17.11.2007 on the above mentioned subject and to say that this Ministry has 

not recognized Integrated System of Medicine. Moreover, currently there is 

no proposal to introduce or to develop Integrated System of Medicine by the 

Government of India. So the question of budget allocation does not arise. 

Insofar as recognition of Integrated System of Medicine by the State 

Governments are concerned, the information may kindly be obtained from 

the concerned State Government.

MEMORANDUM OF ASSOCIATION 

1. NAME OF ASSOCIATION- 

(A) AYUSH MEDICAL ASSOCIATION

The Registered office of the Association shall always be in N.C.T of Delhi and 

presently the same is situated at Kirti Nagar, New Delhi [India] 

3. WORKING AREA 

All over India 

4. OBJECTS OF THE ASSOCIATION 

The following will be the objects of the Association - 

a) Assembing the modern medicinal researches, new researches, techniques 

and progress in AYUSH (Astang Ayurveda, Yoga with Naturopathy, Unani 

Tibb and Homoeopathy) to make an effort for using for the AYUSH doctors 

and try legally to remove all the prohibition by using new techniques, 

inventiontions and restricted in the field of AYUSH. And manage of its 

education and higher education, educational training , researches etc. And 

conduct the programme for these protection, promotion and all round 

development through publicity and broadcasting all other essential and 

legally remedies. 

b) To make continuous efforts in maintaining the state of AYUSH (Ashtang 

Ayurved, Yoga with Naturopathy, Unani Tibb, Siddh, Homeopathy) intact 

with Government of India, provincial governments, autonomous bodies, 

corporations, PSUs and to make all possible efforts to ward the rights and 

interest of practitioners of above said medicinal system and keep them 

aware about their rights and duties. 

c) To remove the AYUSH medical system from the customory and alternative 

medical system and try to recognised it like other scientific medical system 

and national medical system as modern medical system. 

d) To get strictly implemented the National Policy on AYUSH and for that 

purpose to get appointed at least one doctor of AYUSH on every Primary 

Health Centre (P.H.C.) and to make efforts to get appointed the AYUSH 

doctors on the vacant posts fell due to non-availability of the allopathic 

doctors as has been mentioned in Paragraph 2.1 of the National Policy of

e) To establish National AYUSH Doctors Welfare Council (NADWC) for the 

doctors of AYUSH to meet their timely and/or untimely death and accidental 

losses to their families and for fulfillment of this object to get the aids and 

contribution from the Government. 

f) To make efforts for the appointment and employment of the AYUSH doctors 

in the Medical Departments of Central Government like Defence, Railway, 

Sports etc. 

g) To do all such jobs which are timely or immediately required for the 

development of AYUSH Medical system and for the objects mentioned 

above. 

h) To make all possible efforts for providing food, clothing, shelter, 

transportation, medicines and other relief requirements in the event of 

natural calamities and disasters like flood, fire, draught, earth-quake sunami, 

storm etc. 

i) To establish and maintain permanent and temporary AYUSH treatment 

Centres, camps for the treatment of the physically challenged/ disabled 

persons (men and women) like blind, deaf, dumb and having other physical 

in-capabilities. 

j) To help the handicapped to provide them disability certificate and organise 

the camps system on different places in the whole of India. In this relation 

and attempt for the presence of concerning local officers in the camp and 

simultaneously to issue the disability certificates for the present handicapts 

in the camp and decide it to provide them the knowledge for the facilities 

and other aids given by state government and cental government. 

k) To work for the welfare and to provide medical, psychological or any other 

help to the destitute women, rape victims or the women suffering from 

gynecological ailments. 

l) To make arrangement for the night stay of the AYUSH doctors in different 

cities and towns. 

m) The entire income, receipt, movable and immovable property shall be solely 

used and invested for the aforesaid aims and objects of the Association 

and none of its part or benefit out of the said income shall be used by the 

present or previous member or any person claiming through any present 

and past member. No payment shall be made to any such person and he 

will not be a beneficiary of the same and therefore no person shall have 

any claim over the assets movable or immovable property of the Society 

on the basis of its membership nor he/she shall be able to get anything out 

of the same.

5. Procedure to obtain the object- 

1) To estabished and organised the programmes in the whole of India, 

National, Provincial, District and city level etc. Organise committees sub 

mittees and trust councel for the progress of modern scientific and recent 

researches and techniques and progress with AYUSH in the field of medical 

and AYUSH MEDICAL ASSOCIATION and organissation.

2) To generate, collect and publish the literature and to preserve, restore and 

maintain the ancient and modern books and manuscripts relating to AYUSH 

(Ashtang Ayurved, Yoga with Naturopathy, Unani, Sidh, Homeopathy). If 

AYUSHMA desires to collect, publish, print and circulate booklets, magazines 

of such literature which are related to the medical streams of AYUSH. 

3) To distribute prizes, certificates and other inspiring rewards and honors to 

the doctors, scientists and learned persons working in the fields of AYUSH 

(Ashtang Ayurved, Yoga with Naturopathy, Unani, Sidh, Homeopathy). 

4) To establish organize and maintain workshops, industries, health centers 

libraries, reading rooms, orchard for production of herbal medicines relating 

to and required by the practitioners/doctors of AYUSH (Ashtang Ayurved, 

Yoga and Naturopathy, Unani, Sidh, Homeopathy) and to make all efforts 

for their development, production, preservation, and also to maintain the 

museums for the doubtful, hardly available medicines, badly generated 

botanical products. 

5) To spread knowledge of all the branches of AYUSH (Ashtang Ayurved, Yoga 

with Naturopathy, Unani, Sidh, Homeopathy) to all walks of life and factions 

of society, to make them understood the benefits and characterstics of the 

system of treatment in all the said branches of knowledge and also to do 

all other such type of works. 

