GUIDANCE DOCUMENTMarch 2011 (v5)hotels, air travel should be ec<strong>on</strong>omy or standard class unless <strong>the</strong> durati<strong>on</strong> of <strong>the</strong> flight extends bey<strong>on</strong>d5 hours (in which case premium ec<strong>on</strong>omy or business class may be c<strong>on</strong>sidered) and meals should be ofa standard that <strong>Healthcare</strong> Professi<strong>on</strong>als would routinely expect if <strong>the</strong>y were paying for <strong>the</strong>m out of <strong>the</strong>irown pockets. A meal at <strong>the</strong> c<strong>on</strong>ference hotel <strong>with</strong> wine would normally be c<strong>on</strong>sidered acceptable.Q16 Is it appropriate for members to cover <strong>the</strong> full registrati<strong>on</strong> fee of third-party c<strong>on</strong>ferenceswhere such fee covers <strong>the</strong> cost of a c<strong>on</strong>ference dinner and/or social or cultural activities?A16 Members must not pay for <strong>the</strong> expenses which relate to <strong>the</strong> purely social or cultural aspects of <strong>the</strong>c<strong>on</strong>ference. Modest and incidental ga<strong>the</strong>rings such as <strong>the</strong> welcome cocktail are appropriate andmembers may cover <strong>the</strong>se expenses. Where <strong>the</strong> registrati<strong>on</strong> fee includes an element of entertainmentmembers must request that <strong>the</strong>se elements are separated in <strong>the</strong> registrati<strong>on</strong> fee and subsequently notpay for this element. If <strong>the</strong> c<strong>on</strong>ference organiser is unable to separate <strong>the</strong> entertainment costs from <strong>the</strong>registrati<strong>on</strong> fee, members should assess <strong>the</strong> image that may be projected to <strong>the</strong> public and rec<strong>on</strong>sidersupporting <strong>the</strong> event. For <strong>the</strong> avoidance of doubt, <strong>the</strong> c<strong>on</strong>ference dinner may be supported if it isexpected that all delegates to <strong>the</strong> c<strong>on</strong>ference would normally attend and provided <strong>the</strong> dinner is o<strong>the</strong>rwisein line <strong>with</strong> <strong>the</strong> requirements of <strong>the</strong> guidelines.Q17 Please provide examples of <strong>the</strong> types of third party educati<strong>on</strong>al c<strong>on</strong>ferences that membersmay provide financial support to cover <strong>the</strong> attendance by individual <strong>Healthcare</strong> Professi<strong>on</strong>als.A17 Where permitted under nati<strong>on</strong>al and local laws, members may provide reas<strong>on</strong>able financialsupport to cover <strong>the</strong> cost of attendance (e.g. registrati<strong>on</strong> fee, travel, meal and accommodati<strong>on</strong>) byindividual <strong>Healthcare</strong> Professi<strong>on</strong>als at third party scientific events such as medical c<strong>on</strong>gresses andsymposia, seminars, training courses and <strong>the</strong>rapy-orientated training.Q18 May a member provide financial support to cover <strong>the</strong> cost of c<strong>on</strong>ference attendance(including c<strong>on</strong>ference registrati<strong>on</strong> and reas<strong>on</strong>able travel, meals and accommodati<strong>on</strong>) to HCPswho are c<strong>on</strong>ference faculty members?A18 Yes, a member may provide financial support to individual HCP who are c<strong>on</strong>ference facultymembers to cover <strong>the</strong> cost of <strong>the</strong> c<strong>on</strong>ference attendance. The principles set out in <strong>the</strong> guideline in Secti<strong>on</strong>III relating to <strong>the</strong> HCP sp<strong>on</strong>sorship shall apply. Payment should generally be made to <strong>the</strong> c<strong>on</strong>ferenceorganiser or <strong>the</strong> appropriate supplier/vendor or intermediary agency or alternatively members mayreimburse <strong>the</strong> faculty members expenses against original invoices or receipts. Fur<strong>the</strong>rmore, in <strong>the</strong> interestof transparency, <strong>the</strong> faculty member should declare that he/she is <strong>the</strong> recipient of such sp<strong>on</strong>sorship froma member company at <strong>the</strong> time he/she delivers a presentati<strong>on</strong> at <strong>the</strong> c<strong>on</strong>ference.Q19 Are members permitted to invite <strong>Healthcare</strong> Professi<strong>on</strong>als to educati<strong>on</strong>al c<strong>on</strong>ferences,offering to cover <strong>the</strong>ir reas<strong>on</strong>able expenses or are members <strong>on</strong>ly permitted to support <strong>Healthcare</strong>Professi<strong>on</strong>al attendance at c<strong>on</strong>ferences in resp<strong>on</strong>se to unsolicited requests from <strong>Healthcare</strong>Professi<strong>on</strong>als?A19 Members are permitted to invite <strong>Healthcare</strong> Professi<strong>on</strong>als to attend educati<strong>on</strong>al c<strong>on</strong>ferencesprovided <strong>the</strong> selecti<strong>on</strong> is based up<strong>on</strong> <strong>the</strong> training and educati<strong>on</strong>al requirements of <strong>the</strong> individual<strong>Healthcare</strong> Professi<strong>on</strong>al and is in no way tied to <strong>the</strong> <strong>Healthcare</strong> Professi<strong>on</strong>al‟s past or potential future useof <strong>the</strong> member‟s products or services. Members have to ensure that <strong>the</strong>y comply <strong>with</strong> all nati<strong>on</strong>al andlocal laws, regulati<strong>on</strong>s or professi<strong>on</strong>al codes of c<strong>on</strong>duct <strong>with</strong> regards to transparency. In countries wherespecific provisi<strong>on</strong> is not made, members must maintain appropriate transparency by giving prior writtennotificati<strong>on</strong> to <strong>the</strong> hospital administrati<strong>on</strong>, <strong>the</strong> HCP superior (or o<strong>the</strong>r designated competent authority)5
