<strong>Waterfowl</strong> Research ProjectsThe VDGIF h<strong>as</strong> worked cooperatively with o<strong>the</strong>r organizationsin <strong>the</strong> Atlantic Flyway on a number of research projects thathave helped identify movements and migration routes of anumber of different waterfowl species. New technology, such<strong>as</strong> satellite telemetry, h<strong>as</strong> helped provide detailed informationon <strong>the</strong> timing of migration, specific migration routes used duringspring and fall movements, important staging or stop-over are<strong>as</strong>,and breeding are<strong>as</strong> used by birds that winter in <strong>Virginia</strong>. This work h<strong>as</strong>helped highlight <strong>the</strong> importance of high quality habitat are<strong>as</strong> alongmigration routes, and is being used to help target are<strong>as</strong> where more conservationefforts are needed. Some examples include identifying: migration routes of tundr<strong>as</strong>wans traveling from <strong>Virginia</strong> to Al<strong>as</strong>ka and <strong>the</strong> Canadian arctic, nesting are<strong>as</strong> ofAtlantic brant in <strong>the</strong> Fox B<strong>as</strong>in of <strong>the</strong> e<strong>as</strong>tern Canadian arctic, pintail staging are<strong>as</strong>along <strong>the</strong> Delaware Bay and St. Lawrence River in e<strong>as</strong>tern Canada, and <strong>the</strong> timing,duration and habitats used by black ducks migrating from wintering are<strong>as</strong> in <strong>Virginia</strong> tonesting are<strong>as</strong> in e<strong>as</strong>tern Canada. VDGIF is also cooperating in a new project along with<strong>the</strong> Sea Duck Joint Venture and several o<strong>the</strong>r state agencies, to identify sea duckmovements and migration patterns along <strong>the</strong> E<strong>as</strong>t Co<strong>as</strong>t. Hunters recovering a banded bird can keep <strong>the</strong> band, butremember to report <strong>the</strong> recovery information by ei<strong>the</strong>r calling <strong>the</strong> toll-free number1-800-327-BAND (this number is also written on <strong>the</strong> band), or reporting it online at<strong>the</strong> USGS website, www.reportband.gov. After reporting <strong>the</strong> band you can request a“Certificate of Appreciation” that includes information about where and when <strong>the</strong> birdw<strong>as</strong> banded. What Terms Do I Need toUnderstand?<strong>Migratory</strong> Birds are birds protected byfederal law <strong>as</strong> a result of treaties signed witho<strong>the</strong>r countries. Protected migratory birdsare listed in Title 50 Code of Federal Regulations,Section. 10.13. This list includes almostall birds found in <strong>the</strong> United States with <strong>the</strong>exception of <strong>the</strong> house sparrow, feral pigeon(commonly called rock dove), Europeanstarling, Eur<strong>as</strong>ian collared-dove, mute swan,and upland game birds (which are protectedby state laws).All migratory birds are protected. How -ever, a subset of migratory birds cl<strong>as</strong>sified<strong>as</strong> migratory game birds may be hunted inaccordance with state and federal regulations.The list of migratory game birdsincludes species of ducks, geese (includingbrant), swans, mergansers, doves, rails,coots, gallinules and moorhens, woodcock,and snipe.Daily bag limit means <strong>the</strong> maximumnumber of migratory game birds of a singlespecies or combination (aggregate) ofspecies permitted to be taken by one personin any one day during <strong>the</strong> open se<strong>as</strong>on in anyone specified geographic area for which adaily bag limit is prescribed.Aggregate daily bag limit means <strong>the</strong> maximumnumber of migratory game birdspermitted to be taken by one person in anyone day during <strong>the</strong> open se<strong>as</strong>on when suchperson hunts in more than one specifiedgeographic area and/or for more than onespecies for which a combined daily bag limitis prescribed. The aggregate daily bag limit isequal to, but shall not exceed, <strong>the</strong> largestdaily bag limit prescribed for any one speciesor for any one specified geographic area inwhich taking occurs.Possession limit means <strong>the</strong> maximumnumber of migratory game birds of a singlespecies or a combination of species permittedto be possessed by any one person whenlawfully taken in <strong>the</strong> United States in any onespecified geographic area for which a possessionlimit is prescribed.Aggregate possession