Notes on Political Influence in New YorkThis report expresses influence as a product <strong>of</strong> a.) lobbying and b.) campaigncontributions. While both mechanisms are commonly used to influence elected <strong>of</strong>ficials,they differ in several key respects.Lobbying is defined as activities meant to influence the passage or defeat <strong>of</strong> anylegislation by either house <strong>of</strong> the state legislature or approval or disapproval <strong>of</strong> anylegislation by the governor. Lobbying, in short, involves legislation, orders, and rules. Allpersons or organizations which spend more than $5,000 on lobbying in any given yearmust register as a lobbyist with the Joint Commission on Public Ethics (JCOPE) anddisclose all lobbying-related spending publicly. There is no monetary limit on lobbyingspending in New York.Campaign contributions are expenditures expressly made to impact the outcome <strong>of</strong> anelection <strong>of</strong> a public <strong>of</strong>ficial. All campaign contributions are reported to the state Board<strong>of</strong> Elections. In New York, individuals and limited liability companies (LLCs) may give upto $150,000 in political contributions annually, incorporated businesses and nonpr<strong>of</strong>itsmay contribute up to $5,000, and partnerships may contribute up to $150,000 perindividual partner. 1Campaign contributions by special interest groups are typically made through anassociated political action committee (PAC). The New York State Trial LawyersAssociation operates the LAWPAC committee, and the New York State Academy <strong>of</strong> TrialLawyers operates the ATL PAC committee. These committees and their relatedorganizations are used interchangeably in this report for purposes <strong>of</strong> convenience andclarity.This report does not analyze elected <strong>of</strong>ficials’ outside income, such as serving “<strong>of</strong>counsel” for a plaintiffs’ firm. It is not possible for us to conclusively distinguishbetween legitimate outside income and payments intended to influence public <strong>of</strong>ficials;this is the responsibility <strong>of</strong> duly authorized law enforcement <strong>of</strong>ficials.Furthermore, it is important to bear in mind that this report analyzes only the monetaryinputs into state politics – the report does not attempt to quantify the outputs resultingfrom or attributable to such activity (for example, the enactment <strong>of</strong> legislation which isbeneficial to plaintiffs’ lawyers).1 Because most law firms are organized as partnerships rather than corporations, their ability to makecampaign contributions is substantially higher than other businesses <strong>of</strong> comparable size.4


Summary <strong>of</strong> FindingsLobbyingIn 2014, the two plaintiffs’ lawyer special interest groups, the New York State TrialLawyers Association (NYSTLA) and New York State Academy <strong>of</strong> Trial Lawyers (NYSATL),spent a record high $1,264,098 lobbying New York elected <strong>of</strong>ficials, representing an11% increase over the previous year and a 51% increase since 2010.Campaign ContributionsIn 2014, plaintiffs’ lawyers as a whole 1 made a record high $1,825,854 in politicalcontributions to state elected <strong>of</strong>ficials, an increase <strong>of</strong> 42% over the previous year,including:- $1,094,693 from NYSTLA and NYSATL political action committees- $731,161 from individual plaintiffs’ lawyers and law firms associated withNYSTLA and NYSATLIn 2014, NYSTLA, the dominant plaintiffs’ lawyer special interest group in New York,contributed $1,081,943 to state-level campaigns, including:- 79% <strong>of</strong> all the members <strong>of</strong> the legislature- 87% <strong>of</strong> the Senate- 76% <strong>of</strong> the AssemblyIn 2014, NYSTLA contributed $319,600 to campaign committee accounts:- $102,300 to the Democratic Assembly Campaign Committee- $60,000 to the Democratic Senate Campaign Committee- $102,300 to the Senate Republican Campaign Committee- $35,000 to the Republican Assembly Campaign Committee- $20,000 to the Senate Independent Democratic Conference committeeIn 2014, plaintiffs’ lawyers as a whole contributed $116,400 to statewide <strong>of</strong>ficecampaigns, including:- $102,300 to the New York State Democratic Committee 2- $8,300 to one <strong>Attorney</strong> General candidate- $5,800 to one Comptroller candidate1 Includes LAWPAC, ATL PAC, and contributions by individual plaintiffs’ lawyers associated with thesegroups. Instead, they contributed the maximumlegal amount to the state Democratic Committee, which spent heavily on the election.5


