Board - new developments<br />

�� s<strong>in</strong>ce 2005 no longer<br />

adm<strong>in</strong>istratively under<br />

M<strong>in</strong>istry of Trade and<br />

Industry like the F<strong>in</strong>nish<br />

Consumer Agency, but<br />

under the M<strong>in</strong>istry of<br />

Justice<br />

�� NEB under Reg. 261<br />

<strong>in</strong>sofar as <strong>in</strong>dividual<br />

disputes between a<br />

consumers and airl<strong>in</strong>es<br />

are concerned<br />

�� New Act on the<br />

Consumer Disputes<br />

Board entered <strong>in</strong><strong>to</strong> force<br />

competence of the<br />

an <strong>ADR</strong> <strong>in</strong> F<strong>in</strong>land, as<br />

the F<strong>in</strong>nish Consumer<br />

Disputes Board has<br />

general competence <strong>in</strong><br />

all consumer matters<br />

�� Preconditions formally<br />

the same for nationals<br />

and non non-nationals nationals alike,<br />

no differentiation even<br />

between EU EU- and non non-<br />

br<strong>in</strong>g<strong>in</strong>g the matter<br />

before the Board<br />

�� ECC F<strong>in</strong>land has only<br />

limited resources for<br />

translation – need <strong>to</strong><br />

filter <strong>in</strong> the future?<br />

�� Long handl<strong>in</strong>g times<br />

(6 - 14 months)<br />

Cooperation and <strong>ADR</strong>-<br />

development<br />

consults it frequently<br />

on <strong>in</strong>dividual cases and<br />

matters of <strong>in</strong>terpretation<br />

�� The Board is<br />

extremely useful <strong>in</strong><br />

develop<strong>in</strong>g case law<br />

– guides the<br />

consumer advisers,<br />

also the ECC often<br />

knows beforehand<br />

whether it makes<br />

sense <strong>to</strong> send a<br />

particular matter <strong>to</strong><br />

the<br />

�� Board


Cooperation and Development<br />

�� While ECC F<strong>in</strong>land<br />

cooperates with<br />

<strong>ADR</strong> actively, it does<br />

not develop <strong>ADR</strong> <strong>in</strong><br />

F<strong>in</strong>land (<strong>ADR</strong>-<br />

system has been <strong>in</strong><br />

place s<strong>in</strong>ce 70’s),<br />

nor does it see that<br />

this should be a duty<br />

for the ECC ECC-net net<br />

�� <strong>ADR</strong> should be<br />

developed primarily<br />

from a national<br />

perspective, but it<br />

goes without say<strong>in</strong>g<br />

that there should be<br />

no discrim<strong>in</strong>ation on<br />

grounds of<br />

nationality


�� Filter<strong>in</strong>g function should<br />

be considered by the<br />

network and the<br />

Commission <strong>in</strong> <strong>ADR</strong>-<br />

development ( <strong>ADR</strong><br />

only handles a fraction<br />

(4000) of the some 100<br />

000 contacts consumer<br />

advisers <strong>in</strong> F<strong>in</strong>land<br />

receive, yet it is<br />

stretched <strong>to</strong> the limits –<br />

implications <strong>in</strong> cross-<br />

border context)<br />

�� <strong>ADR</strong> cannot be the<br />

answer <strong>to</strong><br />

everyth<strong>in</strong>g:<br />

consumer <strong>in</strong>fo and<br />

amicable<br />

settlements even<br />

cheaper and quicker<br />

complements <strong>to</strong><br />

<strong>ADR</strong>


�� Board has <strong>in</strong>terest<strong>in</strong>g case law on <strong>in</strong>terpretation of<br />

Regulation 261, e.g e.g. . on technical defects as<br />

extraord<strong>in</strong>ary circumstances