limit means <strong>the</strong>maximum number of migratory game birdsof a single species or combination of speciestaken in <strong>the</strong> United States permitted to bepossessed by any one person when takingand possession occurs in more than onespecified geographic area for which apossession limit is prescribed. The aggregatepossession limit is equal to, but shall notexceed, <strong>the</strong> largest possession limit prescribedfor any one of <strong>the</strong> species or specifiedgeographic are<strong>as</strong> in which taking and possessionoccurs.Personal abode means one’s principal orordinary home or dwelling place, <strong>as</strong> distinguishedfrom one’s temporary or transientplace of abode or dwelling such <strong>as</strong> a huntingclub, or any club house, cabin, tent, or trailerhouse used <strong>as</strong> a hunting club, or any hotel,motel, or rooming house used during ahunting, ple<strong>as</strong>ure, or business trip.Widgeon, illustration ©Spike Knuth16


<strong>Migratory</strong> bird preservation facility means:1. Any person who, at <strong>the</strong>ir residence orplace of business and for hire or o<strong>the</strong>rconsideration; or2. Any taxidermist, cold-storage facilityor locker plant which, for hire or o<strong>the</strong>rconsideration; or3. Any hunting club which, in <strong>the</strong> normalcourse of operation, receives, possesses,or h<strong>as</strong> in custody any migra -tory game birds belonging to ano<strong>the</strong>rperson for purposes of picking, cleaning,freezing, processing, storing, orshipment.Normal agricultural planting, harvesting, orpost-harvest manipulation means a plantingor harvesting undertaken for <strong>the</strong> purpose ofproducing and ga<strong>the</strong>ring a crop, or manipulationafter such harvest and removal of grain,that is conducted in accordance with officialrecommendations of state Extension Specialistsof <strong>the</strong> Cooperative Extension Service of<strong>the</strong> U.S. Department of Agriculture.Normal agricultural operation means a normalagricultural planting, harvesting, postharvestmanipulation, or agricultural practicethat is conducted in accordance with officialrecommendations of state Extension Specialistsof <strong>the</strong> Cooperative Extension Service of<strong>the</strong> U.S. Department of Agriculture.Normal soil stabilization practice means aplanting for agricultural soil erosion controlor post-mining land reclamation conductedin accordance with official recommendationsof state Extension Specialists of <strong>the</strong> CooperativeExtension Service of <strong>the</strong> U.S. Departmentof Agriculture for agricultural soil erosioncontrol.Baited area means any area on which salt,grain, or o<strong>the</strong>r feed h<strong>as</strong> been placed,exposed, deposited, distributed, or scattered,if that salt, grain, or o<strong>the</strong>r feed couldserve <strong>as</strong> a lure or attraction for migratorygame birds to, on, or over are<strong>as</strong> wherehunters are attempting to take <strong>the</strong>m. Anysuch area will remain a baited area for tendays following <strong>the</strong> complete removal of allsuch salt, grain, or o<strong>the</strong>r feed.Baiting means <strong>the</strong> direct or indirectplacing, exposing, depositing, distributing,or scattering of salt, grain, or o<strong>the</strong>r feedthat could serve <strong>as</strong> a lure or attraction formigratory game birds to, on, or over anyare<strong>as</strong> where hunters are attempting totake <strong>the</strong>m.Manipulation means <strong>the</strong> alteration ofnatural vegetation or agricultural crops byactivities that include but are not limitedto mowing, shredding, discing, rolling,chopping, trampling, flattening, burning,or herbicide treatments. The term mani -pulation does not include <strong>the</strong> distributing orscattering of grain, seed, or o<strong>the</strong>r feed afterremoval from or storage on <strong>the</strong> field wheregrown.Natural vegetation means any nonagricultural,native, or naturalized plantspecies that grows at a site in response toplanting or from existing seeds or o<strong>the</strong>rpropagules. The term natural vegetationdoes not include planted millet. However,planted millet that grows on its own insubsequent years after <strong>the</strong> year of plantingis considered natural vegetation.17


