Research fundingResearch fundingOver the years, <strong>SCCL</strong> has been successful inobtaining research grants, and many sponsorshave chosen to support its activities. A largedonation in 2005 from the Marianne andMarcus Wallenberg Foundation enabled it toprocure and renovate premises of its own in2007. In addition, the Marianne and MarcusWallenberg Foundation has made furthergrants to ensure the continuation of the <strong>SCCL</strong>’sgeneral activities <strong>for</strong> another five years (up toand including 2016). The <strong>SCCL</strong>’s general activitiesare also funded by the Skandia insurancecompany’s science foundations.In addition, the Ragnar Söderberg Foundationand the Torsten Söderberg Foundation haveallotted research funding <strong>for</strong> post-doc appointmentsat <strong>SCCL</strong>. This donation is all the moreimportant because previously the Departmentof Law was in no position to finance post-doctoralresearch. The donation has now made thispossible. The bursaries received correspond to atotal of 15 years’ full-time research. Similarly, in2007 the <strong>Stockholm</strong> Property Association resolvedin 2007 to endow a research post at <strong>SCCL</strong>,named after the Association, in memory ofProfessor Anders Victorin. Additional fundinghas been received from LO-Media AB, ProventusAB, TV4 AB and Bonnier AB<strong>SCCL</strong> has inaugurated a research exchange, the<strong>Stockholm</strong> <strong>Centre</strong> Ox<strong>for</strong>d Fellowship, with theInstitute of European and Comparative Law atthe University of Ox<strong>for</strong>d, whereby a researcherfrom <strong>SCCL</strong> can spend a whole year doingresearch at Ox<strong>for</strong>d. The exchange is jointlyfunded by <strong>Stockholm</strong> University, Advokatvännerna,Stiftelsen Fakultetskurser, MannheimerSwartling Advokatbyrå and Gernandt &Danielsson Advokatbyrå.For special purposes, such as book purchases,printing and meetings, <strong>SCCL</strong> receives, on application,supplementary grants from the LawFaculty Literature Foundation, the JusticeEdvard Cassel Foundation and the Departmentof Law. In addition, <strong>SCCL</strong> receives a specialannual grant from a number of interested parties<strong>for</strong> its special arbitration law library. TheTax Law Research Department also receives anannual grant from interested parties.AdvokatvännernaIn 2002 some twenty commercial law firms<strong>for</strong>med an organisation to support the <strong>SCCL</strong>’sactivities. This group, called “<strong>SCCL</strong>’s Advokatvänner”(SAd) is headed by a committee consistingof three lawyers. Practically all of Sweden’sleading commercial practices are now membersof SAd. They have undertaken to support<strong>SCCL</strong>’s activities financially. SAd mainly providesfinancial support to <strong>SCCL</strong> <strong>for</strong> projects ofspecial interest to commercial lawyers. Themember law firms participate in seminars andin collaboration with the researchers workingwithin <strong>SCCL</strong>. Since 2010 SAd has funded acommercial law essay prize – the <strong>SCCL</strong> Prize– as well as helped to finance the <strong>Stockholm</strong><strong>Centre</strong> Ox<strong>for</strong>d Fellowship.45

In addition, representatives fromthe government participate in <strong>SCCL</strong>’s ResearchPanel <strong>for</strong> Financial Market Law. <strong>SCCL</strong> also cooperateswith national and international centresof law and economics research, such asCEVIA (the <strong>Centre</strong> <strong>for</strong> Enterprise Liability) andFOCOFIMA (Forum <strong>for</strong> Company Law andFinancial Law) at the University of Copenhagen,the Department of Law, University ofSouthern Denmark, and SIFR (the Institute <strong>for</strong>Financial Research) at the <strong>Stockholm</strong> School ofEconomics.European Law Institute<strong>SCCL</strong> has also, mainly through the agency of itsCouncil Chairman, Johan Gernandt, advokatand Chairman of the General Council of theCentral Bank of Sweden, been instrumental inhelping set up, in 2011, a European law <strong>for</strong>um<strong>for</strong> co-operation between leading Europeaninstitutions of legal research. The purpose ofsuch a <strong>for</strong>um, the European Law Institute, is topromote transboundary contacts between academicsand practitioners, above all in the fieldof property law.International co-operationIn recent years <strong>SCCL</strong>’s main concern has beenwith expanding its international co-operation.For example, <strong>SCCL</strong> inaugurated in 2011 a cooperationwith the University of Ox<strong>for</strong>d andChrist Church College, which among otherthings has made it possible <strong>for</strong> Swedish researchersto join the faculty of Ox<strong>for</strong>d Universitythrough the <strong>Stockholm</strong> <strong>Centre</strong> Ox<strong>for</strong>d Fellowshipand spend a whole academic year theredoing research. It has also been agreed that<strong>SCCL</strong> and the University of Ox<strong>for</strong>d are to1011


