First, it encourages settlement negotiations by notify<strong>in</strong>g the prospective defendant of claims<br />

aris<strong>in</strong>g from his allegedly unlawful conduct and thereby reduc<strong>in</strong>g the amount of litigation. See<br />

Casavant v. Norwegian Cruise L<strong>in</strong>e Ltd., 460 Mass. 500, 505 (2011). Second, it may limit the<br />

amount of damages recoverable by the pla<strong>in</strong>tiff if he proves his case. Slaney v. Westwood Au<strong>to</strong>,<br />

Inc., 366 Mass. 688, 689 (1975).<br />

The demand letter is a prerequisite <strong>to</strong> suit, which must be alleged and proved by the<br />

pla<strong>in</strong>tiff. Spr<strong>in</strong>g v. Geriatric Authority of Holyoke, 394 Mass. 274, 287 (1985); York v.<br />

Sullivan, 369 Mass. 157, 163 (1975). A proper demand letter must conta<strong>in</strong> certa<strong>in</strong> language<br />

which will apprise the recipient that the letter seeks relief under chapter <strong>93A</strong>. Cassano v. Goqos,<br />

20 Mass. App. Ct. 348, 350 (1985). The Cassano Court listed the follow<strong>in</strong>g options, any one of<br />

which will satisfy the requirement that the letter characterize the claim as one under <strong>Chapter</strong><br />

<strong>93A</strong>:<br />

Id.<br />

1. Any express reference <strong>to</strong> c. <strong>93A</strong>;<br />

2. Any express reference <strong>to</strong> the consumer protection act;<br />

3. Any assertion that the rights of the pla<strong>in</strong>tiffs as consumers have been violated;<br />

4. Any assertion that the defendant has acted <strong>in</strong> an unfair manner (G.L. c. <strong>93A</strong>, §<br />

2[a]);<br />

5. Any reference that the pla<strong>in</strong>tiffs anticipate a settlement offer with<strong>in</strong> thirty days; or<br />

6. Any assertion that the pla<strong>in</strong>tiff will pursue multiple damages and legal expenses<br />

should relief be denied.<br />

The demand letter must also reasonably describe the unfair or deceptive act(s) alleged.<br />

Richards v. Arteva Specialties S.A.R.L., 66 Mass. App. Ct. 726, 731 (2006). For <strong>in</strong>stance, the<br />

pla<strong>in</strong>tiff’s failure <strong>to</strong> identify a particular statute or regulation <strong>in</strong> the demand letter, the violation<br />

of which the pla<strong>in</strong>tiff claims is a breach of <strong>93A</strong>, will foreclose recovery as a matter of law.<br />