Lawful Hunting MethodsIt is legal to take migratory game birdsincluding waterfowl and coots, on or over<strong>the</strong> following lands or are<strong>as</strong> that are noto<strong>the</strong>rwise baited are<strong>as</strong>:• Standing crops or flooded standing crops(including aquatics);• Standing, flooded, or manipulatednatural vegetation; flooded harvestedcroplands; or lands or are<strong>as</strong> where seedsor grains have been scattered solely <strong>as</strong><strong>the</strong> result of a normal agricultural planting,harvesting, post-harvest manipulation,or normal soil stabilization practice;• From a blind or o<strong>the</strong>r place of concealmentcamouflaged with naturalvegetation;• From a blind or o<strong>the</strong>r place of concealmentcamouflaged with vegetation fromagricultural crops, <strong>as</strong> long <strong>as</strong> such camouflagingdoes not result in <strong>the</strong> exposing,depositing, distributing, or scattering ofgrain or o<strong>the</strong>r feed; or• Standing or flooded standing agriculturalcrops where grain is inadvertently scatteredsolely <strong>as</strong> a result of a hunter enteringor exiting a hunting area, placingdecoys, or retrieving downed birds.It is legal to take migratory game birds,except waterfowl and coots, on or overlands or are<strong>as</strong> that are not o<strong>the</strong>rwise baitedare<strong>as</strong>, and where grain or o<strong>the</strong>r feed h<strong>as</strong>been distributed or scattered solely <strong>as</strong> <strong>the</strong>result of manipulation of an agricul tural cropor o<strong>the</strong>r feed on <strong>the</strong> land where grown, orsolely <strong>as</strong> <strong>the</strong> result of a normal agriculturaloperation.Wanton w<strong>as</strong>te of migratory game birds: Noperson shall kill or cripple any migratorygame bird without making a re<strong>as</strong>onableeffort to retrieve <strong>the</strong> bird, and retain it in hisactual custody, at <strong>the</strong> place where taken orbetween that place and ei<strong>the</strong>r (a) his automobileor principal means of land transportation;or (b) his personal abode or temporary ortransient place of lodging; or (c) a migratorybird preservation facility; or (d) a post office;or (e) a common carrier facility.Non-toxic Shot: No person may take ducks,geese (including brant), swans, coots,mergansers, moorhens, gallinules, rails orsnipe while possessing shot (ei<strong>the</strong>r in shotshellsor <strong>as</strong> loose shot for muzzleloading)o<strong>the</strong>r than approved non-toxic shot. For alist of approved non-toxic shot, see page 5or www.fws.gov/migratorybirds/CurrentBirdissues/nontoxic.htm.Opening Day of a Se<strong>as</strong>on: No person on <strong>the</strong>opening day of <strong>the</strong> se<strong>as</strong>on shall possess anyfreshly killed migratory game birds in excessof <strong>the</strong> daily bag limit, or aggregate daily baglimit, whichever applies.Field Possession Limit: No person shall possess,have in custody, or transport more than<strong>the</strong> daily bag limit or aggregate daily bag limit,whichever applies, of migratory game birds,tagged or not tagged, at or between <strong>the</strong> placewhere taken and ei<strong>the</strong>r (a) his automobile orprincipal means of land transportation; or (b)his personal abode or temporary or transientplace of lodging; or (c) a migratory birdpreservation facility; or (d) a post office; or(e) a common carrier facility.Tagging requirement: No person shall put orleave any migratory game birds at any place(o<strong>the</strong>r than at his personal abode), or in <strong>the</strong>custody of ano<strong>the</strong>r person for picking, cleaning,processing, shipping, transportation, orstorage (including temporary storage), or for<strong>the</strong> purpose of having taxidermy servicesperformed, unless such birds have a tag attached,signed by <strong>the</strong> hunter, stating his address,<strong>the</strong> total number and species of birds,and <strong>the</strong> date such birds were killed. <strong>Migratory</strong>game birds being transported in any vehicle<strong>as</strong> <strong>the</strong> personal baggage of <strong>the</strong> possessor18