arrange an annual international conference oncommercial law.<strong>SCCL</strong> is currently establishing contacts withleading research institutes in South America,the USA and Germany, with a view tostrengthen its international network and inthis way promoting a greater element of crossborderresearch between different disciplinesand countries.In September 2012 <strong>SCCL</strong> hosted a symposiumwhere future international projects were discussedand guidelines <strong>for</strong> future <strong>for</strong>ms of cooperationwere adopted. The co-operation withUniversity of Ox<strong>for</strong>d is managed by The Ox<strong>for</strong>dCommittee, which is composed by representativesof the co-operating parties. TheDirector makes decisions <strong>for</strong> the conduct ofday-to-day activities in accordance with directionsand guidelines issued by the Board ofDirectors.The International SecretaryAn International Secretary has been attachedto <strong>SCCL</strong> since the autumn term 2002, taskedamong other things with promoting <strong>SCCL</strong>’sinternational contacts and comparativeresearch.The CouncilThe Council deals with general scholarly issueswithin the framework of <strong>SCCL</strong>, e.g. to ensurethat <strong>SCCL</strong>’s activities are when necessary conductedin partnership with the community atlarge and on a basis of co-operation betweendifferent legal and other disciplines, and alsothat they address urgent issues of a legalnature. The members of the Council representvarious legal disciplines and various fields oflegal practice. They possess a high level ofscholarly competence or other legal competencein their several fields. The Council includesthe members of the Board of Directorsand the Special Committee, the Director andthe heads of the Research Panels. The Research PanelsResearch Panel <strong>for</strong> the Law of Contract and ObligationsHead of Research Panel: Emeritus ProfessorLars Gorton, <strong>Stockholm</strong> UniversityThis Panel focuses on current problems inthe field of property law. Issues addressedrecently have included unjust enrichments,duty of notification and <strong>for</strong>mation of precedents.Issues often come to centre on principles,and a discussion of this kind can also becarried on against the background of a morespecific issue of contract law. The members ofthe Panel are practitioners and academics witha special interest in the development of the lawof contract and obligations.Many topics are of course linked with otherResearch Panels, and accordingly, there is closeco-operation between us where seminar activitiesare concerned.The Research PanelsMost scholarly activity takes place within theResearch Panels on the initiative of their members.The Research Panels are made up ofrepresentatives of the academic community,public and governmental agencies, courts, lawpractices and business undertakings. TheHeads of Panels are ex officio members of theCouncil.The Research Panels have an extensive rangeof seminar activities, that attracts a large numbersof participants, anything up to a hundredeach. It is also common <strong>for</strong> Panels to co-operateand arrange joint seminars. In some casesthe subject of the seminar is developed into amajor conference, which in turn has resulted inadditions to <strong>SCCL</strong>’s publication series.Seminar activities have been successful in thesense of triggering widespread discussion inthe subject field concerned, which is of benefitboth to the participants themselves and toresearchers affiliated to <strong>SCCL</strong>. The researchersthen have an opportunity of presenting theircurrent fields of research, but can also keepabreast of ongoing discussions in the subjectfields concerned. The seminars also give otherparticipants an opportunity of meeting todiscuss topics of importance in their variousprofessional