<strong>in</strong>vestigate the claim, does not have access <strong>to</strong> the evidence which can provide the most complete<br />

understand<strong>in</strong>g of the claim at the pre-suit stage. Therefore, as an <strong>in</strong>itial matter, upon receipt of<br />

the demand letter, defense counsel should contact pla<strong>in</strong>tiff’s counsel <strong>to</strong> request an extension of<br />

time <strong>to</strong> <strong>in</strong>vestigate and <strong>to</strong> ask for the <strong>in</strong>formation needed <strong>to</strong> assess the demand. Any extension<br />

granted should be confirmed by letter and that <strong>in</strong>itial letter should request the <strong>in</strong>formation needed<br />

<strong>to</strong> conduct the <strong>in</strong>vestigation. All of these exchanges should be <strong>in</strong> writ<strong>in</strong>g so that, later, the court<br />

will have objective proof that the defendant acted reasonably and complied with the duty <strong>to</strong><br />

<strong>in</strong>vestigate.<br />

I. Information Request Letter<br />

While there is no exact science as <strong>to</strong> what should be <strong>in</strong>cluded <strong>in</strong> the defendant’s <strong>in</strong>itial<br />

request letter, the written request should <strong>in</strong>form pla<strong>in</strong>tiff’s counsel that the defendant requires<br />

additional <strong>in</strong>formation <strong>in</strong> order <strong>to</strong> respond adequately and appropriately <strong>to</strong> the demand letter.<br />

This letter should <strong>in</strong>clude specific requests for <strong>in</strong>formation such as:<br />

• A prelim<strong>in</strong>ary exam<strong>in</strong>ation of the product at issue;<br />

• A specific explanation of the precise manner <strong>in</strong> which the product was defective<br />

and how it caused the pla<strong>in</strong>tiff’s accident and/or <strong>in</strong>juries;<br />

• Any expert reports regard<strong>in</strong>g the defective condition of the product at issue;<br />

• Any test<strong>in</strong>g or <strong>in</strong>vestigation the pla<strong>in</strong>tiff’s reta<strong>in</strong>ed expert has performed<br />

<strong>in</strong>clud<strong>in</strong>g any alteration of the evidence;<br />

• Documentation regard<strong>in</strong>g the ownership of the product <strong>in</strong>clud<strong>in</strong>g all <strong>in</strong>voices,<br />

owner's manuals and warranty materials which came with the product;<br />

• Documents concern<strong>in</strong>g repair and ma<strong>in</strong>tenance work performed on the product<br />

and a description of all such work <strong>to</strong> the extent that the pla<strong>in</strong>tiff knows this<br />

<strong>in</strong>formation;<br />

• Documentation of the pla<strong>in</strong>tiff's claimed damages <strong>in</strong>clud<strong>in</strong>g any lost wages,<br />

medical expenses or other losses;<br />

• Pla<strong>in</strong>tiff's complete medical records and any pho<strong>to</strong>graphs of the <strong>in</strong>juries;<br />

• The names and addresses of any witnesses <strong>to</strong> the accident;<br />

• A complete explanation of how the accident happened; and<br />

• Any police reports or other official reports regard<strong>in</strong>g the accident.<br />