shall not be considered <strong>as</strong> being in storage ortemporary storage.Custody of birds of ano<strong>the</strong>r: No person shallreceive or have in custody any migra torygame birds belonging to ano<strong>the</strong>r personunless such birds are properly tagged.Termination of possession: Subject to allo<strong>the</strong>r requirements of this part, <strong>the</strong> possessionof birds taken by any hunter shall bedeemed to have ce<strong>as</strong>ed when such birdshave been delivered by him to ano<strong>the</strong>r person<strong>as</strong> a gift; or have been delivered by himto a post office, a common carrier, or a migratorybird preservation facility and consignedfor transport by <strong>the</strong> Postal Service or a commoncarrier to some person o<strong>the</strong>r than <strong>the</strong>hunter.Gift of migratory game birds: No person mayreceive, possess, or give to ano<strong>the</strong>r anyfreshly killed migratory game birds <strong>as</strong> a gift,except at <strong>the</strong> personal abodes of <strong>the</strong> donoror donee, unless such birds have a tag attached,signed by <strong>the</strong> hunter who took <strong>the</strong>birds, stating such hunter’s address, <strong>the</strong> totalnumber and species of birds, and <strong>the</strong> datesuch birds were taken.Transportation of birds of ano<strong>the</strong>r: Noperson shall transport migratory game birdsbelonging to ano<strong>the</strong>r person unless suchbirds are properly tagged.Species identification requirement: No personshall transport within <strong>the</strong> United Statesany migratory game birds, except doves andband-tailed pigeons, unless <strong>the</strong> head or onefully fea<strong>the</strong>red wing remains attached toeach such bird at all times while being transportedfrom <strong>the</strong> place where taken until <strong>the</strong>yhave arrived at <strong>the</strong> personal abode of <strong>the</strong>possessor or a migratory bird preservationfacility.Marking package or container: No personshall transport by <strong>the</strong> Postal Service or a commoncarrier migratory game birds unless <strong>the</strong>package or container in which such birds aretransported h<strong>as</strong> <strong>the</strong> name and address of <strong>the</strong>shipper and <strong>the</strong> consignee and an accuratestatement of <strong>the</strong> numbers of each species ofbirds <strong>the</strong>rein contained clearly and conspicuouslymarked on <strong>the</strong> outside <strong>the</strong>reof.More restrictive regulations may apply toNational Wildlife Refuges opened to publichunting. For additional information onrefuge-specific regulations seewww.fws.gov/refuges/.Unlawful HuntingMethodsNo persons shall take migratory gamebirds:• With a trap, snare, net, rifle, pistol,swivel gun, shotgun larger than 10gauge, punt gun, battery gun, machinegun, fish hook, poison, drug, explosive,or stupefying substance;• With a shotgun of any description capableof holding more than three shells,unless it is plugged with a one-piecefiller, incapable of removal withoutdis<strong>as</strong>sembling <strong>the</strong> gun, so its total capacitydoes not exceed three shells. Thisrestriction does not apply to crows andduring dates states have selected under<strong>the</strong> Conservation Order for light geese(i.e., greater and lesser snow and Ross’sgeese);• From or by means, aid, or use of <strong>as</strong>inkbox or any o<strong>the</strong>r type of low floatingdevice, having a depression affording<strong>the</strong> hunter a means of concealmentbeneath <strong>the</strong> surface of <strong>the</strong> water;• From or by means, aid, or use of anymotor vehicle, motor-driven land conveyance,or aircraft of any kind, exceptthat paraplegics and persons missingone or both legs may take from any19

Valid only in <strong>the</strong> counties of Caroline,King George, Essex, Westmoreland, andRichmond.<strong>Waterfowl</strong> Blind License: Stationary, floatingblind, and offshore blind stake licenses areavailable during <strong>the</strong> time periods listedbelow from any license agent through <strong>the</strong>Department’s point of sale system, or onlineon our website (www.HuntFishVA.com).Hunters have <strong>the</strong> option of requesting a blindplate be sent to <strong>the</strong>m if <strong>the</strong>y do not have one.The blind plate, if requested, and a decal for<strong>the</strong> plate will be mailed within 3 to 5 businessdays. Hunters who purch<strong>as</strong>e a blind licenseonline will be able to print out a copy of <strong>the</strong>irapplication information. A license for <strong>the</strong>irblind will be emailed immediately after <strong>the</strong>sale is complete. The license plate furnishedmust be affixed to <strong>the</strong> blind at a locationwhere it can be e<strong>as</strong>ily seen.Spacing of Blinds Generally: Except foradjacent landowners, licensed stationaryblinds may be placed no closer than 500yards to each o<strong>the</strong>r, except <strong>the</strong>y may beplaced closer toge<strong>the</strong>r