Commissi<strong>on</strong>er Chaney stated that <str<strong>on</strong>g>the</str<strong>on</strong>g> Mississippi Insurance Department(“MID”) is c<strong>on</strong>tinuing its efforts to do what is best for <str<strong>on</strong>g>the</str<strong>on</strong>g> State of Mississippi in regardsto a health insurance exchange, and urged <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Advisory</str<strong>on</strong>g> <str<strong>on</strong>g>Board</str<strong>on</strong>g> members to stay <strong>on</strong>course. Commissi<strong>on</strong>er Chaney also stated that MID will not submit <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Exchange</str<strong>on</strong>g>Blueprint applicati<strong>on</strong> until after <str<strong>on</strong>g>the</str<strong>on</strong>g> Presidential electi<strong>on</strong> in November.Mr. Aar<strong>on</strong> Sisk, Senior Staff Attorney, Mississippi Insurance DepartmentMr. Sisk stated that due to <str<strong>on</strong>g>the</str<strong>on</strong>g> threat of Hurricane Isaac, <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Advisory</str<strong>on</strong>g> <str<strong>on</strong>g>Board</str<strong>on</strong>g> meetingoriginally scheduled for August 30, 2012, in Biloxi, Mississippi, was postp<strong>on</strong>ed. TheSeptember meeting was rescheduled for September 12, 2012 and held at <str<strong>on</strong>g>the</str<strong>on</strong>g> offices ofAdams and Reese due to lack of availability of space at <str<strong>on</strong>g>the</str<strong>on</strong>g> Woolfolk State OfficeBuilding. Mr. Sisk discussed <str<strong>on</strong>g>the</str<strong>on</strong>g> development of <str<strong>on</strong>g>the</str<strong>on</strong>g> Rules for Public Comment whichwere distributed to <str<strong>on</strong>g>Advisory</str<strong>on</strong>g> <str<strong>on</strong>g>Board</str<strong>on</strong>g> members. He explained that in order to maintainrules of decorum at <str<strong>on</strong>g>Advisory</str<strong>on</strong>g> <str<strong>on</strong>g>Board</str<strong>on</strong>g> meetings, <str<strong>on</strong>g>the</str<strong>on</strong>g> formal public comment process wasdeveloped to allow individuals <str<strong>on</strong>g>from</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> public an opportunity to speak.III.Adopti<strong>on</strong> of Rules for Public Comment:A moti<strong>on</strong> was made to adopt <str<strong>on</strong>g>the</str<strong>on</strong>g> Rules for Public Comment. Said moti<strong>on</strong> was made byMs. Werner, sec<strong>on</strong>ded by Dr. Bruns<strong>on</strong>, and approved by a unanimous voice vote of <str<strong>on</strong>g>the</str<strong>on</strong>g><str<strong>on</strong>g>Advisory</str<strong>on</strong>g> <str<strong>on</strong>g>Board</str<strong>on</strong>g> members.2


IV.Updates and Announcements: Mr. Lanny Craft, Executive Director, MississippiComprehensive Health Insurance Risk Pool Associati<strong>on</strong>Mr. Craft gave a brief update <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Mississippi Comprehensive Health Insurance RiskPool Associati<strong>on</strong>’s (“MCHIRPA”) progress in developing One, Mississippi. He statedthat eHealth Insurance, Inc., was selected for <str<strong>on</strong>g>the</str<strong>on</strong>g> Phase I “shop and compare” platformafter a request for proposals (“RFP”) was issued. He stated that this platform becamefully functi<strong>on</strong>al at <str<strong>on</strong>g>the</str<strong>on</strong>g> beginning of July and c<strong>on</strong>sumers may use it to compare healthinsurance policies <str<strong>on</strong>g>from</str<strong>on</strong>g> two different companies. Mr. Craft said that visi<strong>on</strong> and dentalpolicies will be offered <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> website in <str<strong>on</strong>g>the</str<strong>on</strong>g> future. He stated that at <str<strong>on</strong>g>the</str<strong>on</strong>g> end of May anRFP was issued for Phase II & III development of <str<strong>on</strong>g>the</str<strong>on</strong>g> One, Mississippi