The meeting was called to order by <strong>the</strong> Chairperson <strong>of</strong> <strong>the</strong> NationalConstitutional Conference (<strong>NCC</strong>) at 14:30 hours, followed by <strong>the</strong>singing <strong>of</strong> <strong>the</strong> National An<strong>the</strong>m and prayer by Bishop Harrison Sakala.2. Chairperson’s Opening Remarks2. The Chairperson, in his opening remarks, welcomed <strong>the</strong> members <strong>of</strong><strong>the</strong> Conference to yet ano<strong>the</strong>r important day when <strong>the</strong> Conferencewould begin rewriting <strong>the</strong> history <strong>of</strong> Zambia. He stated that <strong>the</strong>meeting was important in Zambia’s long road towards causing itself agood Constitution that would stand <strong>the</strong> test <strong>of</strong> time.3. He informed <strong>the</strong> Conference that <strong>the</strong> purpose <strong>of</strong> <strong>the</strong> meeting was toadopt <strong>the</strong> draft rules and regulations that would guide <strong>the</strong> Conferencedeliberations in an orderly manner. He stated that <strong>the</strong> InterimCommittee on Rules and Regulations constituted at <strong>the</strong> last meeting t<strong>of</strong>ormulate <strong>the</strong> afore-mentioned draft rules and regulations hadcompleted its work within <strong>the</strong> prescribed time-frame.4. He fur<strong>the</strong>r welcomed <strong>the</strong> new members <strong>of</strong> <strong>the</strong> Conference andregistered <strong>the</strong> <strong>NCC</strong>’s pr<strong>of</strong>ound appreciation for <strong>the</strong>ir unprecedentedstep in joining <strong>the</strong> Conference. He stated that this was evidence that2


Zambians were focussed and determined to work out and give<strong>the</strong>mselves a good Constitution.3. Adoption <strong>of</strong> Agenda5. The Agenda <strong>of</strong> <strong>the</strong> Meeting was adopted following a proposal by Mr.Alfred Mudenda and seconded by Mr. Mwandila.4. Announcements by <strong>the</strong> Secretary6. The Secretary <strong>of</strong> <strong>the</strong> Conference urged <strong>the</strong> members <strong>of</strong> <strong>the</strong> Conferenceto sign <strong>the</strong> Attendance Register every day for record keeping purposes.7. The Secretary also requested members <strong>of</strong> <strong>the</strong> Conference, whenaddressing <strong>the</strong> Conference, to stand up and state <strong>the</strong>ir names for <strong>the</strong>record <strong>of</strong> <strong>the</strong> Conference.8. He apologised on behalf <strong>of</strong> Secretariat for <strong>the</strong> derailment experiencedin <strong>the</strong> payment <strong>of</strong> allowances. He informed <strong>the</strong> meeting that Secretariatwould improve and perfect <strong>the</strong> payment system in due course.9. The Secretary announced that members who were overpaid orunderpaid would be dealt with on an individual basis. He stated thatSecretariat would write to <strong>the</strong> affected members and indicate how <strong>the</strong>individual accounts would be regularised.5. Consideration and Adoption <strong>of</strong> <strong>the</strong> Report <strong>of</strong> <strong>the</strong> Interim Committeeon Rules and Regulations10. Following <strong>the</strong> announcements by <strong>the</strong> Secretary <strong>of</strong> Conference, <strong>the</strong>Chairperson invited Dr. Patrick Matibini, Chairperson <strong>of</strong> <strong>the</strong> Interim3


Committee on Rules and Regulations to present <strong>the</strong> report <strong>of</strong> hisCommittee. See Annex III for <strong>the</strong> list <strong>of</strong> members <strong>of</strong> <strong>the</strong> InterimCommittee on Rules and Regulations.11. Dr. Matibini stated that <strong>the</strong> Committee appointed to develop <strong>the</strong>regulations, rules <strong>of</strong> procedure and disciplinary rules for <strong>the</strong> NationalConstitutional Conference (<strong>NCC</strong>) was appointed on 21 st December,2007, pursuant to sub-section (3) <strong>of</strong> Section 16 <strong>of</strong> <strong>the</strong> NationalConstitutional Conference Act, No.19 <strong>of</strong> 2007.12. He stated that <strong>the</strong> Terms <strong>of</strong> Reference <strong>of</strong> <strong>the</strong> Committee were to lay <strong>the</strong>ground work for <strong>the</strong> operations <strong>of</strong> <strong>the</strong> <strong>NCC</strong>. This included <strong>the</strong>formulation <strong>of</strong> <strong>the</strong> rules and regulations that would govern <strong>the</strong>proceedings <strong>of</strong> <strong>the</strong> Conference and establish <strong>the</strong> <strong>NCC</strong> Committeesystem.13. Dr. Matibini informed <strong>the</strong> Conference that <strong>the</strong> Committee held a totalnumber <strong>of</strong> six meetings during <strong>the</strong> period from 21 st December, 2007 to5 th <strong>January</strong>, <strong>2008</strong>. The Committee, at its first meeting, resolved that <strong>the</strong>rules establishing <strong>the</strong> committee system, <strong>the</strong> rules <strong>of</strong> procedure for <strong>the</strong>Conference and its committees and <strong>the</strong> rules and procedures to govern<strong>the</strong> maintenance and enforcement <strong>of</strong> discipline within <strong>the</strong> <strong>NCC</strong> and <strong>the</strong>Secretariat should be reformulated.14. He stated that in formulating <strong>the</strong> committee system, <strong>the</strong> proposalswere informed by <strong>the</strong> content <strong>of</strong> <strong>the</strong> Mung’omba Constitution ReviewCommission Report and <strong>the</strong> Draft Constitution. To this end, <strong>the</strong>number and proposed names <strong>of</strong> <strong>the</strong> committees were based on both<strong>the</strong> structure and content <strong>of</strong> <strong>the</strong> Report and <strong>the</strong> Draft Constitution.Therefore, <strong>the</strong> Terms <strong>of</strong> Reference <strong>of</strong> <strong>the</strong> committees covered each andevery article <strong>of</strong> <strong>the</strong> Draft Constitution.4


