With theannouncement of elections, the Model Code of Conduct has come into force withimmediate effect. The Model Code of Conduct also provides that there shall be a ban onthe transfer of all officers/officials connected with the conduct of elections. This ban shallbe effective till the completion of the elections.Therefore, in the interest of free and fair election and to ensure that an atmosphereof trust and confidence is maintained during the conduct of elections, the State ElectionCommission under its powers conferred upon by Article 243ZA of the Constitution ofIndia, further directs that there shall be a ban on the transfers of all officers/officialsconnected with the conduct of elections. These include but are not restricted to;1. District Election Officers.2. Returning officers and Asstt. Returning Officers.3. Superintendent of Police, Addl./Deputy Superintendent of Police and police stationincharge.4. Addl. District Magistrates, Sub-Divisional Officers, Tehsildars, Vikas Adhikaris andother officers in the district administration.5. Officers and Officials of other departments/institutions who can be drafted forelection related duties by the District Election Officers and Returning Officers, and6. Officers and Officials of any other department or institution controlled by the StateGovt. who may be in a position to influence voters.The State Election Commission will, however, consider such cases of transfer ofofficers/officials which are deemed absolutely necessary due to certain circumstances.The concerned Department of the State Government should make specific references tothe State Election Commission on all such proposals alongwith full justification for thesame. Regarding officers and officials who are not directly connected with elections andare posted in the district, the District Election Officers may give approval for all suchessential cases on a case to case basis upon full justification and satisfaction.These orders shall be effective till the completion of the elections.By Order(R.K.Pareek)Dy.
