3.12 Noisy Jet SurchargeAircraft will be subject to a surcharge of £750 plus an extra £150 for each fullPNdB above the following limits:90 dB (A) (103 PNdB) 07:00 - 22:59 hrs83 dB (A) (96 PNdB) 23:00 - 06:59 hrsThe PNdB limits are regularly reviewed.The above times are local <strong>and</strong> based on the Actual departure times.3.13 Night Noise PolicyThe Company’s policy for controlling night noise can be found on the <strong>Airport</strong>website www.magworld.co.uk/nightnoise.3.14 TrackingThe Company reserves the right to levy a surcharge, as provided for bySection 3 of the Civil Aviation Act 2006, against any Operator who on apersistent basis (equivalent to 5% or more departures in any month) fails tooperate along the Preferred Noise Routes (PNR’s) as prescribed by theCompany <strong>and</strong> recorded <strong>and</strong> monitored by the Company’s noise <strong>and</strong> trackingmonitoring system. The surcharge will be levied as set out below:-During the period 07.00 hours <strong>and</strong> 22.59 hours (local)During the period 23.00 hours <strong>and</strong> 06.59 hours (local)£500 per failure£750 per failurePrior to the Company levying the surcharge the Company will consult with theOperator to establish steps the Operator can take to avoid further failures. Iffollowing consultation the Operator continues to exceed the 5% threshold then theCompany will levy the surcharge retrospectively for each of the failures.The above times are local <strong>and</strong> based on the Actual departure times.13
