Green Building andLow-carbon City綠 色 建 築 與 低 碳 城 市On 19 June, the HKIS delegates flew to Fuzhou, FujianProvince to attend the Sustainable Urban Form: GreenBuilding and Low-carbon City. The Forum was jointlyorganized by the Development Bureau, HKSAR and theMinistry <strong>of</strong> Hosing and Urban-Rural Development. A largegroup <strong>of</strong> more than 200 <strong>Hong</strong> <strong>Kong</strong> delegates led by MrsCarrie Lam, Secretary for Development, attended theForum.There was a visit to the 4th Exposition on GreenConstruction and Energy Conservation which ranconcurrently with the Forum. This year, the PFM Division<strong>of</strong> the HKIS participated in the exhibition with the ‘greenproperty management’ display boards showing theconcepts <strong>of</strong> waste management, energy saving, waterconsumption reduction, noise/dust control, quality aircontrol and green walls/ro<strong>of</strong>s, etc. The exhibition involvedthe local organizations as well as the pr<strong>of</strong>essionalinstitutes and government departments from <strong>Hong</strong> <strong>Kong</strong>.The subjects covered the planning, design, constructionand maintenance <strong>of</strong> Green buildings. It included sharing <strong>of</strong>their views and tools for green buildings and low-carboncity. There were quite a lot <strong>of</strong> local suppliers showing theenergy saving products related to electricity, water, recycledenergy and green construction materials. We alsomade use <strong>of</strong> this opportunity to introduce our pr<strong>of</strong>essionto the Exhibition and explained our ‘green PropertyManagement’ Philosophy to Mrs Carrie Lam while shewas visiting our stand.The forum drawn animated discussions about our futuregeneration who would suffer from the climatic change orglobal warming due to the emission <strong>of</strong> carbon from therapid urbanization. It stressed the importance <strong>of</strong> lowcarboncity and how to improve the architectural designs,through the maximum use <strong>of</strong> natural ventilation instead<strong>of</strong> relying on air conditioning. Use <strong>of</strong> environmentallyfriendly materials will have a great advantage on savingthe environment. Every possible means <strong>of</strong> greening wouldbe explored to improve the open space. The careful andstrategic planning <strong>of</strong> roads and footpath with greeningsurrounds would largely contribute to the low-carbon city.Even the contractors nowadays have suggested insertinggreen initiatives in the building contracts with a view toencouraging the use <strong>of</strong> green materials. For example,amount <strong>of</strong> carbon emission <strong>of</strong> the building materials andconstruction activities can be put forward together withfinancial assessment <strong>of</strong> tender.Finally, a few site visits to the green housing projects werearranged in Fuzhon. We were impressed by the extensiveuse <strong>of</strong> solar panels in some residential projects. Wealso saw how to collect rainy water for treatment beforeusing for irrigation and cleansing purposes. On the lastday, 21 June, we visited Xiamen which is a beautiful citywith lovely seaside and beaches. We enjoyed seeing theheritage buildings (i.e. earthen dwelling called Tianluo( 土 樓 ) which were built with timber columns and its wallconstruction was made <strong>of</strong> clay. The ro<strong>of</strong> structures wereframed in a circular shape and looked very impressive. Theone we could get in for visit ( 裕 昌 樓 ) was more interesting,which contained inclined timber columns on 2/F and 3/F,but in opposite direction, <strong>of</strong> the structure. It was a mostfruitful and enjoyable trip as we missed the bad weatherthroughout the whole journey.HKIS members to the Conference土 樓4


working very hard for the councils, committees or panels<strong>of</strong> our <strong>Institute</strong>, or public organizations; while some aredoing a lot <strong>of</strong> social services via their own networks.Many <strong>of</strong> you are wholeheartedly making contributions tothe world without caring about being awarded. Thisaward reminds me my volunteer services delivered to theEquestrian Event <strong>of</strong> the 2008 Olympic Games.It was my honour to be part <strong>of</strong> the 2008 Olympic Games,as a volunteer, it gave me not only an opportunity to learnmore about equestrian but also an opportunity to workwith people from different nations.The Equestrian Events (<strong>Hong</strong> <strong>Kong</strong>) <strong>of</strong> the Games <strong>of</strong>the XXIX Olympiad Company Limited has providedmany training sessions to the volunteers. The trainingincluded various topics, such as working with thedisabled, environmental friendliness and psychological &interpersonal skills in volunteering. I really learnt a lot andwas enhanced by attending the training.I had been assigned to the team which was responsiblefor setting up fences for the jump race and the dressagearena. There were many days that I needed to get up at3:00a.m. and to report duty at 5:00a.m., working withthe Olympic <strong>of</strong>ficial delegates and other volunteers inAugust sun and heavy rain storm. I really treasure all theseinvaluable, memorable and once-in-a-lifetime experiences!The Olympic Games would not be a gigantic successwithout the contributions from the volunteers. The purpose <strong>of</strong> the centralized processing systemfor building plans is to ensure that all interestedgovernment departments are consulted and thattheir comments on private development proposalsare collated by the Building Authority (BA) withintime limits allowed for processing building plans.It also serves the purpose <strong>of</strong> making the BuildingsDepartment (BD) a focal point where issues arising6


