It outlines <str<strong>on</strong>g>the</str<strong>on</strong>g>necessity for revising <str<strong>on</strong>g>the</str<strong>on</strong>g>se particular Codes which relate to <str<strong>on</strong>g>the</str<strong>on</strong>g> detenti<strong>on</strong>, treatmentand questi<strong>on</strong>ing <strong>of</strong> pers<strong>on</strong>s by police and audio and visual recording with sound <strong>of</strong>interviews with suspects.A refresh <strong>of</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Codes is needed to keep abreast <strong>of</strong> technological developmentsthrough gradual introducti<strong>on</strong> <strong>of</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> use <strong>of</strong> secure digital recording <strong>of</strong> interviews in policecustody suites; as a c<strong>on</strong>sequence <strong>of</strong> changes to terrorism provisi<strong>on</strong>s for post-chargequesti<strong>on</strong>ing with judicial oversight <strong>of</strong> detained pers<strong>on</strong>s; to reduce pre-charge detenti<strong>on</strong>for terrorist suspects to 14 days and as a c<strong>on</strong>tingency measure in emergencycircumstances for pre-charge detenti<strong>on</strong> up to 28 days for terrorist suspects.This <str<strong>on</strong>g>c<strong>on</strong>sultati<strong>on</strong></str<strong>on</strong>g> also provides an opportunity to <strong>of</strong>fer comments <strong>on</strong> proposals for <str<strong>on</strong>g>the</str<strong>on</strong>g>use <strong>of</strong> appropriate healthcare pr<strong>of</strong>essi<strong>on</strong>als in police custody suites as set out atAppendix 1. However, <strong>on</strong> devoluti<strong>on</strong> <strong>of</strong> justice resp<strong>on</strong>sibility for <str<strong>on</strong>g>the</str<strong>on</strong>g><strong>PACE</strong> Codes <strong>of</strong> Practice that set out how people detained in police custody in Nor<str<strong>on</strong>g>the</str<strong>on</strong>g>rnIreland are to be treated, transferred to <str<strong>on</strong>g>the</str<strong>on</strong>g> Department <strong>of</strong> Justice and <str<strong>on</strong>g>the</str<strong>on</strong>g>refore comewithin <str<strong>on</strong>g>the</str<strong>on</strong>g> ambit <strong>of</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Justice Minister and wider Assembly.


Building a fair, just and safer communityThe proposed changes which are available separately for <str<strong>on</strong>g>c<strong>on</strong>sultati<strong>on</strong></str<strong>on</strong>g> are outlinedbelow.Code C (Detenti<strong>on</strong>, Treatment and Questi<strong>on</strong>ing <strong>of</strong> Pers<strong>on</strong>s by Police Officers)Healthcare for detained pers<strong>on</strong>s in police custody suites is provided by ForensicMedical Officers. C<strong>on</strong>siderati<strong>on</strong> is being given to broaden <str<strong>on</strong>g>the</str<strong>on</strong>g> scope <strong>of</strong> healthcareprovisi<strong>on</strong> to that provided by appropriate healthcare pr<strong>of</strong>essi<strong>on</strong>als. See Appendix 1.Code E (Audio recording <strong>of</strong> interviews with suspects) and Code F (Visual recordingwith sound <strong>of</strong> interviews with suspects)Tape recordings are becoming outdated and <str<strong>on</strong>g>the</str<strong>on</strong>g> Code revisi<strong>on</strong>s are required to keepabreast <strong>of</strong> technological developments by making provisi<strong>on</strong> for gradual introducti<strong>on</strong> <strong>of</strong>secure digital audio and visual (with sound) recording equipment in police custodysuites.Code H (Detenti<strong>on</strong>, Treatment and Questi<strong>on</strong>ing <strong>of</strong> terrorism suspects)Revisi<strong>on</strong>s create <str<strong>on</strong>g>the</str<strong>on</strong>g> same flexibility for delivery <strong>of</strong> healthcare to people detained underterrorism legislati<strong>on</strong> and mirror those in Code C.O<str<strong>on</strong>g>the</str<strong>on</strong>g>r revisi<strong>on</strong>s arise as a c<strong>on</strong>sequence <strong>of</strong> terrorism policy changes that are exceptedmatters. In summary -• The Parliamentary Joint Committee <strong>on</strong> Human Rights was critical <strong>of</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> lengthyperiods <strong>of</strong> detenti<strong>on</strong> without charge <strong>of</strong> some terrorist suspects and post chargequesti<strong>on</strong>ing is being brought in by way <strong>of</strong> remedy. This is to encourage <str<strong>on</strong>g>the</str<strong>on</strong>g>police to lay charges at <str<strong>on</strong>g>the</str<strong>on</strong>g> earliest opportunity but with <str<strong>on</strong>g>the</str<strong>on</strong>g> proviso that fur<str<strong>on</strong>g>the</str<strong>on</strong>g>rquesti<strong>on</strong>ing may be permitted, subject to judicial oversight, should new evidencecome to light.