24 th <strong>June</strong> <strong>2013</strong>John Dilworth writes:This beautiful violin, with its original label stating ‘Andreas Guarnerius fecit Cremonae / sub tituloSanctae Teresiae 1684’ is fully characteristic of the Guarneri workshop at this time. Andrea himself wasthen a grand old man of 61, a pupil and supporter of Nicolo Amati and a senior member of the smallgroup of luthiers that had already established Cremona as the world centre of violin making. FrancescoRugeri, his senior by three years, and the great Antonio Stradivari were active, but not necessarily partof the Amati circle. Only Nicolo, who died in the year this violin was made, or his son Hieronymus IIwould have outranked Andrea in any sort of luthiers guild. Guarneri also had two sons to continue hisworkshop and preserve the family name under the sign of St Theresa in the Piazza San Domenico. Butthe eldest, Pietro, had left home in about 1677 to work in Venice, leaving only Giuseppe, the youngerson, to assist. In 1684, Giuseppe was eighteen years old, and probably quite experienced in his father’scraft. It can be assumed that his hand is present in some degree to most of the work bearing Andrea’slabel from around 1680, as his father worked through old age to his final year of 1698, when he died atthe age of 75. However, his activity in the later years was probably limited, and the Hills give evidenceof work labelled independently by Giuseppe as early as 1690, only six years after this violin wascompleted, and by which time the younger man’s own style was fully formed. Giuseppe later becameknown as Giuseppe ‘filius Andrea’ in order to distinguish him from his son, the great Giuseppe Guarneridel Gesu, but his own achievement as a violin and cello maker is of course substantial.sufficient remains to fully harmonise the instrument. As with the back, the wood is not of the mostoutstanding quality, the grain is a little broad and slightly wavering, but is good alpine spruce, given astrong, stable arching. The soundholes are beautifully poised and certainly reflect the style of Andrea,freely cut, open, rather slanted across the front, the nicks emphatic and the lower wings deftly fluted.The scroll is a definitive piece, charming and forceful, a slightly impressionistic version of the Amatiprototype. It sums up Andrea’s workmanship entirely; faithful absolutely to the principals, methodsand proportions of his teacher Nicolo, but rendered with more freedom, or perhaps just less finesse.The distinctly ‘comma shaped’ eye identifies Guarneri work, and seems to have gradually developed inthe cutting of the last turn, to the point where the broad tail seems to overwhelm the diminished eyein the very last scrolls made by Giuseppe ‘filius Andrea’.The varnish is a beautiful pale golden brown, wholly transparent and supple, but rather over polishedthrough time and continued use and upkeep over three hundred years.This violin is a superb and characteristic example of the Guarneri workshop in this period. The backhas a full, luxuriously rounded arch springing from a small but emphatically worked edge channel, withtypically delicate margins. The wood is a little plain, as is often the case, but it is a flawless piece cutfrom matched quarter sawn halves. The purfling is a little ragged, compared with the flawless workof Amati and Stradivari, and entirely typical, although the very distorted points seen on Andrea’s earlywork, where the tip of the purfling mitre is deflected sharply across the corner, have evolved into alonger, straighter, if still somewhat unsteady tip.On the table, some of the original purfling has been lost to repair work on the exposed edges, but20 21

Tibbalds & Son Violin Dealers and Repairers wasestablished in 1879 at 24 Clifton Street, Brighton.W.H. (William Henry) started the business as a youngman and was later joined by his son Bert (HerbertEdward). After his father died in 1934 Bert continuedto run the business alone until his death in 1954.W.H had four sons, three of whom survived the FirstWorld War and all of whom played strings. Thefamily had a long business association with AlbertCooper of Winchester. The remarkable collectionof instruments he built up (which later providedthe financial basis for the Albert Cooper MusicalCharitable Trust) began when, in his own words, “Iwas called in to clear up the estate of the well known Brighton firm of W.H. Tibbalds after the sad demise ofBert Tibbalds. Lodged behind the work bench was a bow by J.B. Vuillaume, it had obviously been there along time, probably lost during the war years. More out of respect for the family, and with their permission,I decided to keep this fine example of French work. However, it was at least another ten years or so before itbecame possible to form even the nucleus of a collection of instruments.”The violin was made in 1903 and belonged to Bert’s brother Arthur who played it until his death in1976. It has remained in the family since then but is now offered for sale by his grandchildren.54Lot 10455

