GUIDANCE DOCUMENTMarch 2011 (v5)Q11Under <strong>the</strong> guidelines, what do <strong>the</strong> terms „reas<strong>on</strong>able‟ and „hospitality‟ mean?A11 The guidelines seek to find a balance between <strong>the</strong> courteous and professi<strong>on</strong>al treatment of<strong>Healthcare</strong> Professi<strong>on</strong>als by <strong>Eucomed</strong> members, <strong>with</strong> <strong>the</strong> desire to avoid even <strong>the</strong> appearance thathospitality may be used by members as a means to induce <strong>Healthcare</strong> Professi<strong>on</strong>als to purchase,prescribe or recommend company products. Accordingly, members must assess what is „reas<strong>on</strong>able‟ inany given situati<strong>on</strong> and regi<strong>on</strong>al variati<strong>on</strong>s will apply. As a general guideline, „reas<strong>on</strong>able‟ should beinterpreted as <strong>the</strong> appropriate standard for <strong>the</strong> given locati<strong>on</strong> and must comply <strong>with</strong> <strong>the</strong> local laws,regulati<strong>on</strong>s and professi<strong>on</strong>al codes of c<strong>on</strong>duct. If <strong>the</strong> meeting venue is a hotel which complies <strong>with</strong> <strong>the</strong>requirements of <strong>the</strong> guidelines, it would be acceptable for members to offer participants meals andaccommodati<strong>on</strong> at <strong>the</strong> same hotel.The term „hospitality‟ includes meals and accommodati<strong>on</strong>. It is important that members differentiatebetween „hospitality‟ which is permitted and „entertainment‟ which is not. „Entertainment‟ includes, but isnot limited to, dancing or arrangements where live music is <strong>the</strong> main attracti<strong>on</strong>, sight-seeing trips, <strong>the</strong>atreexcursi<strong>on</strong>s, sporting events and o<strong>the</strong>r leisure arrangements.Q12 Under <strong>the</strong> guidelines, what standard of air travel may a member provide a <strong>Healthcare</strong>Professi<strong>on</strong>al attending member-sp<strong>on</strong>sored training?A12 Members may provide <strong>on</strong>ly ec<strong>on</strong>omy or standard class air travel to <strong>Healthcare</strong> Professi<strong>on</strong>alsunless <strong>the</strong> flight time is of a durati<strong>on</strong> of greater than 5 hours; in which case, it is appropriate to c<strong>on</strong>siderpremium ec<strong>on</strong>omy or business class provided this is permitted under <strong>the</strong> nati<strong>on</strong>al and local laws,regulati<strong>on</strong>s and professi<strong>on</strong>al codes of c<strong>on</strong>duct of <strong>the</strong> country where <strong>the</strong> <strong>Healthcare</strong> Professi<strong>on</strong>al islicensed to practise.Q13 What does <strong>the</strong> term “facilitate” mean where used in c<strong>on</strong>necti<strong>on</strong> <strong>with</strong> <strong>the</strong> guest or spouseexpenses?A13 The term “facilitate” refers to <strong>the</strong> prior arrangement, organisati<strong>on</strong> or booking of meals, travel oraccommodati<strong>on</strong> by a member <strong>on</strong> behalf of <strong>the</strong> spouse/guest of a <strong>Healthcare</strong> Professi<strong>on</strong>al participant.Such organisati<strong>on</strong> or booking is not permitted unless <strong>the</strong> individual qualifies as a participant in <strong>the</strong>ir ownright. If <strong>Healthcare</strong> Professi<strong>on</strong>als attending product training wish to be accompanied by a spouse/guestwho does not have a professi<strong>on</strong>al interest in <strong>the</strong> informati<strong>on</strong> being shared, <strong>the</strong> <strong>Healthcare</strong> Professi<strong>on</strong>almust take sole resp<strong>on</strong>sibility for <strong>the</strong> payment and organisati<strong>on</strong> of <strong>the</strong> spouse/guest‟s expenses.Q14 In <strong>the</strong> event that a <strong>Healthcare</strong> Professi<strong>on</strong>al is accompanied by a spouse/guest at membersp<strong>on</strong>soredproduct training, may <strong>the</strong> spouse/guest be admitted to any member-related activity?A14 It would not be appropriate for <strong>the</strong> spouse/guest of a <strong>Healthcare</strong> Professi<strong>on</strong>al to be invited toattend any of <strong>the</strong> member-related activities, including associated meals even when <strong>the</strong> <strong>Healthcare</strong>Professi<strong>on</strong>al has paid for <strong>the</strong> spouse/guest expenses. Any uninvited appearance by a spouse/guestshould be str<strong>on</strong>gly discouraged.Q15 In c<strong>on</strong>necti<strong>on</strong> <strong>with</strong> providing financial support to cover <strong>the</strong> cost of c<strong>on</strong>ference attendanceby individual <strong>Healthcare</strong> Professi<strong>on</strong>als, what are deemed to be reas<strong>on</strong>able travel, meals andaccommodati<strong>on</strong>?A15 Members must assess what is reas<strong>on</strong>able in any given locati<strong>on</strong> and regi<strong>on</strong>al and countryvariati<strong>on</strong>s will apply. However, as <strong>with</strong> member-sp<strong>on</strong>sored training, <strong>the</strong> hospitality provided by membersat third party educati<strong>on</strong>al events should not be of such a level as to become <strong>the</strong> main attracti<strong>on</strong> of <strong>the</strong>event. Accordingly, hotel accommodati<strong>on</strong> should not normally be provided at top category or luxury4