15. The Conference was informed that in proposing <strong>the</strong> procedures to befollowed at <strong>the</strong> committee stage and in <strong>the</strong> Conference, <strong>the</strong> Committeerecognized <strong>the</strong> importance <strong>of</strong> <strong>the</strong> following matters:a) <strong>the</strong> need to conduct business in an orderly fashion and withdispatch;b) <strong>the</strong> need to clo<strong>the</strong> <strong>the</strong> leadership <strong>of</strong> <strong>the</strong> Conference and <strong>the</strong>committee with sufficient power to manage <strong>the</strong> business <strong>of</strong> <strong>the</strong>Conference and <strong>the</strong> Committee;c) <strong>the</strong> need to provide for equal and equitable participation bymembers both at <strong>the</strong> Committee stage and in <strong>the</strong> Conference;d) <strong>the</strong> need to ensure that <strong>the</strong> Secretary to <strong>the</strong> Conference and <strong>the</strong>Secretariat are given sufficient latitude to manage <strong>the</strong> affairs <strong>of</strong> <strong>the</strong>committees and Conference efficiently and effectively; ande) <strong>the</strong> need to provide for <strong>the</strong> participation <strong>of</strong> <strong>the</strong> public generally ando<strong>the</strong>r persons in particular, whose input may be required at <strong>the</strong>Committee level in order to ensure that <strong>the</strong> functions <strong>of</strong> <strong>the</strong>Conference are discharged fully.16. Pursuant to sub-section 2 <strong>of</strong> section 16 <strong>of</strong> <strong>the</strong> National ConstitutionalConference Act, No. 19 <strong>of</strong> 2007 which establishes <strong>the</strong> DisciplinaryCommittee, <strong>the</strong> Committee recognized <strong>the</strong> need to develop rulesgoverning <strong>the</strong> maintenance and enforcement <strong>of</strong> discipline amongstmembers both at committee level and in <strong>the</strong> Conference and among <strong>the</strong>Secretariat staff. The regime <strong>of</strong> rules and procedures proposed areintended to achieve <strong>the</strong> following objectives:5


a) To provide for simple, informal and yet just system <strong>of</strong>governing and enforcing discipline;b) to provide opportunity for members complained against tomake adequate written and or oral representations;c) to provide for a speedy resolution <strong>of</strong> <strong>the</strong> complaints;d) to provide for a range <strong>of</strong> options in imposing sanctions againsterring members; ande) to provide for an avenue <strong>of</strong> appeal to <strong>the</strong> High Court, if need be,to search for legal redress.17. The Conference heard that <strong>the</strong> Committee had proposed rules <strong>of</strong>debate. The proposed rules <strong>of</strong> debate were intended to give <strong>the</strong>Chairperson sufficient authority to do <strong>the</strong> following:a) Effectively guide <strong>the</strong> deliberations;b) ensure orderly debate by members <strong>of</strong> <strong>the</strong> Conference; andc) allow for equal and equitable participation <strong>of</strong> members <strong>of</strong> <strong>the</strong>Conference in <strong>the</strong> deliberations.18. In conclusion, Dr. Matibini acknowledged <strong>the</strong> confidence reposed inhim and his colleagues on <strong>the</strong> Committee, with <strong>the</strong> responsibility <strong>of</strong>executing and discharging this task <strong>of</strong> national significance. He alsoacknowledged <strong>the</strong> support and commitment that was exhibitedthroughout <strong>the</strong> business <strong>of</strong> <strong>the</strong> Committee by <strong>the</strong> members <strong>of</strong> <strong>the</strong>Committee and <strong>the</strong> Chief Parliamentary Counsel and her staff fordrafting <strong>the</strong> instruments in question with pr<strong>of</strong>iciency and efficiency.6


