUSH</strong>MA<br />

the Journal of <strong>AYUSH</strong> MEDICAL ASSOCIATION also<br />

for one year at subsidized rates. The only restriction<br />

on the members mentioned in Sub-Section (d) and<br />

(e) is that the said members shall not be eligible to<br />

caste their votes in elections arid shall not be the<br />

Executive Members.<br />

Exception : The doctors practicing in Naturopathy<br />

with Yoga who are not registered with any State<br />

<strong>Medical</strong> Registration Board or Council but they<br />

meet the requirements of Section 4 above will be<br />

the Associate Members and they shall be eligible<br />

to become Executive members on the posts of<br />

Naturopathy and shall also be entitled to vote.<br />

have right to take part in all movement,<br />

scientific seminar and workshop of <strong>AYUSH</strong><br />

(g) The persons having faith and belief in the objects<br />

members shall be eligible to become patron for<br />

one in Central/State/District Council, but the<br />

restriction is that such members shall not be<br />

candidates in the election of the office bearers of<br />

<strong>AYUSH</strong>MA<br />

(h) 1) All the members will be supplied the Journal<br />

of <strong>AYUSH</strong>MA "Journal of <strong>AYUSH</strong> MEDICAL<br />

ASSOCIATION (JAMA)" at subsidized price.<br />

Every member shall be necessarily the<br />

subscriber of such journal for ever or annual.<br />

2) If any person changes his State, he shall have<br />

to deposit the contribution of the State and<br />

District and if he changes only the district, the<br />

district contribution<br />

Section 6. (a) Any person can apply for membership in any<br />

category on the prescribed form of the <strong>Association</strong><br />

and with the prescribed fee remitted to the Central<br />

Council. Central Council of <strong>AYUSH</strong>MA shall accept<br />

such applications and shall send the contribution<br />

of the State, Division, District etc- to them and shall<br />

issued the certificate of membership.<br />

(b) If Life members want to elevate their membership,<br />

they can deposit the difference of present<br />

membership fee and the deposited membership fee<br />

and thus they can be elevated. Such fee shall be<br />

directly deposited with the Central Council of<br />

by the District/City and rest of the amount 55% shall<br />

be the share of the Centre. If the fee from the<br />

member <strong>AYUSH</strong> Raxak Member is received Rs. 200/<br />

- more than in that also the share of the District<br />

But till the date the District Branch and the City<br />

Branch is formed and the Bank account is opened<br />

the shares of the District and State shall remain<br />

iniaci with ihe Central Council.<br />

b) The branches of District, Division and State acting<br />

in accordance with the decisions taken in their<br />

meetings, by implementing he annual/monthly<br />

contributions may be able to increase their District.<br />

Section 8. The membership of the members can be ended on finding<br />

any of the reasons mentioned below :a)<br />

On sudden death of a member.<br />

b) On becoming mad or insolvent<br />

c) On Non-payment of membership fee<br />

d) On tendering resignation to the Central Council<br />

e) On acting against the interest of the Organization<br />

and <strong>Constitution</strong> and also on indisciplinary acts.<br />

f) On being punished by the court of any law for any<br />

act of moral turpitude, after serving the member a<br />

notice of one month and on explanation of the<br />

member and on hearing him the Central Council/<br />

Committee shall expel him from the membership.<br />

g) In such an event the Managing Committee of<br />

<strong>AYUSH</strong>MA, after conducting inquiry can pass<br />

resolution to expel a member for a limited period<br />

or for ever. The person so expelled shall be loosing<br />

all his rights of membership.<br />

h) Any member who will file suit before the Court<br />

against the <strong>Association</strong>, its Committee/subcommittee<br />

and their office bearers without<br />

presenting his case before the Central Council of<br />

“<strong>AYUSH</strong>MA and before imparting the decision by<br />

the Central Council, the membership of such person<br />

shall be immediately automatically expelled from<br />

the <strong>AYUSH</strong>MA its committee/sub-committees.<br />

i) On expulsion of the name of the Member from the<br />

Registration on the rolls of Central Council of Indian<br />

Medicine / Central Council of Homeopathy or its<br />

State Registration Councils/Boards the membership<br />

of the said member shall be automatically ceased.<br />

j) On absence without any intimation in three<br />

consecutive meetings.<br />

Section 9. The sponsored members of <strong>AYUSH</strong>MA who are elected/<br />

nominated for the Statutory Bodies, <strong>Association</strong>s e.g.<br />

C.C.I.M., C.C.H. or State <strong>Medical</strong> Councils or Registered<br />

Divisions of <strong>AYUSH</strong> Department of the Health & Family<br />

Welfare Ministry and such persons fail to fulfill the objects<br />

of the <strong>Association</strong> and the conditions specified in Section<br />

8 are found applicable then the action for his<br />

impeachment shall be initiated and the intimation of it<br />

shall be sent to all the members of <strong>AYUSH</strong>MA either<br />

collective or individually.<br />

Section 10. For all the functions of the <strong>Association</strong> following<br />