from private building development precipitate. Thispractice note announces additional measures andguidelines to streamline and expedite the processing<strong>of</strong> building plans.Referral <strong>of</strong> plans2. The efficient operation <strong>of</strong> the system depends to agreat extent upon the co-operation <strong>of</strong> authorizedpersons (APs), registered structural engineers (RSEs)and registered geotechnical engineers (RGEs) andthat <strong>of</strong> the government departments to be consulted.Failure to submit the requisite number <strong>of</strong> sets <strong>of</strong>plans will delay the referral process and may affectthe timely receipt <strong>of</strong> comments by BD and theirsubsequent transmission to APs, RSEs and RGEs, asappropriate. To avoid such delays, RSEs and RGEsare requested to make reference to Practice Note forAuthorized Persons, Registered Structural Engineersand Registered Geotechnical Engineers (PNAP)ADM-8 and APs are requested to double-check thenumber <strong>of</strong> sets <strong>of</strong> plans and the documents requiredfor submission prior to submission <strong>of</strong> general buildingplans.3. Procedures for dealing with fire service installationproposals and lease matters are containedseparately.Resolution <strong>of</strong> issues arising from referral <strong>of</strong> plans4. A v a i l a b l e c o m m e n t s o f o t h e r g o v e r n m e n tdepartments are incorporated in approval ordisapproval letters. Adverse comments falling withinthe purview <strong>of</strong> the Buildings Ordinance (BO) andconstituting a fundamental issue in the context <strong>of</strong>PNAP ADM-19 are included as disapproval items.All other comments are simply conveyed as suchin separate paragraphs for the information <strong>of</strong> APs,RSEs, RGEs and their clients, but will not be raisedas disapproval items. Comments received after thedispatch <strong>of</strong> approval or disapproval letters by BD aretransmitted by a separate letter.5. When there are different views taken by APs, RSEs orRGEs from a government department commenting ona submission <strong>of</strong> building plans, the BA will arbitrateand take decisions on matters governed by theBO, according to the policies and procedures headopts to enforce environmental, health and safetystandards for buildings and building works. For allother comments relating to matters not governedby the BO, APs, RSEs and RGEs may approach therelevant government departments direct. In the eventthat there are divergent requirements from differentgovernment departments, BD will organise meetingswith the parties concerned with a view to resolvingthe problem.Pre-submission Enquiry & Conference6. APs, RSEs and RGEs may discuss with BD staffon specific issues <strong>of</strong> uncertainty prior to formalsubmission <strong>of</strong> building plans. In order to takeadvantage <strong>of</strong> this arrangement, APs/RSEs/RGEsshould identify the issues with a specific proposition.7. For sites involving complicated issues, the AP/RSE/RGE may, either at the request <strong>of</strong> or agreedby the relevant Chief Pr<strong>of</strong>essional Officer, make apresentation <strong>of</strong> his case (with 3-D computer model ifappropriate) after the submission <strong>of</strong> plans.Greater certainty in planning building projects8. To assist APs, RSEs and RGEs in achieving greatercertainty in planning building projects, BD operatesa set <strong>of</strong> procedures containing the followingfeatures :(a) On the 45th day <strong>of</strong> a submission <strong>of</strong>new building plans, APs/RSEs/RGEs may enquireand expect to know whether the submission isfundamentally acceptable. He may also requestto discuss non-conformities identified prior tothe issue <strong>of</strong> disapproval letter; and (b) Where asubmission <strong>of</strong> plans is considered fundamentallyunacceptable and disapproval items notified inwriting within the statutory period <strong>of</strong> 60 days, newdisapproval items will not, in normal circumstances,be added to the said proposal for subsequentresubmission <strong>of</strong> plans.9. APs/RSEs/RGEs may make enquiries on (a) abovedirect to the Building Surveyor or Structural Engineerhandling the submission in question. Staff dispositioncharts for staff with responsibilities for processingbuilding plans are on display at relevant locations onBD’s premises.Application for modification10. Each application for exemption or modificationshould be properly made on the specified Form BA16 and should be supported by reasons as to whatspecial circumstances prevail and why exemption ormodification would be justified.11. To assist the BA in the processing <strong>of</strong> applicationsfor modification, adequate information should beincluded in the Form BA16 which can be downloadedfrom BD’s web site (www.bd.gov.hk).7