His colourful life fromthe workshop to the circus and back again is well documented, but most importantly, his work hasgarnered a reputation of its own for its equally colourful character and skill, evoking the very best ofItalian style. Known initially as a copyist of ambiguous intent, his experience at the centre of the 19thcentury violin trade, as an intimate of J.B.Vuillaume at the beginning of the whole movement towardsreplicating the great works of Stradivari and the Cremonese masters, gave him the feeling and respectfor the older craftsmen that enabled him to make his own, original interpretations. Until now, no cellofrom his hand has been reported. But the kind of cello imagined by the most enthusiastic admirer ofLott’s would hardly measure up to the magnificent instrument that has now at last been discovered.The workmanship, the varnish, the model are all almost too much to digest at once, but consistently callout the name that is, scarcely believably, still attached to the top block within; ‘John Lott, Maker’.John Frederick Lott, John Lott II or known familiarly as ‘Jack’, from the loosely biographical work ‘Jackof All Trades’ written by the Victorian writer and violin enthusiast Charles Reade, was the son of JohnFrederick Lott I, a violin maker born in London in 1776. He worked with Bernard Simon Fendt as a violin,cello and double bass maker, and when his sons George (b.1801) and John Frederick II (b.1804) reachedworking age he trained them as violin makers. The sons both eventually joined Richard Davis’ shop inCoventry Street. But by 1823 the younger John had become tired of the London trade and workingfor the entrepreneurs of the time, and joined a circus in the somewhat unlikely role of elephant trainer,having tried his hand as a professional musician and a sign writer. But in travelling abroad with thecircus, he met his Swiss wife, and presumably gained some familiarity with the French language thathelped his later association with Vuillaume. It is also said that he crossed the Atlantic with the circus,and developed his varnish with the help of an American chemist. By the time he returned to Londonin about 1840, he was equipped to make his own living as a violin maker, but a more imaginative,cosmopolitan and creative craftsman than his contemporaries.Needless to say, Lott’s own label is rare indeed. His most highly regarded instruments have passedmuch of their time under other identities and descriptions, but these days, his distinctive handiworkis relatively easily recognised. Although we can admire his work now, for some time it was dangerous.What made him exceptional was his range. While most makers were struggling with the differentconcepts of Amati and Stainer, Lott was copying Stradivari, del Gesu, and other more obscure makers,not to say adapting and incorporating parts into his own confections. His reputation as a maker hasby now far outstripped these more dubious practices, and he is seen as a pioneer of new models,new ways of working and interpreting older masters, and the whole practice of ‘antiqueing’ or aginginstruments in the manner perfected by Vuillaume.Lott’s own style is altogether less academic and mannered than Vuillaume’s. His work is very individualand recognisably his own, even while disguising itself as Stradivari or Guarneri. It should be admittedthat perhaps his craftsmanship was not on the level of Stradivari’s, and his Stradivari copies betray hisown hand more easily than his Guarneri copies. Lott evidently worked quite quickly, but with greatcontrol. His materials are rarely of the finest imported tone wood, and sometimes have a makeshiftlook, but his varnish is superb. He was not afraid of the brighter red and golden yellows that someearlier English work lacks, and he tackled the great Golden Period varnish of Strad with a boldapplication of thick, ruby red, that is usually worked away and patinated. In this cello, the effect of suchbroad sweeps of deep red varnish, deliberately ground and scraped away to reveal the equally vibrantgolden yellow priming beneath is powerful. It is a cello imagined by a real artist.But how much imagination went into it? It is essentially a very close copy of a Joseph Filius AndreaGuarneri cello, accurately represented and startlingly well recreated. Lott surely had the originalinstrument in his workshop, and the outlines, archings, soundholes and scroll are completelyconvincing. The only difficulty really is that Lott’s varnish has the fire of Venetian red, rather thanthe subtle orange-brown that the original Guarneri would have worn. The one piece back of poplaror willow is not unlike an authenticated Joseph filius of 1697, and the outline is very similar- thedistinctive outward pointing upper corners, delicate and long, and the same full-vaulted