6) To hold, maintain and arrange the workshops for advertisement, 

renaissance and spreading the knowledge and to educate people regarding 

AYUSH (Ashtang Ayurved, Yoga with Naturopathy, Unani, Sidh, Homeopathy) 

and all its branches and to find out doctors who are able to devote for the 

development and strengthening programe of the said branches of 

knowledge. 

7) All the income such as donations, contribution, fee, interest etc. and the 

property of AYUSHMA shall be used for the objects mentioned in the 

Memorandum of the AYUSH Medical Association. But for the safety, security, 

maintain and upkeep of the movable and immovable property of AYUSH 

Medical Association of India Trust shall be created. All movable and 

immovable property of AYUSMA shall remain in the name and under control

of the ‘Trust’ and the amount of current income shall remain in a 

nationalized bank in the name of AYUSHMA. 

8) To send suggestions to the Government to make all systems ofAYUSH 

(Ashtang Ayurved, Yoga with Naturopathy, Unani, Sidh, Homeopathy) to 

suit within the prevailing time and the changing environments and also to 

prepare public renaissance and to forward the results of public opinion to 

the Government for necessary action. 

9) To get nominated the members of the Association in State Assemblies, 

Legislative Councils, Divisions , Legal body formed by the Ministry of Health 

and Family Welfare, Govt. of India, (C.C.I.M, C.C.H. etc.) in State 

Governments, and the Commissions/Councils formed by the State 

Government for strengthening the purposes of AYUSH to achieve maximum 

growth, development, protection and preservation of all the branches of 

AYUSH (Ashtang Ayurved, Yoga with Naturopathy, Unani, Sidh, Homeopathy) 

and to take active part in getting the members of the Association elected 

in the General elections. 

10) To run programmes for pointing out the possibilities of the amalgamation 

and co-ordination between the prevailing different developed, 

underdeveloped and developing streams of medical treatment and to invent 

systems and to. make efforts to present them as completely developed 

systems of medical treatment. 

11) AYUSH (Ashtang Ayurved, Yoga with Naturopathy, Unani, Sidh, Homeopathy) 

will make efforts for keeping the Govt. organization, semi government 

organisations like Central Council of Indian Medicine , Central Ayurved and 

Sidh Research Council, Central Homeopathy Research Council and Central 

Yoga and Naturopathy Research Council etc. in all branches of AYUSH active 

and busy in those streams for purposes for which they were formed. 

12) To make arrangements for the higher education and training for the 

development and research of AYUSH system of treatment, the work in that 

regard shall include to make arrangement and run short term programmes 

for revision of the system of treatment by AYUSHMA members, to settle 

syllabus for the same and to establish the educational and higher 

educational institutions/colleges of AYUSH in accordance with Central and 

State Government laws. 

13) A monthly Journal shall be published to make available the knowledge and 

developments in the field of the AYUSH system of treatment regarding new 

inventions/research to the AYUSHMA members/doctors as : well as the 

general public. Every endeavor shall be made to publish this journal in the 

name of “Journal of Ayush Medical Association”.

RULES AND REGULATIONS OF THE SOCIETY 

Section 1. (a) It shall be AYUSH MEDICAL ASSOCIATION 

(b) In English it shall be referred to as AYUSH MEDICAL 

ASSOCIATION and in short it shall be called as AYUSH 

M.A. 

The Registered office of the Association shall always be 

in National Capital Territory of Delhi and presently the 

same is situated at Kirti Nagar, New Delhi and its Central 

Administrative Office shall remain at AYUSH Medical 

Association, PO Pangara, Banda-210129 U.P. 

All over India. 

DEFINITIONS 

Section 2. (a) Association shall mean Ayush Medical Association, 

which in short shall be referred to as (AYUSHMA), 

and it will have a logo. 

(b) In this Code and Constitution the word AYUSH shall 

have the same meaning as the President of India 

Dr. A.P.J.Abdul Kalam has meant in the year 2003 in 

First Schedule of Government of India (Allocation 

of Business Rules 1961 and in Second Schedule 

under the “Ministry of Health & Family Welfare”

and Homeopathy Department’ the Ayurved, 

Naturopathy with Yoga, Unani, Sidh and Homeopath 

Department has been established i.e. in the word 

AYUSH Ayurved, Naturopathy with Yoga, Unani, Sidh 

and Homeopathic system of treatment and their 

practitioners with whatever name they are 

referred/called, shall be included. 

(c) The Central Council means the Central Managing 

Committee of AYUSHMA, which in English shall be 

referred to as Central Council. 

(d) The State Council means the State Managing 

Committee of AYUSHMA, which in English shall be

(e) The District Branch means the Managing 

Committee of the District, which shall be referred 

as District Branch in english. 

(f) The organ means the State councils, District 

branches and all organized committees, trust, 

councils, departments and the organizers appointed 

for the any purpose of AYUSH M.A. 

Section 3. All the committees formed in each one of the States of 

India, the branches established in Union Territories, which 

are referred to as State Councils in the following, on the 

same pattern the committees formed in Towns, Tehsils, 

Divisions etc. and the branches established in them 

according to the needs shall be referred in the same way. 

All these branches are the organs of AYUSH M.A. and the 

Central Council shall have the over all control on them. 

Section 4. Any adult person having registration as doctor under the 

AYUSH system established by the Department of Health 

and Family Welfare Department, Government of India, 

or any of its department, constitutional Corporations or 

Central Medical Councils or the recognized State Medical 

Councils or Boards and he is accepting the Objects and 

programs of AYUSH M.A. shall be entitled to become a 

Member of AYUSH M.A. by applying on a prescribed form, 

but such persons practicing Yoga and Naturopathy system 

who have been. having degree/diploma in the streams 

of the Institutions detailed in 2001 Edition of Indian 

System of Medicines & Homeopathy published by the 

Health and Family Welfare Ministry, Government of India. 