e considered as relatively simple”, as presentedunder the paper <strong>of</strong> CB(1)570/08-09(06): LegislativeCouncil Panel on Development, Mandatory BuildingInspection Scheme and Mandatory WindowInspection Scheme, Regulation <strong>of</strong> Service Providersissued on 20 January 2009.Apart from structural stability, building safetyand health must also be essential elements forthe inspections. The inspection should embracethe diagnosis <strong>of</strong> building defects as well as theidentification <strong>of</strong> illegal structures and alterations.More importantly, inspections shall be followed bysound and proper remedial proposals which are nosimple tasks but require a high level <strong>of</strong> pr<strong>of</strong>essionalcompetence and expertise.The RIs shall be capable <strong>of</strong> diagnosing the buildingdefects during inspections and identifying thecorresponding remedial methods, resembling medicaldoctors giving consultation to their patients. Indeed,maintenance works are much more complicatedthan new works and call for sophisticated knowledgeand skills. The RIs must have practical knowledgeon statutory requirements related to buildingdesign, building diagnosis, remedial methodology,supervision and specification <strong>of</strong> maintenance workswith hands-on experience on the application.Some repairs might not stand safe until the nextMBIS inspection cycle (10 years) if defects are notproperly diagnosed and rectified. For instance, if thecause <strong>of</strong> water seepage could not be identified andrectified, it is pointless only to apply cosmetic repairsto the consequential defective concrete or looserendering. Also, construction <strong>of</strong> underground drain ismuch easier than drain replacement for an occupiedbuilding while the latter has to take into accountissues such as access arrangement, nuisance tooccupiers and neighbours, compatibility <strong>of</strong> existingand new materials, etc.Therefore, expertise in defect diagnosis andknowledge on supervision and specification <strong>of</strong>maintenance works are <strong>of</strong> paramount importance forthe RIs to discharge their duties under the Schemes.It is conceived that RIs would be comparable toMaintenance <strong>Surveyors</strong> in the Housing Departmentand the Architectural Services Department, whoare mostly members <strong>of</strong> the <strong>Hong</strong> <strong>Kong</strong> <strong>Institute</strong> <strong>of</strong><strong>Surveyors</strong> (hereinafter referred as “HKIS”) in thebuilding surveying division. They are in charge <strong>of</strong>the maintenance <strong>of</strong> public housing and governmentbuildings respectively, which make up a substantialpart <strong>of</strong> the building stock in the city.According to the paper addressed to LegislativeCouncil which outlines the proposed arrangement<strong>of</strong> the MBIS, we note the current plan is to select2,000 target buildings per year. We also expect somebuilding owners will voluntarily engage pr<strong>of</strong>essionalpersonnel to inspect and upkeep their buildingsor participate the proposed Voluntary BuildingClassification Scheme (VBCS), and we assume 1,000voluntary buildings in this regards. Therefore, thegovernment should stress on the expertise <strong>of</strong> theRIs, instead <strong>of</strong> their numbers. The qualificationrequirement <strong>of</strong> RIs should stress on experiencerelated to defect diagnosis and supervision andspecification <strong>of</strong> maintenance works. If suchqualification threshold is relaxed merely for the sake<strong>of</strong> expanding the pool <strong>of</strong> RIs, it will allow incompetentpersons to carry out building inspections andhandling the maintenance works at the expense <strong>of</strong>the quality <strong>of</strong> inspections and repairs, i.e. buildingsafety, hence defeating the purpose <strong>of</strong> MBIS.loose and inadequate. In view <strong>of</strong> the need to assessapplicants their required skills <strong>of</strong> defect diagnosisand supervision and specification <strong>of</strong> maintenanceworks, we opine that this quorum should at leastalso include the RI nominated by the <strong>Surveyors</strong>Registration Board, as surveyors have long beenrecognized as experts in these fields. In BOs.3(7AA)(a),“relevant experience” should be “relevant experiencein building repair and maintenance”. Likewise for“grandfather arrangement” under BOs.3(7AA)(b),experience should only refer to “building repairand maintenance”, rather than “building design,construction, repair and maintenance” since pureexperience in “building design or construction” maynot possess sufficient knowledge and skills in repairand maintenance works.In order to guarantee the standard <strong>of</strong> RIs, interviewbasedassessments may not be an appropriate meansto maintain the threshold, especially the Bill intendsto include a number <strong>of</strong> disciplines which primafacie do not possess the relevant core training orworking experience on building defect diagnosis andmaintenance management. Nonetheless, we agreethat deficiencies in these areas may be remedied bywell-designed Continuous Pr<strong>of</strong>essional Developmentor