back archerupting from the shallow channel at the edges contrasting with the fairly restrained low arch of thefront. That both the Lott and the Guarneri are of compact size is also significant; Joseph filius Andreawas possibly the first maker in Cremona to adopt the modern form over the large bass of the earlyseventeenth century, making his work an obvious model for later makers. The rather narrow andupright soundholes are perfectly in the style of Joseph filius, but possibly most striking of all is Lott’swonderful interpretation of the Guarneri scroll. It is at once massive, powerful and majestic, and atthe same time graceful and beautifully poised like all Cremonese models. Lott has not overworked it;the gouge marks skitter around the head just as in the original- he could rely on his eye to interpretthe movement in the head, and trust his varnish to cover the work in dazzling style. The conditionit appears in today is remarkably as it would have been on the day it was completed. There is littlephysical damage or repair work evident, and the marks of ageing in the edges and varnish are virtuallyall as Lott himself made them.If this cello remains the only fully authenticated example by Lott, it will be sad to think of what we havemissed in others. But as it is, it must surely be one of the most beautiful English cellos extant; steepedin the Cremonese tradition, but indelibly stamped with the hand of an independently minded masterin the nineteenth century London of Charles Dickens, his almost exact contemporary. It would havetaken an imagination like Dickens’ to invent a character like Lott, but here he is, in his inspirationallegacy; a cello, as far as we know unique, and unmatched.68 69

24 th <strong>June</strong> <strong>2013</strong>John Dilworth writes:Alessandro Gagliano is the beneficiary of one of William Henley’s most imaginative and romanticessays. In his ‘Universal Dictionary’, he stated that Gagliano was the son of a Marquis, a student ofmusic banished from the city after a fatal duel who found himself alone in a forest, idly tapping treesto determine their acoustic properties. With this insight he gained a place in the workshop of NicoloAmati and subsequently with Antonio Stradivari in Cremona, and after thirty years of study at the feetof the masters, established the Neapolitan school of Violin making in 1695. It is all tosh, sadly. Thereis as yet no archival proof of any biographical knowledge of the man, and one close look at his workis enough to see that he had no training in Cremona. No aspect of his technique shows any initimateunderstanding of Cremonese methods, and in fact, the startling thing is its originality and individualquality.All we can surmise from his work and circumstances is that he was probably introduced to lutherieby one of the several Fussen-born lute and guitar makers established in Naples at the end of theseventeenth century. Bletschacher lists several in his ‘Die Lautern- und Geigenmacher des FussenerLandes’, including Kaiser, Railich, Stadler, Steger and Tiefenbrunner. All these craftsmen were probablyessentially lute makers, but they would have had much knowledge of tone woods and techniques, andwould probably by this time have been experimenting with violins themselves. There was, enough tosay, a thriving instrument making community in Naples at this time. What marks Alessandro apart is hisinvestment in violin making specifically, and his observations of good Cremonese work that must havecome his way. The geometry, the basic plan, but above all, the attention to detail and finish obvious inhis work shows clearly where his inspiration sprang from.The violin in this instance, which bears a label of 1709, is strikingly classical in appearance. Thesoundholes have a wonderful Stradivari flow, the arching is subtle and beautifully graduated, thepurfling elegant, and the varnish of absolutely the first quality, of a very rich orange-brown and with asuperbly reflective ground.But if we look beneath the skin, as it were, we find crucial divergencies from the Amati rule book.The back is a glorious piece of quarter sawn maple, the consistent rippling flame chasing slightyupward to the treble side. It brings to mind comparisons with Alessandro’s most celebrated violin, the‘Rotondo’ of 1710. The grain though is very coarse, and looks as if it might be local wood, rather thanthe tightly grown maple of Amati and Stradivari. The outline is very Amatise, elegant and symmetricaland very carefully managed. But typically for Gagliano, it is long, not of any known Amati model. Theproportions of all his instruments are idiosyncratic- the outline lengthened, the stop exaggeratedtheseare marks of an individually created form. The arching is fine, but not conventional. The centre isfull and rounded, quite high at the centre, but it falls away quickly to the endblocks on both back andfront, leaving a broad, flat edge