92Representation <strong>of</strong> <strong>the</strong> People Act, <strong>1951</strong>(PART II.—Acts <strong>of</strong> Parliament)House <strong>of</strong> Parliament or <strong>of</strong> <strong>the</strong> Legislature <strong>of</strong> a State also to <strong>the</strong> Secretary <strong>of</strong> that House, <strong>and</strong> <strong>the</strong> appropriate authority shallcause to be published in <strong>the</strong> Official Gazette <strong>the</strong> declarations containing <strong>the</strong> names <strong>of</strong> <strong>the</strong> elected c<strong>and</strong>idates.1 [67A. Date <strong>of</strong> election <strong>of</strong> c<strong>and</strong>idate.—For <strong>the</strong> purposes <strong>of</strong> this Act, <strong>the</strong> date on which a c<strong>and</strong>idate is declared by <strong>the</strong>returning <strong>of</strong>ficer under <strong>the</strong> provisions <strong>of</strong> section 53, 2 ***, 3 *** or section 66, to be elected to a House <strong>of</strong> Parliament or <strong>of</strong> <strong>the</strong>Legislature <strong>of</strong> a State 4 *** shall be <strong>the</strong> date <strong>of</strong> election <strong>of</strong> that c<strong>and</strong>idate.]CHAPTER VI.—Multiple Elections68. Vacation <strong>of</strong> seats when elected to both Houses <strong>of</strong> Parliament.—(1) Any person who is chosen a member <strong>of</strong> both<strong>the</strong> Houses <strong>of</strong> <strong>the</strong> People <strong>and</strong> <strong>the</strong> Council <strong>of</strong> States <strong>and</strong> who has not taken his seat in ei<strong>the</strong>r House may, by notice in writingsigned by him <strong>and</strong> delivered to <strong>the</strong> Secretary to <strong>the</strong> Election Commission 5 [within ten days from <strong>the</strong> date, or <strong>the</strong> later <strong>of</strong> <strong>the</strong>dates, on which he is so chosen, intimate] in which <strong>of</strong> <strong>the</strong> Houses he wishes to serve, <strong>and</strong> <strong>the</strong>reupon, his seat in <strong>the</strong> House inwhich he does not wish to serve shall become vacant.(2) In default <strong>of</strong> such intimation within <strong>the</strong> aforesaid period, his seat in <strong>the</strong> Council <strong>of</strong> States shall, at <strong>the</strong> expiration <strong>of</strong>that period, become vacant.(3) Any intimation given under sub-section (1) shall be final <strong>and</strong> irrevocable.6 [(4) For <strong>the</strong> purposes <strong>of</strong> this section <strong>and</strong> <strong>of</strong> section 69, <strong>the</strong> date on which a person is chosen to be a member <strong>of</strong> ei<strong>the</strong>rHouse <strong>of</strong> Parliament shall be in <strong>the</strong> case <strong>of</strong> an elected member, <strong>the</strong> date <strong>of</strong> his election <strong>and</strong> in <strong>the</strong> case <strong>of</strong> a nominatedmember, <strong>the</strong> date <strong>of</strong> first publication in <strong>the</strong> Gazette <strong>of</strong> India <strong>of</strong> his nomination.]69. Vacation <strong>of</strong> seats by persons already members <strong>of</strong> one House on election to o<strong>the</strong>r House <strong>of</strong> Parliament.—(1) If a person who is already a member <strong>of</strong> <strong>the</strong> House <strong>of</strong> <strong>the</strong> People <strong>and</strong> has taken his seat in such House is chosen amember <strong>of</strong> <strong>the</strong> Council <strong>of</strong> States, his seat in <strong>the</strong> House <strong>of</strong> <strong>the</strong> People shall, 7 [on <strong>the</strong> date on which he is so chosen], becomevacant.(2) If a person who is already a member <strong>of</strong> <strong>the</strong> Council <strong>of</strong> States <strong>and</strong> has taken his seat in such Council is chosen amember <strong>of</strong> <strong>the</strong> House <strong>of</strong> <strong>the</strong> People, his seat in <strong>the</strong> Council <strong>of</strong> States shall, 7 [on <strong>the</strong> date on which he is so chosen], becomevacant.*70. Election to more than one seat in ei<strong>the</strong>r House <strong>of</strong> Parliament or in <strong>the</strong> House or ei<strong>the</strong>r House <strong>of</strong> <strong>the</strong>legislature <strong>of</strong> a State.—If a person is elected to more than one seat in ei<strong>the</strong>r House <strong>of</strong> Parliament or in <strong>the</strong> House or ei<strong>the</strong>rHouse <strong>of</strong> <strong>the</strong> Legislature <strong>of</strong> a State, <strong>the</strong>n, unless within <strong>the</strong> prescribed time he resigns all but one <strong>of</strong> <strong>the</strong> seats 8 [by writingunder his h<strong>and</strong> addressed to <strong>the</strong> Speaker or Chairman, as <strong>the</strong> case may be, or to such o<strong>the</strong>r authority or <strong>of</strong>ficer as may beprescribed], all <strong>the</strong> seats shall become vacant.CHAPTER VII.—Publication <strong>of</strong> election Results <strong>and</strong> Nominations9 [71. Publication <strong>of</strong> results <strong>of</strong> elections to <strong>the</strong> Council <strong>of</strong> States <strong>and</strong> <strong>of</strong> names <strong>of</strong> persons nominated by <strong>the</strong>President.