on-job training under proper supervision.4) What is the mechanism for resolving situation when aRI for repair does not agree with the Repair Proposalprepared by a RI for inspection? Employing differentRIs for inspection and repair may also give rise toliability disputes if the repair works are eventuallyproved ineffective. There shall be provision for thesubmission <strong>of</strong> supplementary inspection report toBuildings Department (hereinafter referred as “BD”)by the RI for repair so as to distinguish the liabilities <strong>of</strong>the two RIs. Likewise, there may be dispute betweenthe owners and the RI for inspection on the scope <strong>of</strong>repair.5) Can the RI recommend deferring repairs frommaintenance point <strong>of</strong> view? For instance, if anaboveground drainage system still has 3-5 yearsserviceable life, deferring replacement to line up withthe next painting cycle should be more economicaland environmental friendly, rather than sticking toMBIS inspection cycle (10 years). Premature repairsshould be discouraged.3) Under Buildings Ordinance (hereinafter referred as“BO”) s.3(5GB), the quorum for a meeting <strong>of</strong> theInspectors Registration Committee is only threemembers including the chairman and the BuildingAuthority’s representative. Unauthorized Building Works (hereinafter referredas “UBWs”)6) Building works not shown on the latest approvedbuilding plans may be exempted from approval andconsent under BOs.41(3) and 41(3A). The RIs shouldbe capable <strong>of</strong> distinguishing between exemptedworks and non-exempted works, and in either case,identifying the contraventions under the BO and alliedregulations. Upon identifying the contraventions andhence the consequences, e.g. inadequate means <strong>of</strong>escape or inadequate natural lighting, the ownerswould be more prepared to remove the UBW.7) There should be an “upgrading policy” in the BD forthe UBWs that will hinder effective repair under theMBIS. For instance, a flat ro<strong>of</strong> structure causingwater seepage and defective concrete to the unitbelow should be removed, and the BD should issuecorresponding order for removal <strong>of</strong> the subject UBWin time for the repair under the MBIS.8) Apart from the UBW, unsuitable or unauthorizedchanges in use should also be included in the MBISreport.Scope <strong>of</strong> Inspection9) The proposed MBIS targets on inspection and repair<strong>of</strong> “common parts”, “external walls” and “projections”.We note that “common parts” and “external walls”are defined under BOs.2(1) in terms <strong>of</strong> the wholeOrdinance whilst “projections” is defined under thenew BOs.30A(1) for MBIS only and it in fact refersto regulations that are not available at this stage.We cannot understand the rationale for the differenttreatment.“Common parts” is defined by referring to Section2 <strong>of</strong> the Building Management Ordinance, whichwill include load bearing walls, columns, beams andother structural supports inside individual flats. It iscontradictory because areas within private premisesare expressly excluded under the MBIS. On the otherhand, it is arguable if there is any “common parts”for buildings under single ownership. Moreover, suchdefinition will exclude ro<strong>of</strong>, flat ro<strong>of</strong> and carparksthat are under private ownership but their conditionswill inevitably have implications on the associated“common parts”, e.g. the floor slab underneath.There are also other ambiguities on the definition <strong>of</strong>“common areas”, e.g. enclosing wall <strong>of</strong> a lightwell,parapet wall, etc.Difficulty in gaining access to individual unit forinspection <strong>of</strong> these building elements, if consideredas common parts, may impede the inspection. On theother hand, inspection to some individual units wouldcertainly provide valuable information for compilingthe remedial proposal. In this regard, the intention <strong>of</strong>inclusion/exclusion <strong>of</strong> inspections to individual unitsshould be clarified. Further, the possibility <strong>of</strong> grantingRIs the authority to inspect common parts withinindividual units and the requirement for inspection tocover certain percentage <strong>of</strong> individual units should beexplored.10) This discussion also applies to party walls betweentwo adjoining buildings. The maintenance responsibilityshall therefore be addressed for such cases.Dispute Resolution11) It is envisaged that there can be increasing numbers<strong>of</strong> appeal cases after the introduction <strong>of</strong> the Schemes.While the existing Building Appeal Tribunal hasalready been overloaded with appeals against BOs.24orders, it is imperative to review the existing appealmechanism under BO and to explore the possibility <strong>of</strong>having a separate system for cases arising from theMBIS and MWIS.12) To this end, our long standing proposal <strong>of</strong> theestablishment <strong>of</strong> a Building Affairs Tribunal (hereinafterreferred as “BAT”) should be further explored. Anessence <strong>of</strong> our proposal on BAT is that the grievingparty may on his own submit a case to BAT withjustifications and/or expert report. Alternatively, it isperceived that this means could be incorporated intothe