(b) The intimation of the meetings shall be delivered<br />

through such prevalent means of information that<br />

the delivery of the intimation be confirmed.<br />

(c) All the decisions shall be deemed to have been<br />

taken on the basis of the majority of votes of the<br />

members attending the meeting.<br />

Section 13. The quorum of the general body meeting shall be 2/3 of<br />

all the members. If the quorum is not complete, the<br />

proceedings of the meeting can be postponed by one<br />

hour from the given time. After such delay the<br />

proceedings shall be initiated by the present members<br />

of the General body and the quorum shall be taken as<br />

complete.<br />

Section 14. To get elected the President, General Secretary and<br />

Treasurer of <strong>AYUSH</strong>MA , to settle the policies of <strong>AYUSH</strong>MA<br />

to amend the Rules and Regulations and to discuss the<br />

ways and means of development of <strong>AYUSH</strong> system of<br />

treatment and modes of its circulation in the country and<br />

abroad and to pass resolution on the related subjects to<br />

the same.<br />

Section 15. The persons who place played vital role in establishment<br />

of <strong>AYUSH</strong>MA shall be treated as Founder Members. Dr.<br />

Madan Gopal Vajpai Ji has been playing important role in<br />

establishing <strong>AYUSH</strong>MA he shall have the First place,<br />

therefore, he will remain the Member of the<br />

Management Committee and he shall be entitled for this<br />

honor for his whole life.<br />

11. There will be a Treasurer who will be from any<br />

stream of <strong>AYUSH</strong> system of treatment.<br />

12. One or more Correspondent/s belonging to <strong>AYUSH</strong><br />

<strong>Medical</strong> system of treatment, legal education or<br />

having interest and knowledge of <strong>AYUSH</strong> science.<br />

13. Executive member will be from each branch of<br />

<strong>AYUSH</strong> <strong>Medical</strong> sytems and thus five executive<br />