committees would be required to submit <strong>the</strong>ir reports to <strong>the</strong>Conference.22. He stated that Rule 3 set out <strong>the</strong> proposed Committees. The proposedcommittees are actually based on <strong>the</strong> content <strong>of</strong> both <strong>the</strong> DraftConstitution and <strong>the</strong> Mung’omba Report. For instance, <strong>the</strong> ExecutiveCommittee was committed to <strong>the</strong> discussion <strong>of</strong> <strong>the</strong> Executive branch <strong>of</strong>Government and similarly, <strong>the</strong> Judicial Committee referred to <strong>the</strong> partdealing with <strong>the</strong> Judiciary. Fur<strong>the</strong>r, he stated that <strong>the</strong> Draft rules hadcaptured <strong>the</strong> two (2) statutory committees, namely, <strong>the</strong> DisciplinaryCommittee and <strong>the</strong> Drafting Committee. The rules also established <strong>the</strong>General Purposes Committee meant to deal with general matters. ThisCommittee would consist <strong>of</strong> all <strong>the</strong> Chairpersons and Vice-Chairpersons <strong>of</strong> <strong>the</strong> Committees.23. The Conference noted <strong>the</strong> following:a. That <strong>the</strong> draft Statutory Instrument did not stipulate <strong>the</strong>frequency <strong>of</strong> <strong>the</strong> <strong>sitting</strong>s <strong>of</strong> <strong>the</strong> committees. This would be anadministrative matter, to be determined by <strong>the</strong> Secretariat;b. That <strong>the</strong> Minister <strong>of</strong> Justice would comply with <strong>the</strong> provisions <strong>of</strong><strong>the</strong> <strong>NCC</strong> Act when appointing members <strong>of</strong> <strong>the</strong> DraftingCommittee;c. That <strong>the</strong> Committees were allowed by <strong>the</strong> <strong>NCC</strong> Act to deal withissues not addressed in <strong>the</strong> draft Constitution; andd. That members <strong>of</strong> <strong>the</strong> Conference were allowed to make writtensubmissions to committees to which <strong>the</strong>y did not belong.8


24. After a lengthy debate on <strong>the</strong> matter, <strong>the</strong> Conference agreed, in relationto Rule 4 (1), that <strong>the</strong> Conference, as opposed to <strong>the</strong> Secretary <strong>of</strong> <strong>the</strong>Conference, should determine <strong>the</strong> number <strong>of</strong> members that eachcommittee would have. This was done in line with subsection 3 <strong>of</strong>section 16 <strong>of</strong> <strong>the</strong> <strong>NCC</strong> Act which empowers <strong>the</strong> Conference toconstitute committees for <strong>the</strong> purposes <strong>of</strong> performing its functions.Subsection 3 <strong>of</strong> section 16 states that:“(3) The Conference may, for <strong>the</strong> purpose <strong>of</strong> performing its functions underthis Act, constitute any committee and delegate to any such committee such <strong>of</strong>its functions as it thinks fit.”25. Therefore, <strong>the</strong> phrase “A committee shall comprise such number <strong>of</strong> membersas <strong>the</strong> Secretary to <strong>the</strong> Conference may determine” was replaced by <strong>the</strong>phrase “A committee shall comprise such number <strong>of</strong> members as <strong>the</strong>Conference may determine”.26. Sub-rule (4) <strong>of</strong> Rule 5, which stated that “A committee may authorize <strong>the</strong>publication <strong>of</strong> any information given before it and any document presented toit.”, was deleted. The Conference was <strong>of</strong> <strong>the</strong> view that <strong>the</strong> saidprovision contradicted section 20 <strong>of</strong> <strong>the</strong> <strong>NCC</strong> Act which allowedmembers <strong>of</strong> <strong>the</strong> press to be present in <strong>the</strong> deliberations <strong>of</strong> <strong>the</strong>Conference or its committees.27. Sub-rule 1 <strong>of</strong> Rule 7 reading “A committee shall, at its first <strong>sitting</strong> elect achairperson, vice chairperson and secretary <strong>of</strong> <strong>the</strong> committee from amongst <strong>the</strong>members <strong>of</strong> <strong>the</strong> committee” was amended to read as follows: “A committeeshall, at its first <strong>sitting</strong> elect a chairperson and vice chairperson <strong>of</strong> <strong>the</strong>committee from amongst <strong>the</strong> members <strong>of</strong> <strong>the</strong> committee”.28. This amendment followed a discussion by <strong>the</strong> Conference as towhe<strong>the</strong>r <strong>the</strong>re was a need to elect secretaries from amongst <strong>the</strong>9


members <strong>of</strong> <strong>the</strong> committee to perform a liaison role between <strong>the</strong>respective committees and <strong>the</strong> Secretariat. The Conference was <strong>of</strong> <strong>the</strong>view that this was not necessary as <strong>the</strong>re would be no reportingchannels to <strong>the</strong> o<strong>the</strong>r secretaries. Fur<strong>the</strong>r, <strong>the</strong> Conference noted that <strong>the</strong>job <strong>of</strong> a secretary was technical and administrative.29. The Conference agreed that meetings <strong>of</strong> <strong>the</strong> Conference should beconvened by <strong>the</strong> Secretary at <strong>the</strong> direction <strong>of</strong> <strong>the</strong> Chairperson <strong>of</strong> <strong>the</strong>Conference. In this regard, sub-rule 1 <strong>of</strong> Rule 8 was amended to reflectthis.30. The word “Conference” appearing in paragraphs (a) and (b) <strong>of</strong> Rule 9was replaced by <strong>the</strong> word “Committee”, respectively.31. Rule 12 was amended in order to grant immunity to persons who giveevidence before a committee.32. Rule 14 was amended by replacing <strong>the</strong> word “return” with <strong>the</strong> word“reject”.33. The Conference requested that all <strong>the</strong> terms <strong>of</strong> reference <strong>of</strong> <strong>the</strong>committees be amended to allow <strong>the</strong>m to discuss related matters.7. Adjournment34. The meeting adjourned at 19:52 hours to <strong>the</strong> following day at 14:00hours, followed by <strong>the</strong> singing <strong>of</strong> <strong>the</strong> National An<strong>the</strong>m and prayer byPastor Godfridah Sumaili.WEDNESDAY, 9 TH JANUARY, <strong>2008</strong>PRESENT10

