MILL RUN HOMEOWNERS' ASSOCIATION, INC.RULES AND REGULATIONSIn accordance with Article IV, Section 39 of the Declaration of Covenants, Conditions, <strong>and</strong> Restrictions for <strong>Mill</strong><strong>Run</strong> Homeowners' Association, Inc. (the "Association") hereby enacts the following set of <strong>Rules</strong> <strong>and</strong> <strong>Regulations</strong>governing all sections <strong>and</strong> phases of the <strong>Mill</strong> <strong>Run</strong> subdivision in Davidson County, Tennessee.I. ASSESSMENTSThere shall be an Annual Assessment, which shall be assessed yearly against each lot in <strong>Mill</strong> <strong>Run</strong>. This AnnualAssessment shall be set by the Board of Directors <strong>and</strong> shall be modifiable at the discretion of the Board ofDirectors as needed. The Annual Assessment will be payable each year with payment options available.II. USE RESTRICTIONSResidential Structures Only. No lot may be used for any purpose except for the construction <strong>and</strong> maintenance ofa residential building, <strong>and</strong> no such residential structure on any such lot shall be designed, constructed or used formore than one family. No lot or any portion thereof shall be used for a roadway to adjoining l<strong>and</strong>s.No Resubdivision. No lot shall be re-subdivided, but shall remain as shown on the recorded plat. A slightvariance in the property lines may be made by adjacent owners, but not for the purpose of subdividing into morelots.Maintenance of Lot <strong>and</strong> Exterior Structure. All lots must be maintained in a neat, safe <strong>and</strong> attractive conditionby their owner. Lawns must be mowed on a regular basis with grass clippings properly removed from driveways,sidewalks, <strong>and</strong> streets. Shrubs, hedges <strong>and</strong> trees must be pruned. Flower beds must be kept clear of leaves,debris <strong>and</strong> weeds. Dead flowers, shrubs, <strong>and</strong> hedges must be removed. Additional maintenance shall include,but not limited to painting, repairing, replacing <strong>and</strong> caring for roofs, gutters, shutters, downspouts, siding,driveways, exterior doors, window screens, garages, fences, porches, railings, <strong>and</strong> other exterior improvements.Street-facing window air conditioners are not allowed. Failure to comply with this rule will result in a fine of $25for each occurrence after one written warning.Recreational Equipment <strong>and</strong> Toys. Following use, all recreational equipment <strong>and</strong> toys shall be kept in such amanner as not to be visible from the street. Such recreational equipment shall include, but not limited to bikes,basketball goals, infant pools, play yards, <strong>and</strong> other toys/equipment. Failure to comply with this rule will result ina fine of $25 for each occurrence after one written warning.Holiday Décor. Exterior holiday décor must be removed by the 10th day following the calendar holiday. Suchdécor shall include, but not limited to exterior lights, bows, seasonal characters, <strong>and</strong> other holiday décor. Failure tocomply with this rule will result in a fine of $25 for each occurrence after one written warning.Noxious or Offensive Conduct. No noxious or offensive operations shall be conducted or maintained on anylot <strong>and</strong> nothing shall be constructed, reconstructed or kept on any lot which may constitute an annoyance ornuisance to the neighborhood. The Association is empowered to determine what does or does not constitute"noxious or offensive operations." Failure to comply with this rule will result in a fine of $25 for each occurrenceafter one written warning.Animals. No animals or livestock of any kind shall be allowed or maintained on any lot, except that no morethan four (4) dogs, domestic cats, or other household domestic pets may be kept, provided that they are not keptfor commercial purposes <strong>and</strong> do not otherwise violate any rule contained herein. No poultry of any kind ordescription shall be allowed or maintained on any lot at any time for any purpose. No pets will be allowed to roamfreely <strong>and</strong> must be on a leash when not secured in an enclosure behind the home on in the home. Failure toimmediately remove any pet waste from any common area or private lot will result in an $25 fine for eachoccurrence after one written warning.Trailers. No trailer, basement house, tent, garage, barn, or other outbuilding shall be erected or used as either atemporary or permanent residence. Failure to comply with this rule will result in a fine of $25 for each occurrenceafter one written warning.Signage.Any signage placed on the lot shall be non-illuminated <strong>and</strong> of not more than four square feet.Garbage <strong>and</strong> Refuse Disposal. No lot shall be used or maintained as a dumping ground for rubbish. Trash,garbage or other waste shall not be kept except in sanitary containers. All such containers for the storage of suchmaterial shall be kept in a neat, clean <strong>and</strong> sanitary condition <strong>and</strong> shall be kept in such a manner as not to be visiblefrom the street. Failure to comply with this rule will result in a fine of $25 for each occurrence after one writtenwarning.Lawful Use. No immoral, improper, offensive or unlawful use shall be made of the Common Area or lots norany part thereof; <strong>and</strong> all valid laws, zoning ordinances <strong>and</strong> regulations of all governmental bodies havingjurisdiction thereof shall be observed.