members will form the Executive Body.<br />

Section 17. (a) General meeting will be held one in six months<br />

normally but an emergent meeting can be called at<br />

any time when it is found necessary.<br />

(b) The intimation of the meeting of Managing<br />

Committee will be delivered 15 days advance and<br />

the emergent meeting can be informed two days<br />

prior to the meeting of prevalent means of<br />

intimation by which it can be assured that the<br />

intimation will be delivered.<br />

(c) The posts of President, General Secretary and<br />

Treasurer for the remaining period shall be filled<br />

by election on majority of votes by the Managing<br />

Committee in the event any of the post falls vacant.<br />

(d) The meeting of the Central council can be started<br />

with the presence of 11 members but in that the<br />

presence of three members besides the office<br />

bearers shall be essential. But if for the meeting<br />

the necessary presence is not collected after passing<br />

of half an hour from the settled time, the meeting<br />

will be postponed to be held after one hour of the<br />

fixed time again at any time and the decisions taken<br />

in such a meeting shall be binding on all.<br />

binding to give a chance to all to become the member<br />

then election will be conducted. This regulation will be<br />

again binding on all Provincial / District / City and Regional<br />

branches.<br />

Section 19. Rights and Duties of the Office bearers.<br />

(a) The Advisor will suggest ways and means for<br />

development and protection of <strong>AYUSH</strong> medical<br />

system, in the light of the objects of <strong>AYUSH</strong> M.A.<br />

(b) The Patron will provide guidance on demand by<br />

Central Council and acting in the wake of its<br />

protection and development to fulfill the objects<br />

of <strong>AYUSH</strong> M.A.<br />

(c) 1. The President will be the supreme officer.<br />

2. He will preside over the meeting of General<br />

Body, Managing Committee and Permanent<br />

Committee lie will provide assistance and<br />

suggestions in the trends of the committees<br />

of <strong>AYUSH</strong>MA and all of its departments,<br />

committees and he will give direction to<br />

in this regard the President will be authorised<br />

to dismiss the said Committee and will<br />

perform all the functions of the dismissed,<br />

organ himself with the help of Permanent<br />

Committee.<br />

But the restriction is that the dismissed organ<br />

will have to be reformed within one year of<br />

its dismissal.<br />

4. To conduct himself or get conducted through<br />

representatives the cases initiated by or<br />

against <strong>AYUSH</strong>MA the provide guidance on<br />

demand by Central Council and acting in the<br />

wake of its protection and development to<br />

fulfill the objects of <strong>AYUSH</strong>MA.<br />

5. For appropriate performance and for the<br />

purposes of the <strong>Association</strong> the President will<br />

accept the expenses from time to time as per<br />

needs and on urgent needs but for<br />

acceptance of such expenditure the President<br />

will submit the details in the next meeting of<br />

the Permanent Committee.<br />

6. To take care of the objects of the AYUSIIMA<br />

and to convert them in the form of work and<br />

to implement them.<br />

7. With the consent of the General Secretary to<br />

appoint and dismiss the employees of<br />

<strong>AYUSH</strong>MA and its concerned and give them<br />

appropriate remuneration.<br />

8. He will not spend the amount of more than<br />

R5.50,000/-of his own will. In special<br />

circumstances the additional expenditure can<br />

be made but he will get verified the detail of<br />

the expenditure before the Permanent<br />

Committee.<br />

(d) The Senior Vice President will perform all the<br />

functions and duties of the President in the absence<br />

of President and will also perform the special duties<br />

and peculiar rights entrusted to him by the<br />

for the development of his own field of treatment,<br />

to preside over such Programs in <strong>AYUSH</strong>MA which<br />

are required for the development and progress of<br />

his particular system of treatment, to prepare the<br />

mode of implementation of the development<br />

programs and to hand over the same to the<br />

President as prepared by him and to get<br />

incorporated them with the consent of the<br />

before the General Body, or Management<br />

seminar/meeting and to adopt and perform<br />

the responsibilities as may be directed by the<br />

records of the <strong>Association</strong> during this tenure<br />

as General Secretary of<strong>AYUSH</strong>MA and to<br />

allocate the work to the Additional General<br />

Secretaries.<br />

4. To inspect the work of employees of<strong>AYUSH</strong>MA<br />

and its organs.<br />

5. To call meetings of all the committees as per<br />

directions of the President.<br />

6. To control and command the income and<br />

To prepare the annual report of income and<br />

expenditure, balance sheet, and budget for<br />

next year with the assistance of the Treasurer<br />

and to produce the same for approval of the<br />

Permanent Council.<br />