website. Mr.Craft stated that ano<str<strong>on</strong>g>the</str<strong>on</strong>g>r vendor has been selected to complete <str<strong>on</strong>g>the</str<strong>on</strong>g>se functi<strong>on</strong>s andc<strong>on</strong>tract negotiati<strong>on</strong>s are underway.Mr. Aar<strong>on</strong> Sisk, Senior Staff Attorney, Mississippi Insurance DepartmentMr. Sisk updated <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Advisory</str<strong>on</strong>g> <str<strong>on</strong>g>Board</str<strong>on</strong>g> <strong>on</strong> MID activities. Mr. Sisk noted he does notbelieve any fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r regulati<strong>on</strong>s or guidance will be released by <str<strong>on</strong>g>the</str<strong>on</strong>g> U.S. Department ofHealth and Human Services (“HHS”) until after <str<strong>on</strong>g>the</str<strong>on</strong>g> Presidential electi<strong>on</strong>. Mr. Siskreported <strong>on</strong> his recent attendance at <str<strong>on</strong>g>the</str<strong>on</strong>g> Nati<strong>on</strong>al Associati<strong>on</strong> of InsuranceCommissi<strong>on</strong>ers (“NAIC”) meeting in August and noted that few decisi<strong>on</strong>s were maderegarding health insurance exchanges. MID has been working to identify <str<strong>on</strong>g>the</str<strong>on</strong>g> process fornotifying HHS of Mississippi’s Essential Health Benefits (“EHB”) benchmark planselecti<strong>on</strong>. Mr. Sisk also menti<strong>on</strong>ed that he has given presentati<strong>on</strong>s at several programsaround <str<strong>on</strong>g>the</str<strong>on</strong>g> State to inform people about One, Mississippi. Mr. Sisk stated that MID hasbegun working <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Exchange</str<strong>on</strong>g> Blueprint applicati<strong>on</strong> which is due by November 16,2012. The <str<strong>on</strong>g>Exchange</str<strong>on</strong>g> Blueprint applicati<strong>on</strong> will inform HHS of Mississippi’s readiness tooperate a health insurance exchange in 2014. He noted that Mississippi will not make afinal decisi<strong>on</strong> <strong>on</strong> whe<str<strong>on</strong>g>the</str<strong>on</strong>g>r to submit <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Exchange</str<strong>on</strong>g> Blueprint applicati<strong>on</strong> until after <str<strong>on</strong>g>the</str<strong>on</strong>g>electi<strong>on</strong>s in November.Mr. Sisk reminded attendees that all materials, reports, and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r documents are posted<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> MID website. She stated that because of <str<strong>on</strong>g>the</str<strong>on</strong>g> importance of <str<strong>on</strong>g>the</str<strong>on</strong>g> issue, <str<strong>on</strong>g>the</str<strong>on</strong>g> Subcommitteeswill be taking an additi<strong>on</strong>al m<strong>on</strong>th to discuss employer participati<strong>on</strong>. Ms. Smith statedthat due to <str<strong>on</strong>g>the</str<strong>on</strong>g> lack of regulati<strong>on</strong>s and restricti<strong>on</strong>s regarding <str<strong>on</strong>g>the</str<strong>on</strong>g> Small Employer<str<strong>on</strong>g>Exchange</str<strong>on</strong>g>, Mississippi has a unique opportunity to be creative when developing rulesand policy.Ms. Smith first discussed <str<strong>on</strong>g>the</str<strong>on</strong>g> products and services that Subcommittee members felt <str<strong>on</strong>g>the</str<strong>on</strong>g>Small Employer <str<strong>on</strong>g>Exchange</str<strong>on</strong>g> could provide that would be of most value. These include asimple exchange process, multiple health plan opti<strong>on</strong>s for employees, detailed guidanceabout participati<strong>on</strong>, and tools and services intended to relieve administrative burdens.Ms. Smith noted advantages and disadvantages identified by Subcommittees regardingsmall employer participati<strong>on</strong> rate requirements. Ms. Smith also discussed a definedc<strong>on</strong>tributi<strong>on</strong> model as an opti<strong>on</strong> for <str<strong>on</strong>g>the</str<strong>on</strong>g> Small Employer <str<strong>on</strong>g>Exchange</str<strong>on</strong>g>. She stated that adefined c<strong>on</strong>tributi<strong>on</strong> model could attract employers who currently do not offer insurance,4