But the doctors of Yoga and naturopathy shall be accepted 

as members only when they submit an Affidavit in a 

prescribed form with their Membership form to the effect 

that they are working only in Yoga and naturopathy and 

shall continue with the same only.

(a) Any persons having eligibility specified in Section 4 

shall be entitled to become a Life Member of AYUSH 

M.A. by submitting a prescribed form with Rs. 501/ 

- as Membership fee. The membership fee for Life 

members shall be Rs.1100/- w.e.f. 1st April, 2010 

in place of Rs.501/-. 

(b) Any persons having eligibility specified in Section 4 

shall be entitled to become a Patron Member of 

AYUSH M.A. by submitting a prescribed form in time 

with Rs. 2100/- or more as Membership fee. 

(c) Any persons having eligibility specified in Section 

4(a) shall be entitled to become a Patron Member 

of AYUSHMA by submitting a prescribed form in 

time with Rs.5100/- or more as Membership fee. 

The provision of Special Member shall be abolished 

w.e.f. 1st April, 2010. 

Note - Such Patrons and Special Members shall 

automatically be the members of the Permanent 

Committee of AYUSHMA. The rights and authorities 

of Permanent Committee are mentioned in Section 

22. 

According to different sections of Constitution life 

long guardians and special members will have right 

to join and franchise in the election of officer 

bearers of AYUSH M.A.. If he is not deprived of 

voting power according to any sec. of the 

constituion. 

Every member of AYUSH M.A. will have a whole 

right to get guardianship AYUSH M.A. Every 

member of AYUSH M.A. can put up no confidence 

proposal against any office bearer. 

(d) Except the persons having eligibility specified in 

Section 4 such doctors having been practicing in

depositing Rs.1100/- or more by deposit of movable 

or immovable assets of the like amount can become 

Associate Members of AYUSHMA. 

(e) Such citizens of India who have desires to work in 

support of the development of the AYUSH system 

in support of AYUSHMA can also become members 

of AYUSHMA by deposit fee of Rs.101/- or the 

movable or immovable assets of the like or more 

amount by submitting a prescribed form can 

become Associate Member of the AYUSHMA. Such 

members will be referred to as AYUSH Protecting 

Members. Such AYUSH Protecting Members shall 

also be supplied copy of the Journal of AYUSHMA 

the Journal of AYUSH MEDICAL ASSOCIATION also 

for one year at subsidized rates. The only restriction 

on the members mentioned in Sub-Section (d) and 

(e) is that the said members shall not be eligible to 

caste their votes in elections arid shall not be the 

Executive Members. 

Exception : The doctors practicing in Naturopathy 

with Yoga who are not registered with any State 

Medical Registration Board or Council but they 

meet the requirements of Section 4 above will be 

the Associate Members and they shall be eligible 

to become Executive members on the posts of 

Naturopathy and shall also be entitled to vote. 

1- Associate and AYUSH Protector member will 

have right to take part in all movement, 

scientific seminar and workshop of AYUSH 

M.A. 

2- Associate and AYUSM M.A. Protector 

member will have right to get whole cooperation 

for the success of aims of AYUSH 

M.A. 

(g) The persons having faith and belief in the objects 

of AYUSHMA and having name and fame or having 

expertise in AYUSH system, shall be able to become

President/National General Secretary and such

restriction is that such members shall not be 

candidates in the election of the office bearers of 

AYUSHMA 

(h) 1) All the members will be supplied the Journal 

of AYUSHMA "Journal of AYUSH MEDICAL 

ASSOCIATION (JAMA)" at subsidized price. 

Every member shall be necessarily the 

subscriber of such journal for ever or annual. 

2) If any person changes his State, he shall have 

to deposit the contribution of the State and 

District and if he changes only the district, the 

district contribution 

Section 6. (a) Any person can apply for membership in any 

category on the prescribed form of the Association 

and with the prescribed fee remitted to the Central 

Council. Central Council of AYUSHMA shall accept 

such applications and shall send the contribution 

of the State, Division, District etc- to them and shall 

issued the certificate of membership. 

(b) If Life members want to elevate their membership, 

they can deposit the difference of present 

membership fee and the deposited membership fee 

and thus they can be elevated. Such fee shall be 

directly deposited with the Central Council of 

AYUSHMA and it will be sent to the concerned State 

Council, or branch of District, Division etc. 

Section 7. (a) If the fee deposit AYUSH Raxak Member less than 

Rs. 200/ -, leaving it aside all the fee received from 

the members shall be shared 25% by State, and 20% 

by the District/City and rest of the amount 55% shall 

be the share of the Centre. If the fee from the 

member AYUSH Raxak Member is received Rs. 200/ 

- more than in that also the share of the District 

and the State.

But till the date the District Branch and the City 

Branch is formed and the Bank account is opened 

the shares of the District and State shall remain 

iniaci with ihe Central Council. 

b) The branches of District, Division and State acting 

in accordance with the decisions taken in their 

meetings, by implementing he annual/monthly 

contributions may be able to increase their District.

Section 8. The membership of the members can be ended on finding 

any of the reasons mentioned below :a) 

On sudden death of a member. 

b) On becoming mad or insolvent 

c) On Non-payment of membership fee 

d) On tendering resignation to the Central Council 

e) On acting against the interest of the Organization 

and Constitution and also on indisciplinary acts. 

f) On being punished by the court of any law for any 

act of moral turpitude, after serving the member a 

notice of one month and on explanation of the 

member and on hearing him the Central Council/ 

Committee shall expel him from the membership. 

g) In such an event the Managing Committee of 

AYUSHMA, after conducting inquiry can pass 

resolution to expel a member for a limited period 

or for ever. The person so expelled shall be loosing 

all his rights of membership. 

h) Any member who will file suit before the Court 

against the Association, its Committee/subcommittee 

and their office bearers without 

presenting his case before the Central Council of 

“AYUSHMA and before imparting the decision by 

the Central Council, the membership of such person 

shall be immediately automatically expelled from

the AYUSHMA its committee/sub-committees. 

i) On expulsion of the name of the Member from the 

Registration on the rolls of Central Council of Indian 

Medicine / Central Council of Homeopathy or its 

State Registration Councils/Boards the membership 

of the said member shall be automatically ceased. 

j) On absence without any intimation in three 

consecutive meetings. 