MethodologySourcesData for this report was aggregated from publicly available reports. Figures for lobbyingexpenditures were obtained from the Joint Commission on Public Ethics (JCOPE), andtotals for campaign contributions were calculated using New York State Board <strong>of</strong>Elections campaign finance disclosure reports.Total lobbying dollars were calculated as the sum total <strong>of</strong> all “reportable lobbyingexpenses” and “reportable lobbying compensation” reported on the JCOPE Client Semi-Annual Reports <strong>of</strong> NYSTLA and the NYSATL. These two groups overwhelmingly representplaintiffs’ attorneys and their interests.Total plaintiffs’ lawyer PAC campaign contributions were calculated as the sum total <strong>of</strong>all campaign contributions to candidates by the two plaintiffs’ lawyer political actioncommittees, NYSTLA’s LAWPAC and NYSATL’s ATL PAC. In terms <strong>of</strong> total dollarcontributions, LAWPAC is the dominant committee by an overwhelming margin. In thecases where ATL PAC did not make political contributions, only contributions byLAWPAC were analyzed.Contributions by law firms and lawyers were calculated by identifying contributionsmade to candidates by individuals and firms who also contributed to LAWPAC and ATLPAC. Instead, LAWPAC contributed $102,300 to the New YorkState Democratic Committee, which spent heavily on the election. Individual lawyers and law firms affiliated withNYSTLA and NYSATL contributed $70,292 to <strong>Attorney</strong> General candidates.ComptrollerIn 2014, LAWPAC contributed a total <strong>of</strong> $5,800 to Comptroller Thomas DiNapoli.ATL PAC did not make any contributions. Individual lawyers and law firms affiliatedwith NYSTLA and NYSATL contributed $11,850 to comptroller candidates.1 Lobbying reports disclose which bodies the organization has lobbied, and the number or description <strong>of</strong>any specific legislation or regulation lobbied. During 2014, both NYSTLA and NYSATL reported that theylobbied the Governor and both houses <strong>of</strong> the state legislature.8


Campaign CommitteesIn addition to contributing to campaigns directly, NYSTLA also supports candidates bymaking contributions to party campaign committees. These committees may receive upto $102,300 annually 1 per individual, partnership, or PAC, and up to $5,000 annuallyfrom a corporation. They may make unlimited contributions to candidates. Between2006 and 2014, LAWPAC made substantial contributions to campaign committees,frequently reaching the legal maximum. LAWPAC Contributions to Campaign Committees2006-2014The LegislatureMuch <strong>of</strong> the NYSTLA’s campaigncontributions are directed to members<strong>of</strong> the legislature. In 2014, 79% <strong>of</strong> allstate legislators received campaigncontributions from LAWPAC. Fully87% <strong>of</strong> state senators and 76% <strong>of</strong>members <strong>of</strong> assembly receivedcampaign contributions from LAWPAC.Receivedcontributions79%Nocontributions21%Legislative CommitteesAll legislation must be reviewed by theappropriate legislative committeesbefore being considered for a vote bythe full house. Our analysis <strong>of</strong> campaign finance data reveals that NYSTLA and NYSATLmake substantial campaign contributions to the powerful Rules and Finance/Ways andMeans committees, as well as the committees which consider legislation relating to civillaw (Judiciary and Codes, in the Senate and Assembly). The graphics on the followingpages highlight the extent <strong>of</strong> these contributions for the respective committees during2014.10


Rules CommitteesThe Rules committees are chaired by leaders <strong>of</strong> each house, the Senate President ProTempore and the Assembly Speaker respectively, and are populated by the seniormembers <strong>of</strong> each party. The Rules committees have broad influence over the flowand passage <strong>of</strong> legislation. We find that:- Lobbying and political spending by plaintiffs’ lawyers as a whole has increaseddramatically, and as in the prior year, 2014 was a record year for both.- NYSTLA has sufficient resources to seek influence in a targeted mannerthrough contributions to key leaders and legislative committees, and in abroad manner through contributions to a majority <strong>of</strong> state legislators.- Given recent accusations <strong>of</strong> bias and favoritism toward plaintiffs’ firms in NewYork’s trial courts, 2,3,4 the contributions made by plaintiffs’ lawyers and firmsto Supreme Court candidates merits further investigation.Plaintiffs’ lawyers as a whole expend considerable resources to push the boundaries <strong>of</strong>civil liability and increase pr<strong>of</strong>its for their members.