flute around the upper and lower bouts. In some ways it resembles thearching of very late period Guarneri del Gesu violins, but in no way does it fall into the Staineresquemodel almost universally adopted thoughout Europe in this period.The purfling is made of three soft veneers, possibly all poplar or willow, but it is fragile stuff thatthreads its way around the edge in uncertain manner, deflected and pressed or wandering and swollenaccording to the vagiaries of the slot into which it fits. You can plainly see the chatter marks andsplits in the wood resulting from planing each strip of veneer from the log with a deep set but notnecessarily well-sharpened blade.The ribs are made of contrasting wood, wildy and irregularly flamed maple cut on the half-slab, whichgives a wonderfully lively reflection under the varnish. But the rib corners are drawn together in longjoints, not the effective short mitre of Cremonese work. The long rib join is common in most ‘provincial’violin making, and betrays a method of working totally unlike the Cremonese internal mould system,possibly working without a mould at all. Internally the coarse pine blocks and linings are not morticed,nor are there locating pins in the endblocks, both of which are consistent markers of Cremonesetechnique.The front is very classical in appearance too, but the very low set soundholes are characteristic ofGagliano. In this case, their very authentic Stradivarian appearance is slightly undermined by the factthat the larger part of the lower wings have been restored, in the careful but characteristic mannerof the Hill workshop. The wood is first-class alpine tone wood, but the two sides appear not to bematched; on the treble side there is a fair amount of hazel figure close to the centre, and the grainpatterns are not consistent.The head also confirms Gagliano’s individuality. Very often his scrolls are decorated or given somedeliberate originality. No two are really treated in the same way, and on this example there is a cleftcarved into the chin, and a slender triangle incised at the base. Although this has become very wornwith use, the original form is reasonably clear. Alessandro Gagliano never treated his heads with thestrict formality of the Cremonese, but more in the free manner of Brescian and Northern Europeanmakers. In profile the head does have several distinguishing Gagliano features; the eye is low in thespiral, and projects suddenly from the winding of the narrow second turn , very much in the way ofCarlo Bergonzi. The pegbox is quite straight and slender, and the throat constricted and roughlyfinished. Tool marks are freely scattered around the volutes, and the workmanship is determinedlycharacterful rather than careful. Again, the wood is very broad-grained, probably local maple, but of aplainer nature than the back.Alessandro’s most successful attribute is his varnish, there is no doubt. It is sad that his sons seemedto reject it almost instantly, and the family name is usually associated with rather hard, yellow or deep,unrelieved brown coating. Alessandro’ varnish is the real thing, the soft red-tinted and beautifullymobile and reflective stuff of the classical masters. It may have come to him via the Fussen connectionand the Albani family of the Italian-German borders, who possibly also gave this beautiful red varnishto the Venetians. On this violin it has been worn by time, and polished and restored, but the glow isdeep in the wood, and the subtle flashes of colour are still apparent in the edges of the back.Alessandro Gagliano is a fascinating maker from many aspects. Working far away in the southat the same time that Stradivari was emerging as the dominant force in Cremona, he is isolatedgeographically and stylistically. There are few other makers in the beginning of the eighteenth centurywho grasped the principals of great violin making so well, and gave them a distinctive personalidentity. It would be very heartwarming to find out that he really was the son of a Marquis, a treetapperas well as a tearaway duellist, but I doubt it. His work is outstanding, and the dynasty of luthiershe founded one of the most long-lived and productive in all of violin making history.178 179