(g) 1. To be responsible for the acts and duties<br />

entrusted by the General Secretary, to use the<br />

rights from time to time as delegated by him,<br />

to provide help to the General Secretary in<br />

the scries of their respective systems of<br />

treatment and in his absence to act as per<br />

the direction of the President or the General<br />

Secretary.<br />

2. To prepare and send their reports to the<br />

President of<strong>AYUSH</strong> M.A. about the Programs<br />

which are being conducted by the Vice<br />

Presidents.<br />

(h) To act as per directions of the General Secretary<br />

and to be answerable to their Vice Presidents, To<br />

work in their respective field of <strong>AYUSH</strong> for the<br />

benefit and development of the organisation.<br />

(i) 1. To do more and more organizational work for<br />

the benefit of the <strong>AYUSH</strong> system in<br />

accordance with the approved plan.<br />

2. To publish and advertise the programs,<br />

objects, policies and functions of the <strong>AYUSH</strong><br />

M.A.<br />

(j) To arrange the programs, functions, seminars etc.,<br />

of <strong>AYUSH</strong> M.A. with the consent of of the members<br />

of the Management Committee.<br />

(k) 1. To collect funds for <strong>AYUSH</strong> M.A. and issue<br />

receipts.<br />

2. To deposit the funds in the Bank A/c or in Post<br />

Office A/c. of <strong>AYUSH</strong> M.A. within 15 days from<br />

Section 20. Non confidence motion against President, General<br />

Secretary and Treasurer can be brought by any member,<br />

which will be discussed according to the time in the joint<br />

meeting of the Central Council and Permanent Committee<br />

which will be passed by 3/4 majority of members.<br />

Section 21. The member who wants to resign will have to address his<br />

resignation to the National President and the National<br />

President taken any action conserved the central council<br />

action shall be taken.<br />

Section 22. (a) For the fulfillment of the objects, for the review<br />

and examination of the programs conducted in a<br />

year a Committee of national level will be formed<br />

which will be referred to as “Permanent<br />

4. To make suggestion to the Central Council<br />

with regard to the Objectives of <strong>AYUSH</strong> M.A.<br />

(c) With the permission, of the President the meeting<br />

shall be called at any time by the General Secretary<br />

with 15 days prior notice.<br />

Section 23. 1. There will be a legal cell in <strong>AYUSH</strong> M.A.<br />

(a) 1. The legal cell will be constituted by such law<br />

graduate members who will be registered<br />

under Advocates Act, 1961 and the number<br />

of the members in this cell will not be less<br />

than 3 however, the number may be<br />

increased by the Permanent Committee from<br />

time to time. The President of <strong>AYUSH</strong>MA shall<br />

be its sitting Chairman and all the members<br />

will be law graduates who will be registered<br />

under Advocates Act, 1961.<br />

2. This cell will have four founder members Shri<br />

Jeewan Prakash Sharma, Sri Anant Ram<br />

Tripathi, Sri Suman Kumar Vajpayee, Sri<br />

Ramakant Garg, who will remain Life<br />

members.<br />

(b) 1. This cell will suggest measures to eradicate<br />

the legal flaws in the <strong>AYUSH</strong> systems of<br />

treatment.<br />

2. To institute suits to secure the rights of the<br />

members of <strong>AYUSH</strong> M.A. and to proceed with<br />

the cases and to continue to make the<br />

members aware of their rights.<br />

3. To approve the appointment of permanent<br />

advocates in state councils and to represent<br />

in the suits by or against <strong>AYUSH</strong> M.A. as<br />

permanent counsels.<br />

Trust will be got registered under the provisions of<br />

the Indian Trust Act. This Trust will never be<br />

dissolved. The National President and General<br />

Secretary of <strong>AYUSH</strong>MA will also be sitting members<br />

of the Trust. All the movable and immovable<br />

properties of <strong>AYUSH</strong> Academy and that of all the<br />

departments of; <strong>AYUSH</strong>MA shall remain in the<br />

name and under control of the Trust. The funds of<br />

the Trust shall remain in nationalized bank or Banks.<br />

The Trust will have the right to dismiss the Central<br />

Management Committee if it is being failed in<br />

achieving the objects of <strong>AYUSH</strong>MA or its<br />

responsibilities are not being taken seriously and<br />

will form a Committee for that purpose to perform<br />

the functions of the Management Committee. In<br />

that Committee there will at least be members from<br />

eight States. It is restriction that the said Committee<br />

will again form a management Committee with in<br />

a period of six months by way of elections according<br />

to Rules. The action against the State and District<br />

branches and office bearers will be taken by the<br />

Central Management Committee after the approval<br />

obtained from the Trust.<br />

3. There will be an All India <strong>AYUSH</strong> Academy<br />

(a) An organization shall be formed under the name<br />

All India <strong>AYUSH</strong> Academy to work under the <strong>AYUSH</strong><br />

