77 Disqualification <strong>of</strong> an insurance agent(1) If an insurer becomes aware that an insurance agent <strong>of</strong> the insurer is no longer competentto act for the insurer, the insurer must as soon as practicable:(a)(b)(c)(d)withdraw the authority given to the agent; andensure that the agent no longer acts for the insurer; andremove the agent’s name, and the names <strong>of</strong> its key individuals, from the insurer’slist <strong>of</strong> agents kept under section 76; andinform the Commission in writing that the agent’s authority has been withdrawn.(2) The insurer must ensure that the interests <strong>of</strong> the agent’s customers are protected and thatany unconcluded business <strong>of</strong> the agent is properly concluded.78 <strong>Insurance</strong> brokers(1) An insurance broker must not provide intermediary services for customers for domesticinsurance with an unlicensed insurer without the approval <strong>of</strong> the Commission.(2) The Commission may grant an approval under this section if:(a)(b)the insurance for the particular risk is not available from a licensed insurer in<strong>Vanuatu</strong>; orthe insurance is available but the terms and conditions are unreasonable.(3) An insurer must to the best <strong>of</strong> its ability ensure that an insurance broker acts within theauthority given by the customer to the insurance broker.79 Independent insurance salespersons(1) An independent insurance salesperson must not:(a)(b)promote or market an insurance product for any person who is not licensed as aninsurer; orpromote or market an insurance product from an insurer, unless the independentinsurance salesperson can provide confirmation, certified by the insurer, tocustomers that the independent insurance salesperson has the right to promote ormarket the insurer’s insurance product.(2) An insurer must:58
