Pairingtwo industry leaders to create this systemwarranty makes sense.Do I have to use products fromProSpec and W.F. Taylor to qualifyfor the Floor System Warranty?Yes. ProSpec and Taylor productshave been tested for compatibility andperformance in a multitude of flooringapplications.Do I have to use every type ofproduct to qualify for the warranty,even if I don’t need it? (e.g.,Moisture Guard Max)No. The product listing simply covers theproducts that are included in each levelof the system warranty. However, anyinstallation is only as good as the evaluationand preparation that goes into it.Do I have to get warranty approvalfrom ProSpec and W.F. Taylor?This warranty program is administeredby ProSpec and must be evaluated andapproved prior to installation. Contact yourlocal sales representative for a job-siteinspection before and after job completion.Contact your local sales representativefor a job-site inspection before andafter if warranty is involved.The following Terms and Conditions and Systems Requirements apply toa Limited System Warranty for ProSpec, a Bonsal American Brand, andW. F. Taylor Branded ProductsTerms and ConditionsSubject to the conditions and limitations in this document, Bonsal American, Inc. warrants to the original owner thatthe ProSpec and W.F. Taylor Co., Inc. products listed in this document will be free from manufacturing defects andwill, with normal usage, perform in accordance with published specifications. For this warranty to apply, the productsmust be installed properly as part of the system in accordance with the respective companies most recently publishedspecifications and industry standard guidelines.System RequirementsThe following products must be used over an approved substrate for the System Warranty to apply. Bonsal Americanwill not be responsible for system failures resulting from use over a damaged, defective or improperly preparedsubstrate and/or framing system. Concrete must conform to ACI 201. Concrete cannot have pre-existing cracks inthe substrate or exhibit vertical plane differences. All installations must conform to the applicable ANSI standards andapplicable building code requirements. Underlayments, selection and use of the moisture mitigation and applicableflooring adhesives products are dependent upon job requirements. It is the responsibility of the owner and/or installer totest and determine the suitability of the material for the intended use.Exclusive RemedyAs the sole and exclusive remedy for breach of this limited warranty, Bonsal American will repair and/or replace, atits discretion, the affected area of the system at a cost not to exceed the original square-foot cost of the portion ofthe system shown to be defective. Proof of original product purchase and installation costs may be required. BonsalAmerican will not pay for repair or replacement of any portion of the system that is not proven to be defective. BonsalAmerican cannot guarantee an exact match to the floor covering. In the event that the exclusive remedy fails, BonsalAmerican’s liability is limited to the dollar value, on a square-foot basis, of the original price of the portion of the systembeing replaced.Limitation of Remedies & DamagesBonsal American is not responsible for structural failure or for workmanship that is not in accordance with the productspecifications, applicable ANSI standards and applicable building code requirements. This warranty does not covernormal wear and tear or cracking due to structural movement, excessive deflection or other failures in the substrateor framing, including damage resulting from weather, topical water, fire and acts of God. THIS LIMITED WARRANTY ISIN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED. BONSAL AMERICAN EXPRESSLY DISCLAIMS ANY OTHERWARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSEAND WARRANTIES ARISING FROM SAMPLES OR ORAL STATEMENTS OR BY OPERATION OF LAW, STATUTE, COURSEOF DEALING, CUSTOM, TRADE OR OTHERWISE. BONSAL AMERICAN SHALL NOT BE LIABLE FOR CONSEQUENTIAL ORINCIDENTAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSSES DUE TO DELAYS OR DISRUPTIONS.Claim ProceduresTo make a claim under this limited warranty, you must notify Bonsal American within 15 days after discoveringany alleged system defect and before performing any repair work. You may be required to provide proof of productpurchase and installation.