—After <strong>the</strong> elections held in any year in pursuance <strong>of</strong> <strong>the</strong> notifications issued under section 12, <strong>the</strong>re shall benotified by <strong>the</strong> appropriate authority in <strong>the</strong> Official Gazette <strong>the</strong> names <strong>of</strong> members elected by <strong>the</strong> elected members <strong>of</strong> <strong>the</strong>______________________________________________________________________________________________________1. Publication <strong>of</strong> results <strong>of</strong> general elections to <strong>the</strong> House <strong>of</strong> <strong>the</strong> People <strong>and</strong> <strong>the</strong> State Legislative Assemblies.—Where a general election is held for <strong>the</strong> purpose <strong>of</strong> constituting a new House <strong>of</strong> <strong>the</strong> People or a new State LegislativeAssembly, <strong>the</strong>re shall be notified by 2 [<strong>the</strong> Election Commission] in <strong>the</strong> Official Gazette, as soon as may be after 3 [<strong>the</strong> results<strong>of</strong> <strong>the</strong> elections in all <strong>the</strong> constituencies] [o<strong>the</strong>r than those in which <strong>the</strong> poll could not be taken for any reason on <strong>the</strong> dateoriginally fixed under clause (d) <strong>of</strong> section 30 or for which <strong>the</strong> time for completion <strong>of</strong> <strong>the</strong> election has been extended under<strong>the</strong> provisions <strong>of</strong> section 153] have been declared by <strong>the</strong> returning <strong>of</strong>ficer under <strong>the</strong> provisions <strong>of</strong> section 53 or, as <strong>the</strong> casemay be, section 66, <strong>the</strong> names <strong>of</strong> <strong>the</strong> members elected for those constituencies] 4 * * * <strong>and</strong> upon <strong>the</strong> issue <strong>of</strong> such notificationthat House or Assembly shall be deemed to be duly constituted:Provided that <strong>the</strong> issue <strong>of</strong> such notification shall not be deemed—5 [(a) to preclude—(i) <strong>the</strong> taking <strong>of</strong> <strong>the</strong> poll <strong>and</strong> <strong>the</strong> completion <strong>of</strong> <strong>the</strong> election in any Parliamentary or Assembly constituency orconstituencies in which <strong>the</strong> poll could not be taken for any reason on <strong>the</strong> date originally fixed under clause (d) <strong>of</strong>section 30; or(ii) <strong>the</strong> completion <strong>of</strong> <strong>the</strong> election in any Parliamentary or Assembly constituency or constituencies for whichtime has been extended under <strong>the</strong> provisions <strong>of</strong> section 153; or](b) to affect <strong>the</strong> duration <strong>of</strong> <strong>the</strong> House <strong>of</strong> <strong>the</strong> People or <strong>the</strong> State Legislative Assembly, if any, functioningimmediately before <strong>the</strong> issue <strong>of</strong> <strong>the</strong> said notification.6 [73A. Special provisions as to certain elections.—Notwithst<strong>and</strong>ing anything contained in section 73 or in anyo<strong>the</strong>r provision <strong>of</strong> this Act, with respect to <strong>the</strong> general election for <strong>the</strong> purpose <strong>of</strong> constituting a new House <strong>of</strong> <strong>the</strong>People upon dissolution <strong>of</strong> <strong>the</strong> Ninth House <strong>of</strong> <strong>the</strong> People,—(a) <strong>the</strong> notification under section 73 may be issued without taking into account <strong>the</strong> Parliamentary constituenciesin <strong>the</strong> State <strong>of</strong> Jammu <strong>and</strong> Kashmir; <strong>and</strong>(b) <strong>the</strong> Election Commission may take <strong>the</strong> steps in relation to elections from <strong>the</strong> Parliamentary constituenciesin <strong>the</strong> State <strong>of</strong> Jammu <strong>and</strong> Kashmir separately <strong>and</strong> in such manner <strong>and</strong> no such date or dates as it may deemappropriate.]74. Publication <strong>of</strong> results <strong>of</strong> elections to <strong>the</strong> State Legislative Councils <strong>and</strong> <strong>of</strong> names <strong>of</strong> persons nominated tosuch Councils.—After <strong>the</strong> elections held 7 [in pursuance <strong>of</strong> <strong>the</strong> notifications issued under section 15A or] in any year inpursuance <strong>of</strong> <strong>the</strong> notifications issued under section 16, <strong>the</strong>re shall be notified by <strong>the</strong> appropriate authority in <strong>the</strong> OfficialGazette <strong>the</strong> names <strong>of</strong> <strong>the</strong> members elected for <strong>the</strong> various Council constituencies <strong>and</strong> by <strong>the</strong> members <strong>of</strong> <strong>the</strong> LegislativeAssembly <strong>of</strong> <strong>the</strong> State at <strong>the</strong> said elections toge<strong>the</strong>r with <strong>the</strong> names <strong>of</strong> any persons nominated by <strong>the</strong> Governor 8 *** undersub-clause (e) <strong>of</strong> clause (3) <strong>of</strong> article 171.]______________________________________________________________________________________________________1.