with <strong>the</strong> mutualconsent of <strong>the</strong> licensees involved. Except forcounty exceptions, listed on page 23, floatingblinds may be positioned no closer than 500yards to any licensed stationary blind,whe<strong>the</strong>r it is occupied or not, withoutconsent of <strong>the</strong> owner of <strong>the</strong> neighboringblind. when hunting waterfowl from such a blindlocated on <strong>the</strong> riparian owner’s property.However, a stationary blind license shall berequired in order to afford <strong>the</strong> riparian owners<strong>the</strong> protections provided by <strong>Virginia</strong>law. The owner of riparian rights, his lesseeor permittee h<strong>as</strong> exclusive privileges oflicensing blinds on his shoreline and priorrights of licensing and erecting blinds in <strong>the</strong>public waters in front of such shoreline.These blinds shall not be located in waterdeeper than eight feet at mean high tide, norshall <strong>the</strong>y be far<strong>the</strong>r than halfway across <strong>the</strong>body of water from <strong>the</strong> riparian owner’sshoreline, except on <strong>the</strong> shores and watersof Back Bay in <strong>the</strong> City of <strong>Virginia</strong> Beachwhere such blinds are limited to (i) <strong>the</strong> riparianowner's shoreline at <strong>the</strong> mean low watermark or (ii) blinds erected and licensed by <strong>the</strong>riparian owner in 2011. The exercise of <strong>the</strong>seprior rights is valid when a license h<strong>as</strong> beenobtained between May 1 and June 15 anddisplayed on a stake or blind by June 30. Noo<strong>the</strong>r blind may be located within 500 yardsof this stake or blind without consent of <strong>the</strong>owner, permittee, or lessee. The stake mustbe replaced by an erected stationary blind<strong>as</strong> specified by Code by November 1 to be alicensed blind under <strong>the</strong> law. Where <strong>the</strong>lands of two property owners adjoin, eachmay place blinds on his property or in <strong>the</strong>public waters in front of his property withoutregard to <strong>the</strong> placement of blinds on hisneighbor’s property.Rights of Nonriparian Owner: Although <strong>the</strong>law states that a riparian owner who doesnot license a blind on his shore by June 30forfeits <strong>the</strong> privilege for that se<strong>as</strong>on, it doesnot mean a nonriparian owner can erect orlicense a blind on <strong>the</strong> property of ano<strong>the</strong>rwithout permission. If a landowner h<strong>as</strong> notlicensed a stake or a blind by June 30, a non -riparian owner may license a location in <strong>the</strong>public waters in front of such land, providingno o<strong>the</strong>r location within 500 yards h<strong>as</strong> beenso licensed. Again, such blind cannot belocated in water in excess of eight feet indepth at mean high tide (see exception forBack Bay in Rights of Riparian Landowner).A nonriparian license for a blind that w<strong>as</strong>licensed <strong>the</strong> previous year <strong>as</strong> a nonriparianblind can be purch<strong>as</strong>ed from July 1 throughAugust 15, and a plate with current decalmust be affixed to a stake or blind by August31. A nonriparian license for a blind or blindsite not previously licensed <strong>the</strong> year beforecan be purch<strong>as</strong>ed from September 1 throughOctober 15, and a plate and current decalmust be affixed to it by November 1.Of course, if a location is secured throughagreement with a riparian landowner havingcontrol of <strong>the</strong> near shoreline, <strong>the</strong> site may belicensed <strong>as</strong> applies to a permittee or lessee ofa land owner. A nonriparian owner, havinglicensed a blind in a given location, h<strong>as</strong> firstoption to license such blind each year unless<strong>the</strong> riparian landowner having claim to thatlocation exercises his right to license it.Riparian Owner’s Rights RenewedAnnually: If a riparian owner fails to exercisehis options, he may elect to do so <strong>the</strong> followingyear, thus preempting any rights of non -riparian owners who have erected blinds in<strong>the</strong> public waters in front of his shoreline.Blue-winged teal, illustration ©Spike Knuth22