M.A., whose office shall remain at the place decided<br />

by the <strong>Association</strong>. Its main aim would be to arrange<br />

for the education, higher education and training in<br />

all the fields of <strong>AYUSH</strong> i.e. Ashtang Ayurved, Yoga<br />

included Naturopathy, Unani, Sidh and<br />

Homeopathy. Which shall also be called All India<br />

<strong>AYUSH</strong> Academy in English.<br />

(b) Its income shall be deposited in the Account of All<br />

India <strong>AYUSH</strong> Academy in the Bank of Post Office<br />

after opening the same and its operation shall be<br />

with the joint signatures of any two of the President<br />

of All India <strong>AYUSH</strong> Academy, General Secretary and<br />

National President or the National General<br />

is collected for a particular purpose of the Academy<br />

the amount shall be spent for that purpose only<br />

but if the amount is necessarily required to be spent<br />

on any other important and special program, the<br />

said amount and assets can be used with the<br />

permission of the Permanent Council of <strong>AYUSH</strong><br />

M.A..<br />

(c) For the operations of the All India <strong>AYUSH</strong> Academy<br />

a Central Management Committee of the Academy<br />

shall be constituted in the following manner :-<br />

(1) The election of the president and General Secretary<br />

of All India <strong>AYUSH</strong> Academy shall be held in terms<br />

of the provisions Sub-section (a) of Section 15<br />

aforesaid.<br />

(2) The elected National President and General<br />

Secretary elected in the manner provided under<br />

Sec, 15(a).<br />

(3) The elected National President and General<br />

Secretary of <strong>AYUSH</strong>MA and the President and<br />

General Secretary of the Academy shall nominate<br />

5 Vice Presidents one each from the five branches<br />

of <strong>AYUSH</strong>) 5 Secretaries ( one each from the five<br />

branches of <strong>AYUSH</strong>) in the manner that at least nine<br />

States of India may be represented.<br />

(4) All the members of the Permanent Council. But the<br />

initial formation will be made by the Management<br />

Committee of <strong>AYUSH</strong> M.A. by nomination, whose<br />

tenure will be one year.<br />

(d) The main functions of the Academy shall be<br />

(1) To conduct the programs for education, higher<br />

education, training, invention, and its revision/<br />

renaissance syllabus and other syllabus etc. for<br />

modern scientific and new inventions, techniques<br />

and development of knowledge with assemble in<br />

<strong>AYUSH</strong> (Ashtang Ayurved, Yoga with Naturopalhy,<br />

Unani, Sidh and Homeopathy).<br />

(2) To get verified and certified the hospitals and<br />

products of <strong>AYUSH</strong> (Ashtang Ayurved, Yoga with<br />

Naturopathy, Tibb, Unani, Sidh and Homeopathy)<br />

for the proper treatment and to report the same<br />

to <strong>AYUSH</strong>MA and to get certificate in this regard<br />

from <strong>AYUSH</strong>MA.<br />

(3) To make special arrangements for inventions work<br />

and education, higher education in the field of<br />

<strong>AYUSH</strong> (Ashtang Ayurved, Yoga with Naturopathy,<br />

Unani, Sidh and Homeopathy).<br />

(4) To conduct the programs for the education,<br />

advertisement, circulation, protection and<br />

preservation of <strong>AYUSH</strong> system of treatment.<br />

(e) Meeting will be called as mentioned hereunder:<br />

(1) The President of the Academy and with his consent<br />

the General Secretary of the Academy shall be<br />

entitled to call the meeting of the Management<br />

Committee when they feel necessary.<br />

(2) Meeting, Resolutions and quoram will be in<br />

accordance with the Sections 12 (a)(b) and Section<br />

13.<br />

(f) Rights & Duties of office bearers of respective posts<br />

will be as under :<br />

(a)1. To inspect the works of All India <strong>AYUSH</strong><br />

Academy and to co-operate in performing all<br />

its works.<br />

2. To guide the General Secretary from time to<br />

time for the proper performance of the<br />

Academy work.<br />

3. To preside over the meeting of the<br />

Management Committee and to make<br />

possible efforts for his presence in tlie<br />

meetings.<br />

4. To allow the expenditure of the Academy for<br />

its proper functioning either normally or<br />

contingently and to get the sanction of such<br />

expenses from the Central Management<br />

Academy and to act as per the direction of<br />

with the approved budget and to watch it and<br />

simultaneously to get audited through some<br />

Auditor and to produce before the<br />

4. To make arrangements for deposit of the<br />

fands received in a nationalized Bank<br />

Section 24. (a) For fulfillment of the aims and objcts and policies<br />

timely regulation and management of the work the<br />

(b) Besides the International <strong>AYUSH</strong> Department,<br />

Education, higher education. Training Department<br />

such Committees, State councils and District<br />

Branches etc. may also be formed but for the said<br />

committees sanction from the 'Central Council' will<br />

be required.<br />

Section 25. (a) In terms of Section 3 of this <strong>Constitution</strong> to promote<br />

the <strong>AYUSH</strong> system of treatment and their<br />

practitioners from whatever name they are<br />

addressed, to obtain the objectives of the<br />

<strong>AYUSH</strong>MA in every state of the country the<br />

organization of a big magnitude shall be made the<br />

tenure of which shall be of two years which may be<br />

extended for further one year in the meeting of<br />

State General Body in special circumstances.<br />

<strong>AYUSH</strong>MA shall do it or get it done with the help of<br />

their State Councils. The work of this State<br />

organization shall be under the direct control and<br />

command of the central Council as per their<br />

approved rules and regulations from time to time.<br />

b) Like committees of <strong>AYUSH</strong>MA there will be following<br />

committees in every State.<br />

a) General body of the State<br />

b) Management Committee of the State (State<br />

Council).<br />

Section 26. The State Council of the concerned State shall be formed<br />

with all Life Members, Patrons and nominated members.<br />

Its meeting, quoram, decisions etc. shall be in the manner<br />

prescribed for the General Body meeting of <strong>AYUSH</strong>MA.<br />

Section 27. Like Central Council the office bearers of the State<br />

Management Council shall also be appointed. The state<br />

presidents/District Branch Presidents shall spend the<br />

money after making budgets. The prepared budgets shall<br />

also be required to be got approved from their<br />

Management Committee and the said budget shall have<br />

to be sent to the Central Management Committee. All<br />

the rules relating to meeting, resolutions, quoram shall<br />

be as that of the Central Council but the rights and<br />

authorities stated in Section 19(3) will be available to the<br />

President of<strong>AYUSH</strong> M.A. only.<br />

Section 28. 1. The State Council shall get approved the amount of<br />

expenditure and its heads in the meeting of the<br />

Council before spending the amount and shall send<br />

its details to the Central Management Committee.<br />

2. The State Council shall appoint a permanent<br />

advocate after the sanction from the Legal Cell, the<br />

said counsel shall act under the control of the Legal<br />

to the State Management Councils and to represent<br />

the State Management Councils in the meeting of<br />

the Central Council. The tenure of such members<br />

shall automatically come to end with the State<br />

Management Council. Binding duty of delivery of<br />

copy of resolution of meetings and also the<br />

correspondence<br />

4. Certified copy of the minutes of the meeting,<br />

resolutions, report of any function or program or<br />

correspondence held by State Council shall be<br />

necessarily sent to the office of the Central Council,<br />

failing which the programs and meeting etc. shall<br />

be deemed to be against the rules and regulations.<br />

5. In the state or District where there is no regular<br />

branch or Council of the State of District active or<br />

established, in that State of District a Committee<br />

for that purpose will be formed and the head of<br />

that Committee will be known and designated as<br />

Chief Organizer. This committee shall be vested with<br />

all rights and privileges of State Council or District<br />

Branch and this committee will also hold annual<br />

function, will conduct functions of all the works of<br />

the organization properly. The period of work of<br />

such committee will not be more than one year but<br />

the Central Council may dismiss such committee<br />

within the one year also. In that period of one year<br />

this Committee by holding campaign of making<br />

members of <strong>AYUSH</strong>MA shall form a State Council<br />

or District or City Branch as per <strong>Constitution</strong>.<br />

6. Within 15 days of formation of State Council or<br />

District Branch etc. it shall be necessary for the State<br />

President or General secretary the President of<br />

the District or City that he will send the Certified<br />

Declaration to the Central Coucil after filling the<br />

particulars on the settled proforma.<br />

Section 29. Every State <strong>AYUSH</strong> M.A. will necessarily have to send the<br />