Chairperson’s Opening Remarks2. The Chairperson informed <strong>the</strong> Conference that it would continueconsidering <strong>the</strong> Report <strong>of</strong> <strong>the</strong> Interim Committee on Rules andRegulations. He stated that in order to maximise participation <strong>of</strong>members <strong>of</strong> <strong>the</strong> Conference, he requested members to ensure that <strong>the</strong>ycaught <strong>the</strong> attention <strong>of</strong> <strong>the</strong> Chairperson so that <strong>the</strong>y are given anopportunity to speak.3. Announcements by <strong>the</strong> Secretary3. The Secretary informed <strong>the</strong> Conference that Tea would be served at16:00 hours and 18:00 hours. The Tea Breaks would last 20 minuteseach.4. The Secretary informed <strong>the</strong> members that <strong>the</strong> eastern gate <strong>of</strong> <strong>the</strong>Mulungushi International Conference Centre would be open for thosewho wished to use it.11


5. He apologised for <strong>the</strong> Secretariat not having distributed <strong>the</strong> Agenda for<strong>the</strong> day. This was due to <strong>the</strong> fact that <strong>the</strong> photocopier had stoppedworking. He informed <strong>the</strong> meeting that <strong>the</strong> Secretariat was doingeverything possible to ensure that fresh copies <strong>of</strong> <strong>the</strong> Agenda weredistributed.4. Continuation <strong>of</strong> <strong>the</strong> Consideration and Adoption <strong>of</strong> <strong>the</strong> DraftNational Constitutional Conference (Committees) Rules, <strong>2008</strong>6. After consideration and adoption <strong>of</strong> <strong>the</strong> Terms <strong>of</strong> Reference <strong>of</strong> <strong>the</strong>various committees, <strong>the</strong> Conference adopted <strong>the</strong> Draft NationalConstitutional Conference (Committees) Rules, <strong>2008</strong> as amended, withHon. Malwa proposing and Mrs. Betty Ilunga seconding <strong>the</strong> motion foradoption.5. Consideration and Adoption <strong>of</strong> <strong>the</strong> Draft National ConstitutionalConference (Disciplinary Committee Proceedings) Rules, <strong>2008</strong>7. Following <strong>the</strong> adoption <strong>of</strong> <strong>the</strong> draft National Constitutional Conference(Committees) Rules, <strong>2008</strong>, <strong>the</strong> Chairperson invited Dr. Matibini to givean executive summary <strong>of</strong> <strong>the</strong> Draft National Constitutional Conference(Disciplinary Committee Proceedings) Rules, <strong>2008</strong>.8. In his summary, Dr. Matibini stated that <strong>the</strong> above-mentioned draftStatutory Instrument was intended to provide <strong>the</strong> procedure thatwould govern <strong>the</strong> Disciplinary Committee established by <strong>the</strong> <strong>NCC</strong> Act.He stated that <strong>the</strong> rules were meant for <strong>the</strong> maintenance andenforcement <strong>of</strong> <strong>the</strong> discipline in <strong>the</strong> Conference.12


9. Dr. Matibini stated that <strong>the</strong> basis upon which discipline would bemaintained was a complaint, which would emanate from differentsources including <strong>the</strong> Conference and from <strong>the</strong> Committee stage. Hestated that once a complaint was initiated and lodged with <strong>the</strong>Disciplinary Committee, <strong>the</strong> above-mentioned Rules would govern <strong>the</strong>proceedings or <strong>the</strong> procedure in which <strong>the</strong>se complaints would betreated.10. Dr. Matibini stated that <strong>the</strong> Interim Committee had also provided for anumber <strong>of</strong> ancillary issues, including issues <strong>of</strong> interim measures,provision for legal representation for those who feel it is necessary toinstruct lawyers to assist <strong>the</strong>m respond to allegations or complaints. Hefur<strong>the</strong>r stated that provision had been made for <strong>the</strong> compilation <strong>of</strong>dossiers or evidence in support <strong>of</strong> or in resistance to complaints, issues<strong>of</strong> service <strong>of</strong> documents and amendments <strong>of</strong> <strong>the</strong> proceedings. Heinformed <strong>the</strong> Conference that, in a nutshell, <strong>the</strong> approach was verytechnical but every effort was made to make <strong>the</strong> procedure as simpleand as cost effective as possible.11. In <strong>the</strong> discussion <strong>of</strong> <strong>the</strong> Draft National Constitutional Conference(Disciplinary Committee Proceedings) Rules, <strong>2008</strong> <strong>the</strong> Conferenceagreed that <strong>the</strong> term “Chairperson” should be defined.12. Paragraph (c) <strong>of</strong> Rule 4 reading “This Committee shall consider any o<strong>the</strong>rmatter referred to it by <strong>the</strong> Conference” was amended with <strong>the</strong> addition <strong>of</strong><strong>the</strong> word “disciplinary” between <strong>the</strong> words “o<strong>the</strong>r” and “matter”. Theamendment was effected to ensure that <strong>the</strong> o<strong>the</strong>r matters to be referredto <strong>the</strong> Disciplinary Committee should have relevance to its work andas such should be related to matters <strong>of</strong> discipline.13. Sub-regulation (1) <strong>of</strong> Regulation 5 which allowed a person lodging acomplaint before <strong>the</strong> Disciplinary Committee to recommend <strong>the</strong> course13