ut that minimum c<strong>on</strong>tributi<strong>on</strong> requirements should be c<strong>on</strong>sidered to avoid decliningc<strong>on</strong>tributi<strong>on</strong>s and low employee participati<strong>on</strong>.VIII.Employer Participati<strong>on</strong> Discussi<strong>on</strong> by <str<strong>on</strong>g>Advisory</str<strong>on</strong>g> <str<strong>on</strong>g>Board</str<strong>on</strong>g> Members:The <str<strong>on</strong>g>Advisory</str<strong>on</strong>g> <str<strong>on</strong>g>Board</str<strong>on</strong>g> members discussed initial findings <str<strong>on</strong>g>from</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir Subcommitteemeetings:Mr. Steve Armstr<strong>on</strong>g, Health Insurance Agents and Brokers Subcommittee:Mr. Armstr<strong>on</strong>g menti<strong>on</strong>ed that <strong>on</strong>going training and educati<strong>on</strong> needs to be required foragents, brokers, employers, employees, and navigators with respect to <str<strong>on</strong>g>the</str<strong>on</strong>g> definedc<strong>on</strong>tributi<strong>on</strong> model and Small Employer <str<strong>on</strong>g>Exchange</str<strong>on</strong>g>. He also noted that <str<strong>on</strong>g>the</str<strong>on</strong>g> State ofUtah’s exchange website is a great reference for Subcommittee members who wish tolearn more about <str<strong>on</strong>g>the</str<strong>on</strong>g> defined c<strong>on</strong>tributi<strong>on</strong> model.Ms. Mary Werner, Small Businesses and Self-Employed Individuals Subcommittee:Ms. Werner raised <str<strong>on</strong>g>the</str<strong>on</strong>g> questi<strong>on</strong> of why <str<strong>on</strong>g>the</str<strong>on</strong>g> defined c<strong>on</strong>tributi<strong>on</strong> model would beattractive to small employers if <str<strong>on</strong>g>the</str<strong>on</strong>g>y are not required to offer health insurance under <str<strong>on</strong>g>the</str<strong>on</strong>g>Affordable Care Act (“ACA”).Ms. Smith replied and stated that <str<strong>on</strong>g>the</str<strong>on</strong>g> defined c<strong>on</strong>tributi<strong>on</strong> model may offer value to smallbusinesses trying to compete with larger businesses by offering more benefits to <str<strong>on</strong>g>the</str<strong>on</strong>g>iremployees.Mr. Roy Mitchell, Experience in Enrollment Subcommittee:Mr. Mitchell stated that <str<strong>on</strong>g>the</str<strong>on</strong>g> Subcommittee viewed <str<strong>on</strong>g>the</str<strong>on</strong>g> defined c<strong>on</strong>tributi<strong>on</strong> model <str<strong>on</strong>g>from</str<strong>on</strong>g><str<strong>on</strong>g>the</str<strong>on</strong>g> perspective of <str<strong>on</strong>g>the</str<strong>on</strong>g> employee. He stated that <str<strong>on</strong>g>the</str<strong>on</strong>g> members of <str<strong>on</strong>g>the</str<strong>on</strong>g> Subcommittee wereinterested in looking at potential disadvantages of <str<strong>on</strong>g>the</str<strong>on</strong>g> defined c<strong>on</strong>tributi<strong>on</strong> model, such ascost-shifting to <str<strong>on</strong>g>the</str<strong>on</strong>g> employee <str<strong>on</strong>g>from</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> employer, in additi<strong>on</strong> to <str<strong>on</strong>g>the</str<strong>on</strong>g> advantages of <str<strong>on</strong>g>the</str<strong>on</strong>g>system.Mr. Robert Pugh, Public Health Experts Subcommittee:Mr. Pugh stated that it would be beneficial to educate small employers and legislativeleaders about <str<strong>on</strong>g>the</str<strong>on</strong>g> defined c<strong>on</strong>tributi<strong>on</strong> model and <str<strong>on</strong>g>the</str<strong>on</strong>g> Small Employer <str<strong>on</strong>g>Exchange</str<strong>on</strong>g> in orderto encourage participati<strong>on</strong>. Mr. Pugh menti<strong>on</strong>ed that <str<strong>on</strong>g>the</str<strong>on</strong>g>re are still issues to be addressed5