Section 9. The sponsored members of AYUSHMA who are elected/ 

nominated for the Statutory Bodies, Associations e.g. 

C.C.I.M., C.C.H. or State Medical Councils or Registered 

Divisions of AYUSH Department of the Health & Family 

Welfare Ministry and such persons fail to fulfill the objects 

of the Association and the conditions specified in Section 

8 are found applicable then the action for his 

impeachment shall be initiated and the intimation of it 

shall be sent to all the members of AYUSHMA either 

collective or individually. 

Section 10. For all the functions of the Association following 

Committees will be formed

(b) The intimation of the meetings shall be delivered 

through such prevalent means of information that 

the delivery of the intimation be confirmed. 

(c) All the decisions shall be deemed to have been 

taken on the basis of the majority of votes of the 

members attending the meeting. 

Section 13. The quorum of the general body meeting shall be 2/3 of 

all the members. If the quorum is not complete, the 

proceedings of the meeting can be postponed by one 

hour from the given time. After such delay the 

proceedings shall be initiated by the present members 

of the General body and the quorum shall be taken as 

complete. 

Section 14. To get elected the President, General Secretary and 

Treasurer of AYUSHMA , to settle the policies of AYUSHMA 

to amend the Rules and Regulations and to discuss the 

ways and means of development of AYUSH system of 

treatment and modes of its circulation in the country and 

abroad and to pass resolution on the related subjects to 

the same. 

Section 15. The persons who place played vital role in establishment 

of AYUSHMA shall be treated as Founder Members. Dr. 

Madan Gopal Vajpai Ji has been playing important role in 

establishing AYUSHMA he shall have the First place, 

therefore, he will remain the Member of the 

Management Committee and he shall be entitled for this 

honor for his whole life. 

For day to day affairs of AYUSHMA the Management

11. There will be a Treasurer who will be from any 

stream of AYUSH system of treatment. 

12. One or more Correspondent/s belonging to AYUSH 

Medical system of treatment, legal education or 

having interest and knowledge of AYUSH science. 

13. Executive member will be from each branch of 

AYUSH Medical sytems and thus five executive 

members will form the Executive Body. 

Section 17. (a) General meeting will be held one in six months 

normally but an emergent meeting can be called at 

any time when it is found necessary. 

(b) The intimation of the meeting of Managing 

Committee will be delivered 15 days advance and 

the emergent meeting can be informed two days 

prior to the meeting of prevalent means of 

intimation by which it can be assured that the 

intimation will be delivered. 

(c) The posts of President, General Secretary and 

Treasurer for the remaining period shall be filled 

by election on majority of votes by the Managing 

Committee in the event any of the post falls vacant. 

(d) The meeting of the Central council can be started 

with the presence of 11 members but in that the 

presence of three members besides the office 

bearers shall be essential. But if for the meeting 

the necessary presence is not collected after passing 

of half an hour from the settled time, the meeting 

will be postponed to be held after one hour of the 

fixed time again at any time and the decisions taken 

in such a meeting shall be binding on all.

peculiar circumstances for 1 year. 

(After the completion of tenure and before 

commencement of elections it is necessary to float an 

information to all the AYUSH Doctors / Teachers to 

become member of AYUSH M.A.. In this way it will be a 

binding to give a chance to all to become the member 

then election will be conducted. This regulation will be 

again binding on all Provincial / District / City and Regional 

branches. 

Section 19. Rights and Duties of the Office bearers. 

(a) The Advisor will suggest ways and means for 

development and protection of AYUSH medical 

system, in the light of the objects of AYUSH M.A. 

(b) The Patron will provide guidance on demand by

in this regard the President will be authorised 

to dismiss the said Committee and will 

perform all the functions of the dismissed, 

organ himself with the help of Permanent 

Committee. 

But the restriction is that the dismissed organ 

will have to be reformed within one year of 

its dismissal. 

4. To conduct himself or get conducted through 

representatives the cases initiated by or 

against AYUSHMA the provide guidance on 

demand by Central Council and acting in the 

wake of its protection and development to 

fulfill the objects of AYUSHMA. 

5. For appropriate performance and for the 

purposes of the Association the President will 

accept the expenses from time to time as per 

needs and on urgent needs but for 

acceptance of such expenditure the President 

will submit the details in the next meeting of 

the Permanent Committee. 

6. To take care of the objects of the AYUSIIMA 

and to convert them in the form of work and 

to implement them. 

7. With the consent of the General Secretary to 

appoint and dismiss the employees of 

AYUSHMA and its concerned and give them 

appropriate remuneration. 

8. He will not spend the amount of more than 

R5.50,000/-of his own will. In special 

circumstances the additional expenditure can 

be made but he will get verified the detail of 

the expenditure before the Permanent 

Committee. 

(d) The Senior Vice President will perform all the 

functions and duties of the President in the absence 

of President and will also perform the special duties 

and peculiar rights entrusted to him by the 

President.

to preside over such Programs in AYUSHMA which 

are required for the development and progress of 

his particular system of treatment, to prepare the 

mode of implementation of the development 

programs and to hand over the same to the 

President as prepared by him and to get

(f) 1. To prepare the report of different programs 

and their achievements for the development 

of AYUSHMA and to present the reports 

before the General Body, or Management 

Committee or the Permanent Committee. 

2. To write the minutes of all the AYUSHMA

seminar/meeting and to adopt and perform 

the responsibilities as may be directed by the

Section 20. Non confidence motion against President, General 

Secretary and Treasurer can be brought by any member, 

which will be discussed according to the time in the joint 

meeting of the Central Council and Permanent Committee 

which will be passed by 3/4 majority of members. 