<strong>of</strong> action to be taken against <strong>the</strong> person complained against wasamended. This amendment was effected in order to allow any personto lodge a complaint before <strong>the</strong> Disciplinary Committee under certaincircumstances. However, <strong>the</strong> course <strong>of</strong> action to be taken against anerring member or member <strong>of</strong> staff was to be determined by <strong>the</strong>Disciplinary Committee.14. After a lengthy debate on <strong>the</strong> matter Sub-rule 1 <strong>of</strong> Rule 5 which stated“A person may complain to <strong>the</strong> Committee that disciplinary action be takenagainst a member or member <strong>of</strong> staff…” was redrafted to read “A complaintmay be lodged with <strong>the</strong> Disciplinary Committee against a member or member<strong>of</strong> staff where it is alleged that <strong>the</strong> member or member <strong>of</strong> staff has…”. Thistext was a compromise which was in line with subsection 2 <strong>of</strong> section16 <strong>of</strong> <strong>the</strong> Act and would allow complaints under that Act to be filedbefore <strong>the</strong> Committee. This text would allow <strong>the</strong> Committee tointerpret whe<strong>the</strong>r any person, whe<strong>the</strong>r from within or outside <strong>the</strong>Conference, could file a complaint.15. Two conflicting views on this matter dominated <strong>the</strong> discussion: Somemembers were <strong>of</strong> <strong>the</strong> view that members <strong>of</strong> <strong>the</strong> public should not beallowed to make complaints against members <strong>of</strong> <strong>the</strong> Conference andstaff <strong>of</strong> Secretariat as this would be subject to abuse from those whooppose <strong>the</strong> work <strong>of</strong> <strong>the</strong> Conference. However, some members were <strong>of</strong><strong>the</strong> view that members <strong>of</strong> <strong>the</strong> public should be allowed to lodgecomplaints before <strong>the</strong> Disciplinary Committee against members <strong>of</strong> <strong>the</strong>Conference and staff <strong>of</strong> Secretariat to avoid suspicion. It was stated thatit was, however, necessary for <strong>the</strong> Disciplinary Committee to discern afrivolous complaint from one which was serious.16. Rule 12 which read “The Committee may, where any party fails to appear at<strong>the</strong> hearing, upon pro<strong>of</strong> <strong>of</strong> service on such party <strong>of</strong> <strong>the</strong> notice <strong>of</strong> hearing,proceed to hear and determine <strong>the</strong> complaint in that party’s absence” was14


amended by adding <strong>the</strong> word “twice” between <strong>the</strong> words “ hearing”and “upon”. This amendment was effected to allow a member who hadnot appeared before <strong>the</strong> Disciplinary Committee twice for genuinereasons to be given ano<strong>the</strong>r opportunity to do so.17. Rule 15 was amended in order to allow <strong>the</strong> Secretary to <strong>the</strong> Cabinet toappoint ano<strong>the</strong>r person to replace a member who is removed from<strong>of</strong>fice on <strong>the</strong> recommendation <strong>of</strong> <strong>the</strong> Disciplinary Committee. Thisamendment was effected with <strong>the</strong> addition <strong>of</strong> <strong>the</strong> following sub-rule:(3) “The Secretary to <strong>the</strong> Cabinet shall, where a member is removed on <strong>the</strong>recommendation <strong>of</strong> <strong>the</strong> Disciplinary Committee under <strong>the</strong>se Rules, appointano<strong>the</strong>r member to replace <strong>the</strong> member who is removed in accordance withsection four <strong>of</strong> <strong>the</strong> Act.”18. The Conference agreed to amend sub-rule (1) <strong>of</strong> Rule 18 in order toallow an individual to withdraw a complaint without <strong>the</strong> intervention<strong>of</strong> <strong>the</strong> Committee if he or she so decided.19. The Conference agreed to delete <strong>the</strong> provision allowing <strong>the</strong>Disciplinary Committee to order any party to pay <strong>the</strong> costs <strong>of</strong> <strong>the</strong>proceedings if misconduct is not proved against any member ormember <strong>of</strong> staff.20. The word “complaint” in Rule 19 was replaced by <strong>the</strong> word“application”.21. The Conference discussed at length Rule 11, which allowed any partyto <strong>the</strong> disciplinary proceedings to be represented by a legalpractitioner. Rule 11 stated:15