• 28-day detenti<strong>on</strong> <strong>of</strong> terrorist suspects is subject to annual renewal. It has notbeen renewed this year and is to be repealed as part <strong>of</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Protecti<strong>on</strong> <strong>of</strong>Freedoms Bill. Detenti<strong>on</strong> will <str<strong>on</strong>g>the</str<strong>on</strong>g>refore revert to a 14-day limit, but an emergencyBill is to be held at Westminster to enable a reversi<strong>on</strong> to 28 days in extremis.Code amendments need to reflect <str<strong>on</strong>g>the</str<strong>on</strong>g> new 14 day limit and <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>tingencyarrangement <strong>of</strong> 28 days.The c<strong>on</strong>sequential Code H revisi<strong>on</strong>s set out operati<strong>on</strong>al guidance for <str<strong>on</strong>g>the</str<strong>on</strong>g> police andprovide necessary safeguards and protecti<strong>on</strong>s for people detained under terrorismlegislati<strong>on</strong>.A new terrorism code <strong>of</strong> practice issued under s41 <strong>of</strong>, and Schedule 8 to, <str<strong>on</strong>g>the</str<strong>on</strong>g> TerrorismAct 2000 and secti<strong>on</strong> 25 <strong>of</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Counter-Terrorism Act 2008 for <str<strong>on</strong>g>the</str<strong>on</strong>g> video recording withsound <strong>of</strong> interviews in terrorism cases is being published separately for <str<strong>on</strong>g>c<strong>on</strong>sultati<strong>on</strong></str<strong>on</strong>g> andwill be accessible throughhttp://www.nio.gov.uk/index/public-<str<strong>on</strong>g>c<strong>on</strong>sultati<strong>on</strong></str<strong>on</strong>g>/documents.htm

Building a fair, just and safer communityAPPENDIX 1REVIEW OF PSNI HEALTHCARE ARRANGEMENTS FOR DETAINED PERSONSThe PSNI is c<strong>on</strong>ducting an internal review <strong>of</strong> healthcare arrangements in police custodysuites. The review is an integral part <strong>of</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Policing Board’s C<strong>on</strong>tinuous ImprovementPerformance Plan (Part 3).<strong>PACE</strong> Codes currently restrict healthcare for detained pers<strong>on</strong>s in police custody to thatprovided by Forensic Medical Officers (FMOs). A FMO is a General Practiti<strong>on</strong>er whoprovides <str<strong>on</strong>g>the</str<strong>on</strong>g> service <strong>on</strong> an “<strong>on</strong> call” basis. The FMO normally provides <str<strong>on</strong>g>the</str<strong>on</strong>g> totality <strong>of</strong>healthcare whilst <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> remains in police custody although an individual canrequest <str<strong>on</strong>g>the</str<strong>on</strong>g>ir own GP provided <str<strong>on</strong>g>the</str<strong>on</strong>g>y bear <str<strong>on</strong>g>the</str<strong>on</strong>g> cost.In order to facilitate <str<strong>on</strong>g>the</str<strong>on</strong>g> outworking <strong>of</strong> any review in terms <strong>of</strong> greater flexibility <strong>of</strong> serviceprovisi<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> current <strong>PACE</strong> Codes would need to be amended to that <strong>of</strong> AppropriateHealthcare Pr<strong>of</strong>essi<strong>on</strong>al (AHP). An AHP means a clinically qualified pers<strong>on</strong> workingwithin <str<strong>on</strong>g>the</str<strong>on</strong>g> scope <strong>of</strong> practice as determined by <str<strong>on</strong>g>the</str<strong>on</strong>g>ir relevant pr<strong>of</strong>essi<strong>on</strong>al body. Whe<str<strong>on</strong>g>the</str<strong>on</strong>g>ra healthcare pr<strong>of</strong>essi<strong>on</strong>al is “appropriate” depends <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> circumstances <strong>of</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> duties<str<strong>on</strong>g>the</str<strong>on</strong>g>y carry out at <str<strong>on</strong>g>the</str<strong>on</strong>g> time. This term would encompass <str<strong>on</strong>g>the</str<strong>on</strong>g> current FMOs but wouldallow for o<str<strong>on</strong>g>the</str<strong>on</strong>g>rs e.g. psychiatric nurses to augment <str<strong>on</strong>g>the</str<strong>on</strong>g> current service.The proposed Code change would be enabling <strong>on</strong>ly. It would not remove resp<strong>on</strong>sibilityfrom <str<strong>on</strong>g>the</str<strong>on</strong>g> police to ensure that a detained pers<strong>on</strong> receives appropriate healthcare asso<strong>on</strong> as reas<strong>on</strong>ably practicable if <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> appears to be suffering from physicalillness or a mental disorder; is injured or o<str<strong>on</strong>g>the</str<strong>on</strong>g>rwise appears to be in need <strong>of</strong> medicalattenti<strong>on</strong>. However, it is clear that individual needs are becoming increasingly complex,with a significant number <strong>of</strong> detained pers<strong>on</strong>s presenting with addicti<strong>on</strong> issues,psychiatric issues, or are assessed as being at risk due to <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir emoti<strong>on</strong>al state.


Building a fair, just and safer communityIn <str<strong>on</strong>g>the</str<strong>on</strong>g> wider healthcare c<strong>on</strong>text <str<strong>on</strong>g>the</str<strong>on</strong>g> clinical resp<strong>on</strong>se to address <str<strong>on</strong>g>the</str<strong>on</strong>g>se c<strong>on</strong>diti<strong>on</strong>s, hasalso become more complex, with an increasing number <strong>of</strong> healthcare pr<strong>of</strong>essi<strong>on</strong>alstrained in specialist roles, to deliver an increasing variety <strong>of</strong> interventi<strong>on</strong>s, aimed atdealing specifically with <str<strong>on</strong>g>the</str<strong>on</strong>g> individual’s healthcare needs. By widening <str<strong>on</strong>g>the</str<strong>on</strong>g> availableresources to address such issues <str<strong>on</strong>g>the</str<strong>on</strong>g> PSNI will be afforded <str<strong>on</strong>g>the</str<strong>on</strong>g> opportunity to enhance<str<strong>on</strong>g>the</str<strong>on</strong>g> service currently provided by Forensic Medical Officers, whose services will still berequiredFor example, a specific potential service enhancement may include a permanentnursing provisi<strong>on</strong> within <str<strong>on</strong>g>the</str<strong>on</strong>g> larger custody suites. That would <strong>of</strong>fer a much greater level<strong>of</strong> pr<strong>of</strong>essi<strong>on</strong>al judgement in terms <strong>of</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> initial risk assessment which under currentarrangements is carried out by a custody Sergeant.More generally, greater involvement and earlier interventi<strong>on</strong> by healthcarepr<strong>of</strong>essi<strong>on</strong>als, from a nursing and psychiatric background, is expected to lead toimproved referrals to appropriate services to deal with any <strong>on</strong>going issues that anindividual may have. The overall benefit would be a more holistic approach to dealingwith <str<strong>on</strong>g>the</str<strong>on</strong>g> causes <strong>of</strong> <strong>of</strong>fending behaviour, and <strong>of</strong>fer better outcomes in terms <strong>of</strong> health &wellbeing and reduced <strong>of</strong>fending.The cost <strong>of</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> existing FMO service currently runs at over £3 milli<strong>on</strong> pounds perannum, for a custody throughput <strong>of</strong> approximately 39000 attendances by detainedpers<strong>on</strong>s. This is c<strong>on</strong>siderably higher than <str<strong>on</strong>g>the</str<strong>on</strong>g> closest comparable services in <str<strong>on</strong>g>the</str<strong>on</strong>g> UnitedKingdom. It is believed that a saving <strong>of</strong> approximately 10% can be delivered, whilst at<str<strong>on</strong>g>the</str<strong>on</strong>g> same time enhancing <str<strong>on</strong>g>the</str<strong>on</strong>g> service delivered to <str<strong>on</strong>g>the</str<strong>on</strong>g> detained pers<strong>on</strong>s.