Section 21. The member who wants to resign will have to address his 

resignation to the National President and the National 

President taken any action conserved the central council 

action shall be taken. 

Section 22. (a) For the fulfillment of the objects, for the review 

and examination of the programs conducted in a

4. To make suggestion to the Central Council 

with regard to the Objectives of AYUSH M.A. 

(c) With the permission, of the President the meeting 

shall be called at any time by the General Secretary 

with 15 days prior notice. 

Section 23. 1. There will be a legal cell in AYUSH M.A. 

(a) 1. The legal cell will be constituted by such law 

graduate members who will be registered 

under Advocates Act, 1961 and the number 

of the members in this cell will not be less 

than 3 however, the number may be 

increased by the Permanent Committee from 

time to time. The President of AYUSHMA shall 

be its sitting Chairman and all the members 

will be law graduates who will be registered 

under Advocates Act, 1961. 

2. This cell will have four founder members Shri 

Jeewan Prakash Sharma, Sri Anant Ram 

Tripathi, Sri Suman Kumar Vajpayee, Sri 

Ramakant Garg, who will remain Life 

members. 

(b) 1. This cell will suggest measures to eradicate 

the legal flaws in the AYUSH systems of 

treatment. 

2. To institute suits to secure the rights of the 

members of AYUSH M.A. and to proceed with 

the cases and to continue to make the 

members aware of their rights. 

3. To approve the appointment of permanent 

advocates in state councils and to represent 

in the suits by or against AYUSH M.A. as 

permanent counsels. 

2. A trust under the name AYUSH MEDICAL 

ASSOCIATION OF INDIA TRUST will also be 

established for the purpose of highest, control, 

maintenance, safety and upkeep of the movable 

and immovable properties of all the departments

Trust will be got registered under the provisions of 

the Indian Trust Act. This Trust will never be 

dissolved. The National President and General 

Secretary of AYUSHMA will also be sitting members 

of the Trust. All the movable and immovable 

properties of AYUSH Academy and that of all the 

departments of; AYUSHMA shall remain in the 

name and under control of the Trust. The funds of 

the Trust shall remain in nationalized bank or Banks. 

The Trust will have the right to dismiss the Central 

Management Committee if it is being failed in 

achieving the objects of AYUSHMA or its 

responsibilities are not being taken seriously and 

will form a Committee for that purpose to perform 

the functions of the Management Committee. In 

that Committee there will at least be members from 

eight States. It is restriction that the said Committee 

will again form a management Committee with in 

a period of six months by way of elections according 

to Rules. The action against the State and District 

branches and office bearers will be taken by the 

Central Management Committee after the approval 

obtained from the Trust. 

3. There will be an All India AYUSH Academy 

(a) An organization shall be formed under the name 

All India AYUSH Academy to work under the AYUSH 

M.A., whose office shall remain at the place decided 

by the Association. Its main aim would be to arrange 

for the education, higher education and training in 

all the fields of AYUSH i.e. Ashtang Ayurved, Yoga 

included Naturopathy, Unani, Sidh and 

Homeopathy. Which shall also be called All India 

AYUSH Academy in English. 

(b) Its income shall be deposited in the Account of All 

India AYUSH Academy in the Bank of Post Office 

after opening the same and its operation shall be 

with the joint signatures of any two of the President 

of All India AYUSH Academy, General Secretary and 

National President or the National General

is collected for a particular purpose of the Academy 

the amount shall be spent for that purpose only 

but if the amount is necessarily required to be spent 

on any other important and special program, the 

said amount and assets can be used with the 

permission of the Permanent Council of AYUSH 

M.A.. 

(c) For the operations of the All India AYUSH Academy 

a Central Management Committee of the Academy 

shall be constituted in the following manner :- 

(1) The election of the president and General Secretary 

of All India AYUSH Academy shall be held in terms 

of the provisions Sub-section (a) of Section 15 

aforesaid. 

(2) The elected National President and General 

Secretary elected in the manner provided under 

Sec, 15(a). 

(3) The elected National President and General 

Secretary of AYUSHMA and the President and 

General Secretary of the Academy shall nominate 

5 Vice Presidents one each from the five branches 

of AYUSH) 5 Secretaries ( one each from the five 

branches of AYUSH) in the manner that at least nine 

States of India may be represented. 

(4) All the members of the Permanent Council. But the 

initial formation will be made by the Management 

Committee of AYUSH M.A. by nomination, whose 

tenure will be one year. 

(d) The main functions of the Academy shall be 

(1) To conduct the programs for education, higher 

education, training, invention, and its revision/ 

renaissance syllabus and other syllabus etc. for 

modern scientific and new inventions, techniques 

and development of knowledge with assemble in 

AYUSH (Ashtang Ayurved, Yoga with Naturopalhy, 

Unani, Sidh and Homeopathy).

(2) To get verified and certified the hospitals and 

products of AYUSH (Ashtang Ayurved, Yoga with 

Naturopathy, Tibb, Unani, Sidh and Homeopathy) 

for the proper treatment and to report the same 

to AYUSHMA and to get certificate in this regard 

from AYUSHMA. 

(3) To make special arrangements for inventions work 

and education, higher education in the field of 

AYUSH (Ashtang Ayurved, Yoga with Naturopathy, 

Unani, Sidh and Homeopathy). 

(4) To conduct the programs for the education, 

advertisement, circulation, protection and 

preservation of AYUSH system of treatment. 

(e) Meeting will be called as mentioned hereunder: 

(1) The President of the Academy and with his consent 

the General Secretary of the Academy shall be 

entitled to call the meeting of the Management 

Committee when they feel necessary. 

(2) Meeting, Resolutions and quoram will be in 

accordance with the Sections 12 (a)(b) and Section 

13. 