“Any party to <strong>the</strong> proceedings under <strong>the</strong>se rules may be represented by a legalpractitioner <strong>of</strong> that party’s choice.”22. There were two schools <strong>of</strong> thought on this matter: On <strong>the</strong> one hand,some members stated that parties appearing before <strong>the</strong> DisciplinaryCommittee should not be represented by a legal practitioner becausethis requirement may disadvantage <strong>the</strong> o<strong>the</strong>r parties who may not beable to afford <strong>the</strong> services <strong>of</strong> lawyers and that <strong>the</strong> practice in manyorganisations did not make legal representation a requirement.23. On <strong>the</strong> o<strong>the</strong>r hand, some members <strong>of</strong> <strong>the</strong> Conference were <strong>of</strong> <strong>the</strong> viewthat <strong>the</strong> clause in question should be retained because legalrepresentation in courts or tribunals was a Constitutional right.24. A decision on this question was deferred to <strong>the</strong> next day at 14:00 hoursdue to <strong>the</strong> lateness <strong>of</strong> <strong>the</strong> hour.6. Adjournment25. Following <strong>the</strong> announcements by <strong>the</strong> Secretary <strong>of</strong> <strong>the</strong> Conference,<strong>of</strong>ficials from <strong>the</strong> Electoral Commission <strong>of</strong> Zambia (ECZ) wererequested by <strong>the</strong> Chairperson to brief members <strong>of</strong> <strong>the</strong> Conference on<strong>the</strong> guidelines to be followed in <strong>the</strong> election <strong>of</strong> members <strong>of</strong> <strong>the</strong>Disciplinary Committee.See Annex VIII for <strong>the</strong> above-mentioned guidelines.5. Continuation <strong>of</strong> Consideration and Adoption <strong>of</strong> <strong>the</strong> Draft NationalConstitutional Conference (Disciplinary Committee Proceedings)Rules, <strong>2008</strong>7. The Chairperson informed <strong>the</strong> Conference that <strong>the</strong> Secretariatrequested <strong>the</strong> Attorney-General to provide his legal opinion on <strong>the</strong>question <strong>of</strong> legal representation before <strong>the</strong> Disciplinary Committeewhich was considered by <strong>the</strong> Conference <strong>the</strong> previous day but notconcluded.8. The Chairperson informed <strong>the</strong> Conference that <strong>the</strong> Attorney-Generalhad responded to <strong>the</strong> above-mentioned request and stated that <strong>the</strong>right to legal representation was founded in <strong>the</strong> Common Law uponwhich <strong>the</strong> justice system <strong>of</strong> Zambia was founded. He stated that <strong>the</strong>Supreme Court had continually upheld that a person had <strong>the</strong> option toretain Counsel <strong>of</strong> his or her choice. He stated that whilst <strong>the</strong>Constitution <strong>of</strong> Zambia specifically recognised <strong>the</strong> right torepresentation in criminal cases, that right was extended to civilproceedings by virtue <strong>of</strong> <strong>the</strong> Common Law. He stated that it wasimportant to note that <strong>the</strong> Disciplinary Committee would sit as aQuasi-Judicial Body and as such any party appearing before such a18


ody had a right to a fair trial or hearing. He stated that <strong>the</strong> tenets <strong>of</strong> afair trial or hearing demanded that one has <strong>the</strong> right to be representedby a person <strong>of</strong> his choice. In that regard, <strong>the</strong> Attorney-General was <strong>of</strong><strong>the</strong> considered view that Rule 11 be retained in its current form.9. Following <strong>the</strong> above advice from <strong>the</strong> Attorney-General <strong>the</strong> Conferenceagreed to retain draft Rule 11 in its current form.10. The Conference <strong>the</strong>reafter adopted <strong>the</strong> draft Rules.6. Consideration and Adoption <strong>of</strong> <strong>the</strong> Report on <strong>the</strong> NationalConstitutional Conference (Procedure) Rules, <strong>2008</strong>11. Dr. Matibini, at <strong>the</strong> request <strong>of</strong> <strong>the</strong> Chairperson proceeded to give abrief overview <strong>of</strong> <strong>the</strong> National Constitutional Conference (Procedure)Rules, <strong>2008</strong>.12. He stated that <strong>the</strong>se Rules were intended to govern <strong>the</strong> business <strong>of</strong> <strong>the</strong>Conference. The first part <strong>of</strong> <strong>the</strong> Rules referred to <strong>the</strong> title, applicationas well as interpretation. The second part referred to issues <strong>of</strong> <strong>sitting</strong>s<strong>of</strong> <strong>the</strong> Conference and <strong>the</strong> more crucial parts <strong>of</strong> <strong>the</strong> Draft StatutoryInstrument referred to <strong>the</strong> procedure and <strong>the</strong> rules <strong>of</strong> debate.13. He stated that most <strong>of</strong> <strong>the</strong> Rules under Conference Procedures weremeant to facilitate <strong>the</strong> orderly business <strong>of</strong> <strong>the</strong> Conference and informulating <strong>the</strong>se Rules, <strong>the</strong> Interim Committee was alive to <strong>the</strong> factthat <strong>the</strong>re was need to clo<strong>the</strong> <strong>the</strong> Chairperson with sufficient powerand authority to maintain order in <strong>the</strong> conduct <strong>of</strong> <strong>the</strong> debate and toensure that <strong>the</strong> Chairperson had sufficient power to direct <strong>the</strong>proceedings.19