ExpensesBrompton’s will charge the Seller for all its out of pocket expenditure over andabove its agreed fee, in particular:a) all costs of Packing and shipping the Lot to us for sale;b) all applicable transit insurance costs;c) all costs relating to packing and shipping the lot if it is returned to the Seller;d) all applicable customs duties;e) all restoration of the Lot agreed in advance with the Sellerf) all examination costs incurred by external experts we believe appropriate, ifagreed in advance with the Sellerg) photography charges of £35 per lot advertised online, and where previouslyagreed charges for the catalogue photography.h) all Storage costs of the lot after the sale;i) all applicable VAT.Brompton’s will on request provide advance estimates of such expenditure andthe Seller is directed to www.bromptons.co where applicable rates for the moreroutine of these expenses are posted from time to time. The Seller is aware thatBrompton’s will not have control of the level of such third party charging andthe Seller is advised, if concerned, to make his/its own direct advance enquiriesof, for example relevant insurance, customs and vat authorities.5a. Where the Lot is included under Brompton’s Auctioneers Limited’s Policya) Unless we agree otherwise, the Lot will be automatically included asconsigned or entrusted goods under Brompton’s Auctioneers Limited’sFine Art Policy for the amount that we from time to time consider to be itsappropriate value. This Value is not an undertaking by us that the Lot will besold for this amount.b) We shall charge the Seller a fee for the inclusion of the Lot under our policy atthe rate of 1.5% of the Hammer Price. If we arrange transport, we may chargethe Seller an additional fee based on the value of the Lot and the particularcircumstances of the requirements for the transport to maintain the benefit ofthe inclusion of the Lot under Brompton’s Auctioneers Limited’s policy duringsuch transport. Although we shall suggest carriers if specifically requested, wecannot accept any liability in this respect.c) The Lot will retain the benefit of inclusion under Brompton’s AuctioneersLimited’s policy until the expiry of seven days after the sale. If the Lot has notbeen sold, it will be at the Seller’s risk after that time.d) We are unable to accept responsibility for damage caused by woodworm,changes in atmospheric conditions or acts of terrorism.5b. Owner’s InsuranceIf the Seller specifically instructs us not to insure the Lot, it will remain at theSeller’s risk at all times until the Buyer has made payment in full. The Seller willindemnify us and our employees and agents, and the Buyer (where applicable)against any claim made against us or them in respect of the Lot, however thatclaim may arise. The Seller will also reimburse us and them on demand for anyexpenses we or they may incur as a result of such a claim, even if we or they arefound to have been negligent and even where such reimbursement is requiredof a payment made without any legal liability being proved. The Seller mustnotify the Seller’s insurers of the terms of this clause.6. The Seller’s Undertakings regarding the LotThis clause sets out the basis on which we shall handle the Lot and which willgovern the Seller’s relationship with the Buyer. If that basis proves incorrect inany way, either we or the Buyer may take legal action against the Seller.We shall handle the Lot, and the Buyer will purchase, on the basis of the Seller’sundertakings that:a) the Seller is the sole owner of the Lot with an unrestricted right to transfertitle to the Buyer free from all third party rights or claims (including copyrightclaims);b) the Seller has complied with all requirements, legal or otherwise relating toany export or import of the Lot and has notified us in writing of any failurec) by third parties to comply with such requirements in the past; andd) the Seller has notified us in writing of any material alterations to the Lot ofwhich the Seller is aware and of any concerns expressed by third parties inrelation to the ownership, condition or attribution of the Lot. If any of (a), (b)and (c) above is incorrect, the Seller will indemnify us and/or the Buyer in fullon demand against all claims, costs or expenses incurred by us or the Buyer asa result, whether arising in relation to the Lot or the proceeds of sale.7. Sale Arrangementsa) We shall have complete discretion as to the way the Lot is described andillustrated in the catalogue or any condition report; the place and mannerof sale; the decision as to which persons should be admitted to the auction,and as to which bids should be accepted; whether expert advice should besought, and the combination or division of goods for sale.b) Any estimate given, orally or in writing, is a matter of opinion only and is notan assurance in relation to the price the Lot will eventually fetch.c) The Seller may not withdraw the Lot from sale without our consent. However,we reserve the right to withdraw the Lot from sale at any time if (i) we haveany doubt as to its attribution or authenticity or as to the accuracy of thestatements made in clause 6 (a), (b) or (c) above or (ii) there is any breachof these Conditions of Business or (iii) we believe it would be improper toinclude the Lot in the sale.d) If either we or the Seller withdraw the Lot, we shall charge the Seller a feeequal to 20% of the Reserve or, if no Reserve has been agreed at that time,20% of the Insured Value, together with any applicable VAT and insurance andother expenses.8. Conduct of Salea) The Lot will be sold subject to the Reserve, which