fields.Research Panel <strong>for</strong> Company and Securities LawHead of Research Panel: Ass. Prof. Carl Svernlöv,advokat, Baker & McKenzie AdvokatbyråThe members of this Research Panel compriseboth academics and professional lawyers. The Research PanelsThe Research PanelsResearch Panel <strong>for</strong> European LawHead of Research Panel: Professor Ulf Bernitz,<strong>Stockholm</strong> UniversityThis Research Panel specifically addresses therelationship between EU law and commerciallaw in the broad sense, e.g. in relation to Swedishlaw. The Research Panel also observesEuropean protection of rights, both in Communitylaw and in convention law under theEuropean Convention.Research Panel <strong>for</strong> Financial Market LawHead of Research Panel: Ass. Prof. GustafSjöberg, <strong>Stockholm</strong> UniversityThis Panel is particularly concerned withshedding light on the regulation and workingsof financial enterprises and markets in a socioeconomicperspective.One task is to promote an exchange of viewsbetween individuals active in the financialsector. The Panel includes both economists andlawyers, plus representatives of government,the academic community and the privatesector. The Panel has established co-operationwith the Ministry of Finance, the Central Bankof Sweden, the National Debt Office and theFinancial Supervisory Authority.The Panel shall contribute towards researchprojects aimed at recruiting a group of competentfinancial market regulators. Physicallyassembling a research group at <strong>SCCL</strong> is part ofthat ambition. Five postgraduate students areespecially closely associated with the Panel,partly through having reference groups from it.Research Panel <strong>for</strong> Real Property LawHead of Research Panel: Professor Jori Munukka,<strong>Stockholm</strong> UniversityThis Panel engages in seminar, conferenceand publishing activities relating to real propertylaw. Its activities are divided between twounits: the Real Estate Law Discussion Club(FDK) and the Tenancy Law Discussion Club(HDK).HDK, which is headed by Hans-Åke Wängberg,<strong>for</strong>mer Chairman of the <strong>Stockholm</strong> Rentand Leasehold Tribunal, concentrates mainlyon tenancy and tenant-ownership issues, andits seminars attract many lawyers from avariety of fields. FDK is a plat<strong>for</strong>m <strong>for</strong> otherissues of real property law. The Panel convenes<strong>about</strong> eight seminars annually, some of them inassociation with other Research Panels. A wellsubscribedHDK seminar concerning tenants’liability <strong>for</strong> damage to the dwelling unit tookplace in the autumn of 2011 on the premises ofthe <strong>Stockholm</strong> Property Association. The proceedingshave now been published in book<strong>for</strong>m, Wängberg (ed.) et al., Hyresgästs skadeståndsansvar,<strong>SCCL</strong> Publication Series No. 17,Jure Förlag 2012. Memorable FDK events haveincluded two seminars in the autumn of 2011,namely one on China’s newly enacted rights ofownership legislation, with Professor WeixingShen, Tsinghua University, and the other on<strong>for</strong>mal requirements governing the purchaseand sale of real property, with Doctoral CandidateElisabeth Ahlinder and Professor ChristinaRamberg.Research Panel <strong>for</strong> Insurance LawHead of Research Panel: Ass. Prof. Jessika vander Sluijs, <strong>Stockholm</strong> UniversityThis Research Panel addresses issues of insurancelaw in the broad sense and comprisesboth academics and professionals. The Panelarranges two evening seminars per term oncurrent insurance-related topics meritingcloser study. We also work regularly with otherResearch Panels, e.g. those <strong>for</strong> Financial MarketLaw and the Law of Damages. Seminar to-picshave, <strong>for</strong> example, included “Subrogation as abusiness idea” and “Solvency II. Frameworklegislation <strong>for</strong> the insurance industry – threator opportunity?”1819