Commercial Businesses.No commercial business may be maintained on the Common Area or on the lots.Alterations. Nothing shall be altered or constructed in or removed from the Common Area except upon thewritten consent of the Association. No l<strong>and</strong>scaping shall be altered or disturbed on the Common Area withoutprior written approval of the Board.Prefabricated Homes. Preassembled structures for residential purposes shall not be permitted even though saidstructure may meet all minimum square footage <strong>and</strong> other requirements.Alterations to the L<strong>and</strong>. No drainage ditches, cuts, swales, streams, impoundments, ponds; no mounds, knolls,dams, hills, or terrain of the lot are allowed without prior approval of the Architectural Committee.Fences. No lot owner may construct or place a fence on the lot owner’s property without the prior approval ofthe Architectural Committee. On corner lots, no fence shall be permitted between the rear corner of the building<strong>and</strong> the street running parallel to the front of the building, <strong>and</strong> any fence facing the street running parallel to side ofthe building shall be erected behind the side set back line. All fences must be maintained in good repair, <strong>and</strong>owners agree to abide by reasonable requests for repairs <strong>and</strong> maintenance. All wood fences must be treated orpainted (must be a wood colored paint or stain) or otherwise maintained to prevent damage <strong>and</strong> wear <strong>and</strong> tear. Afence shall be erected in such a manner so as not to interfere, or restrict with any drainage or easement area.Failure to comply with this rule will result in a fine of $25 for each occurrence after one written warning.Unauthorized Structures. No lot owner may construct or place any outbuilding, i.e storage shed on the lotowner's property without the prior approval of the Architectural Committee. The Architectural Committee shallhave the power to grant conditional authorization to this restriction, including but not limited to specifying theexact size, i.e. not to exceed 10x8 <strong>and</strong>/or the exact location in which such structure can be erected. TheArchitectural Committee shall have the absolute discretion, power <strong>and</strong> authority to determine if an existing storageshed interferes with the aesthetic quality of the subdivision.Parked, <strong>and</strong> Repair of Vehicles. No vehicle may be parked on the grass of a lot or Common Areas. Parkedvehicles may not block neighboring driveways or pedestrian sidewalks. No vehicles of any type shall be parkedupon the properties or in the vicinity of any residence or in the common area for purposes of accomplishing repairsthereto. This restriction shall also apply to all vehicles not in operating condition regardless of whether or not suchvehicles are being repaired. Owners, families, tenants <strong>and</strong> guests should park in the garage <strong>and</strong> driveway tocapacity. If additional parking is required, the vehicle must be parked with the direction of traffic. Owners,families, tenants <strong>and</strong> guests may not park on the lawn adjacent to their driveway or on any l<strong>and</strong>scaped surface.Parking is only permitted on original paved surfaces. Owners shall not park, nor shall they allow their families,guests or tenants to park in any manner which impairs the right of another unit Owner or an Emergency Vehicle tothe use of the public street, nor shall any Owner store vehicles or personal property on, or obstruct, or encroachupon, or permit the use of or permit the obstruction of or encroachment upon, the public street. Failure to complywith this rule will result in a fine of $25 for each occurrence after one written warning.Prolonged Parking, <strong>and</strong> Commercial <strong>and</strong> Recreational Vehicles. There shall be no prolonged outside parkingof commercial or recreational vehicles, including, but not limited to trucks (other than pick-up trucks notexceeding 3/4 ton), camping trailers, boats, <strong>and</strong> motor homes on any lot or common area. Prolonged outsideparking of any type of vehicle as well as utility trailers is prohibited on any lot or common area when suchinterferes with the aesthetic quality of the subdivision. All such vehicles must be placed in the owner's garage orstored at an off-site location or stored on a concrete pad behind a fenced privacy area that prevents the vehiclefrom being seen from the street. The Association shall have absolute discretion, power <strong>and</strong> authority to determineif this restriction is being violated, to allow variances <strong>and</strong> to require conditions on such permitted use. Failure tocomply with this rule will result in a fine of $25 for each occurrence after one written warning.III. MISCELLANEOUS1. Enforceability. If any portion of this document is determined to be legally unenforceable, it shall not negatethe enforceability of the remaining portions of this document.2. Amendments. These <strong>Rules</strong> <strong>and</strong> <strong>Regulations</strong> may be amended from time to time by majority vote of the Boardof Directors.3. Definitions. All definitions <strong>and</strong> terms contained in the Declarations shall apply hereto <strong>and</strong> are incorporatedherein by reference, <strong>and</strong> all terms capitalized herein <strong>and</strong> not defined herein shall have the same meaning as setforth in the Declarations.Established on: September 1st, 2011