cannot be above the lowestimate printed in the catalogue unless the Reserve is agreed to in a currencyother than pounds sterling and the exchange rates fluctuate betweenthe time the Reserve is agreed and the day of the sale. In this case, unlesswe agree otherwise, the Reserve shall be an amount equal to the poundsterling equivalent based on the closing exchange rate on the business dayimmediately preceding the sale. We shall in no circumstances be liable if bidsare not received at the level of the Reserve. We shall however be entitled tosell the Lot below the Reserve. If we do so, we shall be obliged to account tothe Seller as if the Hammer Price was equal to the Reserve.b) The Seller may not bid for the Lot nor employ any person to do so on theSeller’s behalf, although we shall have the right to bid on the Seller’s behalf upto the amount of the Reserve.9. After the Salea) AccountingAfter the sale, we shall require payment in full from the Buyer, includingpayment of the Buyer’s premium within seven days. Provided this hasoccurred, we shall remit to the Seller an amount equal to the Hammer Priceless all charges due from the Seller, 35 days after the date of the sale, unlesswe have received notice that the Lot is a Forgery (as defined in Section A ofthese Conditions of Business). In the event of late payment by the Buyer weshall make such remittance to the Seller within seven days of that payment bythe Buyer. If for any reason we make payment to the Seller of the amount duebefore payment by the Buyer, we shall acquire complete ownership of andtitle in the Lot, save only that in the event that we are obliged to accept theLot back from the Buyer on the basis that it is a Forgery, the Seller will refundto us the proceeds of sale paid to the Seller.Payment will be made in sterling unless the Seller instructs otherwise inwriting. If the Seller requires payment other than in sterling, we shall chargethe Seller for any currency costs incurred. Sale proceeds will be calculated atthe rate of exchange quoted to us by Coutts & Co. prevailing on the day of thepay-out 35 days after the date of the auction. Our certificate as to such ratewill be conclusive.b) Non-Payment by the BuyerIf the Buyer fails to pay the full amount due within 35 days after the dateof sale, we shall be entitled to agree special terms on the Seller’s behalf forpayment, storage and insurance, and to take any steps we consider necessaryto collect the amount due from the Buyer. However, we shall not be obligedeither to remit the price due to the Seller ourselves, nor to take any legalproceedings on the Seller’s behalf. We shall discuss with the Seller theappropriate course of action to be taken to recover the purchase price fromthe Buyer.c) ForgeriesIf within three months of the date of the auction the Buyer satisfies us that theLot is a Forgery (as defined in Clause 1 of these Conditions of Business), then(i) if the Buyer at that time has not yet paid the full amount due, we shall havethe right to cancel the sale and/or (ii) if we have at that time paid the Sellerthe whole or part of the full amount due to the Seller, then the Seller mustrefund to us, on demand, the total amount paid. In the latter case we shallexercise a lien over any property of the Seller under our control as security forthe amount dued) Unsold LotIf any Lot is unsold, or is not included in a sale, or is withdrawn from salefor any reason, it must be collected from us within 35 days after we sendthe Seller a notice requiring the Seller to collect it. If any such Lot remainsuncollected for a period exceeding 35 days, a storage charge of £1 per itemper day will apply and an additional charge will be made for insurance. TheSeller will not be entitled to collect the Lot until all outstanding charges aremet. If any such Lot is not collected within 90 days after the date of the saleor the date of the notice referred to above (whichever occurs first), it maybe disposed of by us as we see fit, which may involve its removal to a thirdparty warehouse at the Seller’s expense and its sale by public auction on suchterms as we consider appropriate, including those relating to estimates andreserves. We shall then account to the Seller for the proceeds of sale, havingdeducted all amounts due. If any Lot is bought in or otherwise unsold byauction, we are authorised as the exclusive agent for the Seller for a periodof two months following the auction to sell such Lot privately for a price that218 219