elated to qualified health plan c<strong>on</strong>tracting and sustainability, and asked when MIDwould make decisi<strong>on</strong>s regarding <str<strong>on</strong>g>the</str<strong>on</strong>g>se issues.Mr. Sisk resp<strong>on</strong>ded by stating that <str<strong>on</strong>g>the</str<strong>on</strong>g>se issues would be discussed after <str<strong>on</strong>g>the</str<strong>on</strong>g> Presidentialelecti<strong>on</strong>, but that MCHIRPA is currently working <strong>on</strong> a cost and sustainability analysis forOne, Mississippi.Ms. Stephanie Barnes Taylor, Health Care Providers Subcommittee:Ms. Taylor menti<strong>on</strong>ed that <str<strong>on</strong>g>the</str<strong>on</strong>g> Subcommittee discussed ensuring that employeesunderstand <str<strong>on</strong>g>the</str<strong>on</strong>g> potential c<strong>on</strong>necti<strong>on</strong> between <str<strong>on</strong>g>the</str<strong>on</strong>g> defined c<strong>on</strong>tributi<strong>on</strong> model and healthsavings accounts (“HSAs”), and encouraged educati<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>se opti<strong>on</strong>s.Dr. Jas<strong>on</strong> Dees, Health Insurance Issuers Subcommittee:Dr. Dees menti<strong>on</strong>ed ano<str<strong>on</strong>g>the</str<strong>on</strong>g>r item to be included in <str<strong>on</strong>g>the</str<strong>on</strong>g> educati<strong>on</strong>al process for HSAs. Hestated that <str<strong>on</strong>g>the</str<strong>on</strong>g> direct pay opti<strong>on</strong> for physicians and direct c<strong>on</strong>tracting should be offered in<str<strong>on</strong>g>the</str<strong>on</strong>g> exchange al<strong>on</strong>g with high deductible plans.Mr. Sisk noted <str<strong>on</strong>g>the</str<strong>on</strong>g>re are some restricti<strong>on</strong>s in <str<strong>on</strong>g>the</str<strong>on</strong>g> ACA regarding HSAs and highdeductible health plans (“HDHPs). These restricti<strong>on</strong>s include eligibility for a HDHP and<str<strong>on</strong>g>the</str<strong>on</strong>g> annual amount of c<strong>on</strong>tributi<strong>on</strong> to a HSA. He stated that MID would work with HHSto offer <str<strong>on</strong>g>the</str<strong>on</strong>g>se plans.Ms. Teresa Mal<strong>on</strong>e, State Government Agencies and Divisi<strong>on</strong>s Subcommittee:Ms. Mal<strong>on</strong>e stated that <str<strong>on</strong>g>the</str<strong>on</strong>g> Subcommittee had difficulty answering <str<strong>on</strong>g>the</str<strong>on</strong>g> primer questi<strong>on</strong>sc<strong>on</strong>cerning minimum participati<strong>on</strong> requirements for small employers. Ms. Mal<strong>on</strong>e saidthat some Subcommittee members felt this would help with adverse selecti<strong>on</strong>, whilesome Subcommittee members were c<strong>on</strong>cerned that a minimum participati<strong>on</strong> requirementmay exclude some employers <str<strong>on</strong>g>from</str<strong>on</strong>g> participating who would o<str<strong>on</strong>g>the</str<strong>on</strong>g>rwise be able to.Dr. Claude Bruns<strong>on</strong>, Large Employers Subcommittee:Dr. Bruns<strong>on</strong> stated that <str<strong>on</strong>g>the</str<strong>on</strong>g> Subcommittee had questi<strong>on</strong>s c<strong>on</strong>cerning plan portability andwanted clarificati<strong>on</strong> <strong>on</strong> this issue.Mr. Sisk stated that <str<strong>on</strong>g>the</str<strong>on</strong>g>re are several different c<strong>on</strong>cepts surrounding plan portability. Onec<strong>on</strong>cept involves being able to keep <str<strong>on</strong>g>the</str<strong>on</strong>g> same plan when changing employers. On a6