(f) Rights & Duties of office bearers of respective posts 

will be as under : 

(a)1. To inspect the works of All India AYUSH 

Academy and to co-operate in performing all 

its works. 

2. To guide the General Secretary from time to 

time for the proper performance of the 

Academy work. 

3. To preside over the meeting of the 

Management Committee and to make

Section 25. (a) In terms of Section 3 of this Constitution to promote 

the AYUSH system of treatment and their 

practitioners from whatever name they are 

addressed, to obtain the objectives of the 

AYUSHMA in every state of the country the 

organization of a big magnitude shall be made the 

tenure of which shall be of two years which may be 

extended for further one year in the meeting of 

State General Body in special circumstances. 

AYUSHMA shall do it or get it done with the help of 

their State Councils. The work of this State 

organization shall be under the direct control and 

command of the central Council as per their 

approved rules and regulations from time to time.

b) Like committees of AYUSHMA there will be following 

committees in every State. 

a) General body of the State 

b) Management Committee of the State (State 

Council). 

Section 26. The State Council of the concerned State shall be formed 

with all Life Members, Patrons and nominated members. 

Its meeting, quoram, decisions etc. shall be in the manner 

prescribed for the General Body meeting of AYUSHMA. 

Section 27. Like Central Council the office bearers of the State 

Management Council shall also be appointed. The state 

presidents/District Branch Presidents shall spend the 

money after making budgets. The prepared budgets shall 

also be required to be got approved from their 

Management Committee and the said budget shall have 

to be sent to the Central Management Committee. All 

the rules relating to meeting, resolutions, quoram shall 

be as that of the Central Council but the rights and 

authorities stated in Section 19(3) will be available to the 

President ofAYUSH M.A. only. 

Section 28. 1. The State Council shall get approved the amount of 

expenditure and its heads in the meeting of the 

Council before spending the amount and shall send 

its details to the Central Management Committee. 

2. The State Council shall appoint a permanent 

advocate after the sanction from the Legal Cell, the 

said counsel shall act under the control of the Legal 

Cell and will fulfill the acts entrusted by the State 

Council, but in Uttar Pradesh the Legal Cell of AYUSH 

M.A. shall act itself. 

3. The State Management Council shall nominate at 

least two persons to participate in the Central 

Management Committee and inform the Central 

Council, the said members shall be called Central 

Representatives and will participate in each 

meeting. The duty of the Central Representatives 

shall to deliver the decisions taken in the meetings

to the State Management Councils and to represent 

the State Management Councils in the meeting of 

the Central Council. The tenure of such members 

shall automatically come to end with the State 

Management Council. Binding duty of delivery of 

copy of resolution of meetings and also the 

correspondence 

4. Certified copy of the minutes of the meeting, 

resolutions, report of any function or program or 

correspondence held by State Council shall be 

necessarily sent to the office of the Central Council, 

failing which the programs and meeting etc. shall 

be deemed to be against the rules and regulations. 

5. In the state or District where there is no regular 

branch or Council of the State of District active or 

established, in that State of District a Committee 

for that purpose will be formed and the head of 

that Committee will be known and designated as 

Chief Organizer. This committee shall be vested with 

all rights and privileges of State Council or District 

Branch and this committee will also hold annual 

function, will conduct functions of all the works of 

the organization properly. The period of work of 

such committee will not be more than one year but 

the Central Council may dismiss such committee 

within the one year also. In that period of one year 

this Committee by holding campaign of making 

members of AYUSHMA shall form a State Council 

or District or City Branch as per Constitution. 

6. Within 15 days of formation of State Council or 

District Branch etc. it shall be necessary for the State 

President or General secretary the President of 

the District or City that he will send the Certified 

Declaration to the Central Coucil after filling the 

particulars on the settled proforma.

Section 29. Every State AYUSH M.A. will necessarily have to send the 

details of its work done in the year. Bank Account No., 

Name of Bank, Complete address of the Bank, Telephone 

No. Detail of income and expenditure, balance sheet, the 

list of Division, District, City, Tchsil branches in the State, 

Membership list, registration certificates, list of their 

office bearers, postal address of every office bearer before 

31st March every year to the Central Council. The State 

Council which will not send such information by 15th 

April, the Central Council will take all possible and 

expected and other steps for making it active 

and alive. 

If any Provincial, District or City Branch not submits its 

income and expenditure statement (balance sheet) upto 

15th April, then its share will not be given sec. 7. 

Section 30. (a) As per the provisions for the State Council of 

AYUSHMA the District, City, Division and Tehsil 

branches will be formed wherein the provisions of 

the State Council shall be binding. There will be 

office bearers of the branches and the Management 

Committee like it is in State Councils. The tenure of 

the said Management Committees shall also be for 

two years. 

(b) The State Council shall get approved the amount of 

expenditure and its heads from their Management 

Committee before spending the amount only then 

they will be allowed to spend the amounts and shall 

send its details to the Central Council. 

(c) The District/City Branch Management Committee 

shall nominate at least two persons to participate 

in the State Management Committee and -inform 

the State Council, the said members shall be called 

State Representatives and will participate in every 

meeting. The duty of the State Representatives shall 

to deliver the decisions taken in the meetings to 

the District/City Branch Management Committee 

and to represent the District Management 

Committees in the meeting of the State Council. The 

tenure of such members shall automatically come 

to end with the State Council.

Exception : At least 15 AYUSH doctors can form State 

/ District / City /Tehsil branch for the fulfillment of 

the objectives of AYUSHMA starting/conducting 

their functions as per the Constitution. 

Section 31. Any member of the prevailing Council can move no 

confidence against State Council or District, City Branch 

President, General Secretary and Treasurer, decision on 

which shall be taken in the prevailing Council, which shall 

be resolved by majority of votes of General Body. 

If any State Council, District or city branch or any of its 

office bearer shall act in contravention of the objectives. 