details of its work done in the year. Bank Account No.,<br />

Name of Bank, Complete address of the Bank, Telephone<br />

No. Detail of income and expenditure, balance sheet, the<br />

list of Division, District, City, Tchsil branches in the State,<br />

Membership list, registration certificates, list of their<br />

office bearers, postal address of every office bearer before<br />

31st March every year to the Central Council. The State<br />

Council which will not send such information by 15th<br />

April, the Central Council will take all possible and<br />

expected and other steps for making it active<br />

and alive.<br />

If any Provincial, District or City Branch not submits its<br />

income and expenditure statement (balance sheet) upto<br />

15th April, then its share will not be given sec. 7.<br />

Section 30. (a) As per the provisions for the State Council of<br />

<strong>AYUSH</strong>MA the District, City, Division and Tehsil<br />

branches will be formed wherein the provisions of<br />

the State Council shall be binding. There will be<br />

office bearers of the branches and the Management<br />

Committee like it is in State Councils. The tenure of<br />

the said Management Committees shall also be for<br />

two years.<br />

(b) The State Council shall get approved the amount of<br />

expenditure and its heads from their Management<br />

Committee before spending the amount only then<br />

they will be allowed to spend the amounts and shall<br />

send its details to the Central Council.<br />

(c) The District/City Branch Management Committee<br />

shall nominate at least two persons to participate<br />

in the State Management Committee and -inform<br />

the State Council, the said members shall be called<br />

State Representatives and will participate in every<br />

meeting. The duty of the State Representatives shall<br />

to deliver the decisions taken in the meetings to<br />

the District/City Branch Management Committee<br />

and to represent the District Management<br />

Committees in the meeting of the State Council. The<br />

tenure of such members shall automatically come<br />

Exception : At least 15 <strong>AYUSH</strong> doctors can form State<br />

/ District / City /Tehsil branch for the fulfillment of<br />

the objectives of <strong>AYUSH</strong>MA starting/conducting<br />

their functions as per the <strong>Constitution</strong>.<br />

Section 31. Any member of the prevailing Council can move no<br />

confidence against State Council or District, City Branch<br />

President, General Secretary and Treasurer, decision on<br />

which shall be taken in the prevailing Council, which shall<br />

be resolved by majority of votes of General Body.<br />

If any State Council, District or city branch or any of its<br />

office bearer shall act in contravention of the objectives.<br />

Admitted policies, resolutions, program of <strong>AYUSH</strong>MA or<br />

will act against the interest of any organ of <strong>AYUSH</strong>MA or<br />

its committees or organs departments or will cause harm<br />

to them or will lake part in such programs which may cause<br />

financial loss of defamation or degradation of <strong>AYUSH</strong>MA<br />

in the eyes of public or commits breach of his timely duties<br />

then the Central Council on the approval of <strong>AYUSH</strong><br />

MEDICAL ASSOCIATION OF INDIA TRUST shall take all<br />

necessary action against such State Council, District/City<br />

Branch or its office bearers after holding inquiry and shall<br />

be empowered to dismiss the concerned State Council,<br />

District/City branch or office bearer there of or will bind<br />

him/them to act in the interest of the organization or will<br />

remove the said State Council, District/City Branch.<br />

Section 32. The place where the District/City/Division Branch hold<br />

their program of <strong>AYUSH</strong>MA and if a Member of Central,<br />

State Council or of Trust is residing within 50 Kms. radius<br />

same manner the State Council shall invite the ofice<br />

bearers of the Central Council or Trust.<br />

Section 33. 1. If in the <strong>Constitution</strong> there is no clear provision<br />

regarding any organ, department, meeting of office<br />

bearers, resolution, quoram, in that event the Rules<br />

and Sub-Rules prepared by Central Council of<br />

<strong>AYUSH</strong>MA shall be binding.<br />

2. If any dispute will arise the same shall be resolved<br />

by the General Body, the appeal against which can<br />

be filed before the <strong>AYUSH</strong> MEDICAL ASSOCIATION<br />

OF INDIA TRUST, who decision shall be final and<br />

binding.<br />

3. The Grand meet of <strong>AYUSH</strong> M.A. shall be surely held<br />

in every two years that of the State Councils shall<br />

be held every year and that of the District/City<br />

branches etc. shall be held after every six months.<br />

These grand meets shall be different from the<br />

General Body meetinsgs.<br />

Section 34. The Bank Account of <strong>AYUSH</strong> M.A. shall be opened near<br />

the office of the Central working office or in Delhi or in<br />

any nationalized bank of India or in Banks and post offices<br />

for the conduct of the functions of <strong>AYUSH</strong>MA the same<br />

shall be opened by the joint signatures of President,<br />

General Secretary and Treasurer or the same shall be<br />

signed by any two of them for operating the same,<br />

wherein the signature of the Treasurer will be necessary.<br />

In the same manner the accounts of the State Councils,<br />

District and City Branches shall be opened, but with their<br />

names the concerned State, City and District, Division<br />

Branch, will alo be surely mentioned e.g. <strong>AYUSH</strong> MEDICAL<br />

1. Election Cell<br />

For the election of office bearers of the State Council, District Branch, there will<br />