Penalty for Violations: Any person whohunts or shoots migratory waterfowl in <strong>the</strong>public waters of this Commonwealth froma boat, float, raft or o<strong>the</strong>r buoyant craft ordevice within 500 yards of any legallylicensed erected stationary blind of ano<strong>the</strong>rwithout <strong>the</strong> consent of <strong>the</strong> licensee shall beguilty of a criminal offense that is punishable<strong>as</strong> a Cl<strong>as</strong>s 2 misdemeanor. This provisionshall not apply to any person when in activepursuit of a visible crippled waterfowl whichw<strong>as</strong> legally shot by <strong>the</strong> person.Additionally, any person who erects <strong>as</strong>tationary blind within 500 yards of ano<strong>the</strong>rlicensed blind without permission of <strong>the</strong>licensee is guilty of a tresp<strong>as</strong>s, and <strong>the</strong> ownerof <strong>the</strong> blind so encroached upon may maintainan action for damages. It should benoted that this is a criminal offense. It shouldalso be noted that by November 1 a stationaryblind must be erected; <strong>the</strong>refore, a stakewith a stationary license affixed <strong>the</strong>retocannot be considered to be a stationary blindafter November 1.Loss of Blind License: The violation of any of<strong>the</strong> provisions of law or regulations <strong>as</strong> tohunting migratory waterfowl from licensedblinds shall constitute a Cl<strong>as</strong>s 2 misdemeanorand, in addition to o<strong>the</strong>r authorized penalties,<strong>the</strong> trial court shall immediately revoke<strong>the</strong> license of <strong>the</strong> blind owner who will have<strong>the</strong> same privileges <strong>as</strong> a new applicant toapply for a blind license <strong>the</strong> following year.Any blind for which <strong>the</strong> license h<strong>as</strong> beenrevoked shall be destroyed by <strong>the</strong> formerlicensee or a conservation police officer.Accidental Destruction of Blind: If a blind isdestroyed in any manner beyond <strong>the</strong> controlof <strong>the</strong> owner, it may be replaced within 30days without losing <strong>the</strong> position it formerlyoccupied.Number of Stationary Blinds Permitted:Clubs or individuals who do not own riparianrights shall be permitted to license no morethan two stationary blinds in <strong>the</strong> publicwaters in any one se<strong>as</strong>on.Floating Blinds, Where Prohibited: The useof floating blinds is prohibited in <strong>the</strong> countiesof Caroline, King George, Essex, Westmoreland,and Richmond in any of <strong>the</strong> publicmarshes, guts, streams, branches, creeks, orbays, including among o<strong>the</strong>rs, Green Bay andPort Tobago Bay, flowing into <strong>the</strong> RappahannockRiver or in any of its tributaries, or inBuckner’s Creek, Nomini Creek and NominiBay, flowing into <strong>the</strong> Potomac River or anyof its tributaries, except from a licensedOffshore Blind Stake Site. (See below fordetails.)Offshore Blind Stake Sites: Offshore blindstakes shall be removed from <strong>the</strong> publicwaters within 15 days of <strong>the</strong> close of <strong>the</strong>waterfowl se<strong>as</strong>on.Nonriparian Owner:A nonriparian owner who h<strong>as</strong> not alreadylicensed and erected a stationary blindfor <strong>the</strong> year in <strong>the</strong> 5-county area identifiedabove and who holds a valid huntinglicense, may apply for a license for offshoreblind stake sites. The license for anoffshore blind stake site may be obtainedfrom November 1 through November 10of each year. Up to 4 offshore blind stakesite licenses may be purch<strong>as</strong>ed per licensee.Once obtained, a stake shall be erectedon <strong>the</strong> site and a license plate suppliedwith <strong>the</strong> license for that se<strong>as</strong>on shall beaffixed <strong>the</strong>reto by November 10.Riparian Owner:From November 11 through November15 of each year, any riparian ownerand any o<strong>the</strong>r person who h<strong>as</strong> alreadylicensed and erected a stationary blindfor <strong>the</strong> year in <strong>the</strong> are<strong>as</strong> noted above,and who holds a valid hunting license,may apply for a license for any remainingoffshore blind stake sites. Up to 4 off-23