The Research PanelsThe Research Panels“My interest in <strong>SCCL</strong> is rooted in my general involvement with socialaffairs, in that I have <strong>for</strong> many years been active in various associationsand organisations, as well as having been a member <strong>for</strong> eightyears of the Swedish Parliament.Insolvency law has an important bearing on the successful handlingof an economic crisis, but the rules still have their shortcomings, andthe Panel’s activities are partly aimed at bringing those shortcomingsinto the open and prompting discussion of the best remedies.<strong>SCCL</strong> has been designed to provide good opportunities <strong>for</strong> discussionsbetween representatives of policy-making and law. The debate onlegal policy in Sweden urgently needs rein<strong>for</strong>cing and developing, inorder, <strong>for</strong> example, to bring <strong>about</strong> legislation strengthening the positionof insolvency law.”Rolf ÅbjörnssonHead of Research PanelResearch Panel <strong>for</strong> Media LawHead of Research Panel: Professor Jan Rosén,<strong>Stockholm</strong> UniversityThe Research Panel <strong>for</strong> Media Law studieslegal phenomena associated with the production,mediation and dissemination of data,entertainment, journalism and in<strong>for</strong>mation inthe broad sense, hereby encompassing contemporarymethods <strong>for</strong> communication inbroadcasting, webcasting and modern telecomfacilities as well as traditional <strong>for</strong>ms of makingmedia content available to the public. Accordingly,the Research Panel’s field of interestcomprehends the legal preconditions governingdissemination of in<strong>for</strong>mation to thepublic as well as public access to in<strong>for</strong>mation,hereby also including matters of secrecy, personalprivacy and personal data. Further, preconditions<strong>for</strong> freedom of expression and in<strong>for</strong>mationas set <strong>for</strong>th in constitutional and civillaw are part of the Panel’s field of interest, asare values of exclusive intellectual propertyrights, especially with regard to trademarksand copyright. EU law and international conventions,agreements and treaties are of particularrelevance to mass communication andmedia content – the panel thus studies thecomplex EU and convention based foundationsof media law. The Research Panel <strong>for</strong> Media Lawregularly arranges at least two advanced seminarseach semester.Research Panel <strong>for</strong> Insolvency Law and Law ofPersonal PropertyHead of Research Panel: Rolf Åbjörnsson,Advokat, Advokatfirman Nordia KBBoth academics and professionals are affiliatedto this Panel. The Panel arranges seminars andsymposia in the fields of insolvency law andthe law of personal property in the broad sense.Seminars in recent years have included: “Possessionof money in an account – The implicationsof the concept of possession in penal andcivil law”; “Credit security in intellectualresources – Background and societal premises”;“Reclaim in bankruptcy of contract per<strong>for</strong>manceand cancellation of contracts whenvoid” and “The genesis of a claim”.Research Panel <strong>for</strong> Tort LawHead of Research Panel: Ass. Prof. Mia Carlsson,<strong>Stockholm</strong> UniversityThe other members of the Panel are expertsin Tort Law from both academic and businesscommunities as well as from the public sector.The Panel addresses the Law of Torts in thebroad sense and provides a meeting point <strong>for</strong>an interchange of views between tort lawyersin various disciplines and fields of activity.Attention is made to focus on both contractualand non-contractual liability.The Panel works primarily through knowledgeinterchanges of different kinds, andmeets regularly <strong>for</strong> the elucidation and discussionof current tort law issues and new developments.As part of its activities, the Panelinitiates and arranges seminars, lectures andconferences having as their target group bothresearchers and practising lawyers as well asother parties with an interest in the Law ofTorts.2021

Prof. TeresaSimon-Almendal, <strong>Stockholm</strong> UniversityOne of the main objectives of the ResearchPanel <strong>for</strong> Tax Law is to provide a meeting point<strong>for</strong> practising tax lawyers and academics, <strong>for</strong>the elucidation and discussion of tax lawissues. The Panel sees an important task inpromoting the interchange of viewpoints andknowledge between the different tax law professionalcommunities. To this end theresearch panel regularly arranges seminars,conferences and lectures within various sectorsof tax law.The Panel has established co-operation withDeloitte, KPMG, PwC and Svalner Skatt & Transaktionin the purpose of supporting tax lawresearch within the frame of the Panel’s aegisat <strong>SCCL</strong> and further developing and strengtheningco-operation between itself and legalpractice. Support is provided in research