existing judiciary system readily.Mandatory Window Inspection SchemeQualified Person’s Qualification and Duties13) The Bill allows both individuals and the RGBC toregister as Qualified Persons (hereinafter referredas “QPs”) under the MWIS. We opine that suchprovision may cause complication on identification <strong>of</strong>legal liability and assurance <strong>of</strong> QPs’ quality. As theinspection <strong>of</strong> windows also requires a high level <strong>of</strong>competence as that <strong>of</strong> RIs under the MBIS, the sameregistration regime should apply to the MWIS.14) Under the MWIS, those QPs not acting as theRegistered Contractor for the window repair will berequired to provide supervision for the works whilethere is no equivalent requirement for the RegisteredGeneral Building Contractor registered QPs. In fact,there is no requirement for independent supervision<strong>of</strong> repair works carried out by RGBC under the MinorWorks regime. The different requirements for thetwo streams <strong>of</strong> QPs should be reconciled and there11


should also be synchronization between the MBISand Minor Works regime.Code <strong>of</strong> Practice15) A comprehensive yet practical Code <strong>of</strong> Practiceshould be in place to set out the framework <strong>of</strong> theSchemes for the use <strong>of</strong> practitioners. During thedrafting <strong>of</strong> the proposed Code, we have already<strong>of</strong>fered our comments and we hope the commentscan be fully addressed in the finalized version.16) Furthermore, it is worth to review if a prescriptive ora performance based Code <strong>of</strong> Practice should beadopted. While vast parts <strong>of</strong> the current draft Codeare dedicated to various testing and repair methods,a performance based approach would allow the RIsto exercise their pr<strong>of</strong>essional judgment and to applymore advanced repair technology only when the needemerges.17) Whilst the Code <strong>of</strong> Practice may be more relevantto the practitioners and property managers, thereshould be some brief and simple guidelines on therequirements and scope <strong>of</strong> the Schemes for the easyreference <strong>of</strong> building owners.Ensuring Compliance18) As the inspection and completion reports are requiredto be lodged with the BD, it is believed that therewill be a mechanism for random audit <strong>of</strong> the reportsand repair works in order to assure the quality <strong>of</strong>inspections and repair recommendations as well asthe effectiveness <strong>of</strong> implementing the subsequentrepair and maintenance works.Operation <strong>of</strong> the Schemes19) A flexible approach should be adopted whenassessing building owners’ applications for subsidyto carry out inspections. Lack <strong>of</strong> owners’ corporationshould never be the reason for barring the ownersfrom applying for the subsidy. The thrust <strong>of</strong> theSchemes is to assure timely inspections and repairscould be carried out to the aged buildings, whichare usually without owners’ corporation or buildingmanagers. Imposing such a restriction on the subsidyapplication requirements will be contrary to the aim<strong>of</strong> the Schemes. As such, sufficient resources shouldbe allocated to assist the building owners receivingnotices from the BD to organize among themselvesfor the employment <strong>of</strong> RIs and subsequentimplementation <strong>of</strong> repair works.20) The government should also study if the BDcan appoint RIs and engage contractors for thesubsequent remedial works in default <strong>of</strong> those ownerswho fail to comply with the inspection notices.21) Although we consider that the reference fee range perunit for inspection ($800-$2400) is reasonable, theactual fee would depend on the scope <strong>of</strong> inspection.In particular, the need and scope <strong>of</strong> material andstructural testing should depend on the findings <strong>of</strong>the preliminary inspections instead <strong>of</strong> compulsory inorder not to incur unnecessary financial burden onbuilding owners.Message from the HKISHousing Policy PanelIn response to the recent Public Consultation onSubsidising Home Ownership conducted by the Transportand Housing Bureau, a Housing Policy Panel has been setup by the HKIS Executive Committee with membership asfollows:Dr Lawrence Poon (Chairman)Mr Edmond Yew (Secretary)Pr<strong>of</strong> Chau Kwong WingMr Wong BayMr Francis NgMr Thomas TangMr Nathan LeeMr Banny WongWhile there is no conclusion yet at this moment as towhich forms <strong>of</strong> housing subsidy should be supportedor not, the Panel has come up with the following line <strong>of</strong>thinking:1. All subsidies involving public expenditure can begrouped under two broad categories namely subsidieswith means test and subsidies without means test.An example <strong>of</strong> the former is the provision <strong>of</strong> 12-yearsfree education by the Government where all studentswill be <strong>of</strong>fered the same level <strong>of</strong> subsidy regardless <strong>of</strong>their family income and asset. The student grant givento university students falls under the latter categoryas only students with financial need will be eligible forsuch grant and the money to be granted will vary fromstudent to student depending on their differences infinancial difficulties.2. It is considered that housing subsidy, be it ownershipsubsidy or rental subsidy, should be under the lattercategory i.e. means test is required.12


