4. making any reference to ssu2scl or rescript in any website, advertising or marketingmaterials;5. making any reference to the ability to translate SyncSort UNIX job control scripts intoany other command language or job control parameters, including without limitationSortCL, in any website, advertising or marketing materials; and6. inducing any <strong>Syncsort</strong> customer to disclose to any of them, or accepting from any<strong>Syncsort</strong> customer, information regarding plaintiff’s software products, includingassociated printed documentation and materials or any SyncSort UNIX job control script.It is ORDERED that defendant, its officers, directors, agents, servants, employees andattorneys, and all persons in active concert or participation with any of them:1. destroy all copies in their possession or under their control, whether located within theUnited States or abroad, of ssu2scl and rescript and all source code and documentationrelated thereto;2. destroy all copies in their possession or under their control, whether located within theUnited States or abroad, of any non-publicly available information derived fromplaintiff’s software products, including associated printed documentation and materials(including, without limitation, any version of the SyncSort UNIX Reference Guide andany SyncSort UNIX job control scripts); and3. provide to plaintiff within 30 days of this order written certification of compliance withparagraphs 1 and 2.August 18, 2011/s/ William H.