14. He stated that Part IV <strong>of</strong> <strong>the</strong> draft Rules contained <strong>the</strong> Rules <strong>of</strong> Debateand Part V affected <strong>the</strong> Secretary and <strong>the</strong> Secretariat and placed aspecific obligation on <strong>the</strong> Secretariat to ensure that <strong>the</strong> proceedings <strong>of</strong><strong>the</strong> Conference were maintained.15. Following <strong>the</strong> presentation by Dr. Matibini, <strong>the</strong> Conference agreed toinclude in <strong>the</strong> draft Rules <strong>the</strong> definitions <strong>of</strong> <strong>the</strong> terms “Vice-Chairpersons”, “Spokesperson” and “General Purposes Committee”. TheConference also agreed to elaborate <strong>the</strong> functions <strong>of</strong> <strong>the</strong> Spokespersonin <strong>the</strong> body <strong>of</strong> <strong>the</strong> draft Rules.16. The Conference agreed to amend Rule 4 in order to allow <strong>the</strong>Conference to adjourn its proceedings early if it concluded its businessbefore <strong>the</strong> scheduled time.17. The Conference were <strong>of</strong> <strong>the</strong> view that Sub-rule 1 <strong>of</strong> Rule 4 should beamended to reflect that <strong>the</strong> Conference would not meet on publicholidays.18. The marginal note in Rule 6 was amended to read “Sitting dates” toreflect <strong>the</strong> contents <strong>of</strong> Rule 6 as opposed to <strong>the</strong> use <strong>of</strong> <strong>the</strong> words“Sitting Programme” originally used. Fur<strong>the</strong>r, Rule 6 was reformulatedto provide at least 14 days notice to ensure that all members, especiallythose living in far flung areas, get adequate notice <strong>of</strong> meetings <strong>of</strong> <strong>the</strong>Conference.19. Rules 8 and 9 were swapped to ensure that <strong>the</strong> provisions followed alogical sequence.20. Rule 12 was amended by deleting <strong>the</strong> words “and <strong>the</strong> galleries”because <strong>the</strong> definition <strong>of</strong> <strong>the</strong> word “chamber” included <strong>the</strong> galleries.20


21. The word “House” appearing in Rule 11 (a) was replaced by <strong>the</strong> word“Chamber”.22. The Conference agreed to recast sub-Rule (1) <strong>of</strong> Rule 14 in order tooutline <strong>the</strong> circumstances under which <strong>the</strong> Secretary may order aperson to leave <strong>the</strong> Chamber as a result <strong>of</strong> interruption <strong>of</strong> <strong>the</strong>proceedings <strong>of</strong> <strong>the</strong> Conference.23. Sub-rule (2) <strong>of</strong> Rule 14 was recast to empower <strong>the</strong> Chairperson to orderor cause <strong>the</strong> removal <strong>of</strong> a person who is not a member by any PoliceOfficer.24. Sub-rule (3) <strong>of</strong> Rule 16 reading “Where <strong>the</strong> Chairperson adjourns <strong>the</strong><strong>sitting</strong>, it stands adjourned until its next <strong>sitting</strong> day.” was amended to read“Where <strong>the</strong> Chairperson adjourns a <strong>sitting</strong>, it shall stand adjourned until <strong>the</strong>next <strong>sitting</strong> day.”25. The Conference agreed to elaborate Rule 15 in order to outline <strong>the</strong>circumstances under which a member may move a motion, withoutnotice, that members <strong>of</strong> <strong>the</strong> public be ordered to leave <strong>the</strong> Chamber.26. Rule 20 was deleted as its contents were already covered by Rule 48 <strong>of</strong><strong>the</strong> draft Regulations.27. The word “and” after Rule 26 (1) (a) was replaced by <strong>the</strong> word “or”.28. The Conference agreed that a new paragraph in Rule 29 be introducedin order to allow members to be referred to by <strong>the</strong>ir names and <strong>the</strong>name <strong>of</strong> <strong>the</strong> organisation <strong>the</strong>y belong to.29. The Conference fur<strong>the</strong>r agreed that <strong>the</strong> term “Points <strong>of</strong> Order” bedefined in <strong>the</strong> draft Rules.21


30. Rule 31 was deleted.31. It was agreed that sub-rule 2 <strong>of</strong> Rule 32 reading “The Chairperson shallauthorise <strong>the</strong> use <strong>of</strong> any o<strong>the</strong>r language in <strong>the</strong> proceedings <strong>of</strong> <strong>the</strong> Conference ifadequate provision has been made for <strong>the</strong> translation <strong>the</strong>re<strong>of</strong> into English.” bedeleted because it was felt that all <strong>the</strong> members could speak English.32. It was agreed that Rule 44 should be deleted as its contents werealready covered by Rule 11.33. The words “Rule 41” were replaced by <strong>the</strong> words “Rule 40”.34. There was an extensive debate on sub-rule (2) <strong>of</strong> Rule 48 <strong>of</strong> <strong>the</strong> draftRules which stated as follows:“(2) All questions before <strong>the</strong> Conference shall be determined by consensus, butin <strong>the</strong> absence <strong>of</strong> consensus, <strong>the</strong> decisions <strong>of</strong> <strong>the</strong> Conference shall bedetermined by a two-thirds majority vote <strong>of</strong> <strong>the</strong> members.”35. Some members were <strong>of</strong> <strong>the</strong> view that this provision meant that in <strong>the</strong>absence <strong>of</strong> consensus on a question before <strong>the</strong> Conference, <strong>the</strong>decisions <strong>of</strong> <strong>the</strong> Conference would be determined by a two-thirdsmajority vote <strong>of</strong> all <strong>the</strong> members <strong>of</strong> <strong>the</strong> Conference.36. While o<strong>the</strong>rs felt that <strong>the</strong> above-mentioned sub-rule meant that <strong>the</strong>decisions <strong>of</strong> <strong>the</strong> Conference would be determined by a two-thirdsmajority vote <strong>of</strong> <strong>the</strong> members present in <strong>the</strong> meeting, if <strong>the</strong>re was noconsensus on a question before <strong>the</strong> Conference.37. In order to make progress on <strong>the</strong> matter, <strong>the</strong> Conference agreed thatsince this provision was a reproduction <strong>of</strong> sub-section (7) <strong>of</strong> section 17<strong>of</strong> <strong>the</strong> Act, <strong>the</strong>n <strong>the</strong> contents <strong>of</strong> sub-rule (2) <strong>of</strong> Rule 48 would have to be22