3. In line with other subsidies where means test isrequired, three principles shall be established for allforms <strong>of</strong> housing subsidies to meet: (i) there shouldbe a suitable system for allocating the housingsubsidy, say based on the need <strong>of</strong> the persons to besubsidized. Allocation by balloting, which is purely aluck mechanism without regard to the differences infinancial situation <strong>of</strong> individual applicants, is surelynot acceptable; (ii) the level <strong>of</strong> subsidy <strong>of</strong> a person tobe subsidized should be based on his/her degree <strong>of</strong>financial difficulty rather than across the board; and(iii) the subsidy should be given only when the needstill exists i.e. the subsidy should not be perpetualand there must be a mechanism for discontinuingsubsidy when the financial situation <strong>of</strong> the person to besubsidised has improved to make him/her not qualifiedfor the subsidy. In addition to the said three principles,the cost <strong>of</strong> administering the housing subsidy schemeshould also be taken into consideration when theviability <strong>of</strong> a particular form <strong>of</strong> housing subsidy isassessed.4. Ever since the recent launch <strong>of</strong> the review <strong>of</strong> the Urban RenewalStrategy (“URS”), our <strong>Institute</strong> has been actively involvedin collating views from our members which include holdingOpen Discussion Forum as well as urging our members toact as moderators or otherwise participating in various publicengagement workshops organized for such purpose. In general,our <strong>Institute</strong> is supportive <strong>of</strong> the preliminary proposals putforward by the Steering Committee and contained in the PublicViews and Future Direction Paper for the Consensus BuildingStage <strong>of</strong> the Urban Renewal Strategy Review particularly on thefollowing key issues:- Vision and scope <strong>of</strong> urban regeneration- 4Rs strategy in urban regeneration- Role <strong>of</strong> stakeholders (public and private sector participationand owners participation in urban regeneration)- Compensation and rehousing policies- Public engagement- Social impact assessment- Financial arrangementThe main objective <strong>of</strong> “urban renewal” is to tackle the problem<strong>of</strong> urban decay and to improve the living conditions andquality <strong>of</strong> life <strong>of</strong> residents in dilapidated areas. We agree thatRedevelopment should not be the only option but may includethe other Rs (Rehabilitation, Reservation and Revitalisation).Considering the impact on environment and local community, andunless the buildings have fallen into disrepair to a state creatingpotential hazard to occupiers and the public, Redevelopmentshould be taken as the last resort. By experience, however, wenote that, in terms <strong>of</strong> disturbance to the community, especially tothe existing occupiers <strong>of</strong> the affected premises, there may not besignificant difference between Revitalisation and Redevelopmentbecause in carrying out Revitalisation, the existing trades oroccupiers would most likely be displaced over time by marketforces if not evicted by the landlords or the authority. Referencemight be made to the former trades or occupiers <strong>of</strong> RussellStreet/Yiu Wah Street which had completely disappeared afterthe development <strong>of</strong> Times Square, resulting in a completechange <strong>of</strong> the local characteristics. Other examples are thetransformation <strong>of</strong> Soho district and Lan Kwai Fong in Central. Onthe other hand, preservation may cause less destruction to thearea but will usually be cost inefficient unless the premises canbe put to financially sustainable uses. The need for introducingthe concept <strong>of</strong> proper preventive building maintenance (not justbuilding repairs) to building owners cannot be underestimated.The <strong>Hong</strong> <strong>Kong</strong> <strong>Institute</strong> <strong>of</strong> <strong>Surveyors</strong> also concurs that thechoice for urban regeneration projects should best be a “bottomup”approach to reflect local aspirations and avoid unnecessarymisunderstanding or conflict between Government and thelocal residents. However, when more and more buildings inour society aged and its structure and fabrics deteriorated andbecoming decayed, requests for redevelopment are likely topredominate. In this regard the Urban Renewal Authority hasto deal with over hundreds <strong>of</strong> renewal projects. As such, theAuthority should set out the selection criteria and implementationpriority in a more open and fair manner to avoid disputes orgrudges in the society. There should be a system establishedto allow review <strong>of</strong> the decision on the priority by the Authority.Having said that, the selection criteria and priority setting shouldnot be in conflict with the objectives <strong>of</strong> urban re-generation andalso the aim <strong>of</strong> the