24 th <strong>June</strong> <strong>2013</strong>will result in a payment to the Seller of not less than the net amount – i.e. afterdeduction of all charges due from the Seller – to which the Seller would havebeen entitled had the Lot been sold at a price equal to the Reserve, or forsuch lesser amount as we and the Seller shall agree. In such event the Seller’sobligations to us with respect to such a Lot are the same as if it had been soldat auction.10. Photographs and IllustrationsWe shall have the right (on a non-exclusive basis) to photograph, video orotherwise produce an image of the Lot. All rights in such an image will belong tous, and we shall have the right to use it in whatever way we see fit.11. Other MattersVAT The Seller will give all relevant information about his VAT status and that ofthe Lot to ensure that the correct information is printed in the catalogues. Onceprinted, the information cannot be changed. If we incur any unforeseen cost orexpense as a result of the information being incorrect, the Seller will reimburseto us on demand the full amount incurred.C. Buyers12. Brompton’s Auctioneers Limited as agentAs auctioneers, we act as agent for the Seller. Unless otherwise agreed sales ofgoods at our auctions result in contracts made between the Seller, through ouragency, with the Buyer.13. Before the Salea) Examination of goodsProspective buyers are strongly advised to examine personally any goods inwhich they are interested, before the auction takes place. Condition reportsare usually available on request. We provide no guarantee to the Buyer otherthan in relation to Forgeries, as explained in clause 1 of these Conditions ofBusiness.b) Catalogue descriptionsStatements by us in the catalogue or condition report, or made orally or inwriting elsewhere, regarding the authorship, origin, date, age, size, medium,attribution, genuineness, provenance, condition or estimated selling priceof any Lot are merely statements of opinion, and are not to be relied on asstatements of definitive fact. Catalogue illustrations are for guidance only,and should not be relied on either to determine the tone or colour of anyitem or to reveal imperfections. Estimates of the selling price should not berelied on as a statement that this price is either the price at which the Lotwill sell or its value for any other purpose. Many items are of an age or naturewhich precludes their being in perfect condition and some descriptions inthe catalogue or given by way of condition report make reference to damageand/or restoration. We provide this information for guidance only and theabsence of such a reference does not imply that an item is free from defectsor restoration nor does a reference to particular defects imply the absence ofany others.c) Buyers ResponsibilityBuyers are responsible for satisfying themselves concerning the condition ofthe goods and the matters referred to in the catalogue description.d) Importation into a buyer’s destination countryThe purchaser’s inability to import any item into his destination country asa result of Government economic sanctions or other restrictions shall notjustify cancellation or rescission of the sale or any delay in payment. Pleasesatisfy yourself before bidding as to whether a lot is subject to such importrestrictions, or any other restrictions on importation or exportation14. At the Salea) Refusal of admissionOur sales take place on our own premises or premises over which we havecontrol for the sale, and we have the right, exercisable at our completediscretion, to refuse admission to the premises or attendance at an auction.b) Registration before biddingEvery prospective buyer must complete and sign a registration form andprovide identification before making a bid at auction. Prospective buyersshould be aware that we usually require buyers to undergo a credit check.c) Bidding as PrincipalWhen making a bid, prospective buyers will be accepting personal liability,unless it has been agreed in writing, at the time of registration, that a bidder isacting as agent on behalf of a third party acceptable to us.d) Absentee BidsIf a prospective buyer gives us instructions to bid on his behalf, by usingthe form provided, we shall use reasonable efforts to do so, provided theseinstructions are received not later than 24 hours before the sale. If we receiveabsentee bids on a particular Lot for identical amounts, and at auctionthese bids are the highest bids for the Lot, it will be sold to the personwhose bid was received first. Absentee bids are undertaken subject to othercommitments at the time of the sale, and the conduct of the sale may besuch that we are unable to bid as requested. Since this is undertaken as a freeservice to prospective buyers on the terms stated, we cannot accept liabilityfor failure to make a absentee bid. Prospective buyers should therefore alwaysattend personally if they wish to be certain of bidding.e) Telephone BidsIf prospective buyers make arrangements with us not less than 24 hoursbefore the sale, we shall use reasonable efforts to contact the bidders toenable them to participate in bidding by telephone, but in no circumstanceswill we be liable to either the Seller or any prospective buyer as a result offailure to do so.f) Currency ConverterAt some auctions, a currency converter will be operated, based on the ratesof