shore blind stake site licenses may bepurch<strong>as</strong>ed per licensee. Once obtained,a stake shall be erected on <strong>the</strong> site, and alicense plate supplied with <strong>the</strong> license forthat se<strong>as</strong>on shall be affixed <strong>the</strong>reto byNovember 15.Placement of Blinds in Fairfax, PrinceWilliam, and Stafford Counties: No stationaryblind shall be more than 300 yards fromshore, except in waters less than 600 yardswide, in which c<strong>as</strong>e <strong>the</strong> blind may be nomore than half <strong>the</strong> width of <strong>the</strong> water fromshore. This distance is me<strong>as</strong>ured from <strong>the</strong>low water mark.No license shall be issued for stationarywaterfowl blinds on <strong>the</strong> Potomac River inFairfax County adjacent to National ParkService lands in <strong>the</strong> Great Hunting Creek andDyke Marsh are<strong>as</strong>.Floating Blinds in Fairfax, Prince William,and Stafford Counties: Floating blinds mustbe anchored and located no closer to ano<strong>the</strong>r’sblind than 400 yards unless person h<strong>as</strong>written permission of blind owner. Suchblinds must be taken in at a half hour aftersunset.In <strong>the</strong> area adjacent to <strong>the</strong> National ParkService lands in <strong>the</strong> Great Hunting Creek andDyke Marsh are<strong>as</strong> floating blinds must be attachedto a Game Department-placed postor buoy. Only one floating blind per post.These are on a first-come, first-served b<strong>as</strong>is,sites to be occupied no earlier than 4:00 A.M.or later than one half hour after sunset, andblinds removed each day. Hunters in licensedfloating blinds can hunt from designatedlocations during legal shooting hours onThanksgiving Day and on Mondays, Wednesdays,and Fridays during <strong>the</strong> open se<strong>as</strong>on.Placement of Blinds Adjacent to CertainWildlife Management Are<strong>as</strong>: No stationaryblinds shall be licensed in <strong>the</strong> waters adjacentto <strong>the</strong> Chickahominy Wildlife ManagementArea (WMA) in Charles City County,<strong>the</strong> Game Farm Marsh WMA in New KentCounty, and <strong>the</strong> Ragged Island WMA in Isleof Wight County.Occupied or Unoccupied Blinds: No personshall hunt or shoot migratory waterfowl in<strong>the</strong> public waters of this Commonwealthfrom a boat, float, raft or o<strong>the</strong>r buoyant craftor device within 500 yards of any legallylicensed erected stationary blind of ano<strong>the</strong>r,whe<strong>the</strong>r occupied or not, without <strong>the</strong>consent of <strong>the</strong> licensee, except when inactive pursuit of a visible crippled waterfowlwhich w<strong>as</strong> legally shot by <strong>the</strong> person.Crippled <strong>Waterfowl</strong>: When in activepursuit of a visible waterfowl which w<strong>as</strong>legally shot, <strong>the</strong> hunter may pursue suchwaterfowl without regard to <strong>the</strong> 500 yardprohibition protecting licensed waterfowlblinds.Jump Shooting from Boats: Permittedwhere appropriate landowner permissionh<strong>as</strong> been secured or where generally permittedon public waters. Consult with <strong>the</strong> localconservation police officer to learn localrestrictions. Not permitted within 500 yardsof a licensed stationary blind, except withconsent of blind owner. If a boat is usedfor jump shooting and is modified for <strong>the</strong>purpose of concealing <strong>the</strong> hunter, it is afloating blind and must be licensed <strong>as</strong> such.Jump shooting is not permitted from a boathaving a motor attached or any sailboatunless <strong>the</strong> motor h<strong>as</strong> been completely shutoff and/or <strong>the</strong> sails furled and its progress<strong>the</strong>refrom h<strong>as</strong> ce<strong>as</strong>ed.Abandoned Blinds: Those licensing stationaryblinds in <strong>the</strong> public waters shall removesame when licenses are allowed to expire orwhen <strong>the</strong>y no longer intend to use <strong>the</strong>m,whichever comes first.<strong>Waterfowl</strong> Blind Cleanup: Hunters are<strong>as</strong>ked to remove unnatural materials, such<strong>as</strong> netting, camouflage cloth, wire, or twine24


from stationary blinds after <strong>the</strong> waterfowlhunting se<strong>as</strong>on. Birds such <strong>as</strong> ospreys,eagles, and owls often use blind structuresfor perching and/or nesting. Such materials,if left after <strong>the</strong> hunting se<strong>as</strong>on, can causeinjury and even death to <strong>the</strong>se birds if <strong>the</strong>ybecome entangled in <strong>the</strong> material.Are<strong>as</strong> Closed to<strong>Waterfowl</strong> HuntingThe discharge of firearms is prohibited within750 yards of a wildlife sanctuary in any city in<strong>Virginia</strong>.Taking, attempting to take, pursuing, ordisturbing waterfowl is prohibited in <strong>the</strong>following are<strong>as</strong>:✦ In <strong>Virginia</strong> Beach on <strong>the</strong> waters and from<strong>the</strong> shores of Crystal Lake, Linkhorn andBroad Bay, and Long Creek and <strong>the</strong>irtributaries.