be Election Cells.<br />

(a) Election for the Central Council<br />

The Election Cell for Central Council shall be formed in the following<br />

manner:-<br />

1. All the members of Legal Cell, wherein the Chairman of the<br />

Legal Cell will be the Chairman of the Election Cell.<br />

2. Two nominated members of the Permanent Council but the<br />

restriction is that when the election of the President of the<br />

Central Council will be held the Chairman of the Legal Cell will<br />

not remain the Chairman of the Election Cell and then the<br />

Adhoc Committee formed for this purpose will appoint the<br />

Adhoc Chairman with its majority of votes.<br />

3. Permanent Election Cell will be formed for the appointment of<br />

State Council where in the Central Council will send one of its<br />

supervisor.<br />

4. Election Cell for District Branch<br />

a) President of the concerned State Council<br />

b) Two members nominated by concerned State Council.<br />

(b) Functions<br />

They will have to get conducted the elections of the President; and<br />

General Secretary and Treasurer of the District Branch and City Branch.<br />

(c) Expenses of elections<br />

The branch whose office bearers are being elected by election the<br />

said branch/council shall bear the expenses of the election.<br />

(d) Powers<br />

To maintain transparency and clarity in the elections all the,<br />

decisions shall be taken on the basis of majority of votes. If any<br />

decision cannot be taken with the majority of votes in that ;<br />

eventuality all the disputes relating to this shall be adjudicated by<br />

the Permanent Committee, appeal against which decision can be<br />

address to the <strong>AYUSH</strong> MEDICAL ASSOCIATION OF INDIA TRUST, whose<br />

(e) Control<br />

The election cell formed for the elections of the branch shall also<br />

function under the control and command of the Central Election Cell.<br />

2. GOVERNING AND ADMINISTRATIVE COMMITTEE<br />

The governing and Administrative Committee will be constituted by the following<br />

1. Senior Vice President of the concerned Council, who will be the sitting<br />

Chairman.<br />

2. Vice President of each one of stream of treatment of <strong>AYUSH</strong>.<br />

3. Three members nominated by the State and District Committee for the<br />

Permanent Committee and the Central Committee.<br />

a) Functions<br />

1. This committee shall be answerable to their respective Councils<br />

and Branch<br />

2. To send suggestions for the formation of policy from time to<br />

time to govern and administer the doctors and system of<br />

treatment of <strong>AYUSH</strong> and to interfere in the administrative and<br />

governing activities,<br />

3. All other such works which are decided by the concerned<br />

Council.<br />

b) Control<br />

Being under complete control of the Central Council this will act under<br />

the command and control of the District/ City and State Council,<br />

3. Building construction and sale and purchase Committee Department<br />

For making arrangement for the permanent offices of the State Councils, District<br />

and City offices of<strong>AYUSH</strong>MA and for establishing hospitals, Research Rooms/<br />

laboratories Reading rooms and to make buildings for that purposes the<br />

Permanent Committee will make a Building Construction Committee with the<br />

consent of the concerned organ and will decide its area of jurisdiction, rights and<br />

duties from time to time.<br />

4. Social work and Health services Department<br />

For the overall development and for the purpose of giving benefit of<strong>AYUSH</strong><br />

systems of treatment to every person Social work and Health services Department<br />

will be formed which will be constituted by the following members :-<br />

Two persons will be nominated from each of the stream of <strong>AYUSH</strong>, who<br />

will be having expcrtize in their respective fields in the eyes of such learned<br />

doctors who were distinguished and for whom the Department of Social<br />

work and Health services was formed within the Central Council, State<br />

Council, District and City Branch or in whose area of work the said social<br />

work and health services were done.<br />

One Member from the Department of Social work and Health services<br />

Department<br />

Functions 1. The function of Social work and Health services<br />

Department is to organise medical treatment camps and in<br />

those camps to provide free medical treatment or treatment<br />

on receipt of the fee settled by the Central Council. To provide<br />

medical help to the down trodden, poor and destitute men<br />

and women and to work for construction of a healthy society.<br />

2. To send details of every program to their own branch,<br />

State Council or Central council.<br />

5. Establishment, Public relation and Advertisement Department.<br />

For publication, advertisement, general awareness about the programs,<br />

objectives, policies of <strong>AYUSH</strong>MA the Establishment, Public relation and<br />

Advertisement Department will be created and the following members will<br />

constitute:<br />

1. The General Secretary of the concerned State Council, District/ City Branch<br />

shall be its sitting Chairman<br />

2. Every secretary of <strong>AYUSH</strong> system of treatment.<br />

3. A nominated member by all the Secretaries of Establishment, Public relation<br />

and Advertisement Department and Central Council.<br />

4. <strong>AYUSH</strong> Rakshak Member who are nominated.<br />

a) Control<br />

The Central Council shall have control over this department and this<br />

department will send its report to the Central Council quarterly.<br />

6. International <strong>AYUSH</strong> Department<br />

To spread acceptability and fame of <strong>AYUSH</strong> systems of treatment in the whole<br />

world with a view to spread feelings to remain healthy the International <strong>AYUSH</strong><br />

Department will be made which will consist the following members :-<br />

1. The President of the Central Council will be its sitting Chain-man<br />

2. At least 5 or maximum 25 members will be nominated by the Permanent<br />

Qualification and Disqualification of the office bearers<br />

Qualification necessary for the post of President of <strong>AYUSH</strong> M.A.<br />