Admitted policies, resolutions, program of AYUSHMA or 

will act against the interest of any organ of AYUSHMA or 

its committees or organs departments or will cause harm 

to them or will lake part in such programs which may cause 

financial loss of defamation or degradation of AYUSHMA 

in the eyes of public or commits breach of his timely duties 

then the Central Council on the approval of AYUSH 

MEDICAL ASSOCIATION OF INDIA TRUST shall take all 

necessary action against such State Council, District/City 

Branch or its office bearers after holding inquiry and shall 

be empowered to dismiss the concerned State Council, 

District/City branch or office bearer there of or will bind 

him/them to act in the interest of the organization or will 

remove the said State Council, District/City Branch. 

Section 32. The place where the District/City/Division Branch hold 

their program of AYUSHMA and if a Member of Central, 

State Council or of Trust is residing within 50 Kms. radius

Section 33. 1. If in the Constitution there is no clear provision 

regarding any organ, department, meeting of office 

bearers, resolution, quoram, in that event the Rules 

and Sub-Rules prepared by Central Council of 

AYUSHMA shall be binding. 

2. If any dispute will arise the same shall be resolved 

by the General Body, the appeal against which can 

be filed before the AYUSH MEDICAL ASSOCIATION 

OF INDIA TRUST, who decision shall be final and 

binding. 

3. The Grand meet of AYUSH M.A. shall be surely held 

in every two years that of the State Councils shall 

be held every year and that of the District/City 

branches etc. shall be held after every six months. 

These grand meets shall be different from the 

General Body meetinsgs. 

Section 34. The Bank Account of AYUSH M.A. shall be opened near 

the office of the Central working office or in Delhi or in 

any nationalized bank of India or in Banks and post offices 

for the conduct of the functions of AYUSHMA the same 

shall be opened by the joint signatures of President, 

General Secretary and Treasurer or the same shall be 

signed by any two of them for operating the same, 

wherein the signature of the Treasurer will be necessary. 

In the same manner the accounts of the State Councils, 

District and City Branches shall be opened, but with their 

names the concerned State, City and District, Division 

Branch, will alo be surely mentioned e.g. AYUSH MEDICAL 

ASSOCIATION MADYHYA PRADESH STATE COUNCIL OR 

AYUSH MEDICAL ASSOCIATION, DISTRICT BRANCH

Section 35. Auditing of the accounts of the AYUSH M.A. shall be got

Instructions Regarding formation of

1. Election Cell 

For the election of office bearers of the State Council, District Branch, there will 

be Election Cells.

(a) Election for the Central Council 

The Election Cell for Central Council shall be formed in the following 

manner:- 

1. All the members of Legal Cell, wherein the Chairman of the 

Legal Cell will be the Chairman of the Election Cell. 

2. Two nominated members of the Permanent Council but the 

restriction is that when the election of the President of the 

Central Council will be held the Chairman of the Legal Cell will 

not remain the Chairman of the Election Cell and then the 

Adhoc Committee formed for this purpose will appoint the 

Adhoc Chairman with its majority of votes. 

3. Permanent Election Cell will be formed for the appointment of 

State Council where in the Central Council will send one of its 

supervisor. 

4. Election Cell for District Branch 

a) President of the concerned State Council 

b) Two members nominated by concerned State Council. 

(b) Functions 

They will have to get conducted the elections of the President; and 

General Secretary and Treasurer of the District Branch and City Branch. 

(c) Expenses of elections 

The branch whose office bearers are being elected by election the 

said branch/council shall bear the expenses of the election. 

(d) Powers 

To maintain transparency and clarity in the elections all the, 

decisions shall be taken on the basis of majority of votes. If any 

decision cannot be taken with the majority of votes in that ; 

eventuality all the disputes relating to this shall be adjudicated by 

the Permanent Committee, appeal against which decision can be 

address to the AYUSH MEDICAL ASSOCIATION OF INDIA TRUST, whose 

decision will be final.

(e) Control 

The election cell formed for the elections of the branch shall also 

function under the control and command of the Central Election Cell. 

2. GOVERNING AND ADMINISTRATIVE COMMITTEE 

The governing and Administrative Committee will be constituted by the following 

members : 

1. Senior Vice President of the concerned Council, who will be the sitting 

Chairman. 

2. Vice President of each one of stream of treatment of AYUSH. 

3. Three members nominated by the State and District Committee for the 

Permanent Committee and the Central Committee. 

a) Functions 

1. This committee shall be answerable to their respective Councils 

and Branch 

2. To send suggestions for the formation of policy from time to 

time to govern and administer the doctors and system of 

treatment of AYUSH and to interfere in the administrative and 

governing activities, 

3. All other such works which are decided by the concerned 

Council. 

b) Control 

Being under complete control of the Central Council this will act under 

the command and control of the District/ City and State Council,

For making arrangement for the permanent offices of the State Councils, District 

and City offices ofAYUSHMA and for establishing hospitals, Research Rooms/ 

laboratories Reading rooms and to make buildings for that purposes the

consent of the concerned organ and will decide its area of jurisdiction, rights and 

duties from time to time. 

4. Social work and Health services Department 

For the overall development and for the purpose of giving benefit ofAYUSH 

systems of treatment to every person Social work and Health services Department 

will be formed which will be constituted by the following members :-

Two persons will be nominated from each of the stream of AYUSH, who 

will be having expcrtize in their respective fields in the eyes of such learned 

doctors who were distinguished and for whom the Department of Social 

work and Health services was formed within the Central Council, State 

Council, District and City Branch or in whose area of work the said social 

work and health services were done. 

One Member from the Department of Social work and Health services 

Department 

Functions 1. The function of Social work and Health services 

Department is to organise medical treatment camps and in 

those camps to provide free medical treatment or treatment 

on receipt of the fee settled by the Central Council. To provide 

medical help to the down trodden, poor and destitute men 

and women and to work for construction of a healthy society. 