maintained. However, <strong>the</strong> Conference agreed that a legal opinionshould be sought from <strong>the</strong> Attorney-General or <strong>the</strong> courts as to itsmeaning. It was agreed that this legal opinion be availed to <strong>the</strong>Conference at its next session.38. The Conference agreed to provide a procedure that should be followedin <strong>the</strong> event that <strong>the</strong> Conference failed to garner consensus. It wasagreed that members <strong>of</strong> <strong>the</strong> Conference should be allowed to demand adivision if consensus on a matter is not garnered. In this regard, it wasagreed that not less than one hundred members could demand for adivision. This provision would be extended to <strong>the</strong> committeesestablished by <strong>the</strong> Conference on a proportional basis.39. Following <strong>the</strong> discussion on issues in paragraph 38 above, <strong>the</strong> DraftRules were adopted with Hon. Ronnie Shikapwasha, MP proposingand Engineer Monica Milupi seconding <strong>the</strong> motion for adoption.7. Nominations for <strong>the</strong> Positions <strong>of</strong> Members <strong>of</strong> <strong>the</strong> DisciplinaryCommittee <strong>of</strong> <strong>the</strong> National Constitutional Conference40. Nominations for <strong>the</strong> positions <strong>of</strong> members <strong>of</strong> <strong>the</strong> DisciplinaryCommittee <strong>of</strong> <strong>the</strong> Conference were conducted.41. At <strong>the</strong> end <strong>of</strong> <strong>the</strong> nominations, Hon. Mutale Nalumango, MP, Ms.Grace Lombe Chitambala, Ms. Charity Mpande and Hon. GraceNjapau, MP, emerged unopposed as members <strong>of</strong> <strong>the</strong> DisciplinaryCommittee. Mr Bwalya Chiti also emerged unopposed as <strong>the</strong> member<strong>of</strong> <strong>the</strong> Disciplinary Committee, who was a legal practitioner asrequired by subsection (2) <strong>of</strong> section 16 <strong>of</strong> <strong>the</strong> Act. Nine (9) o<strong>the</strong>rmembers, namely: Hon. Robbie Chizyuka, MP, Hon. Sakwiba Sikota,MP, Mr. Lazarus Chota, Senior Chief Imwiko, Rev. David Masupa, Dr.Cornelius Matandiko, Col. Joseph Miti, Mr. Edwin Sakala and Mr. Sage23


Samuwika successfully filed in <strong>the</strong>ir nominations for <strong>the</strong> positions <strong>of</strong>members <strong>of</strong> <strong>the</strong> Conference.8. Elections <strong>of</strong> Disciplinary Committee Members42. Elections for <strong>the</strong> positions <strong>of</strong> members <strong>of</strong> <strong>the</strong> Disciplinary Committeewere conducted. Dr. Cornelius Matandiko, Senior Chief Imwiko andHon. Sakwiba Sikota, MP, were elected with 332, 276 and 270 votesrespectively. Colonel Joseph Miti received 17 votes, Mr. Edwin Sakala,21 votes, Rev. David Masupa, 36 votes, Mr. Sage Samuwika, 53 votes,Lazarus Chota, 95 votes and Hon. Robbie Chizyuka, MP, 172 votes.9. Composition <strong>of</strong> Committees43. The Secretariat requested members <strong>of</strong> <strong>the</strong> Conference to indicate <strong>the</strong>committees which <strong>the</strong>y preferred to participate in, highlighting <strong>the</strong>irfirst, second and third preferences. Members were requested toindicate <strong>the</strong> above-mentioned preferences in booklets which werecirculated by <strong>the</strong> Secretariat.44. Members were <strong>the</strong>n informed that <strong>the</strong> Secretariat would placemembers into <strong>the</strong> various committees taking into consideration <strong>the</strong>irrespective preferences and areas <strong>of</strong> expertise. The members werefur<strong>the</strong>r informed that <strong>the</strong> membership <strong>of</strong> <strong>the</strong> various committeeswould be presented to <strong>the</strong> Conference at its next session for approval.45. The members were also informed that <strong>the</strong> Conference, at its next<strong>sitting</strong>, would break into committees in order to facilitate <strong>the</strong> election<strong>of</strong> Chairpersons and Vice-Chairpersons <strong>of</strong> those committees. Once thatexercise had been undertaken, <strong>the</strong> Chairperson would proceed to24


announce <strong>the</strong> members <strong>of</strong> <strong>the</strong> General Purposes Committee, who willcomprise <strong>the</strong> Chairpersons and Vice-Chairpersons <strong>of</strong> <strong>the</strong> variouscommittees.10. Date <strong>of</strong> Next Meeting46. Members <strong>of</strong> <strong>the</strong> Conference were informed that <strong>the</strong> date <strong>of</strong> <strong>the</strong> nextmeeting would be communicated at a later date.11. Closing47. In closing, <strong>the</strong> Chairperson thanked <strong>the</strong> members <strong>of</strong> <strong>the</strong> Conference for<strong>the</strong>ir commitment to <strong>the</strong> exercise, which was exhibited by <strong>the</strong> almostone hundred per cent (100%) attendance. He urged <strong>the</strong> members tocontinue with this spirit.48. There being no fur<strong>the</strong>r business to discuss, <strong>the</strong> meeting was adjournedat 23:15 hours.