fieldswith a bearing, direct or indirect, on the implementationof tax law issues handled by the taxdepartments of the firms mentioned, and thisco-operation also helps to finance the Panel’spublic seminars.Research Panel <strong>for</strong> Arbitration and Other Formsof Dispute ResolutionHead of Research Panel: University LecturerPatricia Shaughnessy, LL.D., <strong>Stockholm</strong>UniversityThe <strong>Stockholm</strong> University Institute <strong>for</strong> ArbitrationLaw, <strong>for</strong>med in 1985, has merged with<strong>SCCL</strong> and its activities were taken over, as from2005, by <strong>SCCL</strong>’s Research Panel <strong>for</strong> Arbitrationand Other Forms of Dispute Resolution. ThePanel is tasked with bringing together academics,judges and practising lawyers with a viewto promoting research and education in arbitrationlaw, both Swedish and internationallegal relationships. These activities help thePanel to promote interchange of ideas, knowledgeand experiences within dispute resolutionsin commercial disputes. The main emphasisbeing on aspects of commercial law.The Panel arranges scholarly lectures,courses and seminars, as well as other <strong>for</strong>ms ofeducational activity. Prof. FredricKorling and Prof. Mauro Zamboni, <strong>Stockholm</strong>UniversityThe principal aim of this Research Panel is todevelop and organise interdisciplinary researchin commercial law, with special emphasis onits globalisation and internationalisation.The Panel’s purpose is to create a methodologicalfoundation <strong>for</strong> evaluating and analysingdifferences and similarities betweendifferent types of regulatory instruments (hardlaw and soft law) provided by national, transnationaland international agents regardingcommercial transactions.The Panel devotes special attention to issuesconcerning the development and conditions ofthe legal profession, the drawing up transnationalcodes and principles and elements in thecontexts of academic studies and professionalpractice.2223


<strong>SCCL</strong>’s publication series and library<strong>SCCL</strong>’s Publication Series and LibraryIn addition to the arrangement of seminarsand conferences, publication of the researchfindings produced is a vital component of<strong>SCCL</strong>’s activities. A project plan <strong>for</strong> <strong>SCCL</strong>’spublishing activities was there<strong>for</strong>e drawn up inassociation with Professor Peter Wahlgren,resulting in a separate series of publications.<strong>SCCL</strong> also aims to inaugurate internationalco-operation in the publishing field.Large numbers of articles and research reportsare published every year by the researchersaffiliated to <strong>SCCL</strong> and by lecturers at majorseminars and conferences. <strong>SCCL</strong> there<strong>for</strong>emaintains publications of two kinds, issued inits series, namely its Yearbook and digests ofpapers <strong>for</strong> specific conferences. The lecturesgiven at Council meetings have, however, beenpublished in Juridisk Tidskrift (JT).Library<strong>SCCL</strong> has on its own premises an extensivelibrary which began with a donation by the lateProfessor Jan Hellner and with the acquisitionof the library of the Institute <strong>for</strong> Company andSecurities Law, whose activities are being continuedby <strong>SCCL</strong>. Since then the library has beenaugmented through a variety of large donations,e.g. by Professor Lars Gorton and ProfessorHenrik Edelstam.Since the <strong>Stockholm</strong> University Scientific Institute<strong>for</strong> Arbitration Law became part of <strong>SCCL</strong>,its specialist library of Swedish and internationalarbitration law has come under <strong>SCCL</strong>’smanagement.The library also receives ongoing donationsfrom Jure Förlag AB of newly published swedishdoctrine. It now holds <strong>about</strong> 5,500 titles, and<strong>SCCL</strong> intends successively building the librarieswhich will be accessible to researchers inthe field of commercial law and to <strong>SCCL</strong> itselfand its Council, the aim being <strong>for</strong> library activitiesultimately to be run on a separate basisand with their own librarian.Ass. Prof. Fredric Korling is in charge of <strong>SCCL</strong>’slibrary. University Lecturer Patricia Shaughnessyis in charge of acquisitions <strong>for</strong> thelibrary of the Research Panel <strong>for</strong> Arbitrationand Other Forms of Dispute Resolution.