2. To send details of every program to their own branch, 

State Council or Central council. 

5. Establishment, Public relation and Advertisement Department. 

For publication, advertisement, general awareness about the programs, 

objectives, policies of AYUSHMA the Establishment, Public relation and 

Advertisement Department will be created and the following members will 

constitute: 

1. The General Secretary of the concerned State Council, District/ City Branch 

shall be its sitting Chairman 

2. Every secretary of AYUSH system of treatment. 

3. A nominated member by all the Secretaries of Establishment, Public relation 

and Advertisement Department and Central Council. 

4. AYUSH Rakshak Member who are nominated. 

a) Control 

The Central Council shall have control over this department and this 

department will send its report to the Central Council quarterly. 

6. International AYUSH Department 

To spread acceptability and fame of AYUSH systems of treatment in the whole 

world with a view to spread feelings to remain healthy the International AYUSH 

Department will be made which will consist the following members :- 

1. The President of the Central Council will be its sitting Chain-man 

2. At least 5 or maximum 25 members will be nominated by the Permanent 

Council. 

3. Three such members who will be nominated by Central Council.

Qualification and Disqualification of the office bearers 

Qualification necessary for the post of President of AYUSH M.A. 

1. An Indian citizen having degree from the institutions having recognition by the 

Medical Councils, Indian Medical Central Council, Homeopathic Central Council, 

and C.C.BL.Y.N and having registration or approved and Registered with 

Registration Divisions having five years degree or any equivalent qualification, 

which is admissible for M.D./M.S. examination, 

2. Having attained at least 25 years of age. 

3. Having distinguished work done in the required Medical stream. 

4. His nsame must have been approved by two office bearers each of at least five 

state councils. 

5. Musrhave knowledge of all the AYUSH sciences and the activities of AYUSH 

Department 

6. At least Rs. 25,000/- must have contributed to AYUSH M.A. till the date of the 

election is declared. 

7. He should be eligible to vote in the election of AYUSH M.A. But the provisions 

sub-section of Section 5 and 7 will not be applicable for the post of President of 

State Councils, but for the condition mentioned in para 4 and 6 above, it is 

necessary that he should have approval of two each of the five District branches 

office bears. 

For me District branch etc. the requirements for the post of President, mentioned 

at No.1 & 3 will be sufficient. 

Qualification necessary for the post of Ihe General Secretary and Treasurer 

1. Any person can only be eligible to become General Secretary or Treasurer of 

AYUSHMA only when he has got registration with the Board /Council under the 

enactment of the Central Government or State Government in any discipline of 

AYUSH system of treatment. 

2. He should have completed the age of 25 years. 

3. Having general knowledge of the policies of the AYUSH Department and I all 

branches of AYUSH science. 

4. He must have eligibility to vote in the election for AYUSHMA. 

Qualification necessary for the other posts. 

He should have the eligibility to vote in the election of the President and General 

Secretary as defined in this Constitution. 

Disqualification Office bearers: 

Holding of any post in any other medical organization by any office bearer shall 

be the complete disqualification. For election of any office in the present

organization or presenting nomination for the election the member shall have 

to submit a declaration to the effect that he is not a member of office bearer of 

any other medical organization nor shall remain so during ‘ his entire tenure. 

Election of General Secretary and Treasurer 

The election of the President, General Secretary and Treasurer will be held as 

per me procedure prescribed above. The elected office bearer shall form his 

Management Committee within fifteen days, whose office bearers shall in 

accordance with this eonstilution, rules and regulations. 

This will be the restriction that he will make his full endeavor to maintain 

representation of AYUSHMA, Slate AYUSHMA, all round representation of Branch 

Association Central area i.e. through out India. 

Election Process: 

a) The president of the Election Cell shall declare the election process : 

one month before the date of election for the election programs of President, 

General Secretary and Treasurer, mentioning the date of nomination, scrutiny of 

nomination documents. Withdrawal of the candidature, sending of ballot papers, 

the date of its return and the date of receipt back of the same clearly. 

b) The ballot papers will be sent to the voters containing the names of the candidates 

and one declaration by UPC and two envelopes (one big and one small) in a 

sealed envelope. The ballot paper sent by this process if received delayed or lost 

in transit/It shall not caste any effect on the election process and no claim of any 

candidate in this regard shall be entertained. 

c) No mark of identification , name, signature will be appended by the voter on the 

ballot paper. The candidate to whom he has to vote, a mark of right ( ) the ballot 

will be put in the small envelope and closing it firmly be sent in the big envelope 

with the declaration be sent back to the address mentioned in the notification 

on his own expenses. 

d) The expenses of election shall be born by the council of which the election is 

being conducted. 

e) The election of the General Secretary of the State Council, District and City 

Branch can be conducted by the Council by calling its General Body meeting. 

f) The necessary directions regarding elections will be mentioned in the nomination 

form and declaration form as well 

g) The voters will be the members under Section 5(a) and (b).

Section 37 


Amendment of the Rules and Regulations of AYUSHMA 

Any amendment in the Constitution, Rules and Regulations shall be 

effected only in accordance with Section 12 and 12 A of Societies 

Registration Act in the National Capital Territory of Delhi wherein 

the consent of all the members of Legal Cell and 2/3 members of 

AYUSH MEDICAL ASSOCIATION OF INDIA TRUST will be necessary. 

Section 38 Dissolution of the Organization : If it is felt necessary that the 

organization be wound up, it will be wound up in accordance with 

the provisions of Section 13 and 14 of Societies Registration Act in, 

the National Capital Territory of Delhi. 

Section 39 Enforcement of the Act. 

All the rules, regulations and provisions of Society Registration 

Act, 1860 will be enforced on this Society in N.C.T. New Delhi. 

Section 40 Compulsory Certification 

It is certified the this is a true and certified copy of the Rules and 

Regulations of this Society.