exchange quoted to us by Coutts & Co. at opening on the date of theauction. Bidding will however take place in sterling. The currency converteris not always reliable, and errors may occur beyond our control either inthe accuracy of the Lot number displayed on the converter, or the foreigncurrency equivalent of sterling bids. We shall not be liable to the Buyer for anyloss suffered as a result of the Buyer following the currency converter ratherthan the sterling bidding.g) Video imagesAt some auctions there will be a video screen. Mistakes may occur inits operation, and we cannot be liable to the Buyer regarding either thecorrespondence of the image to the Lot being sold or the quality of the imageas a reproduction of the original.h) The auctioneer’s discretionThe auctioneer has the right at his absolute discretion to refuse any bid toadvance the bidding in such manner as he may decide to withdraw or divideany Lot, to combine any two or more Lots and, in the case of error or dispute,to put an item up for bidding again.i) Successful bidSubject to the auctioneer’s discretion, the striking of his hammer marksthe acceptance of the highest bid and the conclusion of a contract for salebetween the Seller and the Buyer.j) Online BiddingBrompton’s Auctioneers offer an online bidding service via thesaleroom. comfor bidders who cannot attend the sale. Base Rate;• to cancel the sale of the Lot or any other item sold to the Buyer at the same orany other auction;• to arrange a resale of the Lot, publicly or privately, and, if this results in a lowerprice being obtained, claim the balance from the Buyer together with anycosts incurred in connection with the Buyer’s failure to make payment.i) Failure to collectWhere purchases are not collected within seven days after the sale, whetheror not payment has been made, we shall arrange storage at the Buyer’sexpense, and only release the items purchased after payment has been madein full of storage, removal, insurance and any other costs incurred, togetherwith payment of all other amounts due to us.j) Export LicenceUnless otherwise agreed by us in writing, the fact that the Buyer wishes toapply for an export licence does not affect his obligation to make payment220 221

If theBuyer requests us to apply for an export licence on his behalf, we shall beentitled to recover from him our disbursements and out of pocket expensesin relation to such application, together with any relevant VAT. We will notbe obliged to refund any interest or other expenses incurred by the Buyerwhere payment is made by the Buyer despite the fact that an export licenceis required. It is the buyer’s responsibility to obtain any export or importlicences and/or certificates as well as any other required documentation.16. Extent of Our LiabilityWe have an obligation to refund the Buyer in the circumstances set out in clause17. However, neither the Seller nor we, nor any of our employees or agents, areresponsible for the correctness of any statement as to the authorship, origin,date, age, attribution, genuineness or provenance of any Lot nor for any othererrors of description or for any faults or defects in any Lot. Neither the Seller,ourselves, our employees or agents, give any guarantee in respect of any Lot.Any warranty of any kind whatsoever is excluded by this clause.17. Refund in the case of ForgeryA sale will be cancelled, and the amount paid refunded to the Buyer if a Lot(other than a miscellaneous item not described in the catalogue) sold by usproves to have been a Forgery. We shall not however be obliged to refund anyamounts if eithera) the catalogue description or saleroom notice at the auction datecorresponded to the generally accepted opinion of scholars or experts at thattime, or fairly indicated that there was a conflict of opinions, orD. CopyrightThe copyright in all images, illustrations and written material relating to a Lotis and shall remain at all times our property and shall not be used by the Buyernor anyone else without our prior written consent. Where the vendor providesthe text, photographs and illustrations for publication the vendor warrants thatuse is authorised by the copyright owner and indemnifies the Company againstclaims and costs arising from wrongful use.19. NoticesAny notice given under these Conditions is to be in writing and, if given by post,will be taken to have been received by the addressee on the second workingday after posting or, if the addressee is overseas, on the fifth working day afterposting.20. SeverabilityIf any part of these Conditions of Business is found by any court to be invalid,illegal or unenforceable, that part may be discounted and the rest of theconditions shall continue to be valid and enforceable to the fullest extentpermitted by law.21. Law and JurisdictionThese Conditions of Business are subject to English law, which shall apply totheir construction as well as to their effect.