passing <strong>of</strong> the Land (Compulsory Sale forRedevelopment) Ordinance, Cap. 545 which encourages privateparticipation in the urban regeneration process. For the latterpurpose, the Government has recently lowered the applicationthreshold for compulsory sale to be made to the Lands Tribunalfrom ownership <strong>of</strong> not less than 90% to not less than 80% <strong>of</strong> theundivided shares in respect <strong>of</strong> certain classes <strong>of</strong> lot.On the topic <strong>of</strong> compensation, small business operators inparticular affected by large scale urban redevelopment projectsare unlikely able to find suitable replacement shop premiseswithin the same district. There should be assistance to help themto identify suitable alternative premises elsewhere. Alternatively,for business operators, additional ex-gratia payment should bedetermined by reference to the number <strong>of</strong> years <strong>of</strong> such businessoperated at the affected premises. The longer the history thehigher the ex-gratia payment should be.While our <strong>Institute</strong> accepts that the notional value <strong>of</strong> seven-yearoldflat as the basis for calculating compensation to affected flatowners, the current difference in ex-gratia compensation (i.e. theHome Purchase Allowance) payable to affected owner-occupiersand non-owner-occupiers is too wide. Given the nature <strong>of</strong> suchpayment, we consider other factors like the period <strong>of</strong> ownership,current living conditions, level <strong>of</strong> income or even the number<strong>of</strong> other residential units owned should be taken into accountin determining the level <strong>of</strong> the ex-gratia payable to those nonowner-occupiers.In addition, there should be difference in exgratiapayment between such owners who are individual andcorporations, the latter <strong>of</strong> which normally are purely establishedfor investment purposes.Our <strong>Institute</strong> is also supportive <strong>of</strong> more options available to thoseowners affected in lieu <strong>of</strong> cash compensation. The idea <strong>of</strong> “flatfor-flat”is good but details <strong>of</strong> the arrangement have to be sortedout to ensure fairness and practicality <strong>of</strong> implementation. Thereplacement new flat needs not be in the same level/orientation/size <strong>of</strong> the old flat acquired. It is proposed that the unit pricedifference between the replacement new flat and notional value<strong>of</strong> seven-year-old flat be fixed by reference to a relevant date; thedifference between the two should be settled by cash paymentby the affected owners who opt for the “flat-for-flat” option uponhanding over <strong>of</strong> the replacement new flat to them. Moreover,such affected owners should be given the right to change theirchoice and to receive the entitled cash payment at any-time priorto the completion <strong>of</strong> the purchase <strong>of</strong> the replacement new flat.Apart from the “flat-to-flat” option, the feasibility <strong>of</strong> “ownerparticipations”in redevelopment project on a “project-sharing”approach should also be explored.To conclude, urban regeneration embraces the concepts <strong>of</strong>sustainable development and building a quality city. Planning & Development DivisionChairman's MessageFrancis Lam PDD Council ChairmanFuzhou - 2010 Mainland and <strong>Hong</strong><strong>Kong</strong> Construction Industry ForumMr Ben Chong and Francis Lam from our Division joinedthe HKIS Delegation participating in the 2010 Mainlandand <strong>Hong</strong> <strong>Kong</strong> Construction Industry Forum held from19 June to 21 June in Fuzhou, Fujian Province. The Forumwas jointly organized by the Ministry <strong>of</strong> Housing andUrban-Rural Development and the HKSAR GovernmentDevelopment Bureau. It was a very successful conferencewhich provided a platform for all stakeholders bothin <strong>Hong</strong> <strong>Kong</strong> and the Mainland to share knowledgeand experience in green building and low-carbon cityplanning. The Forum was also supplemented by avisit to the 4th Exposition on Green Construction andEnergy Conservation held at the newly completedFuzhou International Exhibition Centre with participatingparties from the Mainland China, Taiwan, <strong>Hong</strong> <strong>Kong</strong>and Singapore. Delegates <strong>of</strong> the Forum generally foundthe three-day forum very useful in enhancing theirunderstanding on the latest policy directives and industrypractices in achieving low-carbon built environment.Transport and Housing Bureau to attend a specialconsultation session on 11 August. In order to arouse publicinterest in this area, we have prepared a press releaseand sent to media on 8 July, repeating what we hadraised to Deloitte earlier in March. Those comments weresummarized in the Chairman's Message <strong>of</strong> March Issue<strong>of</strong> <strong>Surveyors</strong> Times for members' information. In general,the Council supports to license property managementcompanies including owners' corporations and NGOs.Whereas for licensing individual practitioners, wehave reservation as we have noted several unresolveddifficulties. It seems that the press release did not drawtoo much