1. An Indian citizen having degree from the institutions having recognition by the<br />

<strong>Medical</strong> Councils, Indian <strong>Medical</strong> Central Council, Homeopathic Central Council,<br />

and C.C.BL.Y.N and having registration or approved and Registered with<br />

Registration Divisions having five years degree or any equivalent qualification,<br />

which is admissible for M.D./M.S. examination,<br />

2. Having attained at least 25 years of age.<br />

3. Having distinguished work done in the required <strong>Medical</strong> stream.<br />

4. His nsame must have been approved by two office bearers each of at least five<br />

state councils.<br />

5. Musrhave knowledge of all the <strong>AYUSH</strong> sciences and the activities of <strong>AYUSH</strong><br />

Department<br />

6. At least Rs. 25,000/- must have contributed to <strong>AYUSH</strong> M.A. till the date of the<br />

election is declared.<br />

7. He should be eligible to vote in the election of <strong>AYUSH</strong> M.A. But the provisions<br />

sub-section of Section 5 and 7 will not be applicable for the post of President of<br />

State Councils, but for the condition mentioned in para 4 and 6 above, it is<br />

necessary that he should have approval of two each of the five District branches<br />

office bears.<br />

For me District branch etc. the requirements for the post of President, mentioned<br />

at No.1 & 3 will be sufficient.<br />

Qualification necessary for the post of Ihe General Secretary and Treasurer<br />

1. Any person can only be eligible to become General Secretary or Treasurer of<br />

<strong>AYUSH</strong>MA only when he has got registration with the Board /Council under the<br />

enactment of the Central Government or State Government in any discipline of<br />

<strong>AYUSH</strong> system of treatment.<br />

2. He should have completed the age of 25 years.<br />

3. Having general knowledge of the policies of the <strong>AYUSH</strong> Department and I all<br />

branches of <strong>AYUSH</strong> science.<br />

4. He must have eligibility to vote in the election for <strong>AYUSH</strong>MA.<br />

Qualification necessary for the other posts.<br />

Disqualification Office bearers:<br />

Holding of any post in any other medical organization by any office bearer shall<br />

organization or presenting nomination for the election the member shall have<br />

to submit a declaration to the effect that he is not a member of office bearer of<br />

any other medical organization nor shall remain so during ‘ his entire tenure.<br />

Election of General Secretary and Treasurer<br />

The election of the President, General Secretary and Treasurer will be held as<br />

per me procedure prescribed above. The elected office bearer shall form his<br />

Management Committee within fifteen days, whose office bearers shall in<br />

accordance with this eonstilution, rules and regulations.<br />

This will be the restriction that he will make his full endeavor to maintain<br />

representation of <strong>AYUSH</strong>MA, Slate <strong>AYUSH</strong>MA, all round representation of Branch<br />

<strong>Association</strong> Central area i.e. through out India.<br />

Election Process:<br />

a) The president of the Election Cell shall declare the election process :<br />

one month before the date of election for the election programs of President,<br />

General Secretary and Treasurer, mentioning the date of nomination, scrutiny of<br />

nomination documents. Withdrawal of the candidature, sending of ballot papers,<br />

the date of its return and the date of receipt back of the same clearly.<br />

b) The ballot papers will be sent to the voters containing the names of the candidates<br />

and one declaration by UPC and two envelopes (one big and one small) in a<br />

sealed envelope. The ballot paper sent by this process if received delayed or lost<br />

in transit/It shall not caste any effect on the election process and no claim of any<br />

candidate in this regard shall be entertained.<br />

c) No mark of identification , name, signature will be appended by the voter on the<br />

ballot paper. The candidate to whom he has to vote, a mark of right ( ) the ballot<br />

will be put in the small envelope and closing it firmly be sent in the big envelope<br />

with the declaration be sent back to the address mentioned in the notification<br />

on his own expenses.<br />

d) The expenses of election shall be born by the council of which the election is<br />

being conducted.<br />

e) The election of the General Secretary of the State Council, District and City<br />

Branch can be conducted by the Council by calling its General Body meeting.<br />

f) The necessary directions regarding elections will be mentioned in the nomination<br />

form and declaration form as well<br />

g) The voters will be the members under Section 5(a) and (b).<br />

Amendment of the Rules and Regulations of <strong>AYUSH</strong>MA<br />

Any amendment in the <strong>Constitution</strong>, Rules and Regulations shall be<br />

effected only in accordance with Section 12 and 12 A of Societies<br />

Registration Act in the National Capital Territory of Delhi wherein<br />

the consent of all the members of Legal Cell and 2/3 members of<br />

<strong>AYUSH</strong> MEDICAL ASSOCIATION OF INDIA TRUST will be necessary.<br />

Section 38 Dissolution of the Organization : If it is felt necessary that the<br />

organization be wound up, it will be wound up in accordance with<br />

the provisions of Section 13 and 14 of Societies Registration Act in,<br />

the National Capital Territory of Delhi.<br />

Section 39 Enforcement of the Act.<br />

All the rules, regulations and provisions of Society Registration<br />

Act, 1860 will be enforced on this Society in N.C.T. New Delhi.<br />

Section 40 Compulsory Certification<br />

It is certified the this is a true and certified copy of the Rules and<br />

Regulations of this Society.<br />