✦ Hog Island Wildlife Management Area inSurry County and all of <strong>the</strong> waters of <strong>the</strong>James River within a radius of 1,000 yardsaround that island, with <strong>the</strong> exception ofblinds erected by <strong>the</strong> Department ofGame and Inland Fisheries.✦ The waters of <strong>the</strong> James River aroundPresquile National Wildlife Refuge(except for <strong>the</strong> Turkey Island Cutoffnavigational channel) to <strong>the</strong> mean lowwater mark on <strong>the</strong> opposite shore.✦ G<strong>as</strong>ton Reservoir (Roanoke River) from apoint beginning at High Rock and extendingto <strong>the</strong> John H. Kerr Dam.✦ The public waters extending 1,000 yardsout from <strong>the</strong> marked shoreline of <strong>the</strong>Lands End WMA on <strong>the</strong> RappahannockRiver in King George County, with <strong>the</strong>exception that adjacent landowners maystill exercise <strong>the</strong>ir riparian rights. Because <strong>the</strong>se conditions can be dangerous, some safety tips areprovided (below) so hunters can be better prepared before heading out on <strong>the</strong> water.Wea<strong>the</strong>rTo stay warm and avoid <strong>the</strong> risks of hypo<strong>the</strong>rmia or cold water immersion:• Control wind and wetness by using waterproof jackets, waders, and boots.• Wear a belt around your waders to prevent water from entering.• Wear wool clothing or clothing that stays warm when wet, like some fleeceproducts. Bring extr<strong>as</strong> in a waterproof bag.• Wear a hat. Most warmth escapes through your head.• Bring a variety of high energy/sugar content food bars for quick energy andcalories.• Your extremities are very important. It’s no fun to hunt with cold feet, hands, orhead. Bring waterproof gloves and footwear, and chemical hand and foot warmersthat you can put inside your gloves or boots.• If you fall in—go home! Or, take a break and change into warm, dry clo<strong>the</strong>s.26


Duck Boat SafetyWhen planning a hunt, check to be sure <strong>the</strong> boat is in good working condition andincludes enough g<strong>as</strong> for <strong>the</strong> trip, all necessary safety gear, and boat lights and fl<strong>as</strong>hlights ingood working order. Hunters must follow all boating rules, and everyone on board shouldwear a properly fitted U.S.C.G. approved life jacket, vest, or flotation coat anytime while on<strong>the</strong> water. Cell phones and radios are important communication devices and should beproperly charged and kept in a waterproof bag. A GPS unit is helpful in finding your way butdon’t depend solely on it <strong>as</strong> a means of navigation, <strong>as</strong> reception varies and units can fail.• Check <strong>the</strong> wea<strong>the</strong>r before leaving.• Choose a route close to shore and avoid crossing large expanses of open water,especially in bad wea<strong>the</strong>r.• Anchor from <strong>the</strong> bow, never from <strong>the</strong> stern.• Don’t overload your boat. Check <strong>the</strong> capacity plate and keep <strong>the</strong> amount of gear,dogs, and people within your weight limits. Also, be sure <strong>the</strong> load is properlybalanced and try to keep movements and weight shifts (dogs and people) to aminimum. Overloading, sudden shifts in weight, or excessive wea<strong>the</strong>r conditionsare <strong>the</strong> most common causes of boats capsizing or swamping.• If your boat does capsize or swamp, stay with it. Even when filled with water it willprovide some floatation and is e<strong>as</strong>ier to see by potential rescuers.• Firearms should be unloaded and properly secured in a c<strong>as</strong>e while being trans -ported in a boat. Floating gun c<strong>as</strong>es earn <strong>the</strong>ir keep if one happens to go overboard.• Be extra careful when shooting from a boat. Small boats often have little room toswing a shotgun, so be aware of where dogs and o<strong>the</strong>r partners are, and only shootwhen all is clear. Never stand in an unsecured boat to shoot.• Leave a float plan with a responsible person that includes <strong>the</strong> names of all personsin your party, type and registration number of your boat, time and location of yourhunt, and when you expect to return.<strong>Waterfowl</strong> hunting can be safer and more enjoyable if you plan ahead and make safepractices part of your water-b<strong>as</strong>ed hunt.