attention in the public but as a pr<strong>of</strong>essional<strong>Institute</strong> supplying pr<strong>of</strong>essional members practicing in thisarea, our Division will no doubt keep a close monitoringin this respect for any future development. Quantity Surveying DivisionChairman's MessageDaniel Ho QSD Council ChairmanAssessors for Assessment <strong>of</strong>Pr<strong>of</strong>essional Competence 2010This year's Assessment <strong>of</strong> Pr<strong>of</strong>essional Competence (APC)will be held in September 2010. You may have alreadyreceived our invitation to join the assessors' panel for thisAPC. You are encouraged to become one <strong>of</strong> the assessors.Your participation will definitely help the candidates and theinstitute. Please contact Ms Judy Shiu at 2526 3679 if youhave not yet returned your reply slip.Pre-qualification Structured LearningWhilst on the subject <strong>of</strong> APC, I would like to mention about apilot programme implemented since late last year.Pursuant to the HKIS QSD APC rules and guide ("APCRules"), "the candidate must undertake a minimum <strong>of</strong> 24hours <strong>of</strong> Pre-Qualification Structured Learning (<strong>PQSL</strong>) forevery six full months after entry to the APC but before takingthe Final Assessment for the first time subject to a minimumaggregate <strong>of</strong> 96 hours". The candidates are expected to gainskills and knowledge which are not always possible to obtainwithin day-to-day business <strong>of</strong> the practice.The candidates can fulfill this requirement by attendingcourses and training sessions, undertaking researches, postqualificationstudies etc, which follow the APC Rules, at theirchoices. The past <strong>PQSL</strong> submissions from the candidatesindicated that there was a 'big' gap between the quality <strong>of</strong>various courses and studies, which might defeat the intention<strong>of</strong> the <strong>PQSL</strong>.In light <strong>of</strong> this, there were suggestions that the institute shouldorganize a structured learning course for the candidates.The course would ensure that the candidates would gain anappropriate level <strong>of</strong> skills and knowledge prior to attendingthe APC. After deliberation, the council then decided last yearto implement a pilot scheme for a period <strong>of</strong> two years.The sub-committee responsible for the pilot scheme is ledby our Honorary Treasurer Mr Sunny Chan. The pilot schemeis comprised <strong>of</strong> 19 seminars with a total <strong>of</strong> 49 hours. Theduration <strong>of</strong> each seminar ranges from 1.5 to 3 hours. Theseminars cover topics related to both pre-contract andpost-contract quantity surveying services, which includemeasurement, cost planning, contract administration,procurement, real estate development, dispute resolution andproject management. The speakers <strong>of</strong> the seminars are wellexperiencedpractitioners and experts in the related topics.By the end <strong>of</strong> July, we have organized six seminars (see Table1) and the rate <strong>of</strong> participation is very encouraging. I wouldlike to take this opportunity to encourage more candidatesto join the seminars and to give their feedbacks for futureenhancement <strong>of</strong> the scheme.Besides the candidates, the participation <strong>of</strong> speakers alsocontributes significantly to the success <strong>of</strong> the scheme. Mock MediationThomas Ho, QSDMediation is a confidential dispute resolution processin which a neutral person (the 'mediator') assists theparties in a dispute to reach a negotiated agreement. Themediator assists the parties to understand the issues indispute, identify creative options to resolve the disputeand finalize agreement. Mediation is a recognized and wellaccepted alternative to arbitration and litigation. Mediationcosts a small fraction <strong>of</strong> the cost <strong>of</strong> arbitration andlitigation and can result in a fast and effective solution to acomplex problem. Under the Civil Justice Reform, PracticeDirection-31 requiring the filing with the court a mediationcertificate, a mediation notice and response was madeeffective from 1 January 2010 in proceedings where all theparties are legally represented. In order to let members toknow more about mediation, a presentation on mediationwith a role play was held on 17 June.In this presentation, representatives from the <strong>Hong</strong> <strong>Kong</strong>Mediation Council - Construction Mediation Interest Groupgave us a presentation on the process <strong>of</strong> mediation andperformed a mock mediation on a construction dispute.There were about 200 participants in this presentation.The event started with a presentation by Mr LeungHing Fung (Associate Pr<strong>of</strong>essor <strong>of</strong> Department <strong>of</strong> RealEstate and Construction <strong>of</strong> The University <strong>of</strong> <strong>Hong</strong> <strong>Kong</strong>)on the process <strong>of</strong> mediation and then followed with arole play on a construction dispute by Mr Peter Tang(Director <strong>of</strong> Powerpoint Consultants Ltd.), Ms Alice To(Senior Associate <strong>of</strong> Pinsent Masons) and Mr Thomas Ho(Managing Director <strong>of</strong> TLS & Associates Ltd.)
